Dave Theisen will be bringing a request to approve updated by-laws. 8 b. Information was in your packet for the last meeting. 19 c. FOllowing is a proposed resolution making a clarification that the City will provide snow removal on the south side of East Minnesota Street from 91st Avenue going west to ?? - - . -- . - , , . Pursuant to due call and notice thereof, the City Council for the City of st. Joseph met in regular session on Thursday, June 6, 1996 at 7:00 p.m. in the st. Joseph City Hall. Members Present: Mayor Donald "Bud" Reber. Councilors Ross Rieke, Bob Loso, Ken Hiemenz. Deputy Clerk Judy Weyrens. others Present: Fred Reber, steve streng, Mary Ann Graeve, Gary Heltemes, Dave Theisen. Approve Agenda: Hiemenz made a motion to approve the agenda with the addition of Fire Chief Report and Application for payment #3 - Water Filtration Improvement. The motion was seconded by Loso. Ayes: Reber, Loso, Hiemenz. Nayes: None. Motion Carried 3:0:0 Consent Aqenda: Loso made a motion to approve the consent agenda as follows: a. Approval of minutes - May 16 and May 22, 1996 b. Approval of the Watab Creek Deer Hunters exemption from gambling for an event to be held on September II, 1996 at the La Playette. . c. Approval of First Responder training for the Police Department. d. Councilor Rieke arrived at 7:03 p.m. Discussion: Loso requested the Police Department rotate the years of training so the entire department is not in need of training the same year. Ayes: Reber, Rieke, Loso, Hiemenz Nayes: None Motion Carried 4:0:0 Bills Payable: Deputy Clerk Judy Weyrens presented the bills - payable. The Council discussed the rotation of business for providing mechanical repairs to City vehicles. Hiemenz questioned - the dog boarding policy and reimbursement schedule. He stated the City needs to have a policy whereby the City reimburses the Vet Clinic for expenses incurred when the city boards a dog that is infested or diseased. Hiemenz also stated that he hoped that all individuals whose dogs are picked up and are retrieved by their . -, . owner pay the established fees. There being no further questions on the bills payable, Loso made a motion to approve the bills payable, check numbers 22511-22576; seconded by Hiemenz. Ayes: Reber, Rieke, Loso, Hiemenz Nayes: None. Motion Carried 4:0:0 Overtime and Callouts: Loso made motion to approve the overtime and call outs as presented; seconded by Hiemenz. Ayes: Reber, Rieke, Loso, Hiemenz Nayes: None. Motion Carried 4:0:0 Mayor Reports student Issues: Mayor Reber reported that he is concerned with the amount of vandalism and disrespect for property and regulations by the students. He stated that he will be asking the City Attorney for an opinion as to additional measures to control behavior. It is Reber's hope that the City Attorney will find a measure to verify the number of students living in a rental unit. Reber would also like to find a way to hold those responsible for damage to City streets and property accountable. Councilor Reports RIEKE . student Issues: Rieke continued to discuss the student problems and stated the City needs to determine how hard it wants to work on the issue and what action does the legal system allow us. CORE: CORE is in a hiatus and will begin again in fall College Avenue Gathering: Rieke stated that he received a number of calls on the incident on May 25 and felt the Police Department handled the situation very well. LOSO Summer Recreation: Dave Hiedeman, Summer Recreation Director, is requesting the City appropriate an additional $ 1/000 for summer recreation. Funds are needed to hire additional staff for the softball programs as they have an influx of participants. The Council discussed the revenue received and the billing of the adjoining Townships for their residents participation. with the hopes of receiving funding from st. Joseph Township and st. Wendel Township, Rieke made a motion authorizing up to $1/000 for additional staff for the summer recreation program. The motion was seconded by Hiemenz. Ayes: Reber.. Rieke, Loso, Hiemenz. - Nayes: None Motion Carried 4:0:0 - Hiedeman is also requesting authorization to purchase a Rubbermaid storage container to store all the summer recreation equipment in the amount of $200.00. Nayes: None Motion Carried 4:0:0 Recreation Association: Loso invited the Council to participate in the 20th year anniversary celebration of the st. Joseph Recreation Association. The event will be on June 14, 1996 beginning at 7:00 p.m. and ending at 10:00 p.m. Annual Conference: Loso stated that he will be attending the League of Minnesota Cities Annual Conference and will spend a large amount of time on the section dealing with grants and assistance. HIEMENZ stearns County Leaque Meetinq: Hiemenz & Mayor Reber attended the stearns County League meeting with the following discussion items: I. Doug Weiszhaar discussed the super pave blacktopping. 2. Representative Fishbach and Dehler discussed legislative topics. . Garbaqe: Discussed the number of rental units with garbage in the yards. It was stated that the Police Department has been sending out notices to enforce the Ordinance. Hiemenz also discussed a business sign on Minnesota street that is in need of repair. star City: Hiemenz reported that a sub-committee of the star Commission has prepared an application for membership to the st. Joseph Economic Development Authority (EDA). To assure the completeness, the sub-committee is requesting authorization to have the application and criteria reviewed by the City Attorney. Reber made a motion authorizing the sub-committee of the star Commission to meet with the City Attorney as requested; seconded by Loso. Ayes: Reber, Rieke, Loso, Hiemenz Nayes: None Motion Carried 4:0:0 The star Commission is also requesting authorization to establish a screening commi t tee to recommend members for the EDA. The Committee would accept the applications, review, interview and make recommendations to the City Council. The committee would function is the same manner as the Police Hiring Committee. Rieke made a motion authorizing five (5) members of the star Commission to form a screening committee for the EDA; seconded by Loso. Discussion: Loso stated that he would like to review all the appl icants. Reber stated that the I ist of appl icants would be available at the City Offices. Ayes: Reber, Rieke, Loso, Hiemenz - Nayes: None. Motion Carried 4:0:0 . . . Fire Chief Reports: Fire Chief Dave Theisen presented the Council with the six (6) month Fire Report. Theisen stated that the Fire Department responded to 113 emergency calls, 86 of which were medical responses. The Department estimated that they would respond to 200 calls during 1996. At the current pace they will well exceed that estimate. Gary Heltemes questioned if the department has seen an increase in carbon monoxide calls. Theisen stated that they have responded to a number of them. The Fi re Department wi 11 respond onl y in a medical response and circulate the house. Rieke stated that the Department requires a waiver be signed by the property owner when responding to a carbon monoxide call. Theisen also reported on the increased number of cellular phone calls reporting slumpers. The County is trying to screen the calls better as the Fire Department must respond to all calls. Loso questioned the response time of Gold Cross and if an ambulance is dispatched for every medical call. Theisen stated that whenever the st. Joseph Rescue Squad is dispatched so is Gold Cross. The response time of Gold Cross has been cut down somewhat due to all the road construction and varies as to what portion of the Fire District they are responding to. . Loso made a motion accepting the Fire Report and authorizing the payment of $ 13,244.50; seconded by Rieke. Ayes: Reber, Rieke, Loso, Hiemenz Nayes: None Motion Carried 4:0:0 Theisen stated that the Fire Department is in the process of updating the by-laws of the department and he will be appearing before the Council June 20, 1996 requesting approval. Local Performance Aid: After reviewing the various reports received by the Council throughout the year, Hiemenz made a motion to verify that the City of st. Joseph has measures of performance in place and will continue to update and increase these measurements. The motion was seconded by Loso. Ayes: Reber, Rieke, Loso, Hiemenz Nayes: None Motion Carried 4:0:0 Policy Review: Rieke stated that the Personnel Committee has not had time to review the Funeral Policy for Law Enforcement and use of accumul ated hol iday hours. Loso made a motion to tabl e the matter for 30 days until the Personnel Committee can meet and make a recommendation. The motion was seconded by Rieke. Clerk/Administrator Reports Doa Control: A resident requested the Council consider revising the fees charged for dog licenses. He is also requesting the Council charge more for un-neutered or un-spayed dogs. The Council discussed the charges and license process currently in place and fel tit served the needs of the City. If at some time there is an abundance of stray dogs or dogs running at large they would reconsider the issue. County Board of Review - Final Report: The City received the final report from the County Assessor detailing the changes in valuation as a result of the Board of Review meeting. Noise Violation: A first noise violation was received for 109 College Avenue North. Those present discussed the need for stronger penalties. At the end of school the risk is considerably less and it appears as the students know that nothing will happen unless they receive a second noise violation. The City Attorney will be consulted on this matter for his opinion and recommendation. . Workers Comp Coveraqe Increase: The League of Minnesota Cities Insurance Trust has increased Workers Comp coverage to include payment for diagnostic testing for employees who have been exposed to certain defined infectious diseases. Broken Windows: The morning of the gathering on College Avenue the windows in the Police department were vandalized and are in need of replacement. Well Closinq: Dick Taufen, Public Works Director, applied for and received a grant in the amount of $ 1,163 for the closing of well #l. Council Meetinq - Julv 4: Due to the 4th of July holiday falling on the 1st Thursday, the Council meeting needs to be rescheduled. The Council agreed to reschedule the meeting for July II· and schedule the second meeting of the month according to the matters before them. PUBLIC COMMENTS Fred Reber: Fred Reber questioned the Council if they can use the election list to verify residency of students and enforce the rental ordinance. Weyrens stated that the lists received are secured for the purpose of election day activities and are turned in to the County at the end of election day. Councilors requested . - the City Attorney review this matter. - Mary Ann Graeve: Mary Ann Graeve questioned where the applications for the EDA can be picked up and how will the public be informed. Hiemenz reported that they are not ready and the openings will be published in the st. Joseph Newsleader and applications will be . , . available at the City Offices. Graeve also questioned the gathering on College Avenue and if the College Presidents and Development Directors were contacted. She stated that in her opinion, inconveniencing these people may have an impact on the College viewpoint. Also.. the City is making an assumption that all those involved where students, which may not be the case. While reading the City Council minutes for the May 2, 1996 Council meeting.. Graeve noticed an error. Page 2506 states the Council considered removing the snow on the East Minnesota Street sidewalk. It was her understanding the Council passed a resolution verifying the removal. Councilors present agreed with Graeve and stated that the tape will be reviewed and the necessary corrections will be made. Graeve requested a copy of the revised minutes. Gary Heltemes: Discussed the need for sidewalk along East Baker Street. Pedestrian traffic is very heavy as Kennedy School is located at the end of East Baker Street. Steve Streng: Streng questioned the Council on the status of charging for fire calls. Rieke stated that he originally suggested the idea and felt that with Accu Serv in the city it would be a . good dea I . However, after researching the matter he was unaware of the good will gestures between the ambulance service and Fire Department. If the Department starts charging for the services, the City may also incur additional costs. Theisen also reported that the Department receives funding from the County to purchase additional equipment and charging for fire calls may have an affect on funds. Mailboxes: The Council briefly discussed the location of mailboxes along East Minnesota Street. Those present questioned if grouping of mail boxes had been discussed. The Council referred this matter to the City Engineer for his consideration and opinion. Ad;ourn: Loso made a motion to adjourn at 8:26 p.m..: seconded by Hiemenz. MEMBERS PRESENT: Mayor Donald Bud Reber; Councilmembers Ross Rieke, Ken Hiemenz, Cory Ehlert; Clerk/Administrator Rachel Stapleton. Bob Loso was absent. OTHERS PRESENT: Monte Eastvold. Mayor Reber called the meeting to order at 4:40 P.M. with Councilors Rieke, Ehlert and Hiemenz present. He stated the purpose of the meeting is to consider resolutions authorizing the issuance and awarding sale of bonds for financing projects. Monte Eastvold of Juran & Moody, Inc. informed the Council that these bond issues received a Baa rating by Moody's Investor's Service. He then presented a tabulation of the 4 bids received for financing the East Minnesota Street project and Improvements to the Roske Addition. Councilmember Hiemenz introduced the attached Resolution Authorizing Issuance, Awarding Sale, Prescribing the Form and Details and Providing For The Payment of $1,280,000 General Obligation Improvement Bonds of 1996, awarding the sale to Piper Jaffray, Inc. with a Net Effective Rate of 5.6543% and moved to its adoption, which motion was seconded by Councilmember - Rieke. Ayes: Reber, Rieke, Hiemenz, Ehlert. -- Nayes: None. Motion carried. Monte Eastvold then presented a tabulation of 5 bids received. Councilmember Rieke introduced the attached Resolution Authorizing Issuance, Awarding Sale, Prescribing the Form and Details and Providing For The Payment of $780,000 General Obligation Water Revenue Bonds of 1996 awarding the sale to Piper Jaffray, Inc. with a Net Effective Rate of 5.9007% and moved to its adoption, which motion was seconded by Councilmember Ehlert. This agreement is entered into between Saint John I s University, hereinafter known as the "Institution," and the::èitýðf - ~t._- Joseph, MN, hereinafter known as the "Organization;" a local public aqency (type of organization) for the purpose of providing work to students eligible for the Minnesota College Work Study Program (MCWS). Pursuant to Title I Part. C of the Economic Opportunity Act of 1964 and Title IV, Part C of the Higher Education. Act of 1965, as amended by the Higher Education Amendments of 1968, 1972, 1976, 1980, 1986 and 1992 (pub. L 102-325), the organization agrees that no student will be denied work or subjected to different treatment under this agreement on the grounds of race, color, national origin, or sex. It further agrees that it will comply with the provision o(the Civil Rights Act of 1964 (Pub. L 88-352; 78 Stat. 252) and . Title IX of the Education Amendments of 1972 (Pub. L. 92-318) and the Regulations of the Department of Education. Article I. Organization Conduct of Work Study Program f. A. Pursuant to the purpose of and in accordance with the Act, the Organization will conduct a program of work in the public interest and will employ eligible students from Saint John's University on a part-time basis. Such work: 1) will not result in the displacement of currently employed workers or interfere, impair or cancel existing contracts for services; 2) will be governed by such conditions of employment as will be appropriate and reasonable in light of such factors as type of work performed, geographical location, and the skills of the employee; 3) does not involve the construction, operation or maintenance of any facility used or to be used for sectarian instruction or as a place - for religious worship; .". ~ 4) does not involve political activity, or work for any political party, . and' , . 5) will be responsibly supervised. B. It is further agreed that in the conduct of the foregoing, the Organization: 1) shall employ student(s) on average of 5-12 hours per week under the Work Study Program not to exceed 20 hours in any week. If any student exceeds this limit, the Organization further agrees to pay the student directly for those hours exceeding the limit; 2) shall be considered the employer for purposes of FICA and will provide workers compensation coverage; 3) shall provide the necessary payroll information to the Institution in a timely manner; 4) shall pay 25% of the hourly rate and 100% of any part of the . hourly rate which exceeds the agreed upon rate and 100% of any overtime hours; f 5) shall participate in furnishing data for reports as may be required by the United States Commissioner of Education or the State of Minnesota; 6) shall maintain final authority in selection and dismissal of employees. Article II. University Conduct of Work Study Program A. The Institution, in its administration of the program: 1) will submit required applications to and maintain contacl with applicable Federal and State agencies; 2) will determine the eligibility of students; ~ 3) will present eligible students as available to work; ~ ~ -'1 . . . 4) will process payroll, provide fiscal accounting and other records as necessary; . 5) will bill the Organization for its share of payroll and FICA costs; Article III. Contract Limits A. The contract shall be effective from July 1, 1996 to August 31, 1996. B. The number of students employed and the specific duties performed will be mutually agreed upon by the Institution and Organization. C. The wage rates will be determined by the Organization which will_ notify the. Institution of the rate. The rate of pay will not be less than the minimum rate as authorized under the Work Study Program (presently $ per hour). D. The student earnings limit will be determine by the Institution and cannot . be exceeded. If the issuance of the license will not violate any ordinance provision, the clerk/administrator shall issue a license to the applicant upon payment of the required fee. Section 65.0~¡: LICENSE FEE. The fee for every license shall be the amount as established by resohÏÜon of the City Council, and as from time to time modified by council resolution. Every license shall expire on December 31 of the year for which it is issued. If the license applicant is blind, the license fee shall be waived in accordance with Minn. Stat. §461.12. Joseph met in regular session on Monday, June 3, 1996 at 7:30 p.m. in the st. Joseph City Hall. Members Present: Chair Hub Klein. Commissioners S. Kathleen Kalinowski, Marge Lesnick, Dan Nierengarten, Andy Brixius, Kurt Schneider. Secretary Judy Weyrens. Others Present: Jim Schwegel, Claude Menzhuber, Tom Gustafson, Val Stanger, Dale Greiger, Gary Heltemes, Merlyn Jerzak, Peter Omann. The hearing was delayed due to the lack of a quorum. Schneider and Brixius arrived at 7:45 p.m. Special Use Hearinq - Silver Motors: Chair Klein called the hearing to order at 7:45 p.m. The purpose of the· hearing was to consider a special use permit to allow the operation of a mechanical car repair business in a general business zone. st. Joseph Code of Ordinances No. 52.20 subd 3(b) allows for the following operations in a general business district with a special use permit. Automobile service stations including sales gasoline - service stations and auto repair garages, provided that no fi 11 ing station, public garage or gasoline distributing station sha 11 be ....... located within 200 feet of a school, church, hospital or meeting place having a seating capacity of more than 50 persons. The request for special use has been submitted by the William Loso Trust on behalf of Silver Motors, 110 Birch Street West, St. Joseph, MN 56374. Tom Gustafson spoke on his own behal f. He stated that he owns Silver Motors and is renting the Loso property for a mechanical repair business. Most of the work is refurbishing cars/buses and they are then sold. He also stated that he would construct a fence around the property. Chair Klein stated that the st. Joseph code of Ordinances allow for repair garages in a general business zone by special use if they are not located within 200 feet of a school, church, hospital or meeting place having a seating capacity of more than 50 persons. Commissioners discussed the definition of a meeting place and requested legal opinion before further consideration. Claude Menzhuber, owner of the EI Paso (adjacent to proposed special use), stated that the property has never been kept so clean and he is supportive of the mechanical repair business. Jim Schwegel, owner of the Der Wohnplatz apartment complex, spoke in opposition of the special use permit. He stated that all the - parked in the of the building unsightly and his cars rear are tenants should not have to look at it day after day. He has spent much time and money repairing and upgrading his apartment complex and does not want junk cars stored in his backyard. The all ey adjacent to the Loso property is part of the state snowmobile track. Gustafson stated that he would fence what the st. Joseph Code of Ordinances all ow and will make sure the fence does not become a traffic hazard. He stated that he plans to keep a very neat business and will deal with any problems that arise. Chair Klein closed the hearing at 8:07 p.m. Nierengarten made a motion to table the special use request to the July 1, 1996 Planning Commission meeting so that a legal opinion can be made as to the definition of a meeting place. Additionally, Mr. Gustafson should present a fencing plan, approved by the Building Inspector to the Commission at the same meeting. The motion was seconded by Kalinowski. Benedict - 306 Minnesota street West: Merlyn Jerzak, Physical plant Director, appeared before the Commission to discuss the property located at 306 MN Street West. In the past the College has rented the property for student living. During the past year the house has been converted to the Multi-Cultural Office housing a full time director and 2 part time staff. The property is zoned R-1/ Single Family. As such, an office that is not a home occupation is not a permitted use under the st. Joseph Code of Ordinances. Commissioners informed Jerzak that the options to continue the use would be either a special use permit or rezone the property E & E. After discussion, Commissioners requested Weyrens to consult with the City Attorney as to his recommendations and schedule the hearing for July 1, 1996. Buildinq Permit Request - Peter Omann: Peter Omann appeared before the Commission requesting authorization to make application for a building permit for Omann Insurance. Omann stated that they have purchased property adjacent to the Cedar East Office complex and plan to construct an office building. The building will house two office suites and will be constructed of brick. After reviewing setback and parking requirements, Lesnick made a motion authorizing Omann Insurance to make application for a building permit to construct on office building. The motion was seconded by Brixius.
