The Mayor's appointments are included in your packet. Rachel Stapleton 8 a. Information ln packet. Our current policy is to hold all dogs 10 days as previously recommended by the COUNCILO/!S League. The League has expanded this recommendation to Ross Rieke hold unclaimed dogs five business days unless there are Bob Loso extenuating circumstances. I would recommend this Ken Hiemenz change. Cory Ehlert . 8 b. Joe Bettendorf has sent a letter concerning future proposed rate increase. 8 c. Copies in packet. 8 d. Information from John Scherer and Gary Renick, The Church's Attorney. John will send the information from Gary Renick to Jerry Relph, St. BenIs Attorney. It appears that the Church is strongly reconsidering vacation of the alley. 8 e. John Scherer will send a counter proposal to Mike RajkowskiIs proposal. 8 f. The Council, by resolution, needs to authorize an official of the City to be the representative to the Minnesota Municipal Utilities Association. This is the group the City went with for the mandatory drug and alcohol testing requirements. You may appoint a representative and one or two alternates. These individuals may be employees or members of the Council. 10. Enclosed in your packets is a copy of the document circulated by some East Minnesota Street residents. I sent a copy to Joe Bettendorf also. . 11. I do not believe that there will be anyone to protest a delinquent utility bill. 14. Rick Hansen recently acquired the property of Lot 7 tract A \.¡here the house is, from Krebsbachs I . He maintains that the alley is physically located on this ,,~ ê ill . . · property and wonders what the City will do. I indicated that he could ask the Council to look into the matter. I also discussed it with Joe Bettendorf and if the Council would desire, he could have Dave Regan do a check on the situation. Also John Scherer may have thoughts. I indicated to Mr. Hansen that we would not readily provide any monetary payment, but would look into relocating the physical alley to the location as it is platted. 15. The police federation provided information to me concerning their wage and benefit requests, before the last meeting after the packets went out. I have enclosed another copy for your convince. A decision needs to be made on this matter. Also, are wages to increase the CPI increase for the rest of the employees for the next pay period or for all the employees? · · , . . League of Minnesota Cities St. Paul, MN 55103-2044 December 11, 1995 To: All Attendees of the November 1995 MCFOA Region-III Meeting Held at the Albany Golf Course Club House From: Kent Sulem, LMC Codification Attorney Re: Impounded Animal Holding Periods Tom Thelen, the League's Field Representative, asked me to respond to a question that arose at your November meeting. It is my understanding that there is some confusion among city officials as to how long a dog or other impounded animal must be held before it can be sold or destroyed. I hope this letter will provide the answers you are looking for. . The general rule is that an animal impounded by a city for running at large, unless reclaimed by its owner, must be held for a minimum of five regular business days before it can be sold or otherwise humanely disposed of. A regular business day is defmed as any day during which the animal pound is open for business for at least four consecutive hours between the hours of 8:00 a.m. and 7:00 p.m. In other words, weekends and holidays do not count unless the shelter where the animal is being held is open the sufficient number of hours on that particular day. Minnesota Statute 35.71 governs this type of impoundment. The day of the actual impoundment shall not be counted as one of the five days. In the case where an animal has been impounded because it has been subjected to cruelty by its owner, the city must hold the animal for a minimum of ten days following notice to the owner of the animal's impoundment. Because the statute governing this type of impoundment, Minn. Stat. §343.29 as amended by Chapter 244, sect.8 of the 1995 Session Laws, does not specify how to count the days, the general rule of construction would be to follow calendar days, starting with the day following notice. An animal impounded for quarantine to observe for signs of rabies should be held for the recognized incubation period for the type of animal impounde~. In most cities, a ten to fourteen day holding period has been established as the common practice, but the Board of Animal Health has recently indicated that this might not be sufficient for several animals. The League is currently deciding how to best work with the Board of Animal Health to distribute . the new recommendations. In the meantime, a city should hold an animal impounded for observations of rabies for the time period set in the city's local ordinance. Most cities also allow the animal's owner to provide for adequate quarantine so this issue may not be of prime concern to many cities. While this practice would basically ensure compliance with the general rules of impoundment, excluding rabies concerns, many cities will fmd the cost of holding animals longer than minimally required to be too costly from a fmancial perspective.
