Pursuant to due call and notice thereof, the City Council for the
City of st. Joseph met in regular session on Thursday, December 7,
1995 at 7:00 p.m. in the st. Joseph City Hall.
Members Present: Mayor Donald "Bud" Reber. Councilors Ross
Rieke, Bob Loso, Ken Hiemenz, Cory Ehlert. Deputy Clerk Judy
Weyrens.

Approve Aqenda: Loso made a motion to approve the agenda with the
following additions: 1) Police Sergeant Position; 2) Background
Investigation for Liquor License Applicant. The motion was
seconded by Rieke.

. Consent Aqenda: Ehlert requested to remove item b) Computer
Service Contract from the consent agenda and made a motion to offer
Cyberstar the computer service contract provided their quote is
less than quotes already received. The motion died for lack of a
second. Council Members concurred that since quotes have already
been received and a recommendation is before them, they woul d have
Cyberstar placed on the list to solicit bids in the future.
street Addressing Ordinance Amendment: Hiemenz discussed the
portion of the Ordinance dealing with the naming of cul-de-sacs,
31.1(e). The Council had previously requested to name cul-de-sacs
with the wording circle or court and this is not represented in the
amendment.
Rieke made a motion to approve the consent agenda as follows:
1. Approval of the November 16 and 30 City Council Minutes
2 . Awarding the Computer Maintenance Contract to KLN.
3. Approving the Non-Intoxicating Liquor, Cigarette, and
Amusement licenses as on file in the City Offices.
4. Approving the Amendment to Ordinance 31 - Naming of
streets and Avenues with a correction to paragraph E
section 31.1. Cul-de-sacs are to be named with the
wording circle or court.
The motion was seconded by Loso.

. Bills Payable: During the discussion of the Bills Payable, the
Council requested the Department Heads be reminded to use both car
repair shops in the City when repairs are needed. Loso made a
motion to approve the bills payable, check numbers 21706 - 21853;
seconded by Hiemenz.

Treasurer's Report: Loso made a motion to approve the October
Treasurer's Report as presented; seconded by Rieke.

Water Treatment Prolect: City Engineer, Joe Bettendorf presented
the final plans for the water treatment plant. The revised layout
does not require construction easements from the adjoining
properties. The price breakdown is as follows:
Treatment Plant $ 490,000
Building Addition 100,000
Computer System 20,000
After discussing the alternatives to the building addition and the
future expansion possibilities, Hiemenz made a motion to proceed
with the water treatment plant, building addition and computer
system. The motion was seconded by Rieke.

1996 East MN street Improvement: Bettendorf discussed the .
functional classification of streets. According to this
classification there are three ( 3 ) types of streets:
l. Arterial - streets through the Community (ie: CSAH 75)
Typical Assessment: $58.00 per foot
2. Collector - Within the Community and commercial areas
(ie: College Avenue, East MN Street)
Typical Assessment: $46.00 per foot
3 . Residential - Streets within neighborhoods
Typical Assessment: $37.50 per foot
Bettendorf stated when calculating the assessment for East MN
Street, the residential rate of $37.50 per foot was used. The
resident was then assessed 80% of that figure, calculating at
$30.00 per foot.
Steve Frank questioned if there is an advantage to re-classifying
the street a state Aid street. Bettendorf responded that the City
must have a population of 5,000 before a street can be designated
a state Aid Road.
Jim Graeve questioned the classification of West Minnesota street
in comparison to East Minnesota. Bettendorf stated that West MN
street is considered an Arterial because of the number of cars
exiting the interstate, connecting to CR 75.
Reber stated that he feels the current assessment policy places too .
much of a burden on the property owners. The Counci 1 concurred and
discussed alternative formulas and establishing a useful life for
roads. If the useful life of a street 1S not met, the resident
would be glven credit on the restoration/overlay. Loso made a

motion adopting the following assessment formula:
Residents shall pay 60 percent of the residential street rate
for street overlays, seal coats, and reconstructions.
Additionally, the project will be assigned a useful life and if the
street needs to be re-done before that time, the resident will be
given credit for the remaining years.
The motion was seconded by Hiemenz.

The Council requested that an assessment policy be written for the
assessment of street overlay, street reconstruction, and seal
coating of streets.
Bettendorf stated that with regard to the proposed 1996 East
Minnesota street Improvement, two decisions need to be made, the
width of the street and if there will be sidewalk.
Rieke made a motion approving the plans and specifications and
ordering advertisement of bids for the East Minnesota Street
. reconstruction with the following change: The sidewalks will stop
at 12th Avenue SE. The motion was seconded by Loso.
Discussion: If in the future the residents East of 12th
request sidewalk, the Ci ty wi 11 install the sidewalk.

Adoption of the 1996 Budaet: Mayor Reber stated that since steve
Frank could not attend the hearing on November 30, he would give
him time to discuss his concerns with the Council.
Mr. Frank stated that his taxes have been consistently increasing
since he purchased his home. He questioned the Council if they
reviewed the revenue received from licenses and services and if the
fees need to be raised. He also encouraged the Council to review
such things as: Does the crime rate justify additionally services?;
What does the star City provide?; Is the recreation we provide in
the best interest of the City and are the fees covering the
expenses?; Has the City requested competitive bids for Attorney and
Engineering services? Is leasing of equipment a consideration?
Mayor Reber stated that the budget process is a lengthy process and
encourages residents to attend these meetings. It is at this time
that department heads are required to make adjustments to the
budgets and cost saving ventures are reviewed.
. At this time Clerk/Administrator Stapleton reviewed the budget
process with the Council and stated the Council must make a
decision with regard to the 1996 budget and levy.
There being no further comments or questions, Loso made a mOtion
that the following sums of money be levied for the current year,
collectible in 1996, upon the property in the City of st. Joseph

Department Head Report: Fire Chief, Dave Theisen, presented the
1995 annual Fire Report. During 1995 the Fire Department responded
to 175 calls, of which 141 were medical. The overall payroll is
down slightly from 1994. Theisen also reported that the new fire
engine is working to their satisfaction.
Rieke questioned if they charge for fire responses and if so what .
the collection rate is. Theisen responded that only those calls
which are not residents in the Fire District are charged, and of
those they collect about half. Since it is very time consuming to
collect these charges, Rieke suggested Theisen contact Accu Serve,
(a medical billing company), to see if they would be interested in
assisting the Fire Department for a fee. This matter was turned
over the Fire Board for review and recommendation.
Loso made a motion to recess at 8:55 p.m.; seconded by Rieke.

Mayor Reber reconvened the meeting at 9:05 p.m.
CITY ENGINEER REPORTS
Industrial Park: Bettendorf stated that he attended a meeting along
with the Mayor and other interested persons with regard to the
possible relocation of Vic West Steel. Vic West Steel is in need
of a new building and is willing to sign a long term lease for who
ever constructs the building. Along with this is the re-alignment
of CR 133. The County wi 11 pay 80% of the reconstruction of CR 133
and has scheduled it for 1997. In order for the re-alignment to be
complete an easement needs to be acquired f rom Leo Buettner..
Bettendorf stated that he and the city Attorney, John Scherer will
meet with the property owner and try and negotiate an easement.
Roske Property: As the City has agreed to reconstruct East MN
Street, a decision needs to made with regards to the Roske Property

and if the utilities and road will be extended. The Council agreed
that since East Minnesota street will be reconstructed it would be
prudent to improve the Roske Property at this time. However, since
the Township is part owner, their approval would be needed. Rieke
made a motion authorizing Joe Bettendorf to proceed with plans
specifications contingent upon Township approval. The motion was
seconded by Hiemenz.

Water Improvement Proiect: Loso made a motion approving the
resolution to proceed with the plans, specifications, and ordering
the advertisement of bids for the water treatment improvement. The
motion was seconded by Rieke.

12th Avenue: Bettendorf questioned the Council as to their intent
regarding the extension of 12th Avenue. The Council agreed that
since CR 133 will be re-aligned, '.I. is important to secure an

easement for the extension of 12th Avenue. The Council authorized
. Joe Bettendorf and Ken Hiemenz to negotiate an easement with the
affected property owners for the extension of 12th Avenue.
Waae and Benefit Proposal - Police Federation: The Personnel
Committee presented the request of the st. Joseph Police Officers
Federation, as foIl ows:
I. Wage increase - 5% foundational increase and an increase in
wages based on the cost of living (1994 - 4%) .
Loso made a motion to offer the st. Joseph Police Officers
Federation a wage increase based on the Social Security
Administration Cost of Living Increase. The index will be
available mid-December. The motion was seconded by Hiemenz.
Ayes: Reber, Loso, Hiemenz.
Nayes: Rieke, Ehlert Motion Carried 3:2:0
2 . step Increase - Gustin & Klinefelter. This is approved
contingent upon Department Head approval.
3. Uniform Allowance: The federation is requesting an increase of
5100.00 per year for uniforms, making the annual allowance 5500.00.
Loso made a motion to increase the uniform allowance up to $500.00.
However, uniform checks will only be disbursed upon Officers
. providing the City Office with receipts for the purchase of
uniforms. This disbursement can be paid at any time during year-.
Thus an Officer does not have to wait unit the beginning of a
quarter to purchase uniforms. The motion was seconded by Rieke.

As reques ted by the Personne I Commi t tee, thi s matter Viill be tab led
until early 1996.. so as not to disregard it.. but to consider it
separately.
5. Exercise Equipment/Health Club: The federation is requesting
an allowance of S300/yr.. per Officer to be used for Health Club
Membership,
The Personnel Committee recommended and the Council agreed :0
consider this item separately at a later date. There might be a
possibility of a small exercise room in the neVi fire facility that
would be available to all the City employees.
Mayor Reports
Entrance Siqn: Reber presented sketches of the proposed entrance
signs welcoming people to st. Joseph. The Lions are working on
funding to construct three signs at a total cost of 518..000 to
$20,000. Reber stated he will continue to update the Council on
this matter.
Snow Plowing - Business District: Mayor Reber stated that he met .
with Mike Deutz concerning sidewalk snow removal on Minnesota
Street. Deutz is proposing the City remove the snow from the
sidewalks from 1st Avenue East to 2nd Avenue West and College
Avenue from Minnesota Street to the Funeral Home. The sidewalk
snow would be removed before the streets are plowed. This would
save the Maintenance Department time since they must replow the
street when the s i de'..¡a 1 k snow ~s removed after the street ~s
plowed. Reber stated that he discussed this snow removal change
with Dick Taufen, Public Works Director} and he felt it Toiculd be

snow removal policy as stated above for a trial period of one year;
seconded by Rieke.

Councilor Reports
RIEKE
COF'.E: The CORE Committee will be meeting on December 11, 1995 to
begin planning the February Speak out. The meeting will be held at
CSE.
EHLERT
APO: Ehlert reported that he attended an APO meeting on November.
30, 1995. The meeting was a forum with the MET Council.

Skatinq Rink: Loso reported that he hired four (4) people to be
attendants at the warming house. Weather permitting the rinks will
be open on December IS, 1995 with the following hours:
Monday - Friday 4:00 p.m. - 9:00 p.m.
Saturday, Sunday, and School Holidays 11:00 a.m. - 9:00 p.m.
Bathroom facilities will also be available this year as a satellite
will be placed down by the warming house.
HIEMENZ
Resident Concerns: Hiemenz stated that he received calls
concerning the signs on the Roske Property objecting to the 'early
sale of the property and calls supporting the East MN Improvement
Project.
CLERK/ADMINISTRATOR REPORTS
Kitchen Remodelinq: After reviewing the alternatives available, and
the associated costs, the Senior Citizens have Hithdrawn their
. request to have the kitchen remodeled.
Mandated Druq Testinq: Stapleton reported that all Cities are
required to perform random drug testing and a policy needs to be in
place January I, 1996. After discussing the requirements, Rieke
made a motion authorizing Stapleton to execute an agreement \.¡i th

Roske Property Annexation: The resolution for annexation of the
Roske Property and County Rd 75 will be ready for approval at the
December 21, 1995 meeting. Scherer discussed the options available
for annexing the remaining property along MN street to square off
the boundaries. It was his recommendation to proceed with the
annexation of the Roske Property and CR 75 and then follow with a
second annexation resolution for the remaining property.
Mayor Reber extended the meeting 15 minutes at 10:00 p.m.
Backqround Investiqation: Todd Fultz is in the process of making
application for a liquor license transfer of Sal's Bar. As a new
licensee, the Council must authorize a background investigation.
Rieke made a motion authorizing Police Chief Lindgren to perform a
background check on the new owner(s) of Sal's Bar; seconded by
. Loso.
Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert

Mark Mimbach - Buildinq Remodelinq: Scherer reported that he has
been contacted by the person doing business in the former Video and
Balloons To Go building questioning what he needs to do to clear
matters. The City at this time can make the property owner go

through the process of appearing before the Planning Commission and
upon their approval a building permit could be issued. state
Building Codes allow a penalty which doubles the permit fee for
building without a permit. The City also has an option of
continuing the process of prosecuting through the court system.
After considerable discussion, Ehlert made a motion to continue the
process in prosecuting Debra Mimbach property owner of 405 West
County Road 75, and require said owner to go through the process of
obtaining a building permit which includes appearing before the
Planning Commission and doubling the permit fee. The motion was
seconded by Reber.
Rieke made a motion to amend the motion to require Mimbach to go
through the process of obtaining the building permit and stay the
prosection for a period of time; seconded by Hiemenz.

Sergeant Position: Rieke made a motion to accept the job
description of a Police Sergeant as reviewed by the City Attorney,
de I eti ng the word "SOME" as it appears bef ore the word "KNOWLEDGE".
The motion was seconded by Hiemenz.

Rieke made a motion to contact Paul Neis of the League of MN Cities
to have him review the City's point system/pay scale and the place
the Sergeant Position within the system; the motion was seconded by
Ehlert.

Nayes: None. Motion Carried 5:0:0
Pat Schneider - Baseball Facilities: Pat Schneider appeared before
the Council to request possible funding assistance for the Memorial
Park Lights and the construction of a ball field at Kennedy School.
Schneider stated that he has been receiving donations and he has
been questioned if the City is willing to participate; and if so to
what level. Ehlert thanked Schneider for all his work and efforts.
At this time the Council did not make a commitment but Rieke and
Hiemenz encouraged him to appear before the Council again. .
At 10:30 p.m. Mayor Reber extended the meeting 15 minutes and went
into a closed session to discuss pending litigation. (Rieke
stepped down from his chair and left the building.)

The meeting was opened at 10:45 p.m. at which time Rieke re-entered
the building.
Hiemenz made a motion to dismiss the City -vs- Rieke without costs
or disbursement awarded to either party including both sides paying
their own expenses incurred with regard to this litigation .

BENEFICIAL FOR OUR COMMUNITY.

F.B.I., WASHINGTON, D.C. 10/19/95
Maryland State Police advised that a trooper, age 28, with eight years of law enforcement
service, was slain on 10/17/95 at approximately 0105 hours. The victim stopped a speeding
vehicle that was occupied by two subjects. The victim called for back-up and intended to
conduct a voluntary vehicle search. The victim aþprœched the vehicle, and the subject pulled
a .45 caliber Llama semiautomatic weapon from beneath the seat and shot the victim through
the eye. The back-up officer witnessed the shooting and proceeded to fire his weapon at the
fleeing vehicle, wounding the driver in the forearm and the head. The second subject exited the
fleeing vehicle. The driver drove the vehicle into a pond and proceeded to force his way into
a nearby residence. The residents subdued the wounded subject, disarmed him, and notified the
police. The State Police arrested the driver, and the second subject was apprehended a short
distance from the scene.

F.B.I., WASHINGTON, D.C. 11)/24/95 .
Teller County Sheriff s Department, Colorado, advised that a deputy, age 27, 'With two years
of law enforcement service, was ambushed while sitting in a patrol vehicle on 10/16/95 at
approximately 0700 hours. The victim was assigned to guard the scene of a rural house fire
until arson investigators could arrive. The victim was shot in the head with a single shotgun
blast. The victim's service weapon was stolen. Investigation revealed a stolen vehicle that was
found near the scene of the murder, Further investigation led police to the identity of the male
who stole the vehicle. That male suspect then became the prime suspect in the murder of the
officer. Contact with the subject's family determined that the subject was suicidal. On 10/17/95
the subject's body was found, and the victim's weapon was found near his body,

Pierce County Sheriff s Office, Washington, advised that a deputy, a ten-year veteran, was shot
to death on 10/16/95 at 0740 hours with a 9mm semiautomatic weapon, The victim and ten
members of an anti-drug team, all wearing protective vests, arrived at a residence to execute a
search warrant and arrest a subject believed to be selling drugs from the residence. After
knocking and announcing, six deputies entered the front door, with the victim entering first.
The subject exited a bedroom and began shooting. The victim was shot in the head and torso,
Fellow deputies returned fire, shooting the subject four times, Charges are pending until the .
subject is released from the hospital.

According to prelimi~ary information received by the F.B.I., 56 city, county, state, and federal
law enforcement officers were killed due to criminal action during January through September
1995. Fifty-seven were slain dunng the same period in 1994. This year, 22 officers were slain
in the southern states, 20 in the western states, six in the northeastern states, five in the
midwestern states, two in Puerto Rico, and one in the Mariana Islands.
Twenty-one officers were slain while attemptipg arrests (seven while attempting to apprehend
robbery suspects, ten while attempting other arrests, two while attempting 19 apprehend burglary
suspects, and two in drug-related matters), 14 while investigating suspicious persons, five while
responding to, disturbance calls, nine in ambush siruatioñS, five in traffic stops, and two while
handling a prisoner.
Handguns were used in 35 killings, 12 with a rifle, two with a shotgun, one with a knife, and
six with a bomb. Forty-six of the killings have been cleared by law enforcement authorities.
Twelve officers were wearing protective vests. Thirty-four officers were killed in accidental
situations.

Maricopa County Sheriff's Office, Arizona, advised that a deputy, age 47, with seven years of
law enforcement service, was slain on 9/28/95 at 1701 hours. The victim responded to a
. domestic violence C3l1 in an apartment complex where the wife was being beaten by the husband.
The victim arrived before the back-up officers, and because the victim believed the wife's life
to be in danger, the victim entered the apartment and was shot three, possibly four times with
a Chinese-made SKS 7.62 X 39mm caliber rifle. The victim was unable to return fire. The
subject then shot himself with the same weapon. The wife was not injured.

. Hanson to express our interest in obtaining the criminal prosecution contract with the
City of St. Joseph. I would be the attorney responsible for handling the criminal
prosecution.
As you may know, I was formerly employed with the law firm of Rajkowski,
Hansmeier. Part of my duties there included handling the criminal prosecution for five
municipalities, one being St. Joseph. ,I believe I have developed considerable
experience in prosecuting criminal cases for municipalities and I have developed a good
rapport with the various police departments, particularly S1. Joseph.
One of the partners in Hughes, Thoreen, Relph & Hanson is Jerry Relph. He
would from time to time act as my back-up should I have a conflict in my schedule.
Jerry has been in practice for over 20 years and part of his practice included over 10
years experience as a City Attorney for a number of southeastern Minnesota
communities.
I understand the criminal contract will be decided at your January 4, 1996
council meeting. Hughes, Thoreen, Relph & Hanson would submit a bid for services
beginning February 1, 1996. This would allow a transition period for this firm to begin

Minutes of meeting on December ll, 1995
Meeting was called to order by John Anderson at 6:38 pm at Bo Diddley\s.
Members present: Darwin Erickson, Irma Lanier, Claudette Klein, John
Anderson, Marge Lesnick, Joe Braun, and Liaison Bob Loso.
Minutes were approved as submitted.
Liaison Report: No report
Winter Fest: It was decided not to have the fest with so little time
to prepare for it and to postpone it for one year and do something in
spring.
Skating rink & Attendants: Bob Loso hired 3 women and 1 gentleman. They
are college students. Rink will open December 13.
New Business:
Skating lessons: Joe Braun will again take on the task of recruiting
students to give skating lessons and will post posters at the colleges
and also a notice in the Newsleader.
. Park Appreciation Day: It was decided to have a Park Appreciation Day
on December 29 & 30 at Memorial Park (baseball park) and serve hot
chocolate and apple cider from l-5 each day. John will get supplies
needed. Other members of the board will work a 2 hour shift.
Spring Fling: This was discussed and we decided to have the Park
Appreciation Day instead.
Next meeting will be January 22, 1996.
Meeting adjourned at 7:50 pm.
