RESOLUTION CITY OF ST. JOSEPH WHEREAS, pursuant to proper notice duly given as required by law, the council has met and heard and passed upon all objections to the proposed assessment for the improvement of a bituminous street overlay improvement on Cypress Drive beginning at Old Highway 52 and following the entire loop back to Old Highway 52; East Baker Street from Seventh Avenue Southeast to a point 300 feet east of Tenth Avenue Southeast; and Ninth Avenue Southeast from East Baker Street to East Minnesota Street by constructing a bituminous overlay. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ST. JOSEPH, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part thereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included in hereby found to be benefited by the proposed . improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of 10 years, the first of the installments to be payable on or before the first Monday in January, 1997 and shall bear interest at the rate of 8 per cent annum beginning January 1, 1997. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner, of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, without interest accrued to the date of payment, to the city treasurer. Such payment must be made before April 15, 1996. 4. The clerk shall forthwith transmit a certified duplicate of this assessment to the county auditor to be extended on the property tax lists of the county. Such assessments shall be collected and paid over in the same manner as other municipal taxes. Adopted by the council this 15th day of February, 1996. Mayor . City Clerk · " - Resolution No. 1991-6-140 A RESOLUTION RELATING TO DEFERMENT QE SPECIAL ASSESSMENTS EQE PERSONS ß5 YEARS QE AGE OR OLDER OR RETIRED BY VIRTUE QE PERMANENT AND TOTAL DISABILITY EQE WHQM IT WOULD BE A HARDSHIP TQ MAKE THE PAYMENTS, AND ~STABLISHING AN INTEREST RATE EQB S!lCH DEFERMENT WHEREAS, Minnesota Statutes Section 435.193 through 435.195 authorizes the City, upon proper application, to defer the payment of ~pecial assessments ag.3.i~1s~,; any 11C:::mvs'!:,fiad prt:lper"<;y OW';¡'12d by a. ~l's(jn 65 years of age or older or retired by virtue of permanent and total disability for whom it would be a hardship to make the payments; and, WHEREAS, Minnesota Statutes Section 435.194 authorizes the municipality to establish an interest rate to be added to the deferred assessment which shall be payable in addition to the deferred - Issessment: and, - WHEREAS, the City Council has determined that deferment of the assessments should be granted to any person otherwise qualified who shall make proper application claiming that average annual principal and interest due on the assessment is in excess of 3% of his or her current annual income and therefore is a hardship. Provided, however, that this deferment shall apply to homesteaded property only. NOW. THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ST. CLOtm, MINNESOTA: That the assessment of any homestead property owned by a person 65 years of a~e or older or retired by virtue of permanent and total disability for whom it would be a hardship to make the payments, be - -- · - deferred subject to the aforementioned income and property value ~ conditions upon submission of an appropriate application signed by the gualified person: and, BE IT FURTHER RESOLVED, that interest at the rate for that particular assessment shall be added to the deferred assessment and shall be payable upon termination of the deferment in accordance with the terms and provisions of Minnesota Statutes Section 435.195, if: 1- the owner dies and the spouse is not otherwise eligible; 2. the property or any part thereof is sold, transferred, or subdivided; 3. the property should lose its homestead status; or, 4. if for any reason the City determines that the taxpayer is no longer in the hardship category; and BE IT FURTHER RESOLVED, that application for deferments must be - submitted to the City Clerk no later than September 30 of the year - preceding the year in which payments are due; and, BE IT FURTHER RESOLVED, that this resolution replaces Resolution 1983-3-57, and shall not be construed to prohibit the determination of hardship on the basis of exceptional and unusual circumstances not covered by the standards and guidelines where the determination is made in a nondiscriminatory manner and does not give the applicant an unreasonable preference or advantage over other applicants.
