MAYOR REPORTS: 1) The Council received a copy of the report from

made a motion to accept the report and authorize the City Attorney
to prepare a letter of response to Mike Hazen and advise Council on
the confidentiality of the information; the motion was seconded by
Loso.

Loso made a motion to have all the copies of the documents sent out
on this matter turned back to the Mayor who will return them to the
City Attorney. The motion was seconded by Rieke.

2) The League Bulletin shows $18,336 in proposed cuts in Local
Government Aid for our City.
3) The Mayor received a response from Minnesota Pollution Control
Agency on the Kacures Property, 307 1st Avenue NE. He gave a copy
of the report to Jim Kacures.
4) The Mayor has received letters from the Economic Development
Partnership on enterprises interested in locating in the area. The
City would be interested in grant funding to assist in development
of the Industrial Park.
COUNCIL REPORTS
RIEKE: The CORE agendas are available for the February 6 meeting.
EHLERT: 1) As discussed at the last meeting, Ehlert has discused
wi th members of the Sno-Joes speed control of snowmobiles going
through the City. The Sno-Joes proposed posting a person at each
end of town on the snowmobile trail as a warning during busy times.
Changing the trail would be difficult this year, because it is part
of the State trail. The Sno-Joes will further discuss speed
· control and will bring recommendations back to Ehlert.

RESOLUTION
A RESOLUTION OF THE CITY OF ST JOSEPH APPROVING ACCEPTANCE OF
OUTLOT A, PONDVIEW RIDGE ADDITION.
WHEREAS, the City of St. Joseph has considered acceptance of
a quit claim deed for Outlot A of pondview Ridge Addition in the
City of St. Joseph; and
WHEREAS, ownership of it will serve a public purpose.
NOW THEREFORE, BE IT RESOLVED BY THE CITY OF ST. JOSEPH TO
ACCEPT THE QUIT CLAIM DEED WITH THE FOLLOWING STIPULATIONS:
1. Any easement granted for ingress and egress is subject to an
underlying drainage and utility easement that the City currently
holds across the property.
2. The driveway shall be constructed by and for the property
owners to whom the easement is granted.
. 3. The property owners to who the easement is granted are
responsible for all maintenance and snow removal.
4. The property owners assume all liability related to the
construction and maintenance of the driveway.
5. The adjoining property owners pay all legal, engineering and
filing costs associated with the acceptance by the City and
transfer to the City.
6 . The City reserves the right to use the easement area for access
as necessary, and that snow may be stored on the outlot provided
that it does not interfere with use of the easement area.
AND THEREFORE the Mayor and Clerk/Administrator are authorized
to execute and file the appropriate documents with the above
stipulations.

comments. If the Deed meets with your approval, please send it
on to Rachel. She can bring the matter before the Council for a
resolution authorizing the Mayor to execute the Deed.
I would also suggest that Rachel provide the Council with a copy
of this letter as my comments relate to the easement. I suggest
that you add any additional comments as you deem appropriate.

be stored on the outlot provided that it does not interfere with use of the easement area.
Please present these terms to the City Council for review and approval. If the Council agrees, a
. resolution authorizing the Mayor to execute the deed is in order.

RE: BUILDING INSPECTOR APPOINTMENT
Dear Dale:
This letter has been prepared to confirm your appointment as the
building inspector for the City of st. Joseph. The terms of your
employment shall be as follows:
1. Your appointment shall run through the second Thursday of
January, 1996.
. 2 . Th~ City may withdraw the appointment and cancel this
contract upon 30 days written notice to you.
3. You may resign as building inspector and cancel this
contract by providing the City with 30 days written notice
of resignation.
4. Your compensation will be in accordance with the inspection
fees proposed in your correspondence of December 13, 1994.
A copy of the fee schedule contained in that proposal is
attached hereto as Exhibit A. The compensation shall be
paid in the following manner:
a. One-third of the fee to which you are entitled shall be
paid at the end of the month in which the building
permit application fee is received by the City of st.
Joseph.
b. One-third of the fee shall be paid at the end of the
month in which you perform the second inspection of the
property.
c. The final one-third of the fee shall be paid at the end
of the month during which you perform the final
. inspection and the structure is certified for occupancy
(if required).

d. Any construction fully inspected at the end of any
month, for which a permit is issued (Le. fence) may
have full payment at the end of that month.
5. Before undertaking any field inspections, you will provide
the City with proof of liability insurance in the amount of
$600,000 for personal injury and $1,000,000 for property
damage. The policy shall insure you and your company, with
the City of st. Joseph named as an additional insured under
the policy. The insurance certificate must meet the
approval of the City Attorney.
6. That any assistants, employees or agents whom you may employ
to assist you in performing your duties will be well
qualified in the appropriate areas of construction. Any
such people who are not certified building inspectors will
be acting under your close supervision at all times.
7. At all times while you are acting as building inspector for
the City of st. Joseph, you will be acting as an independent
· contractor. Neither you nor any of your employees, agents,
or assistants shall be considered employees of the City of
st. Joseph. As such, you will control the method by which
you perform your duties as building inspector and provide
any necessary tools used in conjunction with the
inspections. You will also provide your own vehicles.
8. You will carry workman's compensation insurance to provide
coverage for any injuries to any individuals whom you employ
to assist you in performing inspection duties for the City
of st. Joseph. You will provide the City with proof of
insurance.
9. You agree to defend and indemnify the City of st. Joseph for
any claims brought by third parties for personal injury or
damage to property resulting from any negligent, careless or
other wrongful act committed by you, your employees, or
assistants in performing your inspection duties.
If the terms of this appointment are acceptable, please sign
where indicated below and return the original of this letter to
the City Clerk. Your signature shall be considered an acceptan~e
of the terms set forth herein and your agreement to comply
therewith.

Dear Dale:
This letter has been prepared to confirm your appointment as th~
. building inspector for the city of st. ~oseph. The terms of your
employment shall be as follows:
1. Your appointment shall run through the second Thursday of
January, 1996.
2. The City may withdraw the appointment and cancel this
contract upon 30 days written notioe to you.
3 . You may resign as building inspector and cancel this
contract by providing the city with 30 days written notice
of resignation.
4. Your compensation will be in accordance with the inspection
fees proposed in your correspondence of December 13, 1994.
A copy of the fee schedule contained in that proposal is
attached hereto as Exhibit A. The compensation shall be
paid in the followin~ manner:
a. One-third of the fee to which you are entitled shall be
paid at the end of the month in which the building
permit application fee is received by the City of st.
Joseph.
b. One-third of the f~~ shall bs paid at the end of the
. month in which you perform the second inspection of the
property.
c. The final one-third of the fee shall be paid at the end
of the month during which you perform the final
inspection and the structure i$ certified fer occupancy
(if rèquired).

d. Any construction fully inspected at the end of any
. month, for which a permit is issued (i.e. fence) ma.y
have full payment at the end of that month.
5. Before undertaking any field inspections, you will provide
the city with proof of liability insurance in the amount of
$600,000 for personal injury and $1,000,000 for proþérty
damage. The policy shall insure you and your company, with
the city of st. Joseph named as an additional insureq under
the policy. The insurance certificate must meet the
approval of the city Attorney. .
6. That any assistants, employees or agents whom you may emplóy
to assist you in performing 'your duties will be well
qualified in the appropriate areas of construction. Any
. such people who are not certified building inspectors will
be acting under your close supervision at all times.
7. At all times while you are acting as building inspector for
the city of st. Joseph, you will be acting as an independent
contractor. Neither you nor any of ycu~ employees, agentß¡
or assistants shall be considered employees of the city of
st. Joseph. As such, you will control the method by which
you perform your duties as building inspector and provide
any necessary tools useq in conjunction with the
inspections. You will also provide your own vehicles.
8. You will carry workman's compensation insurance to provide
coverage for any injuries to any individualß whom you employ
to assist you in performing inspection duties for the city
of st. Joseph. YOu will provide the city with proof of
insurance.
9. You agree to defend and indemnify the city of st. Joseph for
any claims brought by third parties for personal injury or
damage to property resulting from any negligent, careless or
other wrongful act committed by you, your employees, or
assistants in performing your inspeqtion duties.
. If the terms of this appointment are acceptable, please sign
where indicated below and return the original of this letter to
the City Clerk. Your signature shall be considered an acceptance

Pursuant to due call and notice thereof, the Planning Commission
for the City of st. Joseph met in regular session on Monday,
February 6, 1995 at 7:30 p.m in the st. Joseph City Hall.
Members Present: Chair Hub Klein. Commissioners S. Kathleen
Kalinowski, Linda Sniezek, Kurt Schneider, Dan Nierengarten, Andy
Brixius. Secretary of the Commission Judy Weyrens.
Others Present: Bob Brophy, Charlie Reichert, Bill Nelson, Bill
Werlinger, Jim Krebsbach, Charlie Klocker, Bud Reber, Steve Dehler,
Brad Lindgren, Edward Turley.
Public Hearinq - st. Joe's Subway: Chair Klein called the hearing
to order at 7:30 p.m. The purpose of the hearing is to consider a
variance request on the parking required for a convenience food
establishment. st. Joseph Code of ordinances 52.13 subd 4(j)
requires one parking stall per thirty five feet of gross floor
area. The proposed building site contains 1500 square feet,
requiring 43 parking stalls. A variance is being requested to
allow for 25 parking stalls.
· The property is legally described as follows: Lot 13, 14, 15, 16;
Block 2; Loso's 3rd Addition.
The request for variance is being requested by st. Joe's Subway,
410 - 1st Avenue N; Long Prairie MN 56347
Bob Brophy spoke on behalf of the partners of st. Joe's Subway. He
stated that they have recently purchased property adjacent to CSAH
75, next to Kay's Kitchen. The size of the building will be either
1500 or 1700 square feet. According to the st. Joseph Code of
Ordinances, 43 parking stalls would be required based on the gross
floor area of 1500 square feet. Brophy stated that 20 - 30 percent
of Subway business is drive thru, with an additional 15 - 20
percent take out. Based on those numbers, st. Joe's Subway feels
that 27 parking stalls would be adequate.
Commissioners questioned the partnership as to how many employees
would be working at any given time, where they will be parking and
the seating capacity of the restaurant.
Mr. Brophy stated that the restaurant will seat approximately 44
customers. As for the number of employees, the restaurant will
employee approximately 20 employees, 2 full time and 16-18 part
time. It is anticipated that two or three employees would be
working at any given time, and they would most likely require t~em
to park on the street.
· Kalinowski questioned the relationship of the trailer park to the
proposed restaurant.
Brophy stated that the trailer park is buffered by a road.
Schneider questioned the submittance of a final site plan and if
they brought with them a proposed site plan.
Brophy stated that they have not yet determined the exact size of

the building, so they do not have a site plan with them. He also
stated that it was his understanding that the partnership needed to
appear before the Commission again at the time of making
application for a building permit. When they make application for
a building permit they will present a final site plan, and would
feel comfortable if the variance were approved conditionally upon
the acceptance of the final plans.
Brixius made a motion to recommend City Council approval of the
variance request, allowing for 25 parking spaces for st. Joe's
Subway as presented; recommended approval is based on the following
findings:
l. st. Joseph Code of Ordinances 52.7 s ubd 2 ( d) . That the
proposed variance will not impair an adequate supply of light and
air to adjacent property, or diminish or impair established
property values within the surrounding area, or in any other
respect impair the public health, safety or welfare of the
residents of the City.
2 . st. Joseph Code of Ordinances 52.7 subd 2(e). That the
condition or situation of a specific piece of property, or the
intended use of said property, for which the variance was sought,
is not of so general or recurrent a nature as to make reasonably ·
practicable the formulation of a general regulation for such
conditions or a situation.
Specific Finding: Since the establishment is a fast food
restaurant, the majority of business is by drive thru or take out,
requiring less parking.
The motion was seconded by Sniezek.
Discussion: Sniezek reminded the partnership that at the time
of submitting the final plans, landscaping needs to be illustrated.
Ayes: Klein, Kalinowski, Sniezek, Brixius, Nierengarten,
Sniezek.

The hearing was closed at 7:50 p.m.
Lot Split Request - st. Joe's Subway: Bob Brophy requested the
Planning Commission recommend Council approval of splitting the
East 71' of the above mentioned property. Brophy stated that the
lot contains approximately 39,204 square feet, of which only 24,750
is needed for the Subway, leaving 14,454 square feet undeveloped.
Current plans are to construct an office complex with two ('2 )
suites and 12 parking spaces.
Since approval for a building permit would be required before the ·
construction of the building could take place, Kalinowski made a
motion recommending Council approval of the lot split as requested;
seconded by Brixius.

Edward Turley - Hearinq Request: Edward Turley, 106 - 4th Ave SE
appeared before the Commission to discuss the possible addition to
his dwelling. The plans include removing the current deck and
expanding the house, encroaching the setback requirements by two
and 'one-half feet (2 1/2) . After discussion, Commissioners
encouraged Mr. Turley to make application for a variance hearing.
Election of Officers: Kalinowski made a motion to appoint Hub
Klein as the Chair of the Planning commission for 1995; seconded by
Brixius.
Ayes: Kalinowski, Sniezek, Brixius, Nierengarten,
Sniezek.

Nierengarten made a motion to appoint S. Kathleen Kalinowski as
Vice Chair for 1995; seconded by Sniezek.

Minutes: Sniezek made a motion to approve the minutes of December

Linnemann Inn: Brad Lindgren and steve Dehler appeared before the
Commission requesting authorization to make application f01; a
building' permit. Dehler stated that he and Lindgren are in the
process of converting a portion of the Linnemann Inn into an office
facility. The facility would contain seven (7) offices and a
reception area. A building permit is needed to add one wall and
three doors.
Dehler questioned the Commission if the application for a building
permit means that the parking issue will be addressed again.
Schneider stated that is was the recommendation of the Planning
Commission to require the parking lot be tarred and striped.
However, the Ordinance at the time did not specifically require
such. Schneider went on to say that is was his understanding that
the Planning Commission had conducted a public hearing on changing
· the parking lot Ordinance and made a recommendation to the Council.
Commission concurred with Schneider, but felt that since it didn't
appear that the Ordinance had been changed, they cannot require
tarring and striping the lot. Commissioners requested that Weyrens
check the status of the proposed amendment to the parking
Ordinance.

to make application for a building permit as requested; seconded by

Extract of August 1 , 1994 Planning Commission Meeting
Public Hearinq - Ordinance Amendment 52 . 13 s ubd 5 ( b) : Chair Klein
called the hearing to order at 7:30 p.m. The purpose of the
hearing is to allow citizen input on the proposed amendment to
Zoning Ordinance 52.13 subd 5 (b) . The Amendment will read as
follows: Such parking lots shall be maintained in a useable
condition with a hard surface consisting of concrete, bituminous
pavement or paver stone and drained to dispose of surface water.
The Planning Commission clarified to those present that the
Ordinance Amendment is necessary as the current Ordinance makes a
provision for the use of properly treated crushed rock which is no
longer available. Therefore, the Commission is updating the
Ordinance inserting dust free materials that are available
currently. The only change to the ordinance is substituting paver
stone for crushed rock. Klein opened the hearing to those present.
steve Dehler questioned the need for the Ordinance Amendment and if
the Planning Commission was reacting to a situation. Dehler also
. questioned how this would affect homeowners, if properties would be
grandfathered in, and under what circumstances does a property
owner loose their grandfather status. Additionally, Dehler feels
that this Ordinance Amendment requires all residents to have dust
free driveways/off street parking.
Hiemenz stated that this Ordinance Amendment refers to parking
lots, not driveways. The existing parking lots that are currently
not dust free, or properties where action is currently not being
discussed, would be grandfathered in. When the property owner of
a grandfathered parking lot makes application for a building
permit, that owner would then be required to comply with the
, amended Ordinance.
Commissioner Schneider concurred and stated that the Linnemann Inn
does not fall under the grandfather status as the Planning
Commission has been working with the owners of the Linnemann Inn
prior to the Amendment. The parking lot was required as part of
the building permit plan for the remodeling of the Linnemann Inn.
After considerable discussion, Kalinowski made a motion to
recommend Council approval of the Amendment to Ordinance 52.13 subd
5 (b) . The amendment will read as follows:
Such parking lots shall be maintained in a useable condition

portions of your city's facilities on January 20, 1995. The body of this report outlines specific and
potentially hazardous conditions I noted during the survey and my recommendations for their
abatement.
. General City Recommendations
During our meeting we discussed "A Workplace Accident and Injury Reduction" (AWAIR)
program. Your compliance is required because your Standard Industrial Classification is targeted .-.-
by Minnesota Statute 182.653, Subdivision 8:- You should begin to prepare for compliance now.
A W AIR compliance requires you to perform the following five steps:

A W AIR. You should start by doing the following:
· Select one individual to manage the safety and health program.
· Provide adequate resources and the time that is needed for a successful A W AIR
program.
· Recognize and reward those who meet established safety targets and goals.

Implementation of the A W AIR program may help you understand root causes of workplace
accidents. Once root causes have been determined, you can establish new policies and procedures
to prevent accident reoccurrence.
During our discussion, we talked about conducting a regional A W AIR meeting with other cities in
close proximity to you. I recommend that you contact the administrators and/or clerks at these
cities to determine what date would work well for all those involved. Upon agreeing on a date,
please contact me at your earliest convenience for scheduling.

. Annual right-to-know training is not being conducted at your city. I recommend that you start to
perform annual right-to-know training sessions for all city employees. If you have any questions
regarding what the training must consist of. please do not hesitate to contact me.
City Garage
The small fire hydrant pump located within the city garage currently has an exposed drive shaft. I
recommend that you enclose this drive shaft as soon as possible. Openings on this guard cannot
be less than II2-inch or its equivalent.
The remgerator located within the city garage was not equipped with a third line for grounding. I
recommend that you install a new three-wire electrical cord to this remgerator as soon as
possible.
The retractable trouble light located on the east side of the garage currently has a ftayed and
spliced electrical cord. I recommend that you replace the cord or the entire retractable trouble
light as soon as possible. Also, when replacing this trouble light, please purchase a trouble light
with a plastic or other non-conductive material for its reflector plate and hanging mechanism.
Cold Storage Building
. The ladder located in the cold storage building was in poor condition and presents an unstable
working platform for employees. You should immediately remove the ladder and destroy it. You
should ftequently inspect all ladders and immediately withdraw and destroy those which have
developed defects.

Meeting called to order by Vice-Chairman Joe Braun at 6:40 pm.
Members present: Joe Braun, Darwin Erickson, Fay Gretsch, Irma Lanier and Liaison
Bob Loso.
Members absent: John Anderson, Marge Lesnick, Claudette Klein.
Munutes from December ilEeting were approved by Darwin Erickson and seconded by
Fay Gretsch.
Liaison Report:
Summer Recreation program proposals submitted by February 2Rth.
Regarding membership for Park Board: The attorney informed Bob Loso that changes
in the number can not be made until March of 1997. Bob Loso will discuss member-
ship with the City Attorney.
~ request was made to have phones installed in the parks. Cost prohibits installa-
tion of pay phones ($50 per month plus hook up). It wiJl be looked into to find
a cost efficient way of installing some type of phone service.
Minnesota Design Team is coming in April. The Design team consists of architect,
engineers and planners to enable St. Joseph to become a Star City. Park Board
members are asked to attend the meeting to provide information and give feedback
to suggest to enhance our parks. Exact time of meeting will be announced when
available.
· Bob Loso is applying for four types of grants available: 3) Cooperative
1) Outdoor Recreation; 2) Natural Scenic Area Grant Program;
Trail Development Grant; 4) Conservation Partners Grant.
Park Board members will meet on February 13 at 6:30 pm to submit and discuss ideas
for Grant proposals.
Old Business:
Babe Ruth is going ahead. OPen enrollrnentwill be held February 18th at City
Hall. ~ this time we are estimating 3 teams at a cost of $1,900 per team. The
REC Association will take over teams cost after the first year. An area is being
looked for to set up a little league field.
Winter Recreation: Joe Braun has sent out flyers for instructors for skating
lessons. As of yet he has received no response. .
Park Signs: One sign will be made and installed at Centennial Park. Construction
and installation s~t for May 1st. Irma Lanier will get the price of materials to
be submitted to City Council.
Donations: Joe braun is contacting organizations for donations for a Big Toy to
be installed at Morningside Park.
New Business:
Not enough members were present to update 5-year plan.
Soccer fields are being planned for Millstream park. The cost of goals will be
checked in to.
Suggestions for Morningside development in 1995: Big Toy, Tar parking lot, install
· bridges, install backstop.
Have 5-year plan placed in booklets and/or transparencies.

* Council approved changes in employee health insurance to a preferred
provider plan and included long term disability insurance. New insurance cards
will follow soon
* Highway 15 bridge will be named the Bridge of Hope.
* Bob Loso, Dick Taufen, Brad Lindgren, Dave Theisen, Mayor Reber and Marvin
Klug will meet on Tuesday, January 24th at 2 PM to discuss Emergency Plans and
needs to be met.
* City will apply for an outdoor Recreation Grant for a walking trail .
* Star City will host a visit by the Minnesota Design Team April 20, 21, and
22nd. All employees, City Official, and residents are invited to attend.
· Chairperson Weyrens will keep the employees posted and send an update later.
* It was determined that the Park Board may consist of no more than seven
members. The City attorney will review the number of members allowed the
Planning Commission also.
* Control of the intersection at Minnesota Street West and 2nd Ave NW will
remain as is. Stearns County has denied the City's request for additional stop
signs at this intersection.
* The City has received a picture of the water tower from SEH to be displayed
in the Council chambers.
* Police Chief discussed the department's ability to provide additional
security at events on the CSB campus.
* Current City Building Inspector Ron Euteneuer was not re-appointed for the
year of 1995. However, De will be asked to continue as Building Official until a
re-appointment can be made.
* Clerk/Administrator Stapleton will review the sidewalk maintenance agreement
in conjunction with the CSAH 75 signal project.
* Exempt and non-exempt employment status will be discussed further by RieKe,
Loso, and John Scherer. As of September 1, 1994 all employees are classified in
a non-exempt status. This issue is to be addressed at the next City Council
meeting.

and Marthaler to attend computer courses as requested.
* Mayor Reber reported that the personnel committee has asked John
Scherer to provide written response to a complaint by Mike Hazen.
* According to information from the League of MN Cities there may be
a reduction in monies received by approximately $18,000.
* Counc i 1 addressed issue of an oil spill on Kacures property and
shared with Mr. Kacures information from the MPCA which provides
resolution to their satisfaction.
* CO R E w ill meet on Monday, February 6th at 7:00 PM in Brother
Willy's Pub.
* Councilor Ehlert discussed efforts to control speed of
snowmobilers with the assistance of the Sno-Joes.
* Councilor Loso met with the Fire Board on Wednesday, February 1st.
They approved the purchase of various equipment and two firefighters to
attend training.
* City will establish written policy on dispensing information to
the public (tapes and hard copies) and the costs involved.
* There are plans to construct a storage cabinet for audio tapes of
meetings in the City Hall Annex.
* City is ordering an official map of the sidewalk safety district,
4iÞlustrating who is responsible for snow removal from all areas.
Council made a motion deeming all employees "non-exempt" status.
J Suggested formats for department head evaluations were
distributed to Council members for review.
* Skating rink and warming house will remain open through the end of
next week, weather permitting. .<
* Counc i 1 reviewed refuse contract proposals.
* City Engineer Joe Bettendorf presented a capital
improvement plan and will assign costs to each item.
* Counc i 1 authorized Bettendorf to acquire bids and specs for a new
water treatment program, along with financing options for the
approximately $550,000 project.
* Jonelle Yon Pinnon gave a brief presentation on the TRAM bicycle
tour that wi 11 be stopping in st. Joseph on July 26, 1995.
* Counc i 1 is awaiting a response from Chief Lindgren regarding his
proposed employment contract.

the 1978 Ford will be sold the fall of 1995.

University of Minnesota services for St. Joseph (the "Community"), as further described in the MDT
MCDS "Community Manual" and the Community's Application to the MDT:

scheduled for the first day of the visit.

<.¡- Follow-through Visit .
. Establish a follow-through visit consisting of a half-day meeting with the Community¡ occur-
ring at approximately six to twelve months after the initial visit.
2 METHOD OF PERFORMING WORK
The MDT will follow a process generally described in the MDT Community Manual, except that the
team leader shall have the right to adapt or modify any or all aspects of the "typical" visit¡ as neces-
sary, to accommodate the needs of the MDT and the Community.
The MDT shall designate an individual as "team leader" or two individuals as "co-team leaders"
who will act for the MDT Steering Committee to coordinate all aspects of the visit for the MDT. The
Community shall designate an individual from the community to act as "community coordinator".
The community coordinator shall be the MDT's primary contact in the Community. The team
leader /leaders and the community coordinator will be primarily responsible for planning and coor-
dinating the visit for their respective organizations. The visit will occur on dates mutually agreed
upon by the MDT and the Community.
For this visit the MDT team leaders shall be Thora Cartlidge and Michael Schroeder and the commu.
nity coordinator shall be Judy Weyrens.
The dates for this visit shall be 20-23 April 1995.
3 FEE
The fee for the MDT visit shall be $3¡000¡ payable to "MDT / AIA Minnesota" in two equal install-
ments. Each installment shall be paid with a single check. C The first installment shall be be paid upon
acceptance of this contract; the balance shall be conveyed to the team leader at the beginning of the
first day of the visit.
In addition, the Community shall be responsible for expenses exceeding $300.00 incurred in the
preparation of necessary base maps. If the costs are expected to exceed the $300.00 limit¡ the team
leader shall inform the community coordinator of the extent of and the reasons for the cost overnm.
The MDT will make every attempt to keep these costs below $300.00, but will not compromise the
success of the visit because of base maps of inappropriate scale, detail and date. Additional costs of
this nature will be billed to the Community within one month of the completion of the MDT visit.
A follow-through visit¡ mutually planned by the MDT and the Community¡ is included in the fee..
No additional fees will become the responsibility of the Community.

liage 3 COMMUNITY RESPONSIBILITIES
The Community shall provide the following at no cost to the MDT:
· housing and meals for MDT members during their stay in the Community, including all pre-
and post-visit activities.
· meeting and work spaces, equipment, typists and resource persons, as noted in the MDT
Community Manual and as directed by the team leader.
· base information (maps, drawings, studies, reports, aerial photos) as indicated as being avail-
able in the Community Application. This material will be returned to the Community at the
end of the MDT visit.
· publicity and promotional activities necessary to ensure adequate participation on the part of
the Community.
In addition, the community will be responsible for providing progress report to the MDT at six and
celve months after the initial visit, and then annually for a period of five years. Progress reports
ill be used to help the MDT prepare for the follow-through visit, and may be used to develop a net-
work of communities that face similar issues. The MDT will provide the community with a format
for the progress report prior to the initial visit.
5 DRAWINGS
The drawings, documents and other material produced by the MDT for presentation to the
Community shall become the property of the Community. The MDT shall be given adequate time
after the visi! to obtain copies of all work produced during the visit. The MDT will return the draw-
ings with one set of professionally prepared slides of the drawings. Additional slides and profession-
ally prepared 8-1/2" x 11" photostats of the original drawings can be provided to the community at
cost. Arrangements must be made with the team leader before completion of the MDT visit.
6 LIABILITY

The intent of the visit is to provide a general direction (in the form of graphic representations of
Community visions) for community improvement efforts based upon information and issues defined
by the Community during the visit. The drawings produced shall in no way be construed as being
anything more than conceptual in nature. The Community shall be responsible for the further study
.of any and all recommendations made by the MDT prior to implementation. It is expected that the
Community will seek technical assistance, as necessar~ to follow through on MDT recommendations
and that the MDT will have no further responsibility for any of the recommendations made to the
Community.
