ASSESSMENT HEARING - The Assessment Hearing for the Donald "Bud" Reber Overlay project will be held at 7:00 p.m. with Joe Bettendorf in attendance. Enclosed in your packet pI ease find the information which was sent to those being assessed; the first assessment role, a revised assessment CLERK! role with reduced figures. The copy of a resolution ADMINISTRATOR adopting the assessment role is enclosed, providing for Rachel Stapleton interest at 8%, the amount St. Joseph has consistently used. The term is for 15 years, and partial payment is provided both in the resolution and by city ordinance. To adopt the assessment you need to approve the COUNCILORS resolution by motion. - IRoss Rieke 4. CONSENT AGENDA: a) I received no corrections to the - Bob Loso minutes of Oct. 5. Ken Hiemenz Cory Ehlert b) Dick Taufen is requesting to attend Water Operators School at St. John's on October 25, with registration fee of $23.00. c) Dick is also requesting to attend a seminar on Ice and Snow Removal in St. Cloud on November 1, with a registration fee of $20. d) Enclosed please find a copy of correspondence and a draft ordinance on burning, from John Scherer. It regulates burning. I would recommend that we do not have this published until after November 15 to prevent confusion during this years burning season. 10. A plaque will be presented to Fay Gretsch. 12. Brad Lindgren's report is in your packet, but he does not pIan on attending the meeting. 14. It was noted to me that Lorraine Leidholdt has three dogs. I sent her a copy of the ordinance along with a letter stating that if she does have three dogs she needs special permission from the Council, also they needed to be licensed. The person informing me was not complaining about the dogs behavior or care. They evidently are well cared for. \;~ , CITY OF ST. One request lS in Park Terrace by the area of (612) 363-7201 house numbers 26, 31 and 32 on Fifth Avenue NW. (I think Fax: 363-0342 that some years ago there was a request for a light in this area.) NSP will install lights where ever the City asks, but we had the lighting pIan of the whole city revised about 11 years ago. MAYOR Donald "Bud" Reber The other request for a street light was at the entrance to Northland off of County Road 2 on to First Avenue NE. PO Box 668 * St. Joseph, Minnesota 56374 * Phone (612) 363-7201 * Fax (612) 363-0342 October 4! 1995 *First Name* *Last Name* *Address* *Addres1* *City* Dear *First Name* *Last Name*: Notice is hereby given that the City Council will meet at 7:00 p.m. on October 19! 1995 to consider, and possibly adopt~ the proposed assessment for the 1995 street Overlay Improvement of Cypress Drive beginning at Old Highway 52 and following the entire loop back to old Highway 52; East Baker street from Seventh Avenue Southeast to a point 300 feet east of Tenth Avenue Southeast: and Ninth Avenue Southeast from East Baker Street to East Minnesota Street. Adoption by the Council of the proposed - assessment may occur at the hearin~. The entire project area is proposed to be assessed. .......- , The amount to be specially assessed against your particular lot, piece, or parcel of land is $ *Assessment*. Such assessment is proposed to be payable in equal annual installments extending over a period of 15 years, the first of the installments to be payable on or before the first Monday in January 1996, and will bear interest at the rate of eight (8) percent per annum from the date of the adoption of the assessment resolution. To the first installment shall be added interest on the entire assessment from the date of the assessment resolution until December 31, 1996. To each subsequent installment when due shall be added interest for one year on all unpaid installments. You may at any time prior to certification of the assessment to the County Auditor, pay the entire assessment on such property~ with interest accrued to the date of payment, to the City Clerk. No interest shall be charged if the entire assessment is paid within 30 days from the adoption of this assessment. You may at any time thereafter, pay to the City Clerk a portion of or the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 20 or interest will be charged through December 31 of the succeeding year. If you decide not to prepay the assessment before the date given above the rate of interest that will apply is eight (8) percent per year. The right to partially prepay the assessment according to Ordinance No. 37 is available. " . . The proposed assessment roll is on file for public inspection at the City Clerk's Office. The total amount of the proposed assessment is $ 57,320. Written or oral objections will be considered at the meeting. No appeal may be taken as to the amount of an assessment unless a signed¡ written objection is filed with the clerk prior to the hearing or presented to the presiding officer at the hearing. The Council may upon such notice consider any objection to the amount of a proposed individual assessment at an adjourned meeting upon such further notice to the affected property owners as it deems advisable. If an assessment is contested or there is an adjourned hearing, the following procedure will be followed: I. The Ci ty wi 11 present its case first by calling witnesses who may testify by narrative or by examination, and by the introduction of exhibits. After each witness has testified, the contesting party will be allowed to ask questions. This procedure will be repeated with each witness until neither side has further questions. .- 2 . After the City has presented all its evidence, the objector may call witnesses or present such testimony as the - objector desires. The same procedure for questioning of the city's witnesses will be followed with the objector's witnesses. 3. The objector may be represented by counsel. 4. Minnesota rules of evidence will not be strictly applied; however, they may be considered and argued to the Council as to the weight of items of evidence or testimony presented to the Council. 5. The entire proceedings will be tape-recorded. 6. At the close of presentation of evidence, the objector may make a final presentation to the Council based on the evidence and the law. No new evidence may be presented at this point. 7. The Council may adopt the proposed assessment at the hearing. An owner may appeal an assessment to district court pursuant to Minnesota statutes Section 429.081 by serving notice of the appeal upon the Mayor or Clerk of the City within 30 days after the adoption of the assessment and filing such notice with the district court within ten (10) days after service upon the Mayor or Clerk. ,-~ y-? . .' RESOLUTION ADOPTING ASSESSMENT WHEREAS, pursuant to proper notice and duly given as required by law, the Council has met and heard and passed upon all objections to the proposed assessment for the 1995 Overlay Improvement of Cypress Drive beginning at 01d Highway 52 and following the entire 100p back to Old Highway 52; East Baker Street from Seventh Avenue Southeast to a point 300 feet east of Tenth Avenue Southeast; and Ninth Avenue Southeast from East Baker Street to East Minnesota Street; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ST. JOSEPH, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal installments extending over a period of 15 years, the first of the installments to be payable on or before the first Monday in January 1996, and shall bear interest at the rate of eight percent (8% ) per annum - from the date of the adoption of this assessment resolution. To ~ the first installment shall be added interest on entire assessment from the date of this resolution until December 31, 1995. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the city treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and he may, at any time thereafter, pay to the city treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. Any owner of any property so assessed may make partial payment to the City Clerk/Administrator within 20 days from the date on which the City adopts the assessment, with no interest charged on the partial payment amount. The unpaid balance of the special assessment shall be certified to the County Auditor for payment for the term of the assessment. 4. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the county. JOSEPH, MINNESOTA AND THE CITY OF ST. JOSEPH, MINNESOTA The Township of st. Joseph and the City of St. Joseph hereby jointly agree that the area designated for orderly annexation in the Joint Resolution between the Township of St.Joseph and the City of St. Joseph designating an area for orderly annexation dated October 10, 1975 be amended to include the fOllowing: Both the Township and the City agree that no alteration of the stated boundaries of this agreement is appropriate. Furthermore, both parties agree that no consideration by the Board is necessary. BILLS PAYABLE: Deputy Clerk Judy Weyrens presented the bills payable. Loso made a motion to approve the bills payable check numbers 21501 - 21583; seconded by Ehlert. Discussion - Hiemenz questioned an emergency services payment and Loso questioned the budget category for Council costs for the star City Workshop. Council generally concurred that Council costs shall be allocated the specific budget area served. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. Loso made a motion to approve the overtime and callouts as presented; seconded by Ehlert. Discussion - Loso expressed concern about police officers working over a seventy hour week including the "Safe & Sober" hours. Discussion was that with their ten hour shifts, they may have had days off to work these additional hours. The Mayor will discuss this matter with Ch4IÞ Lindgren, Page 2 , T . Lindgren stated that he had done a thorough background check. He will tentatively begin employment with the City on October 19. Hiemenz made a motion to approve hiring Officer Dean Cichy as an additional police officer; seconded by Rieke. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. Lindgren discussed the needed equipment to outfit this officer. He stated that an additional service weapon will be needed along with uniforms, leather goods and radio. Mayor Reber offered the radio he currently has, as he felt he does not use it enough to warrant keeping it. Loso made a motion to approve purchasing the supplies and equipment necessary to outfit the new officer as the Chief feels is appropriate. The motion was seconded by Rieke. CLERK/ADMINISTRATOR REPORTS: 1) Loso made a motion to approve the request to purchase three window mini-blinds for the City Hall Annex offices at total 4IÞ cost of approximately $59.01; seconded by Rieke. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. 2) Rieke made a motion to approve a request to purchase an ease 1 for flip chart presentations at a cost of approximately $100; seconded by Loso. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. 3) Police Sergeant position will be discussed at a future meeting. 4) The Personnel Committee was directed to review the st. Joseph Police Federation wage and benefit proposal for 1996 and return with recommendations to the Council. 5 ) Hiemenz made a motion to accept the resignation of Fay Gretsch from the Park Board and thank her with a plaque of appreciation for her many years of service to the City of st. Joseph. The motion was seconded by Mayor Reber. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. 6 ) St. Joseph will be hosting the Stearns County League meeting on October 17. The Councilors were encouraged to attend this meeting. Hiemenz indicated that he will be unavailable for this meeting. 7 ) The Council was in agreement to set October 24th for the City/Township 4IÞ GSJAC meeting, if this date is acceptable to the Township Board. Page 3 MAYOR'S REPORT: There was a meeting recently concerning the St. AU9U~ Landfill cleanup issue. The State is intending to recover $110,000 from t potential1y responsible parties and then pursue recovering the cost of the cleanup from the insurance companies covering those entities during the use period of the landfill. Mayor Reber proposed and Hiemenz made a motion to approve the donation of $1,000 from the City of St. Joseph. The motion was seconded by Rieke. Discussion - Rieke questioned if the City Attorney would ascertain that this would relieve the City's liability on this matter. Mayor Reber stated that Tom Jovanovich of his office, was at the meeting and he could consult with him and inform the Council on this matter. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. OCTOBERFEST: Mark Zimmer appeared before the Council to clarify that he may allow bands to play in the fully enclosed tent during his Octoberfest event, on Friday and Saturday nights until 1:00 a.m. He stated that he had discussed the matter with nearly all the property owners in the area. He also will have a security officer on Friday and Saturday nights. Hiemenz made a motion to approve the bands playing in the tent until 1:00 a.m. as requested by Mark Zimmer; seconded by Ehlert. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. BUS STOP: Rieke discussed that the CORE Committee had met as requested by the Council, and agreed on fol1owing the recommendations regarding bus stop issue: . Steve Yuhas made a motion to recommend continuing the existing drop off locations of 2nd Avenue NW by Centennial Park and the one on West Minnesota street for individuals returning to St. Joseph from St. Johns. The bus stop pick up location would be on the Northeast corner of 2nd Avenue NW and West Minnesota Street for individuals wishing to be transported to Saint Johns. The motion was seconded by Tillie Wasner. Upon cal1 of the vote the motion carried unanimously. Funding for the shelter was discussed, with a proposal that the cost be split between CSB, SJU, St. Johns Senate, St. Ben's Senate and the City. Rieke stated that the CORE Committee felt that this is the best spot although it may not be ideal. Additionally he had met with Joe Bettendorf and felt the traffic flow issue could be worked out. Mayor Reber stated that he is not in favor of this location, along with the area property owners. Both J. R. Studinski and Schindlers have contacted him with their concerns. Additionally Mayor Reber expressed safety concerns and felt the County Engineer would have a problem with the proposal after recently allowing a four way stop at this intersection, e Page 4 , I . Loso stated that we must exercise caution in moving a problem from one location to another. The problem is not the 10cation, but the activities that cause the problems. Ehlert proposed and the Council generally felt that a solution could be to require the late evening buses to pick up in the downtown area. Rieke recommended and the Council generally concurred to place this matter on the October 19th agenda, for a solution and invite audience comments at that time. Jim Schwagel, from the audience, questioned who would accept liability on this issues. Mayor Reber stated that liability would be a legal issue. Upon Shawn O'Meara, from the audience, asking for a downtown location, that would be acceptable, Mayor Reber stated that anywhere on First Avenue NW and Minnesota Street to College Avenue would be acceptable. Also Rieke discussed that it may be necessary to have different routes for daytime buses and night time buses in order to allow for time constraints during the daytime. COUNCILORS REPORT RIEKE: 1) The CORE Committee met and took seriously their request to recommend to the Council on the bus stop issue. . 2) Rieke felt fortunate to be part of the Star City seminar recently held at St. Benedicts. EHLERT: 1) The Planning Commission met and allowed the extension of a special use permit of Ron Philippi for construction of two, twenty six unit mini storage facilities. This extension would allow for construction of the final one third of the units, with stipulations. 2) Ehlert stated that the Planning Commission also discussed street addressing and recommended adoption of a proposal with several points. Ehlert discussed the various points recommended. Judy Weyrens, Secretary to the Planning Commission, clarified several points. Loso stated that the recommendations to make changes to streets outside the city limits would not take effect until the property is annexed. Additionally, this proposal is quite complicated. Loso recommended that the City stay with the grid system as proposed by Joe Bettendorf. Rieke, Reber, and Hiemenz concurred and Mayor Reber stated that the matter will be reconsidered later in the meeting while Joe Bettendorf is in attendance. 3) At the APO meeting a bill that Joe Opatz presented was discussed. APO wil1 review the first recommendations of this bill which requires their efforts and planning. RIEKE: 1) Rieke stated that the Personnel Committee has received a request to 4IÞ include an allowance for payment of benefits on termination or death of an employee. Hiemenz stated that payment of benef i ts on termination of an Page 5 employee is covered in the manual. Rieke discussed further the person~ Policy does not address payment of sick time accumulated ~n the event death of an employee. The Council agreed to consider a written proposal to amend the personnel policy. OPEN TO THE PUBLIC: There was no public input. Loso made a motion to recess at 8:10 p.m.; seconded by Hiemenz. LOSO: 1 ) Loso met with Ernie Diedrich, Sister Phyllis and Helen Stoltz concerning the Community Garden. They are requesting to use, by lease, an area in Millstream Park, from where the house was removed. Hiemenz made a motion to approve the City Attorney writing up a lease, identifying the location with boundaries, for a community garden. The motion was seconded by Rieke. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. 2 ) The City of St. Joseph received notice that the Department of Natural Resources accepted our grant application for a recreational trail ~ Morningside Park. The grant is a $25,000, 50%-50% matching grant. DNR w be contacting us for further information. 3) Also a community group contacted Loso, requesting plans for construction of a building for Morningside Park. They are interested in funding it. 4 ) Jim Kacures is requesting a letter from the City stating why his request for diagonal parking was denied; and indicating the reasons why the diagonal parking was taken away in 1990. Loso requested and the Council concurred to direct the Clerk/Administrator to write such letter of response as requested. Concerning the proposed signage to control parking, Mr. Kacures stated that he did not wish to discuss that aspect of the matter. CITY ENGINEER REPORTS: Bettendorf presented Application for Payment Number One (Final) of $30,410 to Hardrives for the 1995 Overlay Project, and discussed that the bid was $34,160 but final cost figures were considerably lower. Mayor Reber questioned why the manholes are so low, along the project area. Bettendorf stated that he will check them, but normally they are put down about one inch below the surface because they tend to work up over time and can cause problems with snow plowing if the blade hits an elevated manhole. Ehlert made a motion to approve a Final Application For Payment to Hardrives for $30,410 as recommended by the City Engineer; seconded by Hiemenz. Bettendorf also discussed with the Council that at the last Joint City Township meeting Fred Sandal requested that Bettendorf meet with the St. Wendel Township Board to discuss their utility needs. The Council discussed the options available to St. Wendel and recommended that the St. Wendel Board retain an engineer on their behalf to represent their interests. SUBDIVISION ORDINANCE: Loso made a motion to have the City Engineer consult with the City Attorney to have an amendment to the Subdivision Ordinance prepared which will require a detailed grading pIan for subdivisions. This will provide for a drainage plan for each lot. The motion was seconded by Hiemenz. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. JOSEPH FIRE RELIEF ASSOCIATION: In the absence of Ken Twit, Rachel Stapleton introduced the revised Fire Fighters Relief Association report and the City contribution requirements of $7,671 for 1995, and $5,325 for 1996. In order for the State Auditors office to release the Local Government Aid for the Relief Association, they are requesting revised reports, to meet their requirements for administration expenses. The City must accept the reports and approve a pIan for payment, with two years being acceptable. This must be completed by October 20 or the state aid for the Relief Association for 1995 will be 10st. The Council requested that a Special Fire Board meeting is set to consider this matter and to make recommendations to the Council at the next meeting. Joseph hereby Ordains: That Ordinance 103: Leaf Burning Ordinance is hereby rescinded, and the fol1owing Ordinance enacted in its place: Ordinance 103: FIRE AND BURNING RESTRICTIONS. section 103:01: PURPOSE. The city council has made a determination that unregulated burning within the city has an adverse effect upon the health, comfort, repose and property of the residents of the City, specifically finding: a. Increases the risk of destruction of personal property and structures. b. Increases the pollution of the air and affects the health of residents, primarily those suffering from asthma and other respiratory ailments. c. Causes annoyance by smoke drifting onto adjacent · properties. d. Increases the potential for injury by creating a nuisance attractive to children. e. Causes soot and odor to adjacent property. Therefore, the City Council has enacted this ordinance restricting the ignition and maintenance of fires, and other burning as may occur within the City of st. Joseph. section 103:02: DEFINITIONS. As used herein, the fol1owing terms shall be defined in the fol1owing manner: Subd 1: "Person" - Means any natural person acting either personally or in any representative capacity, corporation, firm, co-partnership, or an association of any nature or kind. Subd. 2 : "Timber" - means and includes trees, saplings, bushes, seedlings, and sprouts from which trees may grow, of every size, nature, kind and description. Subd. 3 : "Forest Products" - means and includes all products derived from timber. · . - ~.. , or . . . Subd. 4: "Owner" - includes a person owning the fee title to any real property, or the person occupying real property pursuant to a leasehold interest therein. Subd. 5: "Open Fire" or "Open Burning" - means a fire which is not contained within a fully enclosed fire box or structure from which the products of combustion are emitted directly to the open atmosphere without passing through a stack, duct or chimney. Subd. 6: "Campfire" - means a fire set for cooking, warming or ceremonial purposes, which is not more than 3' in diameter by 3' high, and which has had the ground 5' from the base of the fire cleared of all combustible material. section 103:03: PROHIBITION OF FIRES. All fires within the City of st. Joseph are prohibited, except for the following: Subd. 1: campfires. Subd. 2: Fire contained in a charcoal grill, camp stove or other device designed for the purpose of cooking or heating. Subd. 3: A fire contained within a building or . structure ignited for the purpose of providing heat to the interior of the structure or to be used in the preparation of food. Subd. 4: Fires ignited for purposes of fire training as therein defined by Minn. Stat. § 88.17 subd. 3(a), pursuant to special permit granted by the local fire warden or other authorized state, county or local authority. section 103:04: MATERIALS. Fuel for all fires permitted shall consist of timber, forest products, and kerosine, fuel oil or natural gas if the fire is contained in a stove or fire box designed for the ignition of that substance. Burning of the following materials shall be strictly prohibited: Subd. 1: Motor oil, rubber, plastics, chemically treated materials or other materials which produce excessive or noxious smoke including, but not limited to, tires, railroad ties, chemically treated lumber, composite shingles, tarp paper, installation, composition board, sheetrock, wiring, paint or paint filters. Subd. 2: Hazardous waste as defined in section 116.06 Subd. 11 of the Minnesota Statutes and applicable Commissioner's Rules. . Subd. 3: Solid waste generated from an industrial or manufacturing process or from a service or commercial structure. 2 " þ ~ . section 103:05: PROHIBITION OF ALL BURNING. No . outside burning may occur during any time when a burning ban is declared by any state, county, or local authority due to an air pol1ution alert or a fire danger. section 103:06: GENERAL REGULATIONS REGARDING PERMITTED FIRES. Subd. 1: No person shall ignite or maintain a fire upon the land of another without the permission of the owner thereof or his agent. Subd. 2: No person shall ignite or maintain a fire on publicly owned or controlled property except in areas designated for the maintenance of campfires by the public authority governing the property. Subd. 3: Any authorized open fire shall be attended by a competent person until such fire is extinguished. section 103:07: PENALTIES. Violations of any of the provisions of this Ordinance shall be deemed a petty misdemeanor, except the violation of section 103:04 Subd. 1, 2 or 3 shall be deemed a misdemeanor. Any person who ignites or maintains a prohibited fire may be liable under this ordinance. STREET SNOW REMOVAL 1. MN Street from 2nd Ave NW to 1st Avenue NE & SE was plowed to the South and hauled out. . 2. College Avenue North from MN street E & W to Date street E was center plowed and side plowed, hauled out 3 . 1st Avenue NW from MN street to Ash Street side plowed and hauled out. 4. 2nd Avenue NW from MN st W to C.R. 75 plowed to the West side and hauled out from MN st w to Ash st w. 5 . Birch st w from 2nd Avenue NW to College Avenue N plowed to the South side and hauled out. (Remember Jim Schwegel owns the apartments now) 6. Cedar st E from 1st Avenue NE to st. Joseph Liquor! hauled when needed. 7. Cul-de-sac's - Eastern Court, Western Court, Dale street, 13th Avenue SE, and Hickory Court (new), plowed in a pile and hauled out 8 . Alley between College Avenue and Ash st (behìnd business places) hauled out when needed. (Safety problems during run off) I would like to discuss the snow removal policies due to some confusion, misunderstandings and concerns about snow plowing and removal last season. I would ask you to consider hiring part time help during this time if needed, along with renting additional trucks from Bill Wasner. I know we have discussed the purchasing of a blower to be attached to the front of the loader, and I hope this is still a consideration. Remember that whatever decision are made on snow removal will have an affect on East MN Street after the reconstruction and possible installation of sidewalks. AS I HAVE WRITTEN PRIOR, OUR OFFICERS WORK ON A 28 DAY SCHEDULE. WE ARE PAID ON A WEEKLY SCHEDULE. SOMETIMES THE . OFFICERS WORK OVER 40 HOURS IN THE WEEKLY PAY PERIOD~ BUT ARE PAID FOR THE REGULAR 40. OTHER WEEKS THEY WORK UNDER THE 40, BUT ARE PAID THE 40 WITHOUT OVERTIME ON A REGULAR SCHEDULE. IN A 1 MONTH CYCLE, THE REGULAR ROTATION HAS EACH OFFICER WORKING 160 HOURS. (4 WEEKS OF 40 HOURS) JEFF DID WORK 30 HOURS OF SAFE & SOBER OVERTIME SHIFTS. HOWEVER THESE 3 DAYS HE WORKED FELL INTO HIS FIVE DAYS OFF ON THE SCHEDULE, SO AFTER WORKING THE OVERTIME SHIFTS, HE STILL HAD 2 DAYS OFF AFTER THAT STRETCH. INSOFAR AS OFFICER EFFECTIVENESS, WE ARE TAUGHT IN SCHOOL, THAT AN OFFICERS HOURS OF WORK, SHIFT PATTERNS, ETC. ETC, ARE GOING TO BE DIFFICULT. ONE EXAMPLE IS WHEN YOU HAVE A COURT CASE AT 9:00AM THAT IS MANDATORY, AND YOU WORK UNTIL 3:AM AND NOT HOME & IN BED UNTIL 4 AM, OR TAKE A CALL AT THE END OF YOUR SHIFT. THE SAME THING WITH A 1 PM COURT DATE AND WORK MIDNIGHTS AND NOT OFF UNTIL 7 AM. YOU RUN SHORT ON YOUR SLEEP THAT DAY. THE OFFICER CANNOT AFFORD TO TAKE A NIGHT SHIFT OFF FOR COURT THE NEXT DAY, AND I CAN'T SCHEDULE OFFICERS AROUND THE COURT DATES. IN ADDITION, SOMETIMES WE HAVE 3 OR 4 OFFICERS IN COURT AT THE SAME TIME. THE COURT ADMINISTRATION OR JUDGE ISN'T GOING TO DELAY A CASE BECAUSE AN OFFICER WORKS A NIGHT SHIFT. THIS IS JUST PART OF THE JOB. THE SAME HOLDS TRUE FOR TRAINING, A DEPARTMENT MEETING, BEING CALLED OUT WHILE OFF DUTY, OTHER TYPES OF MEETINGS, ETC, ETC. WE TRY TO WORK AROUND THIS THE BEST WE CAN. . I HAVE IN THE PAST GRANTED TIME OFF FOR OFFICERS WHO HAVE COURT, TRAINING, ETC. AND WORKING NIGHTS OR WHATEVER WHEN THEY HAVE FELT THE NEED TO COMP OUT, ETC. FOR THIS, AND IT HAS WORKED OUT ON THE SCHEDULE. IN ADDITION. SOMETIMES. WHEN THERE IS TOO MUCH TRAINING, COURT, CALL OUiS, ETC. THE OFFICER MAY JUST TAKE THAT EXTRA DAY OFF. <CaMP, VACATION. I BELIEVE THIS FALLS IN THE REALM REASONABLENESS. SOME ADDITIONAL COMMENTS RELATIVE TO THIS, I KNOW OF SEVERAL OTHER DEPARTMENTS WHO SCHEDULE OFFICERS ON A 12 HOUR SCHEDULE, 6 TIL 6 OR 7 TIL 7. NOW THOSE, ARE SOME LONG HOURS. ALSO, I KNOW OF OTHER DEPARTMENTS WHO HAVE OVERTIME PROJECTS OR SHIFTS OPEN AND THEY DON'T HAVE OFFICERS WHO ARE WILLING TO WORK THEM. I AM GLAD WE DO NOT HAVE THAT PROBLEM. AS I HAVE INFORMED YOU IN THE PAST, THE WHOLE MONTH OF SEPTEMBER, ESPECIALLY THURS, FRI, & SAT NIGHTS WE TRY TO BE AS ACTIVE AND VISIBLE AS POSSIBLE, BECAUSE EACH YEAR BRINGS A NEW FRESHMAN CLASS, AND TO REINFORCE WITH RETURNING STUDENTS, · OUR PRESENCE IN AN ATTEMPT TO AVOID THE LARGE PARTIES, DAMAGE TO PROPERTY, DRINKING ON THE STREETS, NOISE COMPLAINTS ETC, ETC. Work involves responsibility for: 1. under the supervision of the Police Chief, the Sergeant supervises patrol officers within the department. The Sergeant will plan, organize, direct, control. lead, instruct, assign, support, evaluate the performance of, reward and discipline the law enforcement activities of the personnel assigned in his/her department. The Sergeant assesses the training needs of the department and provides it or arranges for its provision, The Sergeant receives and acts upon requests for transfer or career development. The Sergeant consults on the same and makes recommendations to the Chief. Zimmer will provide security during the evening hours, and will also be allowed to play music outdoors until 1: øø PM. * The CUR~ Committee submitted an alternate location £or a bus stop located at. the northeast corner o£ the intersection o£ 2nd Ave NW and Minnesota St W. The Council will invite comments on this issue at the next meeting. * Planning Commission approved request o£ Ron Philippi to extend variance regarding construction o£ mini storage units on Joseph Street. * Personnel Committee will review the Personnel Manual to consider t.he inclusion o£ payment o£ accumulated sick leave to an employee's beneficiary upon the death o£ an employee. * City Attorney John Scherer will prepare a lease for the Council to consider regarding a portion o£ Morningside Park to be used by the Community Garden Committee. * The City received a matching £unds grant in the amount o£ $25,ØØ0 far improvements to Morningside Park. * Jim Kacures requests a letter from the City stating the :r-easons angle parking was denied in the area north of Floral Arts. * Final application £or payment on overlay project was approved. * Stearns County will be inst.alling a signal light on CSAH 75 near . t.he entrance to the Del-Win Ballroom. * At the City/Township meeting the APO discussed the possibility o£ providing services to St. Wendel Township.
