Joe did not have much light to shed on the history of this area, although he was familiar with the issue. We both concur 612'339-9206 that this is not an area that we want to have declared a public road at this point in 800-445'9617 time. We do not want to take a position which may require the City to undertake FAX 320-251'5896 maintenance. - INTERNET ADDRESS As an alternative, we would suggest having the City grant an easement for ingress - and egress across the 66 strip of property to serve the Pikus parcel. A title objection was made at that time regarding access to the subject property, a bulk tank facility. I have enclosed a copy ofthe title opinion of Russ Pikus' attorney, Jerry Relph, as well as a copy . of the survey. Tract A was the parcel which was conveyed and the access to the property in question was the 66 foot strip immediately to thc north of Tract A and continuing westerly to County Road 75. The objection which is at issue is paragraph 7. Mr. Relph has concluded that the City of St. Joseph owns the 66 foot strip providing access to Tract A from County Road 75. As you know, the bond issue becomes callable January 1, 1997. Including the 1-1-97 Principal payment, $390,000 in Principal remains to be paid off through 1-1-02. As of 12-31-96, the debt service fund balance for this bond issue should have approximately $651,657 available for prepayment of the bonds. Early payoff of this issue will eliminate future interest payments of approximately $78,585. Enclosed are three copies of the Call Resolution and Notice regarding the redemption of the remaining G.O. Improvement Bonds, Series 1986. Due to notification requirements for the existing bondholders (a minimum 30 day requirement), it is recommended that the Resolution be acted upon by the City Council prior to December 1, 1996. PAUL, MN 55101·2131 ATTORNEY GENERAL TELEPHONE: (612) 296-7575 October 14, 1996 ATTORNEY GENERAL UNCOVERS COURTESY BIDDING ~ ON PUBLIC CONTRACTS FOR PLAYGROUND EQUIPMENT The Attorney General's Office has found evidence of courtesy bidding on two public contracts for the supply of playground equipment. This Office concluded that two playground equipment vendors submitted courtesy or sham bids on these two contracts. The companies involved denied liability. The matter was settled by a consent judgment whereby each company paid a civil penalty under the Minnesota Antitrust Law and agreed to abide by the law. A troubling aspect of our investigation, however, was that while we felt the companies involved manufactured the courtesy bids of their own volition, we believe they were encouraged to act in this way by the city official in charge of the bidding process. This official asked one vendor if he could get him a second bid on the project. The vendor then contacted a competitor and acquired a second bid on the contract. Later, the city official asked the vendor to get him a second bid on another contract and the same scenario was repeated. - The submission of a complementary bid, one not intended to be win award but only to - make the bidding process appear more competitive, constitutes bid rigging in violation of both Minnesota and federal antitrust law. United States v. Reicher, 983 F.2d 168,170 (10th Cir. 1992) (bid rigging occurs even where one bidder does not have the ability to perfonn the contract because the simple fact that company submitted a bid means that it held itself out as a competitor); see also United States v.W.F. Brinkley & Son Constr. Co., 783 F.2d 1157 (4th Cir. 1986). Competitors should certainly be encouraged to bid on public contracts but the encouragement should come from the city. Such responsibility,. should not be delegated to the c.ompanies vying for the bid. Under Minnesota Antitrust Law, the city official's action did not promote the integrity of the bidding process. It is not wise to encourage competitors to discuss their bids with one another or to encourage, even tacitly, one competitor to secure the bid of another. Under certain circumstances such action may rise to the level of aiding and abetting illegal bidrigging. Common sense suggests that the vendor asked to secure the bid of another will ensure that the other's bid is higher than his own.
