Complaints were the neighbors and passers-by were afraid of the dogs and the dogs jump their fence. b) City 1996 Population Estimate is 4,406; Household Estimate is 985 c) Property Insurance Deductible and Coverage Cost of reduction of deductible to $250 would cost $860 more per year. We hmre only had about one to two claims per year. There have been a few losses within the $250 to $500 that are not claimable due to the deductible. d) Health Insurance Premium Increase (about 13%) This is due to higher claims mainly. Last year there was a decrease in the premium due to less claims. d) LGA Payment Early - Those Counties that were in designated disaster areas received LGA early. Budget Propane - Special Use Permit: Chair Klein called the hearing to order at 7:00 p.m. The purpose of the hearing is to consider a Special Use Permit to allow the operation of a propane distribution business in an Industrial Zone. St. Joseph Code of Ordinances 52.21 subd 4 states that all permitted industrial uses shall require a special use permit under the following procedures. Only industrial uses which do not have heavy odors, smoke or other obnoxious or distasteful smell or appearances, excess noise, excess water or sewage requirements, or hazardous wastes as defined by State and Federal Statutes will be allowed. In granting a special use permit under the Industrial District, the Planning Commission shall find in addition to the requirements under Section 8 that the proposed use is desirable because of the nature of the product, and the isolation of the activity . from residential and! or commercial uses. The request for Special Use has been submitted by Paul Losinski, Budget Propane Inc. Peter Donohue, legal counsel for Budget Propane, stated that he has prepared information for the Commission detailing their proposal. The proposed use is similar to the prior use of the property. Budget propane is proposing to install one tank on the southern edge of the property adjacent to County Road 75. The tanks will be located on top of pea rock. Future plans indicate a second tank to be installed adjacent to the first tank and a building to be constructed in the northeast comer to be used as an office. The northwest section of the property will house empty LP tanks. Donohue reiterated that the proposed use is similar to the prior use of this property. However, Propane is pressure filled without any release into the air. Therefore, no odor will be expelled when filling. Additionally, PCA has recently removed Petroleum from the list of hazardous fuels. Safety devices are built into the system. The proposed tank holds 30 gallons and will be approximately 10' x 60'. Budget Propane currently operates from Thomsen Greenhouse and are looking to relocate. The proposed site has been selected for the following reasons: 1) easy access to County Road 75; 2) central location for customer base. Lesnick questioned the compatibility to the adjoining property owners, specifically the proposed church. Donohue responded that it is his opinion that the uses are compatible. . Churches typically have a higher concentration of activity on the weekends; whereas Budget Propane will have a higher use during typical business hours. When questioned about tank safety regarding extreme heating and lightin& Donhue stated that their are many safety factors built into the tanks. Propane is in a sealed container and is only released through a pressurized gauge. Additionally, Budget Propane is required to have an emergency plan. Donohue also stated that the Minnesota Pollution Control Agency has removed propane from their list of hazardous materials. As this proposal will affect the appearance of one of the major entrances to the City, Schneider questioned why the tanks are located on the Southern edge of the property and if a buffer could be provided. Donohue responded that in their opinion the proposed layout presents the best safety factors and would function best for Budget Propane. That is, the trucks would have easy access to the tanks and future development could occur. Donohue reiterated that his client, Budget Propane, wants to establish a business in St. Joseph and become an active part of the community. It has been Donohue's experience and observation that businesses that are owned by independent operators, such as budget propane, have greater concern for the appearance and overall operation of their business. Losinski discussed the operation of Budget Propane. The company is currently located at Thomsen Greenhouses. They are at a point where they need to expand. The business is conducted from their home with an answering machine. They have one driver who delivers within a 30 mile radius of St. Joseph. . . ? ~ . Jim Graeve questioned the aesthetics of the proposal and if a better location would not be in the Industrial Park. . Ellen Wahlstrom questioned Donohue's statement about propane not being hazardous. Donohue responded that he did not say there were no environmental consequences, but the . material has been removed from the listing of hazardous materials. He also stated that as with other fuels propane does have a residue but it evaporates into air. Ellen Wahstrom also questioned if Budget Propane would be willing to plant white pines to help air quality and provide a buffer. Donohue responded that live screening cannot be placed near the tanks because of the flamable material. Donohue stated that his client is requesting to use the property in a similar manner as in the past. The property is currently zoned Industrial and the use submitted is an Industrial Use. Additionally, his client wishes to use his property as other property owners along County Road 75 have. Property owners east of the proposed site have propane tanks adjacent to County Road 75. Mary Niedenfuer stated objection to the location of Budget Propane. She felt the property is more suited to a restaurant or a similar commercial use. Niedenfuer also stated concern as to odor that may occur. She contacted the St. Cloud Fire Department and they have had some problems with a distribution center that is located near an elementary school. .. Planning Commissioner Linda Sniezek could not be present but expressed the following comments in writing: She urged the Commission to recommend denial of the Special use permit due to the close proximity of Millstream Park and Redeeming Love Luthern Church. She also encouraged the Commission to review the Comprehensive Plan and note that the proposal does not fit with the goals and objectives in the Plan. Finally, she does not wish the first impression of St. Joseph to be bulk tanks. Council Liaison Ehlert stated that he welcomed all business to St. Joseph. However, there may be a better location for a distribution center than on County Road 75. The City is in the process of developing an Industrial Park and that property may be better suited for a distribution center. Ehlert also requested the Commission refer the matter to the City Attorney for his review and comment. Kalinowski concurred with Ehlert to table the matter so the Commission has time to review the information presented by Budget Propane. Weyrens reminded the Commission that in land use issues, the Council must be able to react in 60 days from the time the complete application is received for a special use permit. If the matter is tabled, a special meeting may need to be held to comply with the 60 day statutory requirement. Deb Mimbach, adjacent property owner, stated objection to the proposed use of Budget Propane. She stated that it is her opinion that the uses are not compatible and bulk tanks should not be the first impression of St. Joseph. Lesnick made a motion to table the matter so that the Planning Commission can review the . information presented by Budget Propane and to forward all the information to the City . Attorney for his review and comment. The motion was seconded by Nierengarten. Ayes: Klein, Kalinowski, Lesnick, Nierengarten, Schneider, Ehlert Nays: None. Motion Carried 6:0:0 The hearing was closed at 7:50 p.m. Al Stellmach & Steven Hoffman - Cold Storage Units: Al Stellmach and Steven Hoffman appeared before the Commission to discuss the construction of additional mini storage units. They own Ridgewood Storage and operate the storage units located along County Road 75 and Ridgewood Road. Stellmach stated they would like to construct an additional facility housing 75 units. They are also requested a zero rear yard setback. Ehlert made a motion to schedule a hearing for special use permit for Al Stellmach and Steven Hoffman to construct a mini storage facility and to allow a zero foot setback on the rear yard. The motion was seconded by Kalinowski. Ayes: Klein, Kalinowski, Lesnick, Nierengarten, Schneider, Ehlert Nays: None. Motion Carried 6:0:0 Rick Heid - Pond View Plat 4: Rick Heid presented the final plat for Pond View Ridge Four (4). The plat consists of 30 single family homes. City Engineer Joe Bettendorf requested the Commission straighten 12th A venue SE, allowing single family homes to be built along Klinefelter Park. If 12th A venue SE were to stay as designed, the road would run along Klinefelter Park and some wetland issues would need to be addressed. Klein made a motion recommending the City Council approve Pond View Ridge Plat Four (4) with the following correction: Straighten 12th A venue SE to allow single family development along Klinefelter . Motion Carried 6:0:0 Mark Lambert - Apartment Complex Proposal: Mark Lambert appeared before the Commission to discuss a proposal to construct a 12 unit apartment complex adjacent to the City water storage facility. Lambert stated he purchased right-of-way property from Burlington Northern and has plans to construct an apartment unit. A portion of the property purchased is already used as overflow parking for the Campus Villa apartments. As Commission Linda Sniezek could not attend the meeting she offered the following written comment: Sniezek requested the Commission not allow the apartments because the space which Lambert is proposing was intended for a connection to the Lake Woebegon Bike Trail. Addititionally the City chose not to install a maintenance facility at the same location because it would detract from the water storage facility. She questioned if the City would not place a one story building of their own at this same site, why would we allow a developer to construct a two story building? Kalinowski stated the same concerns of Sniezek and felt it would not be appropriate to place rental units on the proposed site. Lambert responded that he feels the rental units would not detract from the water storage facility . He stated that he has also been looking for a way to pave the overflow parking lot for the Campus Villa's and the new construction would provide the opportunity. . , . .. .. ~. Jim Graeve questioned what would happen to the housing units should the College ot St. Benedict and St. John's University require students to live on campus. Lambert responded . that the units will constructed in a manner which can easily be converted to single family rental units. He further stated that it was his opinion that the City wanted to get the student rentals , out of the neighborhoods, this proposal does that. Lambert stated that he is willing to work with the City and is aware that one of the lights for the water storage facility is located on the property purchased and the City would like an easement along County Road two for future utilities. Lambert finished his presentation by requesting Commission members to view the site and remain open minded. Leander Zipp - Accessory Building: Klein presented information from Leander Zipp, 308 East Minnesota Street, requesting authorization to apply for a variance hearing to allow for an addition to his existing garage. The existing garage is approx. 1400 square feet and he would like to add an additional 72 square feet. Commissioners generally agreed to conduct a public hearing as requested. Approval of Minutes: Nierengarten made a motion to approve the minutes of the March 3, 1997 Planning Commission meeting as presented; seconded by Kalinowski. Wahlstrom presented a petition signed by the adjoining property owners requesting their property be re-zoned to Single Family or Multi Family. Weyrens stated that she would check the status of the zoning classification and contact Wahlstrom. Members Present: Chair Hub Klein. Commissioners S. Kathleen Kalinowski, Marge Lesnick, Linda Sniezek, Dan Nierengarten, Kurt Schneider. Council Liaison Cory Ehlert. Secretary of the Commission Judy Weyrens. Others Present: City Attorney John Scherer, Bob Wahlstrom, Ellen Wahlstrom, Pete Evans, Diane Losinski, Peter Donohue, Mike Novak, Bob Herges, Donna Theisen, Bob Behrendt. The purpose of the meeting was to continue the special use permit hearing of Budget Propane which would allow for a propane distribution center on property zoned Industrial. Pete Evans, representing Redeeming Love Luthern Church, stated his objection to the proposal for a propane distribution center. Redeeming Love owns the property adjacent to the proposed use and does not feel the uses are compatible. If the special use permit is approved, Evans would encourage the Planning Commission to require landscaping to buffer the adjoining property. . Peter Donohue, legal counsel for Budget Propane, reiterated the following: 1. His client is requesting to use the property in a similar manner as in the past. 2. His client is requesting the same rights as other property owners along County Road 75. (Other property along CR 75 have propane tanks) 3. The property is zoned Industrial and the use proposed is an Industrial use. 4. The proposed use will be more aesthetically pleasing because: a. The proposed area is not densely populated b. The property will be landscaped to assure an attractive business site 5. The City cannot hold his client to goals and policies in the proposed Comprehensive Plan. 6. In his opinion they have presented sufficient information to illustrate that safety is not an issue. 7. Budget Propane is willing to revise the site plan with the exception of the primary tank or location of the primary tank. 8. The State Fire Marshall and St. Joseph Fire Chief have already approved the proposed layout and location. Kalinowski questioned Budget Propane as to the type of landscaping they are proposing and how the site will be utilized. Losinski stated the plan provides for crushed granite on the service entrance and pea rock on the property where the primary tank will be located. Because propane is a flammable material, trees and shrubbery cannot be placed near the tanks. However, . they will provide trees and shrubbery on the site where possible. When asked the future plans of Budget Propane and how they will operate, the following was presented: 1. As Budget Propane grows an additional tank will be installed at the site .- 2. Losinski hopes to construct a building on the property within 2 - 3 years - 3. Service trucks will not be stored on the property 4. Empty LP tanks will be stored on the premise. Losinski stated that there would probably be no more than 30 empty tanks on the site at any given point. Commissioners questioned if the tank could be placed in the rear of the property near the swamp portion of the property. Donohue responded that the primary tank has been situated on the property to provide the best scenario for distribution. Further, if the Commission is concerned with the appearance of the tanks, his client is more than willing to install fencing materials such as woven fencing in an attempt to hide the tank. Ellen Wahlstrom stated the following concerns: 1. She is not satisfied with the safety issues, especially after discussing the matter will a firefighter who responded to a propane fire 2. It is her opinion that the proposed use does not conform with the draft Comprehensive Plan, particularly where it states that the uses should be harmonious and compatible. Donohue cautioned the Commission in making a decision based on a draft the Plan, as a draft does not guide property. Further, it is his opinion that the Commission cannot make a decision based on a projected use of adjacent property, such as the Luthern Church. Budget Propane has an application for a special use permit before the . Commission. The Luthern Church, to his knowledge, does not have a building plan or anticipated date construction. He stated that to deny this special use permit would rob the property owner of a sale. The property owner has the right to sell and develop his property . Legal counsel for Budget Propane further stated that the City of St. Joseph has allowed a more flammable material than propane into the City, that being natural gas. The incidents of accidents concerning natural gas are much higher than that of propane. It is their opinion that propane tanks are safer as they are located above ground and can leaks can be detected and repaired easier. City Attorney, John Scherer, disputed the comparison of natural gas to propane and stated they are different fuels in many ways including storage and access to. Mary Niedenfuer questioned why Budget Propane is not considering relocating in the Industrial Park. Dohonue stated they are a willing buyer for a piece of property that was made available by a willing seller and they are not looking for an additional site. The proposed parcel meets all the needs of the buyer. While the condition of the primary tank may not be of question, Niedenfuer questioned what condition the LP tanks would be in and how many would be stored on the property at one time. Losinksi stated that usually 30 tanks are hauled to the property at a time and distributed quickly to his customers. His tanks are in high demand due to the quality . of his tanks. . .. .' Ellen Wahlstrom questioned the Planning Commission why the property in question was zoned Industrial. , Scherer responed that the when the Planning Commission reviewed the zoning a > number of years ago there was not an area designated as Industrial and determined that because of the close proximity to County Road 75, it may make sense to zone the area in question as Industrial. However, about 10 years ago it became apparent to the City that the property in that area would not develop as industrial. Therefore, in 1991 St. Joseph annexed the Industrial Park that was located in St. Joseph Township. The Planning Commission reviewed the zoning around that same time period and because the existing use housed bulk fuel storage tanks, the zoning classification was not changed. It was the intent of the Planning Commission to move all industrial activity to the St. Joseph Industrial Park. Mike Deutz requested the Planning Commission approve the Special Use Permit as requested by Budget Propane. He stated that it is his opinion that it fits in the neighborhood and is a compatible use. Marge Lesnick presented information she received from the St. Cloud Fire Department. The information states that propane is extremely flammable and is heavier than air. Additionally, if there is a leak it would settle into the low areas. A propane leak can go undetected for a long period of time. The information presented also indicated that . propane is easily ignited. Lesnick also stated that they did not recommend a propane distribution center in a City, especially an area that has high density. Millstream Park has high density on weekends from May through October and the trailer park is in the same area. Therefore, it is Lesnick's opinion that the area surrounding the proposed development is a highly dense area. Scherer stated that the information presented by Budget Propane and Marge Lesnick will become part of the official record and labeled "Exhibit A" and "Exhibit B" respectively. Ellen Wahlstrom questioned if the allowance of the special use permit would have a negative impact on the insurance rating of the City. Scherer responded that he was not in a position to respond to that question. The insurance underwriter would need to be contacted for this information. Bob Herges, Realtor for Budget Propane, indicated that a number of the surrounding cities have allowed such uses. Since both the State Fire Marshall and City Fire Chief have approved the plans, he questioned the hesitation of the Planning Commission to approve the permit. Additionally he questioned the Commission as to what types of uses they would consider appropriate for that property. Donohue stated that Townships are preserving vacant land in their jurisdiction for agricultural uses and businesses such as Budget Propane are forced to find property in . Cities. Proper industrial property is hard to locate. Klein requested Commissioners to state their final thoughts on the proposal before them, at which time the following comments were stated: 1. Kalinowski: After reviewing the standards listed in St. Joseph Code of .. Ordinances, she feels that the use will not be harmonious with the general and applicable specific objectives of the Comprehensive Plan and this Ordinance. Additionally, in her opinion the use will be hazardous or disturbing to the existing or future neighboring uses, such as the proposed church and existing park. 2. Sniezek: Stated that in her opinion the proposal has the potential of creating a traffic hazard and/ or congestion. She indicated that County Road 75 is a highly traveled road and crossing could be a problem. Also, the proposed use may result in the destruction, loss or damage of a naturat scenic, or historic feature of major importance. This being Millstream Park and the surrounding wetlands. 3. Lesnick: Concurred with Sniezek and Kalinowski and also reiterated the safety concerns. 4. Schneider: Appreciates all the time Budget Propane has put into their proposal but does not feel the use is harmonious with the surrounding property . He concurred with the above comments. 5. Ehlert: Expressed concern with safety issues. He feels there is a safety concern and it is not a good fit with the neighboring property. The Commission has spent a lot of time reviewing the Comprehensive Plan and the proposed use does not seem to be harmonious with that plan. 6. Klein: Stated concern over the safety of both traffic and the fuel itself. In consideration of the information presented to the Planning Commission and its . application to the Comprehensive Plan and Ordinances of the City of St. Joseph, the Planning Commission makes the following findings: 1. St. Joseph Code of Ordinances 52.8 subdivision 4 contains provisions by which the Planning Commission may approve a special use permit. Based on the standards outlined in St. Joseph Code of Ordinances 52.8 subdivision 4, the Planning Commission finds non compliance with the standards as outlined in said Ordinance:. a. St. Joseph Code of Ordinance 52.8 subd 4(b): Will be harmonious with the general and applicable specific objectives of the comprehensive plan of the City and this Ordinance. Finding: The proposed use is not consistent with the St. Joseph Comprehensive Plan. The proposal is inconsistent with the following: 1. General Goals: To direct growth in a compatible manner with existing land use. Ü. Transportation Goal #3: Provide adequate access to new commercial or industrial areas. b. St. Joseph Code of Ordinances 52.8 subd 4(d): Will not be hazardous or disturbing to existing or future neighboring uses. Finding: Information presented during the hearing indicated that propane is an extremely flammable and easily ignitable fuel. . Based on this information the proposed use of a propane . . .~ distribution center could pose a hazard to the surrounding property. That property being an existing City Park which is v densely populated from May through October and the proposed church which will have a high density concentration on ,. weekends. (The document referred to is labeled Exhibit "B") c. St. Joseph Code of Ordinances 52.8 subd 4(h): Will have vehicular approaches to the property which are so designed as not to create traffic congestion or an interference with traffic or surrounding public thoroughfares. Finding: The crossing of propane trucks will have an impact on traffic. The intersection which would be used by the petitioner is located on a curve which may decrease visibility on County Road 75. Additionally, given the high volume of traffic on County Road 75 and the hazardous material being transported by the petitioner, their is a greater probability of traffic accidents and interference. d. St. Joseph Code of Ordinances 52.8 subd 4(j): Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. Finding: Based on information stated in Exhibit "B", propane is . heavier than air and if their is a leak it would settle in the low lands. The area for the proposed use is adjacent to a City Park and low lands. If a leak would occur it could be hazardous to the natural features surrounding the area proposed for development. Based upon these findings, Klein made a motion to recommend denial of the Special Use Permit that would allow a propane distribution center in an Industrial Zone. The motion was seconded by Sniezek. These findings and recommendations were approved by a vote of 7 to 0 by the St. Joseph Planning Commission on April 22, 1997. I made a further study to re-inforce our decisions on the Special . USe Permit: I spoke with Doug Weiszhaar at the Stearns County Highway Department. I explained our situation regarding the special use permit. If V.le were to approve the special use permit, the Highway Dept may insist on a right turn lane, because they do not want trucks exiting from the traffic lane. Also I believe, we the City, could demand a right turn lane but the right turn would still be in need of a wider approach to make the turn. The expense of this right turn lane would be that of the party applying for the special use permit. I also madea point to contact Wayne Trucking who did make deliveries at this site for Krebsbach Oil Company. I talked to a driver who delivered there and he said he did not want to interfere with anyone trying to do business at that place.and I appreciated his concern. Through the COlirse of our conversatioowhen I asked him about getting on the highway, he said IIpatience". Because of the curve in the road and the little space between east and west bound lanes, you must have good clearing from the west if you are entering east on 75. He did say if you have a "gun:.-ho" driver and he does not have much experience, this spells . tragedy. Joseph and offer the following comments. Weare pleased to note that most of the elements of this plan . are common to the draft Comprehensive Plan that was developed with assistance from the APO in 1993. The plan is improved with the use of updated demographic analysis, however,. there should be some mentioned of growth forecasts. The proposed joint plan for future land use between the City and st. Joseph Township suggests a 2015 population of 7,649 for the City anda'household count of 1,535. We are also encouraged by the list of plan implementation strategies which we believe is an essential element of community planning, particularly the intention to coordinate planning with st. Joseph Township. Completing the joint orderly annexation plan will assist the st. Joseph community in negotiations for future services. My remaining comments pertain to the exhibits for transportation planning. Please note that Exhibit VII, the Transportation Plan for the Metropolitan Area is no longer current. Enclosed is the 2015 Transportation Plan which was adopted by the APO in 1995. The proposed staging plan, which better identifies the future elements of the transportation network is also enclosed. Future collectors that would parallel CSAH 75 both to the north and south of the city are indicated and the 2015 Plan suggests right-of-way should be preserved for these corridors. tIÞ It is also highly desirable. to maintain consistency in the transportation planning that occurs between city and township and with the Metro Area. A Voluntary Association That is Committed to Coordinated Long-Range Planning Through Constant, Cooperative, Intergovernmental Communication , Rachel Stapleton, Clerk/Administrator . Please be aware of the need to preserve these corridors as development proposals are reviewed. The proposed City Plan does lack continuity from County Road 3 to a connection south of the College, an element of both the Metro Plan and the Township. APO studies have shown this linkage is effective in relieving traffic through the city, especially on Minnesota street. However, we also understand that there are concerns about the impacts to natural areas and other disruption that could result from a future roadway in this location. These are the tradeoffs which the City should consider as it finalizes the Comprehensive Plan. The plans from st.
