StOD11 Water Public Hearing For the public hearing we will be presenting infonnation with how the City has complied with the permit issued in 2003. The infonnation is in the process of being compiled. If we receive and input at the hearing we will modify the permit. Utility Extension: As you are aware the City has been requested to extend services to the Leonard Walz property and to Morningside Acres. In the middle of both of these properties is a stretch of Township homes. Joe will be requesting authorization to conduct an infonnation meeting to invite the Township residents to see if we have enough support to annex the island areas. According to the Annexa~ion Agreement we need 60% of the property owners to petition to move the matter to a public hearing. At the public hearing the Township Board and City Council make separate motions regarding the matter, it does not go to a vote of the residents. Callaway Street: Joe has been working on the design and cost estimate to construct Callaway Street to County Road 121. Joe will discuss the matter at the meeting Contract Employees Larry and Al will have a proposal for increasing the wages for the Administrator and Police Chief. They will be forwarded to the Council on Wednesday Joint Citv/Township Meeting I have contacted St. Joseph TO\\'11smp to establish a joint meeting to discuss . items of mutual concern. Two items in particular were discussed: the mining operation on County Road 2 and the Memorandum of Understanding. The Township is available to meet on Monday, March 22 at 7:00 PM. Alcohol Meeting Pete, Larry, Representatives from St. John's and St. Ben's will be meeting with the Bar owners on Wednesday to discuss alcohol related issues. One major concern is the power hour and we would like to discourage this practice. When you turn 21 you drink 21 shots at 12:01 (or in one hour). This is becoming a big problem for St. John's and St. Ben's as they have had to deal with very the very serious side affects of drinking that much in a short period of time. Planning Commission Update: The Planning Commission conducted a public hearing for the possible amendment to the Comprehensive Plan. The amendment would allow R3 developments for the two properties identified above. The Planning Commission is hesitant to Rezone or amend the Comp Plan without being able to assure that the plan being presented will be constructed. Therefore, the Planning Commission will be conducting a Public Hearing to amend the R3 zoning Ordinance requiring that all R3 developments with more than 12 units to utilize the PUD process. This process will allow the City to enter into a binding agreement for a specific development. Gary or myself will update the Council on the specifics on Thursday night. . Pursuant to due call and notice thereof, the City Council for the City of St. Joseph met in regular session on Thursday, February 19, 2004 at 7:00 PM in the St. Joseph City Hall. Members Present: Mayor Larry Hosch. Councilors Gary Utsch, Ross Rieke, AI Rassier, Dale Wick. Administrator Judy Weyrens. City Representatives Present: City Engineer Joe Bettendorf, Police Chief Peter Jansky, Police Officers Dwight Pfannenstein and Pete Janssen. Others Present: Matt Vol brecht, Harvey Pfannenstein. Approve Aqenda: Wick made a motion to approve the agenda with the addition of item 10 (c) 2003 Audit. The motion was seconded by Utsch and passed unanimously. Consent Aqenda: Rassier made a motion to approve the consent agenda as follows; seconded by Wick and passed unanimously. a. Bills Payable - Approve check numbers 33819 - 33908 b. Minutes - Approve the minutes of January and February 2004 as corrected. Public Comments to the Aqenda: No one present wished to speak. Westwood - AUAR Arcon Development: Matt Volbrecht of Westwood Professionals appeared before the Council on behalf of Arcon Development to discuss the draft AUAR. Volbrecht stated that the document before the Council is draft and will not become final until after it is submitted to the Environment Quality Board (EQB) and the required 30 day comment period has expired. It is his intent to submit the draft report to the EQB meeting the deadline for the March 1, 2004. A requirement of the AUAR is to mail the . draft to agencies outlined by the EQB. Those agencies will then have until March 31,2004 to submit comments, which will be mailed directly to the City Offices. At the end of the response period the comments are reviewed and the document is amended as needed. The City Council will review all the comments and then approve a final document. In reviewing the draft AUAR the following items were discussed: · Exhibit 2 needs to illustrate the future transportation plans of the City beyond the Arcon Development. · Reference to the new wells should indicate they are anticipated to be online in 2005. · Wastewater - average daily flow should be corrected to reflect correct flow. · Council Resolution authorizing the AUAR needs to be added to the document. · Traffic counts - include Arcon site and potential future development or open areas. Must use the potential land to be developed. · Traffic concerns -Impact to 20th Avenue, signals at College and County Road 121 · Intersection of 4th Avenue & County Road 75 was included in the AUAR as residents could use the route as a short cut. · Trunk sewers are not included in the project area. · Property Zoning is Agricultural and references in the plan indicate high density residential. · Wellhead protection plan is included to illustrate the City will be preparing the plan. · Sauk River Watershed District should be included in the plan as well as the requirements of the County for utility permits. · A reference should be included that dewatering may impact domestic water uses and wells could be dried. · Change permitted water to read 150 million gallons · Maximum daily demand of water should be changed to Average daily use. · Projected municipal water users should be reduced by 1200 to reflect college housing, as the . College/Monastery of St. Benedict own and operates their own water supply. · Remove reference to water pressure tank solution · Drainage areas of the north should be diverted south to relieve the drainage to the creek. It would be acceptable to state that this matter will be reviewed during the platting process. . · Check reference to assure the documents meet statutory requirements. · Discussed noise levels of equipment during construction and made sure that complaints will be handled. · Document date will be changed to March 1, 2004. Greg Kacures approached the Council and questioned the need for an additional signal light on County Road 75 (CR 75 and 4th Avenue). He stated in his opinion the City already has too many signals on CR 75 and another one is not needed. Mayor Hosch stated that he would like to continue discussing the draft AUAR, but will comment on the signal when the current discussion is completed. Wick clarified that the document being approved by the Council at this time is not the final document and the Council will have another opportunity to review the document before it is finalized. Volbrecht assured Wick that the Council will review all the comments received and have one more opportunity to comment on the AUAR before it is finalized. Rassier made a motion accepting the draft AUAR for the Arcon Development, with the contingency that the Administrator review the document after the changes are made. The document can then be submitted to the EQB and the comment period can begin. The motion was seconded by Rieke and passed unanimously. Volbrecht questioned if the City would be complete the mailing to the required agencies or if Westwood should do so. Weyrens requested that Westwood completing the mailing requirements and provide a list to the City of all agencies receiving a copy. Siqnal County Road 75 and 4th Avenue: Hosch stated that the City has requested Stearns County to install a signal light at the intersection of County Road 75 and 4th Avenue NE. Installing a light is . expensive and Stearns County has allocated three signal lights for the current year, with the sites undetermined. The City would have to pay for a large portion of the signal light and will continue to work with Stearns County. Kacures questioned if the City would have the ability to determine the timing of the signal light. Hosch stated that the City would discuss timing with Stearns County. Northland Plat 8: City Engineer Joe Bettendorf stated that the plans and specifications are finished for Northland 8 and he requested authorization to advertise for bids for the Improvements for Northland 8. If approved for publication, the bid opening will be scheduled for March 16, 2004 at 11 :00 AM. Rassier made a motion approving resolution 2004-06, Approving Plans and Specifications and Ordering Advertisement for Bids. The motion was seconded by Utsch and passed unanimously. MAYOR REPORTS APO Technical Advisory Board: Hosch reported that the APO Technical Advisory Board met recently to rank projects for Federal Funding. St. Joseph has submitted two corridor studies for funding. Both projects received a high ranking, but they did not receive enough support for funding. Hosch stated that he advocated for a reduced cost split for the 44th Avenue Project so that St. Joseph could received funding for one study. Waite Park has agreed to address this matter at their regular Council meeting, before the APO Full Board meets. If the City does not receive funding during this application period, it will be resubmitted again next year. Mayor Reports: Hosch presented the Council with the Mayor Appointments for 2004. Hosch stated that the Committee assignments have not changed since 2003 and requested the Council accept the appointments as presented. Utsch made a motion to accept the 2004 Mayor Appointments as presented with the correction of the Fire Chief and removal of Jennifer Wirz from the Park Board as she has previously resigned. The motion was seconded by Rieke and passed unanimously. . . COUNCIL REPORTS RIEKE Council/Staff Workshop: Rieke thanked the staff and consultants for the one day Planning Workshop held on February 18, 2004. Rieke stated that the day was very informative and requested that they be held twice a year. EDA Reports: The EDA has meet on February 18 and discussed the need to develop additional Industrial Park Land. The current absorption rate for industrial property is approximately 10 acres per year and the City only has 14 acres remaining. Therefore, at the current rate the City will run out of developable Industrial Property within 18 months. RASSIER Council/Staff Workshop: Rassier concurred with Rieke and stated the one day workshop was informative and he encourages them to continue. WICK - No Report UTSCH - No Report Cloverdale Update: Weyrens reported that the City is not prepared at this time to order the improvements to the Cloverdale Area. The City Staff would like the opportunity to review utility extension opportunities and bring the information back to the Council. Weyrens also presented the Council with a petition signed by six of the affected residents in the Cloverdale Project area requesting the Council complete an appraisal of their property before and after the improvement is completed. The appraisal would then verify the cost effectiveness of the improvement to the affected properties. Weyrens stated that at this . time it would be cost prohibitive to complete an appraisal for each property and the staff will consider the request when evaluating alternatives. When the revised improvement plans are submitted to the Council for consideration, the request will include the conducting of a new public improvement hearing. It is anticipated that the project will begin in the Spring of 2005. Rieke made a motion to table action on the Cloverdale Improvement so that the City Engineer, Attorney and Administrator can review alternatives for the proposed improvements and bring the recommendation back to the City Council for review and consideration to schedule a new improvement hearing. The motion was seconded by Wick and passed unanimously. 2003 Audit: Utsch made a motion authorizing the Administrator to execute the contract for professional services to complete the 2003 Audit between the City of St. Joseph and Kern DeWenter Viere. The motion was seconded by Rieke and passed unanimously. Board of Review: Weyrens reported that the Board of Appeals and Equalization has been scheduled for April 6, 2004 at 6:30 PM. The purpose of this meeting is to accept testimony from residents disputing their proposed market valuation. Police Chief Reports: Police Chief Peter Jansky approached the Council to demonstrate the Tasers recently purchased by the City. The Klinefelter Foundation donated $ 2,400 for the purchase of three (3) Tasers. Tasers are a form of non-deadly force which allows Officers to control an individual who is threatening himself or others. The Taser emits 50,000 volts of electricity for five seconds. When shot, an electric current is dispersed throughout the muscular system in the body. The current temporarily immobilizes a person by restricting communication between the brain and muscles without harming the individual. - Officer Dwight Pfannenstein presented the Council with a demonstration on the use of the Taser and stated that he has completed training and will serve as the training officer for the City. Pfannenstein - stated that Taser's will not replace the need for a handgun, rather provide an Officer with another form of . non-deadly force. Non deadly options available to Officers include use of their hands, mace or batons. Pfannenstein offered Council members the opportunity to be tased, using only a ~ second emission. Rassier and Hosch volunteered to be Tased. Adjourn: Wick made a motion to adjourn at 8:30 PM; seconded by Utsch and passed unanimously. PREVIOUS ACTION The council previously tried to make this amendment on January 15, 2004, however the amendment cited . the wrong subdivision of 52.04. The ordinance should have referenced 31 (c) instead of subdivision 22. RECOMMENDED BOARD ACTION Approve the attached Ordinance which will rescind the amendment adopted on January 15,2004, reinstating the prior definition contained in Subdivision 22, and will delete subdivision 31 (c), which contains the challengeable language. AMENDMENT TO ORDINANCE 52 ZONING ORDINANCE The City Council for the City of St. Joseph hereby ordains: That Section 52.04, Subdivision 31(c) of the St. Joseph Code of Ordinances is hereby repealed. Section 52.04, Subdivision 31 shall consist only of the following language: "Subd. 31: Family. a) A family is any number of persons living together in a room or rooms comprised of a single housekeeping unit and related by blood, marriage, adoption, or any unrelated person who resides therein as though a member of the family. Any group of three persons not so , related but inhabiting a single house shall, for the purposes of this Ordinance, be considered to constitute one family. b) With respect to any property validly licensed as a rental unit pursuant to Section 55.11 of the St. Joseph Code of Ordinances, as of October 15, 1990, the definition of "family" which existed prior to October 15, 1990, shall continue to apply. This prior definition had defined "family" as up to five unrelated persons. The application of this prior definition to existing . rental units shall be construed as a non-conforming use as limited by Section 52.08 of the S1. Joseph Code of Ordinances and shall be transferable. A lapse or revocation of the rental license for any such property shall be considered as a discontinuance of a non-conforming use and the property will thereinafter be required to conform with the definition of "family" as set forth in paragraph (a) above." That the Ordinance adding Section 52.04, Subd. 22(c) approved by the City Council on January 15, 2004, is hereby rescinded, and the language existing prior to the Ordinance shall be reinstated. Discussion in the field with Xcel and City staff led to decision to pull the pole and bring a new underground service from the pole north of Baker Street to the new lift station. This also served to clean up the appearance of the site. Item 38 -Temporary Power: The plans called for using the existing power pole adjacent to the old lift station for temporary power. The loss of this pole due to the expanded excavation required installation of temporary power to the site to keep the old lift station running while the new one was construction. The old lift station could not be down more than 1 to 2 hours due to the heavy flow. Background Information and Need for Project: The St. Cloud Wastewater Treatment Facility (SCWWTF) is located seven miles south of downtown St. Cloud near the west bank of the Mississippi River. The SCWWTF was put into operation in 1976 and is owned and operated by the City of St. Cloud. Treatment capacity is shared contractually among the cities of St. Cloud, St. Joseph, Sartell, Sauk Rapids, St. Augusta and Waite Park. The SCWWTF is designed to treat an average flow of 13,000,000 gallons per day. Current influent wastewater flow is nearly 80% of this available capacity making a Facilities Plan necessary. An expansion of the SCW'NTF is projected to begin within 3-5 years. Participate with St. Cloud and the referenced contract cities in the facilities planning process including payment of a proportionate share of facilities planning costs. (At this time, it is anticipated that each new participant to this process will be required to enter an appropriate cooperative planning agreement with the City of St. Cloud and to make advance payment for its estimated cost-share for facilities planning services ). 2. Prepare or update the comprehensive growth and land use plan for your jurisdiction for purpose of projecting wastewater treatment needs through the year 2030. 3. Prepare engineering studies to determine the cost and feasibility for the installation . of conveyance facilities to transport wastewater from your jurisdiction to the SCWWTF. Note that the cost of such studies will be borne by the affected jurisdiction(s). 4. Unincorporated Areas: To be considered for wastewater treatment service, townships must enter an orderly annexation agreement with an adjoining city that provides for annexation prior to the extension of service. 5. Prior to construction of the SCWWTF expansion, each new participant will be required to enter agreements with St. Cloud to provide for: i) payment of a proportionate cost-share for in-place wastewater treatment facilities, ii) payment of a proportionate share of SCWWTF expansion costs, iii) payment of a proportionate share of on-going SCWWTF operations and maintenance costs, iv) implementation and enforcement of Sewer Use Codes, and v) compliance with applicable local, State and federal wastewater regulations. A project number has been assigned to protect the confidentiality of the business prospects. Project 01-E: This project involves the expansion of a service within the community. MDG has been keeping in touch with the project contact over the past two years, the latest communication occurred via email on February 11, 2004 with additional information requested and sent on February 1 ih and 18th and follow-up on the 25th. Project 01-F: . This company has been in contact with the EDA regarding potential sites for a commercial, business since August, 2001. MDG has forwarded the contact information on a number of sites. The last contact was via phone on February 25, 2004. - Project 01-J: This developer owns a commercial subdivision in 51. Joseph and has constructed a commercial building. MDG has been working with the developer and has forwarded potential business leads. MDG phoned developer on February 5th to follow up. MDG met with developer on February 11, 2004 and placed a follow-up call on February 18, 2004. Project 02-E: This company is looking for approximately 1 acre of land for an industrial use for an expansion. MDG followed up with the company representative via phone on February 25, 2004. Project 02-Y: This prospect contacted MDG on October 7,2002 regarding new construction in the Buettner Business Park. MDG has had numerous follow-up conversations with the company and supplied information requested on other sites. MDG followed-up by mail February 4, 2004. Project 02-AA: This business purchased land in Buettner Business Park earlier this year. They are starting building and site plans for proposed construction in the spring of 2004. MDG last followed up with the business contact on February 25, 2004. The architect is currently working on building and site plans for submittal in the next month or two. Project 02-FF: This prospect contacted MDG about a year ago regarding available acreage within the Buettner Business Park. MDG followed-up most recently with via phone on January 30th and sent a follow-up letter on February 25,2004. . EDA Monthly Report to the City Council- February, 2004 Municipal Development Group - Page 1 Project 03-A: These developers are interested in a large highway commercial development in an area not yet annexed into the. City. MDG has been working with them over the past several months. Additional contact with the developers occurred on February 4th and 8th. MDG mailed a letter on February 17, 2004 and followed up via email on February 25, 2004. Project 03-1: This contact phoned the City last spring regarding 5,000 s.f. of retail lease space. MDG has been following up routinely with the contact. The last contacts occurred on January 14th (phone conversation) and via a letter mailed 02-04-04. The contact is interested in finding a franchise owner locally. Project 03-R: This prospect contacted the City in the summer of 2003 inquiring about vacant industrial acreage. MDG forwarded information and continues to remain in contact with the prospect. Latest outreach occurred on February 4th via mail. Project 03-S: This project involves the possible expansion of the industrial acreage in the community. MDG has been working with the property owners on the project since August of 2003. MDG followed up with the property owner on January 21st and February 4th. Project 03-T: This prospect contacted the City in the in the fall of 2003 regarding commercial acreage in the downtown. MDG last followed up via phone on February 4th and 25th. Project 03~U: Inquiry forwarded to MDG on October 1, 2003 regarding a potential commercial development in St. Joseph. MDG followed up occurred on February 2nd, 5th, 111h and 25th. Project 04-A: Offers from three other. Confidential lead: wholesaler/re-packager in St. Cloud Area seeking to relocate. communities (Milaca, Foley & Big Lake) are existing. MDG followed up on February 4, 2004 to establish meeting. Contact returned call on February 5th and a meeting was scheduled fer February 11th. Scheduled meeting cancelled by contact do to equipment malfunction at facility. MDG followed up via email on February 25, 2004 regarding rescheduling the meeting. Other: MDG participated in a meeting with City Administrator Weyrens, Public Works Superintendent Taufen and City Engineer Bettendorf and School Superintendent regarding a possible site for a school.
