Joseph will meet in the City Council Chambers of the City Hall at 7:15 p.m. on Thursday, August 3, 1995, to consider the making of an - improvement on Cypress Drive beginning at old Highway - 52 and following the entire loop back to Old Highway )UNCILORS 52; East Baker street from Seventh Avenue Southeast to ss Rieke a point 300 feet east of Tenth Avenue Southeast; and b Loso Ninth Avenue Southeast from East Baker Street to East ,n Hiemenz Minnesota Street, pursuant to Minnesota Statutes, ry Ehlert Sections 429.011 to 429.111. RESOLUTION ORDERING IMPROVEMENT AND PREPARATION OF PLANS WHEREAS, a resolution of the city council adopted this 20th day of July, 1995, fixed a date for a council hearing on the proposed improvement of Cypress Drive beginning at Old Highway 52 and following the entire loop back to Old Highway 52; East Baker Street from Seventh Avenue Southeast to a point 300 feet east of Tenth Avenue Southeast; and Ninth Avenue Southeast from East Baker Street to East Minnesota Street by installing a bituminous mat overlay. AND WHEREAS, ten days , mailed notice and two weeks , published notice of the hearing was given, and the hearing was held thereon on the 20th day of July, 1995, at which all persons desiring to be heard were given an opportunity to be heard thereon, NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ST. RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS WHEREAS, pursuant to a resolution passed by the Council on July 20, 1995, the City Engineer, Joe Bettendorf, has prepared plans and specifications for the improvement of Cypress Drive beginning at Old Highway 52 and following the entire loop back to Old Highway 52 ; East Baker Street from Seventh Avenue Southeast to a point 300 feet east of Tenth Avenue Southeast; and Ninth Avenue Southeast from East Baker Street to East Minnesota Street by installing a bituminous mat overlay and has presented such plans and specifications to the counc i 1 for approval; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ST. JOSEPH, MINNESOTA: 1 . Such plans and spec if i cat ions, a copy of which is attached hereto and made a part hereof, are hereby approved. 2. THESE MONTHS ARE CONSIDERABLY ACTIVE WITH A TOTAL OF JUST OVER 50Ø INCIDENTS (ICR'S) FOR THE TWO MONTHS. ALSO, AND SO . YOU ARE AWARE OF IT RELATIVE TO COVERAGE, VACATIONS, HOLIDAY TIME OFF ECT. THERE ARE SEVERAL ITEMS I NEED TO DISCUSS WITH YOU, MOST WILL BE FOR YOUR INFO. WE HAD SEVERAL 911 HANG-UP'S COMING FROM THE NEW PAY PHONE IN THE PARK. OFFICERS CAUGHT SOME OF THE KIDS INVOLVED AND SPOKE WITH THEIR PARENTS. THESE CALLS HAVE GONE DOWN OVER THE PAST MONTH. I DO NOT HAVE THE NUMBERS OR STATS, BUT IT IS A NOTICEABLE AMOUNT OF CALLS FOR SERVICE OUR DEPARTMENT IS RECEIVING FROM THE NORTHLAND DEVELOPMENT. EVERYTHING FROM DOGS AT LARGE/BARKING, TRAFFIC COMPLAINTS, JUVENILE COMPLAINTS, DOMESTICS, ETC. WE EVEN HAVE OUR FIRST NEIGHBOR PILING A RESTRAINING ORDER ON ANOTHER NEIGHBOR. I HOPE THIS IS JUST A NEW NEIGHBORHOOD DEVELOPING, AND SETTLING IN VERSES AN ONGOING PROBLEM. AGAIN. FOR YOUR INFO. THE RESERVES WORKED THE GATES DURING THE 4TH OF JULY, THEY EARNED APPROXIMATELY $600.00. AS YOU WILL RECALL, THIS MONEY DOES NOT GO TO THE OFFICER IN WAGES, RATHER BACK TO THE CITY TO PURCHASE ITEMS FOR THE RESERVE UNIT. I BELIEVE THIS IS THE TRUEST DEFINITION OF A VOLUNTEER UNIT, AND I THANK THEM FOR THEIR SERVICE. NOT ONLY FOR THE 4TH OF JULY, BUT OTHER EVENTS DURING THE YEAR, AND THEIR REGULAR RIDE ALONG AND REGULAR SERVICE TO THE POLICE DEPARTMENT AND CITY. THE TRAM: THERE WILL BE APPROXIMATELY 25 HOURS OF OVERTIME DURING THE TRAM EVENT SO WE WILL BE ABLE TO HAVE 2 & 3 OFFICERS ON DURING THE PEAK HOURS AND ACTIVITIES. I WOULD LIKE TO KNOW WHAT THE COUNCIL MEMBERS THINK ABOUT THE PROGRAM, AND I WILL ADVISE YOU AS SOON AS I KNOW WHAT OUR DEPARTMENT WOULD BE ABLE TO DO. THE ST JOSEPH LIONS DONATED MONEY TO THE POLICE DEPARTMENT TO PURCHASE ITEMS CALLED STOP STICKS. THEY ARE TIRE DEFLATING DEVICES USED PRIMARILY IN HIGH SPEED PURSUITS. THEY WORK EXCEPTIONALLY WELL. A LIONS MEMBER SAW THESE WHILE AT THE MN POLICE CHIEF'S CONVENTION IN ST CLOUD, BROUGHT IT UP TO THE MEMBERSHIP, AND MADE THE DONATION. I WILL HAVE THEM AVAILABLE AT THE COUNCIL MEETING, OR ASK AN OFFICER & WE'LL OPEN UP THE TRUNKS AND SHOW THEM. I'VE SEEN VIDEO TAPES OF ACTUAL PURSUITS WHERE THE SUSPECT CAR DROVE OVER THE STICKS (3 ' LONG EACH & LESS THAN 2" TALL) AT 1ØØ PLUS MILES AN HOUR, AND COME SAFELY TO A COMPLETE STOP WITHIN A MILE. IN MAKING THE DECISION TO ACCEPT THESE, I ASKED MYSELF HOW HIGH IS THE THREAT TO PUBLIC SAFETY FOR OUR COMMUNITY AND THE PUBLIC TRAFFIC SAFETY RELATIVE TO HIGH SPEED CHASES. THE ANSWER IS VERY HIGH. UNLESS THE SUSPECT STOPS ON HIS OWN, CRASHES, OR THE CHASE IS TERMINATED BY POLICE, THERE IS LITTLE OTHER WAY TO STOP THE PURSUIT. WITH THESE DEVICES, WE CAN EFFECTIVELY AND BETTER SAFELY TERMINATE MANY PURSUITS. REMEMBER ALSO, MANY TIMES WE, (OUR CITY) CANNOT STOP A PURSUIT THAT COMES THROUGH OUR CITY THAT OTHER AGENCIES INITIATE. THERE IS NO OTHER LOCAL AGENCY THAT HAS TIRE DEFLATING DEVICES IN OUR AREA. REMEMBER A COUPLE OF YEARS AGO THE POLICE TRIED TO STOP A SIMI FROM THE FARGO AREA ON I 94, AND IT WAS STOPPED NEAR CR 2 ? A PART OF THE STORY THAT DID - NOT MAKE IT IN THE PAPER, AND SOMETHING I'M PROUD OF, IS AS SOON AS THE KIDS ENTERED THE CITY LIMITS, THEY MADE A U-TURN ~ TO LEAVE THE CITY WHEN THE DEPUTY CAME Uß TO THEM. WE ALSO ARRESTED THREE OTHER JUVENILES LESS THAN AN HOUR LATER FOR A STOLEN VEHICLE OUT OF LESUER. WITHIN A HOUR, 6 JUVENILES ARRESTED, SEVERAL STOLEN MOTOR VEHICLES RECOVERED~ AND EARLY ON A JULY SATURDAY EVENING. THIS GRANT PAYS 75 Y. OF A NEWLY HIRED OFFICER'S SALARY FOR 3 YEARS, AND UP TO $75,000.00. THERE IS A 25 Y. LOCAL MATCH TO THE GRANT. FOR US THIS AMOUNTS TO APPROXIMATELY $7,000.00 PER YEAR. THE COUNCIL IS SPLIT ON THIS ISSUE OF ADDITIONAL FUNDS FOR AN ADDITIONAL OFFICER IN LIGHT OF ANTICIPATED BUDGET CUTS FROM THE STATE AND FEDERAL GOVERNMENT. OF PARTICULAR CONCERN IS THE ANTICIPATED CUT IN STATE AID TO CITIES, LGA FUNDING. THE CONCERN FOR THE CITY IS THAT THE INCREASED COSTS OF THE OFFICER, AND DECREASED FUNDS FROM THE STATE TRANSLATE INTO EVEN HIGHER LOCAL PROPERTY TAX. FROM THE PROSPECTIVE OF LAW ENFORCEMENT, WE DO NOT HAVE ENOUGH OFFICERS TO COVER THE CITY ON A 24 HOUR A DAY BASIS. FOR A COMMUNITY OF OUR SIZE WE SHOULD. WE HAVE 5 FULL TIME OFFICERS. WHEN NO ONE IS OUT SICK, ON VACATION, USING COMP TIME OFF, OR A HOLIDAY, WE WOULD HAVE 24 HOUR COVERAGE. ON THE AVERAGE DURING A YEAR, ADDING ALL OF THIS TIME OFF IT COMES TO OVER 1,000 HOURS OF NO 24 HOUR COVERAGE FOR THE CITY. THAT'S NO POLICE OFFICER FOR THE CITIZENS, AND BUSINESS'S, AS WELL AS THE COLLEGE, STUDENTS, STAFF AND (ASSISTING) SECURITY. TO GET A LITTLE PERSPECTIVE, COLD SPRING WILL BE ADDING A 4TH OFFICER, WAITE PARK NOW HAS 8 OFFICERS, SARTELL WILL BE ADDING TO 8 OFFICERS, AND SAUK RAPIDS IS PUTTING ON THEIR 10TH OFFICER. Cloud Police Department narcotics division had a conversation with General Manager Tom Dietman in regards to persons who deal controlled substances utilizing hotel rooms. On 4/21/95 you and Night Manager Marie Duthler contacted the Narcotics Division with information of suspicious activity which was occurring in one of the rooms at the Holiday Inn. The activity was consistent with that of persons who deal in controlled . substances. As a result of the investigation one adult male was arrested at the hotel with a substantial quantity of methamphetamine. On 5/10/95 you and Night Manager Marie Duthler again contacted the Narcotics Division with information that they believed persons in one of their hotel rooms was dealing in controlled substances. On 5/10/95 a search warrant was executed on the hotel room and subsequently four adults were arrested and a quantity of methamphetamine was seized. It is because of the cooperation of st. Margie will get a bid to complete the east end of fence in Centennial Park and also a bid for the southwest side to townhouse area from Bemboom. There should be a bike rack placed in Centennial Park this year and purchase a rack that will fit mountain bike tires. A suggesti on was made to: have the Community Garden put in i'1i llstream Park \vith benches, picnic tables and pad and grills. Bob will check this item with S. Phyllis Plantenberg who is in charge of the garden. -- Monument Park - decorative rock around shrubs and trees - wait until spring for this porject. BILLS PAYABLE: Rachel Stapleton presented the bills payable check numbers 21143 - 21231 and a list of five additional bills. She stated that the St. Joe Gas & Bait amount omitted about $150 which needed clarification on the amount of required taxes. She also requested that a bill for Erkens Cleaning Service of $276.90 be considered. Loso requested that the amount for emergency services on check number 21186 is deleted, because a pay request for this service was not submitted. Judy Weyrens has requested to no longer do the maps an advertising. Stapleton requested that the Council establish the thir Saturday in August as the annual community garage sale. This will allow fo continuity through the years, even if there is no organized effort by a organization. Hiemenz made a motion to establish the third Saturday of eac August as St. Joseph Annual Community Garage Sale Day; seconded by Loso. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. 1996 BUDGET SCHEDULE: Loso made a motion to approve the 1996 Budget Schedul as follows; seconded by Hiemenz. Also subsidiary Boards and other requests must be in b this date. Thursday August 10 - Special Council meeting for budget. Between November 29 and December 20 a public hearing on the propose levy will be held. If a continuation hearing lS needed the date an time of it must be announced prior to the adjournment of the hearing. Prior to December 28 the property tax levy must be adopted at subsequent hearing. " , NOISE VIOLATION: Stapleton presented a noise violation from July 1, 1995 at 118 East Ash Street, Dan Schmitz, owner. This was classified as a first violation. HEARING - NOISE VIOLATION: Mayor Reber opened a hearing for Roger Steichen, property owner of 105 West Ash Street, for two noise violations within the violation year. Steichen discussed with the Council that after receiving the first violation he fined the renters and informed them that if they received another violation they would be evicted. He also withheld $350 damage deposit on the first violation. Additionally, the tenants have already moved out, and new renters will reside at the property in fall. City Attorney John Scherer discussed the Council's options for penalties. After further consideration, Mayor Reber made a motion to fine Mr. Steichen $300, because Mr. Steichen had acted responsibly. Further, the fine shall be stayed, with the understanding that no violations will occur within the next six months of the rental year. The rental license will be contingent upon this understanding. The motion was seconded by Loso. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. Mayor Reber closed tha hearing. SENIOR HOUSING: Terry Schmid appeared before the Council to discuss senior housing projects for St. Joseph. Mayor Reber stated that he has received requests for patio type housing. Schmid stated he has done several projects of that type in varlOUS locations in Minnesota. He also stated that financing sources for this type of housing has nearly dried up. Terry stated that his partner could come to a senior citizen meeting to discuss this issue and determine need and interest. WELL NUMBER 4 - APPLICATION FOR PAYMENT: Joe Bettendorf, City Engineer, presented Application for Payment Number 3, to Donabauer Well Company in the amount of $4,788. Hiemenz made a motion to approve the application for payment as presented; seconded by Loso. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. STREET IMPROVEMENT PLAN: Joe Bettendorf presented proposed improvement plans for sealcoat, overlay and construction/reconstruction for a five year period. The Council will study this information and agreed to hold a special meeting on July 13, 1995 at 7:00 p.m. to further discuss a capital improvement plan. OPEN TO THE PUBLIC: At 8:30 p.m. Mayor Reber opened the meeting up to the public. Alan Rassier questioned if the proposed 12th Avenue East connection would be included in the improvement plan. Council generally agreed to the importance of it. They felt that construction of it would go along with development and agreed to discuss the issue at the special meeting. Jerry Hirschfeld, former Owner and Operating Manager of DBL Labs and MCO, thanked the Council, consultants and city staff for their supportive Page 3 , assistance and responsiveness to him and DBL - MCO during his management the company. He stated that becau. most of the work was done in the fall, there was an amount of money set asi( to provide repair to areas that may need it. CITY ATTORNEY REPORTS: 1 ) John Scherer requested, and Council generaJ agreed, to allow the City Attorney to meet with the Fire Hall Build Committee to review the architectural contract. 2 ) There was included in the Council packets, a resolution for annexation ( property. Not all the parcels fit the criteria for annexation by resolutioi and a hearing would be needed. In order to clean up a parcel that Wé approved for annexation by the Municipal Board, but the County had probler with the parcel, Scherer recommended to pass a resolution rescinding tl resolution of October 29, 1991 which would nullify the de-annexation of tl seven parcels of property. Rieke made a motion to approve a resolution rescinding the resolution ( October 29, 1991 as recommended. The motion was seconded by Hiemenz. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. Scherer recommended to approach the County on annexation of CSAH 75, as first step. Annexation of this area would effect an island of Townshj property in the City. Therefore annexation of the island could proceec under the island annexation requirements. Hiemenz made a motion to approac the County for annexation of CSAH 75; seconded by Loso. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. MAYOR REPORTS: 1 ) NSP Gas Company cut into the new street area on WeE. Minnesota Street. There is a gas line In the alley, and Dick Taufe questioned the need to cut up the new street. Stapleton stated that the Company is required and does get a permit for any excavation in the streets. She will review the permit· process with Taufen, and seek further requirements of the Company in order to prevent this type of problem in the future. 2 ) Mayor Reber received a request to have the compost area open Wednesdays from 4 p.m. to 8 p.m. to accommodate those residents that are out of the city on weekends. Council was supportive of this additional service, and Mayor . Reber will discuss it with the compost attendants. 3) Jim Schwagl, Pam Novak, Bruce Backes, Tom Krebsbach, Bud Reber, and Rachel Stapleton met to discuss the bus stop by the Creamery Apartments. Pam Novak agreed, for the College of st. Benedict, to use the bus stop for educational transportation only. The buses that provide for social transportation would not stop at the Creamery Apartments. The College will get new signs posting the hours for the bus stop. .. 4) Mayor Reber attended a meeting in Albany concerning the abandonment of the railroad. ISTEA funding is being sought to construct a recreational trail along the railroad bed from St. Joseph to Sauk Centre. ISTEA funding requires a 20% local match. The proposal is a ten foot wide blacktop trail. 5) Mayor Reber is on the agenda of the County Board of Commissioners meeting for July 11, to further discuss and conf irm wi th the Board that the City . Council is supportive of the four way stop issue at Second Avenue West and Minnesota Street (County Road 2). MEMBERS OF THE COUNCIL REPORT RIEKE: 1) Rieke questioned the methods of control on trash, rubbish and junk cars in the City. (Currently the City responds on a complaint basis, along with yearly inspection of the rental properties.) There are several places that probably are not ln compliance with Ordinance 107, the garbage and refuse ordinance. Rieke recommended that an inventory of trash and garbage is taken and measures taken to assure clean up of all the properties. 2) An individual has stated that the RV site at the campground in Millstream Park is very good, but needs an extra hose of some sort to make it more usable. Rieke will review the site with that individual. 3 ) One of the insurance agents located in St. Joseph has requested to be considered for providing agent serVlces to the City. The City's health insurance, Preferred One, could be handled by him. Stapleton will check on methods of obtaining agent services and possibl~ negotiation of costs. EHLERT: 1 ) Subway Foods discussed at the Planning Commission meeting that they are requesting to install a sign with the base off the utility easement area. However, the face of the sign will hang over the easement area approximately 10 feet, to a height of 25 feet. Also they intend to install . a sprinkler system which will have sprinkler heads in the easement area. Ehlert made a motion to approve the permit to allow the encroachment into the Page 5 .. <; J .. .. . easement area as requested, with the understanding that any removal or dam1lt of Subway's equipment due to this allowance in the easement area, by needs City will be the responsibility of Subway Foods. The motion was seconded by Loso. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. 2 ) The Planning Commission is requesting the City Attorney to review and advise them on a proposal for parking lot surfaces. It requires that the parking lot be dust free according to specific MN/DOT specifications. The Planning Commission will consider this matter at their next meeting. LOSO: 1 ) The AWAIR Safety Committee met and reviewed various issues. The Committee recommended that the City assist in payment for safety shoes. The recommendation is that the City will pay 50% of the cost of the shoes up to a ceiling cost of the shoes of $100. (Maximum the City would pay per pair is $50. ) Mayor Reber felt that the employer should not be required to provide safety shoes. After short discussion Loso made a motion to table the issue until after the next AWAIR Safety meeting. The motion was seconded by Hiemenz. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. 2) The League of Minnesota Cities Annual Conference was very good. Various methods of communication were the main topic of the conference. Information on it is available in the City Office. 3 ) Loso has received requests from people to provide handicap access to ~ playground area in Centennial Park. Concrete Plus will donate a hard surface from the park shelter to the playground area and a landing pad for wheel chairs. Making the bathrooms handicap accessible needs to be considered further. 4 } The Park Board will meet July 10. HIEMENZ: 1) The Star City Committee decided to put the Star City material on display at the Linnemann Inn. 2 ) Joe Bettendorf is preparing a printout in two sizes for the City flag. Mrs. Lauer will be constructing it. Consideration is being given to have the flexibility to hang it on a flag pole or to hang it on a wall. FIRE CHIEF REPORTS: Dave Theisen discussed 1) that he and the Attorney will set up a meeting as previously discussed, to go over the particulars of the architectural contract. 2 ) The Council received the semi-annual report last month, and Theisen asked if there were any questions or comments. Council inquired which calls are billed, and related insurance companies will pay the costs of emergency calls if they are billed. No recommendation was made. . ANNEXATION RESOLUTION: Rieke made a motion to approve a Resolution Initiating Annexation to begin the process of annexation of the Roske Property and County Road 75 Right of Way; seconded by Ehlert.
