Notice of Public Hearing on the East Minnesota
Street project will be held at Kennedy
Elementary, because we need a place to hold
about 100 people. This will be held at the
next Council meeting. The Council may wish to
meet at the City Hall at 7:00 to conduct the
regular business. Then leave for Kennedy to
arrive there about 7:45 p.m.

Notice is hereby given that the City Council for the
City of st. Joseph will meet in the Kennedy Elementary
School cafeteria, 124 - 1st Avenue SE, st. Joseph MN,
at 8:00 p.m. on Thursday, November 16, 1995, to
CLERK! consider the making of an improvement on East
ADMINISTRATOR Minnesota street between the west line of First Avenue
Rachel Stapleton Southeast and the east line of Sixteenth Avenue
Southeast (91st Avenue) , pursuant to Minnesota
Statutes, Sections 429.011 to 429.111.

The area proposed to be assessed for such improvement
Ross Rieke is the property abutting on such street. The
estimated cost of such improvement is $ 1,500,000.
Bob Loso Such persons as desire to be heard with reference to

Several concerns were discussed including the following:

> Specific costs assigned to specific properties
> Issue of low manhole covers
> Tracks left by truck
> Implement an established road maintenance plan
> All properties, including those exempt from general
property tax, are assessed for the project
Council tabled the resolution on this issue until the next
meeting.
* Council presented Faye Gretsch with a plaque in
appreciation for service to the City on the Park Board.
* Bus stop presently located in front of 12Ø - 2nd Ave NW
will be moved to the west side of the US West Communication
building at 18 - 2nd Ave NW.
* Ross Rieke reported that the CORE Committee was
. considering the establishment an escrow fund for the
construction of a bus stop shelter.
* Council adopted a new Ordinance prohibiting open burning
with the exception of recreational fires.
* Lorraine Leidholdt was granted permission to house
three dogs at her residenee.
* Gar Kellom of SJU was authorized to contact John Scherer
regarding rental housing issues.
* Council approved Joe Bettendorf to meet with
representatives of the College/Convent of St. Benedict
regarding roads adjacent to/through their property.
* Council approved snow removal policy as proposed by Dick
Taufen.
* Area residents reported need for street lighting on 4th
Ave NW and at the entrance to Northland Addition. Council
will have Ron Hogland of NSP review street lighting in
v ar'i ous areas and report to the Council. St. Joseph Township
will be notified of the request for lighting at the entrance
to -Lhe Northland Addition.

JSA forms need to be completed for each job that has a
high potential for injury. They may be done just prior
to doing a job, or while doing it. Self inspections
should also be done and documented on a regular basis
(perhaps quarterly to start) , to identity existing and
potential safety hazards. Tom will send self inspection
check list forms.
The equipment used to hang Christmas decorations was
discussed along with the lack of availability of a boom
truck. Tom stated that front end buckets are not
designed for lifting humans. The best situation ~s to
physically lock in place the lifting mechanism.
Dick questioned the design safety of the safety life
lines such as are used in the water tower. Tom stated
January of 1998 design requirements for life lines w~ll
change to allow an upright position for the harness. The
situations that will require this change will be
established.

Pursuant to due call and notice thereof, the City Council for the City of St.
Joseph met in regular session on Thursday, October 19, 1995 at 7:00 p.m. in
the City HalL
MEMBERS PRESENT: Mayor Donald Bud Reber¡ Councilors Ross Rieke, Bob Loso,
Cory Ehlert¡ Clerk/Administrator Rachel Stapleton.
OTHERS PRESENT: Paul Wallin, Steve Dehler, Mike Hazen, Mary Krafnick, Janet
Nadeau, Dick Taufen, John<Scherer, Joe Bettendorf, Art Reber, Tara Ploumen,

Mayor Reber called the meeting to order at 7:10 p.m. with Reber, Loso, and
Rieke present.
AGENDA: Loso made a motion to approve the agenda¡ seconded by Rieke.
Ayes: Reber, Rieke, Loso.
Nayes: None. Motion carried.
1995 OVERLAY ASSESSMENT HEARING: Mayor Reber opened the 1995 Overlay
Assessment hearing and called for comments from the public.
Mike Hazen - 131 9th Avenue SE - Stated 1) a shoddy job was done on Baker and
9th Avenue SE, and the manhole covers are very deep and not feathered at the
. edges. 2) Questioned why the cost was set at 80% - 20% levels. He felt 80%
of the project cost was too high for the individual property owners and that
more of the cost burden should be through raising the general tax levy. He
questioned proposed assessments for the East Minnesota Street project. Mayor
Reber stated preserving the streets is an obligation of the city. The
funding is either through special assessments or general tax levy. Mayor
Reber and Joe Bettendorf discussed that the manholes will be corrected to be
only about one and one half inches lower than the street. They are instal1ed
lower than the street for safety in snow plowing.
Hazen continued - The special assessments will be hard financially for some
of the residents, especially those on East Minnesota Street that have already
had heavy assessments imposed on them. He also indicated that if the Council
should lessen the 80% - 20% assessment requirement in the future he would
like to get reimbursed for change (in any future formula). He also
questioned past policies. Bettendorf stated past policy for assessments was
any widening and curb and gutter were assessed. There has not been much
overlay work done in the City.
Hazen questioned why budgeting for a capi tal proj ect fund has not been
increased through the years to fund these proj ects. The capi tal projects
funds have been spent down through the years. The amount of City
participation in a project is on a project by project basis. The Council
further discussed the var ious methods of assessing projects along with
assessment policies.

Paul Wallin discussed that the lower manholes reduce the speed of cars on tII
project area. He questioned if any smoothing will be done at the edge of
project area where it goes into the old area. Bettendorf stated that he will
100k at it to see if there is too big a bump. Wallin also asked why the
short stretch was done on Baker Street. Bettendorf stated the rest of Baker
Street was improved a few years ago.
Steve Dehler questioned if an overlay is an improvement or maintenance, anê
if there is a street maintenance plan in place. He felt that it Ü
maintenance. He also questioned what is the expected life of a street, tc
which Bettendorf responded that book life is about 20 years. The overlay i~
expected to extend it about ten years. Many streets in St. Joseph outlast
their expected life.
Dehler discussed the effect construction traffic may have on a street, anc
when st. Joseph reaches 5,000 population it will qualify for addi tiona:
funding for state aid streets. Bettendorf stated that traffic does have al
impact on street life, but we can not control where the traffic goes and it
is hard to quantify the impact of various types of traffic. Additionally th:
state aid funding is to be spent on specific state aid roads. The City ma'
assess costs with state aid funding and this is frequently done to cover th;
City costs.
Mike Hazen questioned if the houses owned by the College would be assessed

Ross Rieke stated that the City has street improvement plan and

intending to change the assessment policy. Bettendorf is confident in th
maintenance schedule. Streets are inspected and seal coating is done as th
streets need it, not on a specific yearly schedule.
Jan Nadeau stated that she feels this is not an improvement, but maintenance

there will always be a little bump, and the color will be darker.
Paul Wallin questioned what will happen at the end of ten years or sc

. Discussion - Mayor Reber and Rieke discussed this is the first assessment
policy with 80% of the cost assessed to the property owners. They felt the
full Council should be in attendance to vote on it.

Nayes: None. Motion carried.
Loso made a motion to recess for ten minutes at 8:00 p.m.; seconded by Rieke.
Ayes: Reber, Rieke, Loso.
Nayes: None. Motion carried.
Mayor Reber reconvened the meeting at 8:10 p.m.
Cory Ehlert arrived at 8:10 p.m.
PARK BOARD MEMBER RETIRES: Mayor Reber presented a plaque to Fay Gretsch in
honor of her years of service to the City as a member of the Park Board since
1982.
BUS STOP ISSUE: Rieke discussed that the CORE Committee is of the feeling
that Second Avenue NW and Minnesota Street is the correct 10cation for the
bus stop. He also stated that he had suggested an escrow account is set up
for financing improvement for the bus stop. The five members donating would
be the City, St. Ben's Senate, St. John's Senate, and both Colleges.
The County Engineer indicated that any bus stop must be at least 20 feet from
. a cross walk, but he does not have strong feelings either way about the 2nd
Avenue NW site.
Loso stated that he disagrees with the corner as a stop site but agrees with
the area. He recommended considering a site by the US West building. Rieke
questioned the number of parking places this would remove. Steve Dehler also
indicated that the 10st parking stalls may cause problems for the area
businesses.
John Scherer stated that he heard fourth hand that after this year there may
be no more off campus stops.
Loso made a motion to pull the stop sign from the boulevard by the Schwagel
property and install it in the boulevard by the US West property in the
appropriate location. The motion was seconded by Mayor Reber.
Ayes: Reber, Rieke, Loso, Ehlert.
Nayes: None. Motion carried.
Rieke recommended establishing an escrow fund with the City dedicating $1,000
for bus stop improvements. He felt that when the City takes the lead the
other groups will follow in donations. The leaders of the student groups
that are willing to donate are seniors, so they would not reap the benefits
of the donation, but are still willing to donate.
CONSENT AGENDA: Loso made a motion to approve the consent agenda;

MAYOR REPORTS: Mayor Reber stated that he is supportive of allowing Gal
Kellom, St. John's University official, to contact the City Attorney directl'
to discuss rental housing issues, as Mr. Kellom has requested. Los(
questioned what were the specific issues. Mayor Reber stated that the Cit,
is trying to work with the colleges and rental housing is a serious issue
Mr. Scherer indicated that he did not see this allowance as being over used
and felt that it would be of benefit to the City. He would be representin[
the City and be of benefit to the City rather than helping out the colleges
Rieke stated that although there is an associated cost this will continue t[
open the lines of communication. Loso made a motion to allow Gar Kellom 0
st. John's University to have conversations up to fifteen minutes with~
City Attorney on rental housing issues. The City Attorney will giv
quarterly report and advise the Council on all contacts; seconded by Ehlert
Discussion that the time limitation is too restrictive.

Nayes: Reber, Rieke, Ehlert. Motion failed.
Rieke made a motion allowing Gar Kellom direct access to the City Attorney
as per his request. If the City Attorney feels that this contact is gettin
too in depth or requires a meeting he will get approval from the Mayor, a
this contact should be informational and short term. The Attorney will giv
the Council feed back and update on contacts. The motion was seconded b
Ehlert. Discussion - Loso stated that this allowance of access to the Cit
Attorney is more than Council members or St. Joseph citizens have.
Ayes: Reber, Rieke, Ehlert.
Nayes: Loso. Motion carried.
Loso questioned the status of the Ordinance Amendment regulating parkir
10ts. The status of it will be checked and reported at the next meeting.
Rieke stated that the issue of liability was raised at the last meetir
concerning the location of the bus stop. Mr. Scherer stated it depends c
the situation. Sign placement normally does not expose municipalities to
greater degree.
City Engineer Joe Bettendorf discussed with the Council that he was askedj

. discuss their roads along with County Road 121. Rieke made a motion to
authorize Bettendorf to attend a meeting with College officials to discuss
the roadways to meet both City and College needs. The motion was seconded by
Ehlert.

Nayes: None. Motion carried.
BILLS PAYABLE: Loso made a motion to approve the bills payable check numbers
21612 through 21630 and Building Inspection charges of $566.05 and State
building sur charges of $575.75; seconded by Rieke.
Ayes: Reber, Rieke, Loso, Ehlert.
Nayes: None. Motion carried.
Loso made a motion to approve the callouts and overtime as presented;
seconded by Rieke.
Ayes: Reber, Rieke, Loso, Ehlert.

DEPARTMENT HEADS REPORT
POLICE: The Council received Chief Brad Lindgren's written report for
September.
PUBLIC WORKS
. SNOW REMOVAL: Dick Taufen appeared before the Council and discussed the
method snow was removed in the City during the 1994 - 1995 snow season.
After discussion of plowing and sidewalk snO\'l removal, Mayor Reber made a
motion to continue the methods as from the past year and accept the snow
removal policy as presented; seconded by Ehlert.
Ayes: Reber, Rieke, Loso, Ehlert.
Nayes: None. Motion carried.
WINTER PART TIME HELP: Taufen discussed how the Council wished to handle
getting extra help during snow emergencies. Mayor Reber stated that part
time help is not needed. Snow removal and winter duties need to be
prioritized. Rieke stated if maintenance fee Is a situation exists and extra
help is needed the Mayor should be consulted.
OPEN TO THE PUBLIC: Steve Dehler recommended considering a street light be
installed at the new proposed bus stop 10cation.
DOG ISSUES: Lorraine Leidholdt appeared before the Council to request
special permission to keep three dogs at her residence. Ordinance 104
Regulation of Dogs, requires special permission from the City Council for
harboring more than two dogs. Ms. Leidholdt discussed her use of the dogs in
conjunction with her teaching position, care of the animals and their
obedience training. Stapleton stateq she received several phone calls and a
letter of support from an adjoining neighbor, reinforcing the fact that she
cares for her dogs in a responsible manner. Stapleton stated comments of
protest about the dogs have not been received. Loso made a motion granting
special permission allowing Leidholdt to keep one more than the allowable two

dogs according to Ordinance 104 with the following findings; the motion.
seconded by Rieke:
1 ) The dogs are well cared for and Ms. Leidholdt is a responsible dog
owner.
2) The ownership or harboring of the dogs shall not create a threat tc
the peace, repose, safety or health of the general public or residents
residing in the area in which the animal will be maintained.
3) The ownership or harboring of the animal will not result in offensiv~
noise or odors.

COUNCILORS REPORT
RIEKE: The CORE Committee met at SJU¡ their next meeting will be hel(
November 13 at 6:30 p.m. at St. Ben's. They discussed the bus stop issue
goal setting, and community projects. They also discussed establishing ;
fund for bus stop improvement.
EHLERT: No report.
LOSO: No report.
CLERK/ADMINISTRATOR REPORTS: 1 ) The City has received requests for stree
lights in the following places: .
a) Park Terrace by the area of house numbers 26, 31 and 32 on Fift
Avenue NW.
b) At the entrance to Northland off County Road 2 on First Avenue NE
These roads are not in the City limits.
NSP will instal1 lights where ever the City asks, but we had the lightin
plan of the whole city revised about 11 years ago. Council requested t
have a representative of NSP review the matter and make a recommendation t
them.
2 ) The Council and Planning Commission need to meet to review the propOSE
land use map for the area, as prepared by APO. Council will set a meetir:
date at a future Council meeting.
3) Mayor Reber made a motion to send a thank you to the Star City Commissic
and the facilitators of the Star City Workshop for their assistance to U
City of St. Joseph; seconded by Rieke,

. FIRE RELIEF ASSOCIATION: Loso discussed and made a motion to accept the
revised st. Joseph Fire Relief Association report and city contribution for
1995 of $7,671; and for 1996 of $5,325 to be paid over a two year period;
seconded by Mayor Reber.

Rieke made a motion to approve the attendance of Cory Ehlert at a property
tax seminar October 24 in st. Cloud; seconded by Mayor Reber.
