MAYOR 3 a) No minutes corrections were received except a
Donald "Bud" Reber typo (Center City).
b) Minnesota Deer Hunters applied for an exemption
from gambling license for an event to be held on
September 13 at the La Playette, information is in your
CLERK! packet.
ADMINISTRATOR c) The County Assessor requests affirmation by
Rachel Stapleton motion on the assessor appointment for the 1996
assessment year. Be sure to sign the form before the
meeting is over. Also to increase his salary by the
amount of additional parcels in the new developments,
COUNCILORS Northland Plat 3 (33 parcels), Pond View Ridge 2, and one
Ross Rieke other parcel.
d) Also in packet please find a copy of the semi-

Ken Hiemenz e) Sunday on-sale liquor licenses were omitted from
Cory Ehlert the license applications which were approved at the June
1 meeting. Approval is needed for Sunday on-sale for the
El Paso Club & Lanes, Inc. , d/b/a El Paso Club & Lanes;
LaPlayette Inc. , d/b/a LaPlayette Bar & Restaurant;
American Legion Post 328, d/b/a/ John Keubelbeck Post;
Loso's Inc" d/b/a Loso's Main Street Pub; BIP Inc. ;
d/b/a Sal's Bar & Grill.
6. Information has been sent to the liquor license
holders, along with a notice that the keg ordinance will
be discussed at this time. Also John Scherer intends to
be at the meeting.
7. The information from the City Attorney on the TRAM
special event beer license has been sent to Mike Deutz
and Mark Zimmer.
8. Information from John Scherer is in the packets.
9. We do not expect anyone to show for the delinquent
utility bill hearing. All have paid, or set up a binding
payment plan, except one which has renters. This one
will be paid or turned off prior to the Council meeting.
, 13. The Planning Commission minutes will be available
with their recommendation to approve the variance.

Pursuant to due call and notice thereof, the City Council for the
city of st. Joseph met in regular session on Thursday, June 1, 1995
at 7:00 p.m. in the st. Joseph City Hall.
Members Present: Mayor Donald "Bud" Reber. Councilors Ross Rieke,
Bob Loso, Ken Hiemenz, Cory Ehlert. Deputy Clerk Judy Weyrens.
Others Present: steve streng, Josh Rieke, Ben Poepping, Bruce
Backes, Hub Klein, Mike Deutz, Joe Bettendorf, Jim Schwagel.
Aqenda Approva 1 : Loso made a motion to approve the agenda with the
following additions: Consent agenda (b) outdoor liquor permit;
Clerk/Adm Reports (c) Noise Vi 01 ation. The motion was seconded by
Rieke.
Ayes: Reber, Rieke, Loso, Hiemenz.
Nayes: None. Motion Carried 4:0:0
Consent Aqenda: Rieke made a motion to approve the consent agenda
as follows:
· a) Approval of the May 18, 1995 City Council minutes as
presented.
b) Approval of an outdoor liquor permit to the La Playette for
an event to be held on June 2, 1995. Council waives the 30
day waiting period.
The motion was seconded by Hiemenz.

Councilor Ehlert arrived at 7:05 p.m.
Bills Payable: Hiemenz made a motion to approve the bills payable
as presented, check numbers 21031 - 21070; seconded by Rieke.

Overtime & Callouts: Loso questioned the effectiveness and safety
of patrol officers working 12 hour shifts. Mayor Reber stated he
would çheck with Chief Lindgren on this matter and report back to

· OLD BUSINESS
AWAIR Safety Manual: The Safety Committee has met and adapted the
City of Albany's safety manual to meet the needs of the City of st.

Joseph. Reber stated that he has reviewed the manual and feels
comfortable with it as it is revised. Loso made a motion to adopt
the safety manual as revised; seconded by Hiemenz.
Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert.

Variance Hearinq Fees: Weyrens discussed an average of actual costs
for a variance hearing. Without considering City staff, attorney
or engineer time, the average cost of conducting a hearing is
$79.00. Rieke state that it 1S important to charge a fee for a
variance hearing. Additionally, the Council needs to be alert to
variance requests that are of a recurrent nature, viewing such as
a possible need for modification of City Ordinance. Loso stated
that he feels the fee is too high, and requests are honored with
inadequate findings. Reber, Hiemenz, and Rieke concurred that a
fee needs to be charged and it may be best to leave the fee at the
current rate. After considerable discussion, Mayor Reber requested
the Councilors bring suggestions to the next meeting for
resolution.
CITY ENGINEER REPORTS ·
Pumphouse Renovation Bids: City Engineer Joe Bettendorf presented
the results of the bid opening for the Pumphouse No. 2
Rehabilitation. Loso made a mo_tion to award the bid to Preusser
Construction for $ 49,931; seconded by Rieke.
Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert.
Nayes: None. Motion Carried 5:0:0
Application for Payment #1, Well No. 4: Bettendorf presented an
application for payment to Donabauer Well for completed work on
Well No. 4. Hiemenz made a motion authorizing application of
payment #1 to Donabauer Well in the amount of $ 2,846.67; seconded
by Loso.
Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert.
Nayes: None. Motion Carried 5:0:0
4-Way stop Request: Bettendorf was requested to determine if a 4-
way stop is warranted at the intersection of 91st Avenue and East
Baker street. At this time Bettendorf stated that there is not
enough traffic volume to warrant a 4-way stop. Installing a 4-way
stop on a through street where it is not necessary for access or
safety frequently results in drivers coasting through the
intersection, or ignoring the signs all together. The Council
agreed to monitor the situation over the next months and leave the
intersection as it is currently signed. ·

Parking alonq Date street: Bettendorf reviewed the recent parking
complaints on Date street between College Avenue and 1st Avenue NE.
Bettendorf recommended that the first course of action should be
contacting the landlord of the apartment complex, Mark Lambert, and
see if he could assist with the parking. If the problems re-occur,
the City could sign the street with timed parking. The Council
agreed to monitor the area and at this time leave the street
parking as it is currently designated.
Generator Set: Bettendorf reported that he and Dick Taufen looked
at the used generator at Centre City. The generator is a 1967
Cummins model that was used by the Air Force. Bettendorf expressed
concern as to whether replacement parts would be available for the
generator. Taufen has checked with a welder in Albany who could
fabricate a trailer for the generator that was previously bid.
Bettendorf stated he would check with the company who bid the
generator to see if they would sell just the generator set. Reber
stated that Cummins is a very reputable company that has been in
. existence for many years, and would like Bettendorf to consider
further the used generator. Hiemenz questioned Bettendorf if he
could contact Cummins with the model of the used generator to check
on the availability of parts. Bettendorf will check into the
options available to the City and report back at the next Council
meeting.
Water Filtration Proiect: Bettendorf stated that he has checked
into an air stripper for well #1 to take care of the Benzene. The
approximate cost of the stripper is $40,000 to $50,000. Jim Norton
of SEH will be present at the next meeting to discuss the options
available to the City. It may be more cost effective to abandon
the well and drill a new well. If this would happen, the well
house would be taken down. Bettendorf stated that even with the
absence of the building the City will still need to obtain
easements from the adjoining property owners. At this time the
projected starting date is June 1, 1996.
Capital Improvement Plan: Bettendorf and Taufen are working on the
plan, and will present it to the Council for comment in July.
Reber felt that since this is a time consuming process, a special
!11eeting should be established when they are ready to present the
plan.
Roske Property: Rieke questioned Bettendorf wher. it would be
. appropriate to list for sale the excess property on the Roske site.
Bettendorf stated that before a realtor 1S allowed to list the
property, the road and utilities will need to be platted. At the
present time there 1S enough information available for a
prospective buyer to review.

Millstream Park: Loso questioned Bettendorf as whether a map
existed that illustrates the elevations. Bettendorf stated that he
has a layout map but not an elevation map. In order to generate
such a map, a surveyor would need to be contracted and would cost
between $1,000 and $1,500. Loso stated that he is interest in
drawing a youth athletic field to be used for soccer and baseball.
Bettendorf stated that drawing a layout map would be an additional
cost. The Council authorized Bettendorf and Loso to work on this
matter.
City Flaq: Hiemenz stated that steve Dehler approached him to
request the City consider making a City Flag. Dehler has contacted
a member of the community who is willing to make the flag with the
design being the City skyline. Hiemenz questioned Bettendorf if he
could generate the skyline for a flag. Bettendorf stated he did
have the skyline and would need the dimensions of the flag to
assure an appropriate size. Hiemenz made a moti on to adopt the
skyline design on the water tower as the official City logo, and
have a flag constructed with this logo. The motion was seconded by
Rieke. .

Jim Schwaqel - Bus stop Request: Jim Schwagel appeared before the
Council to request the removal of the bus stop sign located on 2nd
Avenue NW by the Creamery Apartments. Schwagel stated that the bus
stop creates noise problems, property damage and a refuse problem.
Since he has purchased the propet"ty he has spent many hours
cleaning up the debris. Additionally, less than 50% of his tenants
are students and are awakened at night by the noise from the bus
stop. Schwagel stated that he is trying to get away from student
rental and does not want the bus stop in front of his property to
detract from the rental market. He also feels that if the College
is inclined to provide bus stops, they should provide heated
facilities.
Reber felt that this problem needs to be addressed and
representatives from the City, st. Benedict's and Mr. Schwagel
should establish a meeting to resolve this matter. Possible
alternatives would be to put a bus stop by the medical clinic or on
the corner of 2nd Avenue NW and Minnesota street. If the
alternative sites are considered, the property owners affected
should be invited to the meeting as well. Loso felt the slgn
should just be removed. Reber stated that removing the sign does
not resolve the matter and he is confident a resolution can be
reached with all parties involved. .

Mayor Reports
Senior Housinq: Reber questioned if information was received on the
senior housing in Clara City. Weyrens stated that she is not aware
of any information. Reber stated that he will follow up on this
matter and report back to the Council. Terry Schmidt in interested
in such a development, but would need financial assistance.
Noise Violations: Reber read a notice from the st. Cloud Times
where the City of st. Cloud had amended their noise ordinance. The
proposal is very stringent and Reber feels that st. Joseph may be
able to incorporate some of their ideas. Reber will pass this
information to the City Attorney.

RIEKE
Water Fountain: Rieke requested the Maintenance Department check
the water fountain at Centennial Park as it is not currently
working.
EHLERT
APO: Attended an APO meeting.
Park Concern: Ehlert stated that he noticed some children playing
near the newly installed pay telephone and was concerned as to the
misuse of the telephone.
Loso
~~wAIR: At, part of the safety manual the Cì ty needs to supply basic
first aid kits J.n each of the vehicles and the park shel ters. !rr
addition, each employee should be provided with a protective airway
mask. Loso made a motion to purchase 15 first aid kits from Zee
. Medical at a total cost of $ 734.25 and 15 airway packs at a cost
of $112.50; seconded by Ehlert.

Loso also stressed the importance of providing employees with eye
and ear protection. After employees are provided with the
necessary safety equipment they should sign a statement verifying
receipt of such equipment. Hiemenz made a motion authorizing the
purchase of eight (8 ) ear protection devices to be given to the
Maintenance Department employees. The motion was seconded by
Rieke.

Hiemenz made a motion to purchase a pair of safety glasses for each
employee in the maintenance department; seconded by Reber.
Discussion: Rieke questioned how prescription safety glasses fit
into the motion to purchase. Hiemenz clarified the motion is to
purchase non-prescription safety glasses. If an employee wishes to
purchases prescription safety glasses the City would contribute the
cost of slip over safety glasses upon request by the employee.

stop Siqn County Rd 2 : Loso stated that he appeared before the e
County Board of Commissioners to request the placement of a 4-way
stop at the intersection of 2nd Avenue NW and Minnesota
street/County Rd 2. After discussion a motion was made and passed
to sign the intersection as a 4-way stop.
HIEMENZ
Parkinq: Hiemenz discussed the need to control the parking of
vehicles in front yards. Council referred this matter to the
Planning Commission.
Clerk/Administrator Reports
Joint City/Township Meetina: An alternative date needs to be
established for the joint City/Township meeting. After discussion,
the Council requested the meeting be established for July 18 with
July 11 an alternate date.
Liaucr License: Loso made a motion to approve the following liquor
licenses; seconded by Hiemenz.

GORDONH.HAXSMEIER information regarding state and local burninq
FRWERICKL.GRUNKE regulations. I do not necessarily see any conflict
between our leaf burning ordinance and the recently
THOMAS G. JOVA.vOVICH enacted state laws. The state law requires the
JOH.vH.SCHERER issuance of a burning permit from an authorized

I don't believe that it is necessary to change our ordinance in
light of the state law, but a change would probably avoid
confusion among the citizens if the ordinance was amended to make
it consistent with state law. It would be my recommendation that
the ordinance adopt the provision of state law. We can then add
additional provisions to an ordinance creating any additional
restrictions over and above those contained in the state law.
This would create some consistency and would be in everybody's
best interest.
If you think it would be appropriate, why don't I address this
issue when I am at the June 15th meeting.
I also looked at your request for information as to whether or
not Mark Zimmer and Mike Deutz can secure a license to allow them
to sell 3.2 beer on the church property in a beer garden tent as
part of the TRAM event to be held on July 27th. I don't believe
that they can as proposed.
Minnesota Statute and our ordinance (M.S.A. § 340A.403, Subd. 2
and Ordinance 72.2, Subd. 4) allow for the issuance of a special
event 3.2 permit, but that may only be issued to a charitable,
. religious or other Section 501(C) organization as defined by the
Internal Revenue Code (non-profit organization). Neither Mark
nor Mike would qualify for this type of license. The church, the
sponsoring organization, or some st. Joseph civic organization on
the other hand may so qualify.
Mark could not sell the beer at that location under his regular
license. His regular license is limited to his licensed premises
or the adjacent outdoor area. He could sell in the backyard of
the LaPlayette, but not at the church parking lot.
Therefore, I suggest that a qualified organization apply for the
license, pay the application fee and purchase a one-day dram shop
insurance policy. That organization could then contract with
Mark to serve the beer. Any proceeds from the sale would go back
to the licensed organization, except for payments to Mark for his
costs associated with serving the beer.
If Mark will be at the June 15th meeting, that will give me an
opportunity to talk to him about the specifics of his involvement
in this event. In the meantime~ Mark and Mike may also want to
make some inquiries as to whether or not one of the local section
501(c) organizations may be willing to apply for the one-day
license.

Dear Small City Official,
It is once again time for your council to decide whether your city will enroll as a member of the
Minnesota Association of Small Cities (MAOSC), joining over 300 cities with populations of 5,000
and under who have united to work toward our shared interests.
This year our activities in the legislative arena were more important than ever. The state's budget
crunch led to a scramble for resources, with some legislators seeing small cities as easy prey--how
wrong they were.
The Small City Association's lobbying efforts were vital in stopping a property tax proposal which
would have increased local aids and services in the metro area by drastically cutting LGA in many
smal}, rural cities. Our efforts also thwarted a proposal to increase funding for Housing in the core
cities by raiding funds earmarked for small cities.
. MAOSC was also a force when it came to fighting the Governor's proposed $77 million cut in
local aids. We were instrumental in stopping all Local Government Aid cuts, reducing HACA cuts
to $16 million in 1996, and keeping Tax Increment Finance as a viable economic development tool.
With the help of our member cities, we have been able to forge a strong coalition that has garnered
the attention of the legislature, state agencies and other city groups. Our efforts were highlighted
in a recent poll of State Legislators by the Minneapolis Star and Tribune, which listed Nancy
Larson, MAOSC's executive director. as one of the most inf1uentiallobbyists in the State. She was
one of only two city lobbyists so named by legislators.
We are proud of our record and proud of the fact that we do. make a difference for Minnesota's
small cities. Legislation and rule-making does affect small cities differently than other cities, so it is
critical for us to work together as a team. That is why we are asking you to join other cities across
the State by enrolling as a member of the Minnesota Association of Small Cities.
As you can see by the enclosed statement, we strive to keep our dues as a reasonable level and our
budget at a cost-conscious $84,000. But in order to make it even easier for you, we are offering a 5
percent discount to cities that pay their dues prior to July 31, 1995.

Meeting was called to order by John Anderson, Chairperson at 6:39
pm.
Members present: Joe Braun, Irma Lanier, Marge Lesnick, Fay
Gretsch, John Anderson, Claudette Klein and Liaison, Bob Loso.
Member absent: Darwin Erickson.
Minutes were approved with one correction: - between Grant-commi-
tee.
Summer Recreation: Chris Verlo and Dave Hiedeman gave a
presentation of the Summer Recreation program. They will have a
Parent meeting before the program begins in June. They dropped
baseball because of the Babe Ruth League. They gave a very good
synopsis of the up-coming program. If there are any problems,
they should notify Bob Loso immediately.
. Liaison Report:
Five trees were planted in Centennial Park and two were replaced
on Minnesota Street. They were maples and aspen trees from
Thomsons. The telephone was installed in centennial Park. A
bid was received for the roof over the grill area in the
Centennial Park shelter for $5,000 and the City Council approved
this.
Old Business:
A. The Design Team was in town and did an excellent overview of
our area. City Hall has copies of all props.
B. community Park Clean-up: Joe Braun said he had a very good
turn-out with children and adults helping.
C. Sand Volleyballl: Fay talked to George Molus regarding the
volleyball court. The Lions will also donate money for the
playground equipment.
D. Marge Lesnick received a bid from Solarz Nursery and they will
help her plant the flowers in Monument Park. $200 was asked

Pursuant to due call and notice thereof, the Planning Commission
for the City of st. Joseph met in regular session on Monday, June
2, 1995 at 7:30 p.m. in the st. Joseph City Hall.
Members Present: Chair Hub Klein. Commissioners Kurt Schneider,
Marge Lesnick, Dan Nierengarten. Council Liaison Cory Ehlert.
Secretary of the Commission Judy Weyrens.
others Present: Mayor Donald "Bud" Reber, Tim Borresch, Paul
Kollman, Ben Poepping, Melvin Ruegemer, Aurelia Ruegemer, William
Nelson, Bob Brophy.
Public Hearing - Tim Borresch: Chair Klein call ed the hearing to
order at 7:40 p.m. The purpose of the hearing is to consider a
three hundred forty-eight (348) foot var1.ance in the size
limitation of accessory buildings in a Single Family, R-l, zone.
St. Joseph Code of Ordinances No. 52.16 subd 4(e)[i] states, "One
or two accessory buildings covering a combined area not greater
than 900 square feet are permitted. "
. Also requested is a two hundred three (203) foot variance in the
maximum allowable lot coverage by accessory buildings.
st. Joseph Code of Ordinances No. 52.16 subd 4(e)[iii] states, "The
combined area of the lot covered by the accessory buildings
authorized in subparagraphs i) and ii) above shall not exceed 8
percent of the total lot S1.ze.
The property is legally described as Lot 012, Block 006, Townsite
of st. Joseph.
The request for variance has been submitted by Tim and Sue
Borresch, 11 - 3rd Avenue Northwest, st. Joseph, MN 56374.
Tim Borresch spoke on his own behalf. Borresch stated the
property he is requesting a variance for is currently a rental unit
and has an existing garage on the property. He stated that he
would like additional storage space to clean up the property, allow
for the storage of a classic car, and provide additional parking
for the rental units. The proposed garage would be attached to the
existing garage, adding the same amount of floor area.
Klein stated that the Commission needs to be reminded that this a
large request and cautioned them l.n setting precedence. The
Planning Commission has already turned down one request for a
. similar size garage.
Borresch stated that the property across the road has an
accessory building which is larger than he is requesting. This is

the same property where the variance was denied. Commissioner
requested Weyrens check this matter with the Building Official and
report back to the Commission.
Commissioner discussed the property requesting variance is located
one block from the General Business Zone. If the property were in
the Business Zone the additional storage space would be allowed.
Additionally, the property has functioned as a business for many
years. First as a home improvement operation and currently as a
rental unit.
There being no one present to wishing to speak, Schneider made a
motion to recommend the City Council approve the variance request
as presented based on the following findings:
st. Joseph Code of Ordinances 52.7 subd 2(a): That there are
exceptional or extraordinary circumstances or conditions applying
to the property in question as to the intended use of the property
that do not apply generally to other properties in the same zoning
district. The exceptional or extraordinary circumstances must not
be the result of actions taken by the petitioner.
Specific findings: ·
a. The property is a rental unit which functions as a business
b. The property is located one block from the General Business
District and has functioned as a business for many years
c. The property is located near an alley and the additional
garage space would not appear out of line.
d. The neighbors were not present, nor were written comments
received stating objection.
st. Joseph Code of Ordinances 52.7 subd 2 ( d) : That the
proposed variance will not impair an adequate supply of light and
air to adjacent property, or diminish or impair established
property values within the surrounding area, or in any other
respect impair the public health, safety or welfare of the
residents of the city.
st. Joseph Code of Ordinances 52.7 subd 2(e): That the
condition or situation of a specific piece of property, or the
intended use of said property, for which the variance was sought,
is not of so general or recurrent a nature as to make reasonably
practicable the f onnul a tion of a general regulation for such
conditions or a situation.
The motion was seconded by Ehleit.

street Addressing: Liaison Ehlert stated that the Council has
requested the Planning Commission to review the street numbering
process used in the assignment of house numbers larger than 1400 on
East Minnesota street. Ben Poepping presented the City Council
with an alternate system of house numbering.
Ben Poepping introduced himself to those present and discussed his
method of street numbering. Poepping stated he was ini tiall y
invqlved with the street numbering committee and would like the
opportunity to express his thoughts on street numbering. He feels
that the street numbers are adequate until they reach 1400 on East
Minnesota street. Since there currently is not a 14th and 15th
Avenue the street numbers on East Minnesota street should continue
with 1300 numbers until 15th Avenue.
Paul Kollman, and Ruegemers expressed concern over changing
addresses a third time. While they can understand why Poepping
feels the addresses should be changed, they would like a resolution
· on this matter. The Planning Commission received a letter from
Dr's Styles and Cotton. They stated that they have spent over
$6,000 on stationary and letterhead and are requesting that their
address remain as it has been assigned.
The Planning Commission also received a letter from the City
Engineer stating he could not attend the meeting. Schneider was
concerned that the Planning Commission was "checking" the City
Engineer's work. He is a professional whom the Planning Commission
relies on for information.
After considerable discussion, the Planning Commission requested
Poepping to submit a proposal illustrating how he would address the
properties on East Minnesota Street. This matter will be placed on
the next Planning Commission agenda.
st. Joe Subway Foods: Bob Brophy and Bill Nelson, Subway Foods,
appeared before the Commission to discuss the site plan for the
future st. Joe Subway. Brophy stated that the site plan indicates
an access to the property from County Rd 75. Commissioners read a
letter from the Ci ty Engineer! where he stated that the County
would not allow additional ingress/egress from 75. Br.ophy and
Nelson stated that they would not need that access at this time,
but will be addressing the issue again when they develop the second
site. Brophy also discussed the sign and setbacks for the
restaurant. Since it appeared that they would need to go through
· a variance procedure, the Commission instructed the partners to
present all their plans to the City Offices where they would check
the Ordinances for needed variances. This matter will be placed on

the next Planning Commission agenda.
Minutes - May 1, 1995: Schneider made a motion to approve the
minutes as corrected; seconded by Lesnick.
Ayes: Klein, Schneider, Lesnick, Nierengarten, Ehlert

Variance Fee: Ehlert discussed the recent Council discussions on
the possible revision of variance fees. He stated that the fees
appear to be adequate and he doesn't feel they will be changed.
Schneider suggested the Council consider allowing accessory
buil dings to encroach the setbacks only if they are moveable.
Commissioners concurred with Schneider, and further clarified that
an accessory building can be placed in the setback are if a written
agreement is received by the adjoining property owners. Schneider
made a motion to recommend the City Council amend the Ordinance
with regard to the placement of accessory buildings. The amendment
should include the following: Accessory Buildings can be placed in
the setback area with the following provisions: 1) The building
must be moveable. 2 ) A written agreement must be signed by the
adjoining property owners allowing the encroachment.
The motion was seconded by Ehlert. ·

Parkinq lot surfaces: Additional information has been received from
the City Attorney. The Planning Commission tabled this matter to

intersection would reduce the speed on CSAH-2 make it easier for

Doug Weiszhaar advised the Board that traffic counts on saìd
roadways do not warrant the installation of STOP signs on CSAH-2
and studies show that STOP signs are ineffective when used as a
speed control devise because motorists have a tendency to increase
speeds between STOP signs to makeup for the time lost s:opping at

Weare writing to request that you grant us a variance for the pole sign on the proposed
Subway, Our sign pole is 25 feet high and our sign is 5 feet by 20 feet. (Making our total height b
30 feet to the top of the sign.) We understand that your ordinance permits only a 25 foot sign,
We would also like to request a variance crom your ordinance as to the 20 foot easement just
north of the highway 75 right of way. The base of our pole sign will be just north of the 20 foot
easement. Since our sign is 20 feet across, approximately 10 feet of the sign will be over the
easement at the top, Therefore, we are asking that you grant us a variance :trom your ordinance
for the air space that we will be using above the easement. We understand that the easement is
used for a large storm sewer, It is our opinion, and we hope that you agree, that if there is need to
. service this storm sewer, the sign at 30 feet in the air should not cause any hindrance to workers
or machines necessary to accomplish the maintenance,

Dear Rachel:
I have reviewed the site plan submitted for the Subway store development with respect to
the pylon sign and the location of our utility easement. The lots being developed are 150
· feet deep from CSAH 75 to Date Street. The site plan shows a total of 170 feet for this
distance, indicating the Developer plans to use 20 feet of the easement area. I have no
objection to curb, gutter, and bituminous surfacing being within the easement area, but the
pylon sign must be completely off the easement. If I am interpreting the sketch accurately,
this means the sign must move 10 feet north of the location shown on the plans. This is
consistent with Section 32.3 of St. Joseph Ordinance 32, Limiting of Activities in Public
Easements.
