"., " . . ~ . GARBAGE PICKUP AGREEMENT , This Agreement made and entered into this 1st day of March, 1995, by and between Browning Ferris Industries, party of the first part, and the City of st. Joseph, a Municipal Corporation, party of the second part. It is hereby agreed by and between the parties as follows: 1. From March 1, 1995 to December 31, 1996 the party of the first part is hereby employed to operate a refuse collection service, serving all the residences, excluding the non owner occupied rental units and business places, in the City of st. Joseph, Minnesota. Effective October 1, 1989 all absentee landlords will be required to contract for their own refuse hauling. 2 . In providing said service the first party shall: (a) Collect refuse of all owner occupied residences in the - City of st. Joseph. The residents shall have a choice of one of two services. First,. there will be a 1 i mi t 0 f two (2) thirty (30) ~ gallon containers or the equivalent thereof and not to exceed 50 pounds per container. (No 50 gallon barrels) The residents also have a choice to be on a bag system. The bags will be available to the residents to purchase for $ 3.00 per bag from the supplier. Any residents who so chose, may at the beginning of anyone billing period elect to convert to the bag system and will be required to remain on the bag system for one year. The hauler will have sole responsibility for the dispensing of bags, tags and labels and for the bi 11 ing and collection of the residents who chose the bag system. Containers/bags are to be placed at the rear end of all lots having alleys or reasonably near the street on lots not having an alley access. The party of the' second part shall only be responsible for billing for the base service, any other service will be billed for by the party of the first part. The party of the first part will contract with residents separately for extra pickups, construction debris and yard waste, at the individual residence. * Absolutely no tires, batteries, drain oil, paint or chemicals can be picked up. (b) Use a compactor truck for refuse pick up service. (c) Dispose of all refuse at such places where the first p~rty can lawfully dispose of the same at the first party's expense a:1d not at the expense of the City. The party of the first part wlll provide a disposal plan which will minimize the total amount 0: mixed municipal solid waste which is land filled to 35% or less by weight through processJ.ng or delivering the mixed municipal selid waste to a processing site. (d) CoIl ect all refuse once each week, the established , . pickup day being Thursday. The party of the first part shall continue to provide service each and every Thursday, but shall, however, have the right to change said days of pickup upon giving written notice to the second party and obtaining second party's consent. The first party shall publish notice in the st. Cloud Times for any approved change seven days prior to the, change and the First party shall have broadcast said change on the following radio stations: WJON, KSAM, KS95. This broadcast must be aired each of the seven days prior to the approved change. In addition, the first party shall place notices on one refuse container of each of the residents to be served in substantially the following form: CITY OF ST. JOSEPH GARBAGE AND REFUSE PICKUP DAY OF PICKUP GARBAGE PICKUP TIME DATE OF EFFECTIVE CHANGE COMPANY NAME COMPANY PHONE NUMBER (e) Recycling service will be provided at no cost to the residents or City of st. Joseph. Items for recycling will include but not limited to: newspapers, cans, glass and plastic. This - service shall be provided (weekly or bi-weekly). - ( f ) The party of the First Part shall be responsible for providing a curbside spring and fall pickup. All residents affected by this contract, shall twice each year, have the opportunity to participate in a spring and fall cleanup at no extra charge to the City of st. Joseph. Large items can consist of furniture, white goods, or any other household goods, excluding hazardous waste. Their shall be no limit as to the amount of garbage per residence on said cleanup days. (g) The party of the first part will provide a dumpster at no charge, for City use, at 21 - First Avenue NW (behind City Hall Annex) . (h) Doing all work in a reasonable way and protecting from any unreasonable or unnecessary damage or wear to the containers used in the pickup service. ( i ) To indemnify the City of st. Joseph from any and all claims or demands for damage to person or property arising out of or in any way connected to the performance by the party of the first part of the requirements of this agreement and to carry insurance satisfactory to the second party, naming the second party as co-insured providing coverage for damage to property in the sum or $ 100,000 and injury to any one person in the sum of $ 200,000 and injury to more than one person arising out of one occurrence in the sum of $ 300,000, said insurance covering first party and second party for any activities arising out of first party's performance of this agreement, and provide second party with a certificate of insurance. .. ... .- " . 3. The second party shall pay the first party monthly the sum of $ 11.50 from March I, 1995 to December 31, 1995 and $11. 75 from January I, 1996 to December 31, 1996, per single family dwelling, said sum to be payable the month following the rendering of the service. If the performance by the first party of the services herein provided shall be commended in the middle of the month, and services provided shall be for less than an entire calendar month, the sum to be paid the first party shall be pro-rated and the first party shall be paid only that part of the month in which the service is actually provided. 4. The first party shall not be obligated to provide said service in any areas until plowed of snow by the second party, but then shall provide said service in the amount of pickups where the parties to be served have cleared snow to provide access for first party to the containers to be picked up. 5. The City shall at the commencement of the performance of this agreement, and at the start of each three-month period thereafter, make a count of all pickups where service is provided by the first party and said count shall be used to determine the - sum to be paid the first party for the service provided. -- 6. This agreement shall be subject to termination during its term by the second party upon said second party giving written notice of its intent to terminate 30 days before the date it chooses to terminate said agreement. Box 668 St. Joseph, MN 56374-0668 -' Dear Mayor and Members of the Council: - As you are aware, the City received a bill dated October 22, 1996, from Steams Electric in the amount of $4,680.08 for replacement of a power line under the East Minnesota Street Holding Pond. Nonnally, utility companies relocate these lines without cost to the City because they are on public right-of-way with the City's permission, under a franchise agreement. In this particular case, Stearns Electric was on an exclusive easement that was negotiated over private property, and, therefore, had no obligation to relocate or lower their power line without compensation. The power line in question is located just south of the homes along East Minnesota Street between 9th Avenue SE and the holding pond site (the homes ftom Kalla to Ruegemer). It runs underneath the holding pond and connects to a switch near the dentist's office. This is a major 3-phase line that begins at the substation on Ridgewood Road, serves Mathew Hall, Manions, and other industries in the area, passes through St. Joseph, and terminates near Rockville. Stearns Electric didn't want to simply lower and spliœ the cable because the spliced line would be located under the holding pond; it would be hard to access if a fault occurred and the pond was full. Losing this line would create an outage for many users south and west of the site. Instead, they placed three new cables (one for each phase) for a total of 1,080 feet, and installed a modular connection point on the west side of the pond. This gives the utility a splice-ftee installation and allows them to reroute power quickly in the event of a fault. SI-fORT ELLIOTT HENDRICKSON INC. Stearns Electric did not realize that the cable was in the way until the preconstruction conference. We had the City's Contractor lower the grade to assist in cable replacement. I have reviewed the items listed on the bill with Peter Gruber of Stearns Electric and believe the list is accurate. In view of the above, I recommend payment. Since this is a purely storm sewer related item, I will include it on the final cost split summary to Stearns County under the 60/40 cost sharing ratio. M.S. 176.011, subd. 9, (5), provides that "municipal officers elected or appointed for a regular term of office" are considered to be "employees" for workers compensation purposes only if the city has passed an ordinance or resolution to that effect. An elected or appointed official injured while performing his or her duties would not be eligible for workers compensation benefits unless the city had passed that ordinance or resolution. Whom does this (~ffect? This provision clearly applies to mayors and council members, In some cities the clerk and treasurer are elected positions, and are therefor covered by this provision as well. - -- , It seems likely that members of other administrative boards that the city creates pursuant to statute such as planning commissions, utilities commissions, park boards, hospital or nursing home boards, etc. would fall under this provision as welL It's not clear though whether a member of a purely advisory committee or commission that the city creates would be considered to be an "officer" or "official" for purposes of this statute. Some charters may provide specific terms for certain appointed positions such as the assessor, engineer, police chief, etc. Under a strict reading of the work comp statute, these individuals would not be covered by workers compensation unless the city has passed an ordinance or resolution to add coverage - assuming that these individuals would be considered "officers" rather than merely "employees." Ifwe want to add coverage, how should the ordinance or resolution he worded? The resolution or ordinance should specifically list the positions the city intends to cover. If the city wishes to extend coverage only to the mayor and council, the ordinance or resolution should refer specifically and only to elected officials. An ordinance to extend coverage to members of other boards and commissions, could be worded this way: "Pursuant to Minnesota Statutes 176.011, subd. 9, clause 6, elected officials and members of the following boards, commissions, and committees are included in the coverage of the workers compensation act: planning commission, park board, utilities commission... " , If any of the city's appointed positions such as police chief or assessor have a specific term, these positions should be listed as well. AN EQUAL OPPORTUNITY/AFFIRMATIVE ACTION EMPLOYER , ,0 . It's not completèly clear whether the city can distinguish among its elected and appointed officials, by providing workers compensation to some officials but not to others. The statute perhaps could be read to mean that the city's only options are either to cover all elected and appointed officials or none at all. If so, an ordinance or resolution extending coverage, regardless of how it is worded, might be interpreted to mean that all "officials" are covered. Then the'qijestion of whether, say, planning commission members are covered would depend not on whether they are listed in the ordinance or resolution but rather on whether they are "officials" or "officers." Such an interpretation seems unlikely, but cities should at least be aware of the possibility. Is there any reason to use an ordinance rather than a resolution? If the city wishes to provide workers compensation coverage for elected officials, it is preferable to use an ordinance rather than a resolution, Resolutions are often recorded only in the council minutes; years later it can be very difficult and time-consuming to track down a resolution. We've seen a number of cases where a city has been paying premiums for workers compensation coverage for elected officials for years, but now can't find any ordinance or resolution specifying that elected officials are covered. An ordinance will generally be easier to keep track of permanently, since it is recorded in the city's ordinance book as well as in the council minutes. - - Do we need to do anything special if we don't wallt to cover elected officials for workers compensation? If the city does not wish to cover its elected officials for workers compensation, it might be wise to pass on ordinance to that effect as well unless you are absolutely certain that the city has never passed a resolution to provide coverage. That resolution could have been passed as long ago as 1967, when the law was first amended to permit cities to opt for coverage. The following language could be used for the ordinance: "The officers of the City of _ elected or appointed for a regular term of office shall not be included in the coverage of the Minnesota Workers Compensation Act, pursuant to Minnesota Statute 176.011, subdivision 9, clause 6." How much does it cost to add workers compensation coverage for elected officials? Workers compensation for elected officials used to be a pretty expensive proposition. However, over the past several years, LMCIT has very substantially reduced premiums for this coverage, to bring the cost more in line with the actual risk. For elected officials, LMCIT's 1996 premium rate is $.47 per $100 of payroll. This rate is applied either to the official's actual salary or to an imputed salary of $70/week, whichever is greater. .- - .....--.. ~ . . . Obviously, the imputed minimum salary will come into play in most cities, since most council salaries in most cities are much less than that. Using the imputed minimum salary, the manual premium comes to $86 for a five-member council. The actual cost to the city may be somewhat more or less than that, depending on the city's experience modification, volume discount, and deductible if any. This same approach and rate will also be used to calculate premiums for coverage for any other boards, commissions, or committees which are specified in the city's ordinance or resolution extending coverage. Unless the city specifically indicates that members of a particular board are covered, LMCIT will assume that they are not. For officials other than members of the council and other board members, premiums will be based on the actual salary and the appropriate class rate. What benefits would an official receive under workers compensation? As with any other employee, indemnity benefits would be based on the individual's actual earnings from all employment. In other words, benefits would be based on the total earnings from the . official's regular employment plus the salary (if any) he receives from the city. The $70 per week imputed minimum salary is used solely to calculate premiums, and does not figure into the benefit calculation in any way. Are there any less expensive alternative ways to protect elected officials and board members? LMCIT has arranged with CIGNA to offer a less expensive option through which cities can provide some protection for their council members against the risk of being injured or killed in the course of performing their duties. For a cost of$12.75 per person per year, the city can purchase an accident policy which provides benefits for death or a disabling injury arising out of an accident which occurs while the council member is traveling to, participating in, or traveling from a regularly scheduled council meeting, or while conducting official council business on behalf and at the request of the council. The policy provides a death benefit of $1 00,000. It also provides a schedule oflump sum benefits for loss of a hand, foot, or eye. The policy also provides a short-term disability benefit of $400 per week. Disability benefits are payable for a maximum of26 weeks, after a three-day waiting period. Disabi]ity benefits would be paid if as the result of a covered injury the individual cannot do at aJl the substantial and material duties of his type of work. ~ . . , . . This coverage differs significantly from the benefits that would be provided by workers compensation. Some of the more important differences are: · The accident policy does not pay for medical costs. The individual would have to look to his own health coverage to pick up these costs. · Disability benefits would continue for a maximum of26 weeks. By contrast, workers compensation benefits would continue as long as the disability lasts. · Benefits are payable only if the individual is totally disabled from perfòrming the duties of his regular employment. Unlike workers compensation, the policy provides no benefits for partial disability. · Death and disability benefits are paid according to a fixed schedule. Workers compensation benefits, by contrast, are based on the individual's actual earnings, from both his regular employment and his council pay. · Workers compensation includes various other benefits, such as rehabilitation, retraining, etc.; the accident policy does not. · Workers compensation benefits are tax'-exempt; some or all of the benefits paid under the . accident policy might be taxable. Obviously, there are many "borderline" situations where it might be debatable whether a council member is "conducting official council business on behalf and at the request of the council." For example, a mayor or council member might be asked individually to attend a meeting of the Chamber of Commerce or a service club to discuss and explain city policies or proposals the council is considering. Cities might want to consider adopting a resolution specifying whether the city considers such activities to be within the scope of duties that the city expects its elected officials to perform. PST - November 15, 1995.fax6G040 -..e.. . . ORDINANCE 111: ORDINANCE PROHIBITING PUBLIC NUISANCES The City Council for the City of St. Joseph hereby ORDAINS: Section 111.1: DEFINITIONS. As used herein, the following terms shall be defined as follows: Subd. 1: "Disorderly House" shall mean a building, dwelling, apartment or establishment in which actions, conduct or activities occur in violation of laws relating to: a) The sale of intoxicating liquor or non-intoxicating malt liquor; b) The sale or possession of controlled substances as defined in Minn. Stat. § 152.01, Subd. 4. c) The consumption or possession of intoxicating liquor or non-intoxicating malt liquor by underage persons in violation of Minn. Stat. § 340A.503, Subds. 1 and 3. - d) The maintenance or participation in a noisy party or gathering in violation of St. Joseph Ordinance 102, Section 102.2, Subd. 6. - Subd. 2: "Owner" shall mean the legal or equitable owner of real property as those terms have been commonly interpreted by the courts of the State of Minnesota. "Owner" shall not include a mortgagee, contract for deed vendor, or the holder of an unrealized remainder interest in property. Subd. 3: "Possessor" shall mean the person, people or entity having legal right to possess the property or a portion thereof. "Possessor" shall include those holding a leasehold interest in property, or a portion thereof such as an apartment. Section 111.2: PUBLIC NUISANCE DECLARED: The following acts are declared to be public nuisances which endanger the safety, health, morals, comfort or repose of members of the public. Subd. 1. Maintenance of a disorderly house. Subd. 2. Knowingly permitting illegal fires on property by the owner or possessor thereof. Subd. 3. Ignition of illegal fires on public property or on the property of others. Subd. 4. Knowingly creating or permitting a gathering or party on property which results in trespass or damage to adjacent real or personal property. Section 111.3 OWNER AND POSSESSOR LIABLE: For any violation of this Ordinance arising from the use or maintenance of property, both the possessor and owner of the property shall be liable. The owner of property, who does not have actual possession of property, may raise as . . an affirmative defense that he/she was not aware of the violation, had no reason to believe that a . violation may occur and that he/she had taken affirmative steps to forestall a violation. Section 111.4 PENALTIES: Any person or entity violating this ordinance is guilty of a misdemeanor. This Ordinance shall be effective upon passage and publication. Minutes were approved as written by John Anderson. Liaison Report: The Park Board received $4500 from Rick Heidfor Pond View Addition. Bob will have the City Engineer re-bid the trail for Klinefelter Park. The original bid was $72,000. The soccer field could be ready by fall of 1997. We will need to prepare the ground and seed the area in spring. A bid will be needed. Old Business: - The skating rink program is going quite well. The personnel working the warming house are doing fine. Joe Braun will take care of the hot --- chocolate onc' Saturdays and Sundays for four weekends in January. Camping rules: tabled until spring. Playground Equipment for Klinefelter Park: It was suggested that we purchase some equipment for the second phase at the end of February. It was mentioned about the snowmobiles going through town so much. John will talk to STeve Streng and see if an article could be published in the Newsleader regarding areas that they can drive on. Marge said she would call the Sno-Joes also to check into this problem. New Business: The Dry Riders would like to spend the weekend 'in Millstream Park again.
