CONFERENCE
Enclosed is the agenda for the Conference for City Management, Police Management
and Law Enforcement Labor Services Stewards concerning the Labor/Management
Relations Committee of Law Enforcement Labor Services/Coalition of Greater Minnesota
Cities/Metropolitan Area Management Association Cities Conference on Thursday,
January 22, 1998.
The conference is provided for management personnel from cities which have LELS as
a bargaining representative for licensed peace officer bargaining units and the union
steward(s) from those cities.
. City management and City police management are invited to attend, HOWEVER, City
personnel may not attend unless the union steward(s) for the City's bargaining unit(s) is
also allowed to attend (Cost for conference fees for one steward or elected Union officer
per Local will be paid by LELS).

Enclosed is a $15,000.OQ donation to be set aside for improvements at the city softball
fields at Millstream Park. It is anticipated that additional funds will be set aside in coming
months.
The primary intended purpose is for reconstruction of the concessiQJl stand wbiclt is badly
in need of repair and modernization. This includesinGr.easing the~ to.ll.Ccomodate~dditiQnal
storage, improved food preparation. equipment, improved toilet facilities and better handicap
accessability. The recreational association is in the process of developing plans and obtaining cost
estimates for this activity.
. There are other items which have been identified as follows:
The bleachers need repair.
Playing fields need additionqllandscaping and reseeding.
Additional work is needed on retaining walls to prevent unwanted drainage onto
the playing fields.
Accomplishment of the above indicated improvements is being managed by the
Recreational Association. As materials are purchased am:! work is accomplished bills will be
submitted to the city for payment out of the set aside funds.
We anticipate some or all of the above improvements will be accomplished in 1998.

I have had an opportunity to review the Community Access Channel Rules and
Re¡ulations as well as the Request for Cablecast of Local Programming. Upon
review of these forms, I also reviewed the applicable sections of 47 United States

CABLE COMMISSION
" COMMUNITY ACCESS CHANNEL RULES AND REGULATIONS
The Community Access Channel is available to provide public,
governmental and educational information to the community
subscribers. The primary function is to serve a communication
need to our community. Broadcasting will be provided for
communication of issues, activities, and events that impact
the lives of our citizens. Additionally as time permits public
,broadcasting may be allowed.
A. The City of St. Joseph governmental programming shall take
precedence, with all City Council meetings and sub committee
meetings broadcast live and at least one additional time within
5 days following the meeting.
B. The following shall be the order of precedence in
allocating channel time:
1- City Meetings:
All Public Hearings
. City Council
Plannng Commission
EDA Board
Park Board
Cable Commission
Other local government meetings.
2. Other City governmental broadcasting.
3. Educational programming
4. Community Events - In case of a conflict the Community
Access Administrator will establish priority, based on
history of events, anticipated number of interested
subscribers and other methods of measurement.
5. Programming produced by citizens of the local
community.
6. Programming produced locally by persons or
organizations from outside the St. Joseph Community.
7. Non-locally produced programming. A program will be
considered non-local if less than 50% of the content is
produced locally, or if the program is not prefaced or
. followed by a locally-produced segment equal to 50% or
more of its length.
C. The Cable Commission shall function as the Regulating Board
for Cable Access Channel matters.

D. The City Council shall determine the retention time for
tapes of public meetings,
E. The actual costs associated with posting notices on the
bulletin board and broadcasting of tapes may be charged to
those requesting the broadcasting.
PROGRAM CONTENT AND O~rNERSHIP
A. The community access channel is not to be used to adve~tise
or promote the sale of products or services, including
advertising for or endorsement of candidates for public office.
Description or praise of a product, service or ousiness which
encourages purchase is not permitted, Intentionally showing
business or product names, logos, and othe~ symbols
specifically for advertising or promotion is prohioited,
B. Community producers may, however, seek funding for or
sponsorship of their pro<;jrams from private and/or public
sources, Such funding or sponsorship is limited to $200, .
including in-kind donations, for a single program or 3500,
including in-kind donations, for a serles.
Credit to funding sources may only be given at the beginni::g
and ending of the program and may say only that assistance or

F. Although "broadcast standardsn will not be used in
considering programs for cablecast, the following technical
standards will be applied:

G. The above notwithstanding, the Cable Commission will not
edit, or alter in any way, the content of any program submitted
to it for cablecast. Any editing that is required in order to
comply with these rules must be done by the community producer.
H. The community producer is responsible for obtaining all
clearances from the owner for use of any copyrighted or
protected material, including music licensing organization,
program distributors and any other persons necessary to <
authorize transmission of program material on the access
. channel.
Likewise, the community producer is responsible for securing
all talent releases and must be able to document the
cablecasting of the program does not violate the rights of a
third party. The community producer agrees to assume full
responsibility for any and all di2putes arising frciltt
unauthorized use of copyrighted material and agrees to hold
harmless in such di3pu~es the St. Joseph Cable Co~~ission, the.
City of St. Joseph, the cable company serving them, arrd their
affiliates, officers, agents and employees.
I. The producer is responsible for reimbursing the City for
the actual production costs for any programs sold, that are
produced with publicly owned equipment.
J. The Cable Commission is not responsible for loss of program
content due to damaged or lost tape. We will, however, replace
the damaged tape.
K. The community producer retains ownership of the content of
any program produced with publicly owned equipment. If the
Cable Commission has supplied thè tape fc:~ the rnaSt:2.r vr -che
program, the Cable Corrllii32io~ reta:'!13 ownership of the master
. tape éni ~~22rïes the right to cablecast any program produced
;Jsing its equipment and facilities any number of times on any
of its channels. The Cable Commission may also, at its
discretion, erase a program on its video-tape in order to
recycle a videotape or if the material is no longer timely.

SCHEDULING OF ?ROGFAl1MING
.
A. A REQUEST FOR CABLECAST/STATEMENT OF COMPLIfu~CE FO R1'1 must
be signed for all programs to be scheduled for cablecasting.
B. Channel time may be requested up to a month in advance.
Live programs require a minimum of two week's notice with City
costs for staff time paid in advance.
C. The Cable Commission will attempt to satisfy requests for
the cablecast of programs at specific times on specific dates,
depending on the availability of equipment and channel time,
The Cable Commission reserves the right, however, to schedule
programs at the discretion of the Staff,
D, The use in a monopolistic manner by one or a few selected
groups or individuals is not deemed to be in the public
interest, nor is the domination of one type of programming over
another. Channel use limitations may be applied in cases where
the public interest in diversity of programming is not being
maintained,
E, Regularly scheduled series time slots may be allocated at .
the discretion of Cable Co~~ission staff. Series will be
scheduled for a maximum of 13 weeks, after which the co~munity
producer must submit another REQUEST FOR CABLECAST/STATEMENT OF
COMPLIANCE FORM. If a series producer fails to submit new
programs for more than two consecutive scheduling cycles, the
remaining portion of the series may be reassigned at the
discretion of the staff,
F. With the exception of live programs and serìes, no program
will be scheduled until it has been completed, Exceptions may
also be made when the timeliness of a program is essential, A
request for waiver of this requireynent should be made at least
one week in advance,
G, Any program produced with Cable Commission equipment or
facilities or produced locally will be scheduled once for
cablecast. Additional cablecasts may be scheduled at the
discretion of staff and based on the availability of channel
time,
I. The following guidelines will be used in scheduling non-
locally produced progra~~ing:

access channel is programmed per week,

. 2. If the program submitted for playback was not produced
. locally, then the program must have a sponsor who is
either a resident or member of a local community
, organization. This sponsor must hand-deliver the program,
complete the REQUEST FOR CABLECAST/STATEMENT OF COMPLIANCE
FORM and edit the following message at the beginning and
end of the program:
"The following program was produced outside the St.
Joseph area but is being presented courtesy of
(Sponsor's name)
(Address) n
3. Such requests will be filled on a first-come, first-
served basis.
4. If scheduling allows, a non-local program may be
cable-cast twice during any weekly period. Programs or
single episodes in a series will not be scheduled for
cablecast more than twice a month.
e 5. Informational programs produced by public agencies may
be exempted from these guidelines.
J. All programs submitted for cablecast must be clearly labeled
on the tape and the case with the name of the program; the
exact length (in hours, minutes and seconds); the name, address
and telephone number of the person requesting cablecast; and
any special instructions. In addition, the person requesting
cablecast is responsible for securing all clearances and
releases for the program. The clearances and releases must be
in writing and must be presented at the time the tape is
submitted.
K. The community producer and/or sponsor is responsible for
picking up any programs not produced on Cable Commission
videotape. If the program is not picked up within two weeks of
being notified of their availability, City staff may dispose of
or recycle the videotape at their discretion.

above referenced property. This action is being taken because of an alleged

Wiedenfuer The St. Joseph City Council will review these allegations and consider
appropriate action, including a suspension or revocation of your rental license,
for up to a period of twelve months. The meeting will be conducted on
Thursday, January 8, 1998 at 7:00 p.m. in the St. Joseph City Hall, 25 _ 1st
A venue Northwest.
At that time you are entitled to a hearing to be conducted in accordance with
Minnesota Statutes 14.57 to 14.70. This hearing will be for the purpose of
determining whether or not the alleged violation did in fact occur. At that
hearing, you have the right to cross examine witnesses and present evidence
on your behalf. The proceedings will be video recorded. Based upon the
evidence presented, the Council will then make a determination as to whether
or not the alleged violation did in fact occur.
If you wish to have an evidentiary hearing of this type, you must contact the
City Clerk/Administrator in writing at least seven days prior to the scheduled
Council meeting. If a request for hearing is not received by the City
Clerk/Administrator at least seven days before the hearing, you will then be
considered to have waived your right to have an evidentiary hearing and no
evidentiary hearing will be scheduled. A waiver of this right to hearing will be
equivalent to an admission of the basic allegation (s) alleged herein and
reported by the complaining party.
If you waive your right to hearing, or if an evidentiary haring is conducted and
. the Council determines that a violation did occur, then and in those events, the
Council will proceed immediately to consider a disposition, which may include

revocation or suspension of your rental license. Prior to the determination of disposition,
you or your designated representative may address the City Council and at the time of
disposition.
In the event of a revocation or suspension of your rental license, the premises must be
vacated of all renters, within thirty days of the Council action. Any rental occupancy
occurring after that time may result in criminal charges.
You have the right to be represented at the time of this meeting during either the evidentiary
hearing, if requested, or the dispositional hearing. If you wish to have legal representation,
you must hire your own attorney. If you have any questions regarding the law or your
rights, I suggest that you contact an attorney to discuss this matter.
Your failure to appear at this meeting will be considered an admission of the allegation and
a waiver of your right to address the Council before the determination of a disposition. If
you fail to appear, the Council will take whatever action which is deemed appropriate and
you will be notified of this action at a later time. .

COULD HEAR PEOPLE INSIDE SlWING, "THE COPS ARE HERE!" I COULD ALSO
HEAR SOMEBODY SAY JUST STAY INSIDE, THEY CAH'T DO AHYTHIHG TO US.
I THEN NOTIFIED OFFICER BRAD MEYER TO COME TO MY LOCATION. AS OFFICER
MEYER TRIED TO GET SOMEBODY TO ANSWER THE DOOR I WENT TO THE OFFICE
TO TRY AND FIND A PHONE NUMBER FOR THE PROPERTY OWNER. I WAS
UNSUCCESSFUL IN FINDING A LISTIHG FOR THE OWNER OF THIS HOME.
IN THE MEAN TIME OFFICER MEYER MADE CONTACT WITH BRETT DANIEL
BALOUN DOB 10-11-75, ONE OF THE RENTERS. AT THIS TIME, I WAS
INFORMED THAT MOST OF THE PEOPLE WERE LEAVING THE HOUSE.
