FISCAL IMPACT
Acceptance of the report authorizes payment to the volunteer fire fighters in the amount of $ 19,260.00
COMMENTSIRECOMMENDATIONS
The Fire Department bi-annually presents an activity report to the City Council and S1. Joseph Township
Board. After the report is accepted the payroll is prepared and distributed to the Firefighters.

FISCAL IMPACT
The City will be able to bond for the north parking lot for the Wobegon Welcoming Center.
COMMENTSIRECOMMENDATIONS
The Council has previously authorized the construction of the north parking lot for the W obegon
Welcoming Center with understanding that the improvements would be financed through bonding. The
repayment of the bond issue would be a tax levy. In order to accomplish this task, the City needed to
attach the improvement to another proj ect that was being financed. Therefore, when the residents of 16th
Avenue SE requested services, it was an opportunity to attach the parking lot. The residents have already
agreed to the improvements. The process being completed at this time is a formality that is required for
public financing and has been recommended by the legal counsel for Briggs and Morgan (Bond Counsel).

RESOLUTION ORDERING IMPROVEMENT AND PREPARATION OF PLANS
16th Avenue SE and Wobegon Park Improvements
WHEREAS, a resolution of the city council adopted the 6th day of May 2004, fixed a
date for a council hearing on the proposed improvement of 16th Avenue SE by installing
water and sewer lines and the proposed park improvements to the Wobegon
Welcoming Center.
AND WHEREAS, ten days' mailed notice and two weeks' published notice of the
hearing was given, and the hearing was held thereon on the 17th day of June 2004, at
which all persons desiring to be heard were given an opportunity to be heard thereon,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ST. JOSEPH,
MINNESOTA:
1. Such improvement is necessary, cost-effective, and feasible as detailed in the
feasibility report.
2. Such improvement is hereby ordered as proposed in the council resolution
adopted the 16th day of June, 2004.
3. Joe Bettendorf of SEH is here by designated as the engineer for this .
improvement. The engineer shall prepare plans and specifications for the
making of such improvement.
4. The city council declares its official intent to reimburse itself for the costs of the
improvement from the proceeds of the tax exempt bond.

This project provides sanitary sewer and water main improvements to the Pondview Ridge LLP, Schelper,
and Schriefels properties located on 16th Avenue SE. Infonnation on this project was presented at the May
6,2004 St. Joseph Councilnreeting.
Having investigated the facts relating to construction of the proposed improvements, it is my opinion,
from an engineering standpoint, thattbis project is feasible, cost-effective, and necessary.

This request for proposal does not obligate the City to award a contract or complete the project, and the
City reserves the right to cancel the solicitation if it is considered to be in its best interest.
Project Specific Information
Project Overview
The City of St. Joseph requests proposals to complete an alternatives scoping process, StateIFederal
environmental review and official mapping for the proposed Field Street new alignment roadway. The
attached Exhibit A illustrates a generalized map of this corridor and its termini.
Project Goal
It is the goal of this Study that a scoping process be completed to evaluate alignment alternative for
the proposed Field Street Corridor, and that required National Environmental Policy Act (NEP A) and
Minnesota Environmental Policy Act (MEP A) documents be completed for the preferred alignment and
preliminary design recommended from this scoping process. An official map will be surveyed and filed to
· assist in protecting the preferred alignment alternative from development.
Scope of Work and Deliverables
1. Evaluate a no build alternative and up to three (3) build alignment alternatives within the corridor.
The eastern terminus of the corridor is 20th Avenue SE. Evaluate the build alignment alternatives with
a western terminus of Stearns CSAH 2, and also with a western terminus of Stearns CR 121.
2. Collect pertinent data within and adjacent to the corridor necessary to compare the build alignment
alternatives to the no build alternative. Pertinent data will include, but is not necessary limited to the
following: existing and planned land uses, existing and planned roadways and their functional
classification, existing and forecasted travel demands, existing topography, sensitive/protected
environmental land features, and species.
3. Prepare preliminary geometric layouts consistent with Minnesota Department of Transportation
(Mn/DOT) State-Aid standards including profile and typical sections for each alignment alternative.
The City will make available to the consultant aerial background mapping with 2-foot contours
(based on 1998 flight).
4. Prepare cost estimates for each alignment alternative based upon developed preliminary designs.
5. Solicit input from, and coordinate with, pertinent Federal and State resource agencies regarding the
social, economic, and environmental (SEE) impacts, and transportation performance of each
alignment alternative.

· 6. Solicit input from, and coordinate with, local stakeholders, identified in Exhibit B regarding the SEE
impacts, and transportation performance of each alignment alternative.
7. Conduct a public information meeting to present the SEE impacts and transportation performance of
each alignment alternative.
8. Assist local decision-makers in achieving consensus regarding a preferred alignment alternative and
preliminary design based upon documented SEE impacts, transportation performance, and comments
received.
9. Complete an Environmental Assessment (EA)Ænvironmental Assessment Worksheet (EA W) for the
preferred alignment alternative and preliminary design, along with such other environmental studies
as may be required.
10. Conduct a public hearing on the ENEA W document, and obtain a Finding of No Significant Impact
(FONS!) for the preferred alignment alternative and preliminary design.
11. Prepare a Certificate of Survey for the preferred alignment alternative. Tie the alignment of the
selected alternate into the Steams County Coordinate System and prepare such documentation as may
be necessary to file the alignment as an "official map" in accordance with Minnesota Statutes Chapter
462. Conduct a public hearing, and file the alignment with the County Recorder.
12. Coordinate the entire scoping process, ENEA W process, and official mapping process with the Field
Street Corridor Technical Advisory Committee (T AC).
· 13. Complete such other tasks as may be necessary to secure State and Federal approval of the scoping
process and the preliminary design for the selected alternative.
14. The program budget for this study, as shown in the current STIP for fiscal year 2006, is $159,000.
The A TP has accelerated this project to fiscal year 2004.
15. The Project Memorandum for this study is included as Exhibit C.
Responders are encouraged to propose additional tasks or activities if they will substantially improve the
results of the Study. These items should be separated from the required items on the cost proposal.

PROPOSED PROJECT DESCRIPTION
Develop a new transportation corridor on the southerly side of the City of St. Joseph. The
corridor would connect to CSAH 2 on the west side and 88th A venue on the east side of the City.
Route: Generally, the route follows the southerly city limits and lies
north of Interstate 94. It runs through the SW 1,4 of Section 9,
North !h of Sections 14, 15, and 16, T124N, R29W in Stearns
County. The proposed corridor is 2.0 miles long.

WHEREAS, Section lAB of Stearns County Land Use and Zoning Ordinance Number
209 states that this Ordinance shall apply to all areas in Steams County, Minnesota,
"except as otherwise provided in law"; and
WHEREAS, Minnesota Statutes, Section 414.0325, subd. 5 provides that a joint
resolution may provide for the establishment of a board to exercise planning and land use
control authority within any area designated as an orderly annexation area; and
WHEREAS, the City of St. Joseph and the Town of S1. Joseph have signed such a joint
resolution designating the Town of St. Joseph as an orderly annexation area, and in
addition, have created the Township of St. Joseph - City ofSt. Joseph Planning Board,
which has exclusive authority over land use and zoning issues within the orderly
annexation area.
WHEREAS, the County and the Township of St. Joseph - City of St. Joseph Planning
· Board desire to enter into a Memorandum of Understanding in order to provide an
opportunity to cooperate in administering zoning within the County for the purpose of
ensuring better consistency in land use regulations and in the implementation of those
regulations; and
WHEREAS, the County and the Township of St. Joseph - City ofSt. Joseph PIanning
Board desire to enter into a Memorandum of Understanding to ensure mutual
understanding of each party to this Memorandum of their respective duties and
responsibilities related to land use issues; and
WHEREAS, the permitting process may involve provisions enforced by the County,
provisions enforces by the Township and provisions enforced by the Township of St.
Joseph - City of St. Joseph Planning Board.
WHEREAS, this Memorandum of Understanding is intended to replace the previous
Memorandum of Understanding signed by the Township ofSt. Joseph - City ofSt.
Joseph Planning Board on 3/11/02 and the County Board on 3/19/02.
NOW THEREFORE IT IS AGREED, by the County of Stearns and the Township of
St. Joseph - City of St. Joseph Planning Board to cooperate in administering their land
use controls as set out in Attachment 1 of this Memorandum of Understanding.

· ATTACHMENT 1
A. Land Use and Zoning Ordinance Provisions
1. That after the conveyance of all residential dwelling sites in the Agricultural 40
Zoning Districts, the residual parcel shall not be eligible as a residential dwelling site.
2. Residential accessory buildings shall meet the road setbacks and in no case shall they
be located closer to the road than the residential dwelling
3. No residential accessory building shall be located on a lot prior to the location of a
residential dwelling on the same lot.
4. Any manufactured home to be used as a residential dwelling unit shall be no less than
20 feet in width and shall bear the Seal of Compliance issued by the State of
Minnesota. Residential dwelling units shall be no less than 20 feet in width.
5. Home extended businesses shall be allowed as a conditional use in all zoning districts
in which they are allowed.
· 6. The transfer ofresidentml development rights within the Township is allowed in all
zoning districts with approval ofthe Joint Planning Board
7. The transfer of residential development rights :&om another Township into St. Joseph
Township is prohibited in all zoning districts.
8. The transfer of residential development rights :&om St. Joseph Township into another
Township is allowed in all zoning districts.
B. Administrative Provisions
1. The Town shall conduct public hearings and act on conditional use permits for home
extended businesses.
2. The Town shall issue all permits, and conduct site inspections for each permit issued
for any structure or use allowed in item Bl above and provide thè County with copies
of permits and inspection reports for any permit issued therefore on a monthly basis.

3. The Town shall conduct public hearings and act on all variances for structures for
which the Town issues permits, unless otherwise noted in this memorandum of ·
understanding.
4. The Town shall conduct public hearings and act on all variances for the purposes of
considering variance applications relating to setbacks from Township roads.
5. The Town shall not act on any permit or variance within the Shoreland Overlay
District unless the sewage system has fITst been certified.
6. The County shall conduct public hearings and act on all variances for the purposes of
considering variance applications relating to setbacks ITom County highways.
7. The Town shall conduct public hearings and act on all variances from the Town
prohibition relating to the transfer of development rights.
8. The County shall administer and enforce all provisions of Stearns County Ordinance
Number 209; or successor ordinances within the orderly annexation areas of the
Town that are not specifically administered or enforced by the Town through this
memorandum of understanding.
9. In the orderly annexation areas, public hearings for subdivision approvals and
rezoning approvals shall be acted upon by the County.
10. Preliminary plat approval ITom St. Joseph Township and the City ofSt. Joseph, or ·
ITom th~ Township of St. Joseph - City of St. Joseph Planning Board, shall be
required prior to the County Platting Committee review of a prelirrúnary plat.
11. A recommendation from St. Joseph Township and the City of St. Joseph, or ITom the
Township of St. Joseph - City of S1. Joseph Planning Board, shall be required prior to
the County Planning Commission conducting a public hearing on a proposed
rezorung.
12. The plat review committee requirements contained in Sections 5.3.5 and 5.3.7 of
Stearns County Subdivision Ordinance Number 230; or successor ordinance, shall be
applied to all plats proposed in the Town of St. Joseph orderly annexation areas.
13. The fmal plat requirements of Section 5.4 of Stearns County Subdivision Ordinance
Number 230; or successor ordinance, shall apply within the Town of St. Joseph..
14. The County shall issue all permits and act on all variances not specifically
enumerated in sub-items 1 through 13 herein. Additionally, the County shall
administer and enforce all provisions of Steams County Ordinance Number 209; or
successor ordinances that are not specifically administered or enforced by the Town
through this memorandum of understanding.

C Respective Duties and Responsibilities
1. The Town shall provide the County with written notice of any public hearing
regarding a conditional use permit, interim use permit or variance and a copy of the
conditional use permit~ interim use permit or variance application at least 7 days prior
to the public hearing.
2. The County shall provide the Town with written notice of any public hearings
regarding a conditional use permit, interim use permit, rezoning request or variance
and a copy of the conditional use permit~ interim use permit, rezoning request or
variance application at least 10 days prior to the public hearing.
3. The Town shall provlde the County with copies of variances, conditional use permits,
or interim use permits granted pursuant to St. Joseph Township Land Use and Zoning
Ordinance Number 2 and the related findings of fact at the time the applicable
document is recorded with the County Recorder.
4. The County shall provide the Town with copies of all construction site permits,
variances, conditional use permits or interim use permits granted pursuant to Steams
. County Land Use and Zoning Ordinance Number 209; or successor ordinance,
including related findings of fact, on a monthly basis.
5. The Town shall provide the County with copies of all construction site permits~ along
with the inspection report, issued pursuant to S1. Joseph Township Land Use and
Zoning Ordinance Number 2; or successor ordinance on a monthly basis.
6. The County shall provide the Town with copies of all Provisional Uses registered by
the County on a monthly basis.
7. The Town shall notify the County of all proposed ordinance changes prior to holding
a public hearing.
8. The County shall notify the Town of all proposed ordinance changes prior to holding
a public hearing.
9. Ifan ordinance change or rezoning occurs, the County and Town shall review this
memorandum of understanding for potential changes.
10. This Memorandum of Understanding may be terminated by mutual agreement,
however, if the parties are unable to mutually agree, then any party can unilaterally
without cause terminate the Memorandum of Understand on ninety (90) days written
. notice.
AMENDMENT TO ORDINANCE 54
· SUBDIVISION REGULATIONS
The City Council for the City of St. Joseph hereby ordains that Ordinance 54 is amended to
read as follows:
1. That Section 54.18 of the St. Joseph Code of Ordinances is hereby revoked in its
entirety and the following re-enacted in its place:
Subd. 1. Purpose and Intent: Minnesota Statute 462.358 provides Municipalities with
the authority to require that a reasonable portion of any proposed subdivision be dedicated to the
public or preserved for conservation purposes or for public use as parks, recreational facilities,
playgrounds, trails or open space. The City has determined that new-development increased the
demand for and use of park property. In addition, the City has also determined that the demands
on City parks and need for additional park space increases the density of development increases.
Therefore, the intent and purpose of this Ordinance is as follows:
a) To provide a parkland dedication system for new development, which provides
for a larger dedication where density is higher and open spaces are more sporadic.
b) To provide required parkland to be dedicated by this Ordinance to be roughly
proportionate to the impact on the demand for park use in the City as a result of
· new development.
1. For residential development where the impact is based upon the number of
people in the new development, rather than set a standard percentage of
the total development to be dedicated, the City will use a standard
percentage of its starting point in establishing a dedication.
11. For commercial and industrial developments, since the impact is primarily
based upon the loss of open and green space, and the loss of natural areas
the City will use a standard percentage as its starting point in establishing
a dedication.
c) To determine the "rough proportion" of dedication, the City Council utilizes the
National Park Standard of 10 acres per 1000 residents in determining the amount
of park dedication required for any given development.
Subd.2: Reservation of Land. Where a proposed park, playground, school site or other
public site shown on an adopted plan or official map is embraced in part or in whole by a
boundary of a proposed subdivision, and such public sites are not dedicated to the County or
Board of Education, such public grounds shall be shown as reserved land on the preliminary plat
to allow the County State Agency or the Board of Education the opportunity to consider and take
action toward acquisition of such public ground or park or school site by purchase or other
· means prior to approval of the Final Plat.

Subd. 3: Dedication of Land. The City shall require all subdivisions to dedicate a
reasonable percentage of property to the public or preserved for conservation purposes or for ·
public use as parks, recreational facilities, playgrounds, trails, wetlands or open space as
detennined by the City Council. The City Council will make a [mal detennination after
consulting with the Planning Commission and Park Board. No areas may be dedicated as parks,
playgrounds, or public lands until such areas have been approved for that purpose to which they
are to be dedicated by the City Council. The subdivider-developer shall leave such dedicated
land in a condition suitable to the City Council.
a). Land Dedication Fonnula: In detennining the dedication fee when land is
dedicated the following fonnula shall apply:
1. Single Family 1,172 square feet per unit
11. Multiple Family 1,250 square feet per unit
111. Commercial 2% of land are~ not including streets or other
dedications.
IV. Industrial 2% of the land are~ not including streets or other
dedications.
b) Land Eligibility: To be eligible for park dedication credit, any land dedicated
must be located outside of the drainways, wetlands, floodplains or ponding areas after the site
has been developed. Absent unusual conditions, stonnwater drainage areas and holding areas or
ponds shall not be considered wetlands. Lands dedicated for public use must have street frontage
on one or more street (s) with a minimum frontage of200 feet. ·
c) Dedication Credits: The Council may, after reviewing the recommendation of the
Park Board, give credit for land dedication for the following:
1. Where wetlands have been detennined to have a park function by the Park
Board, credit may be given up to a 25 percent of the wetland area and
adjoining lands areas below the high water level.
11. Where a private open space for park or recreation purpose is provided in a
proposed subdivision, and such space is to be privately owned and
maintained by the future residents of the subdivision, credit may be given
up to 25 percent. Before credit is given, all of the following factors must be
satisfied:
1. The land area must be available for use, without preference, of all
of the residents of the proposed subdivision.
2. The required setbacks must not be included in the computation of
such land.
3. The use of the private open space must be restricted for park and
recreation purposes by recorded covenants or declarations which ·
run with the land in favor of the owners of the property within the
subdivision and cannot be eliminated without prior approval of the

City Council after review and recommendation by the Park Board
· and Planning Commission.
4. The proposed private open space must be of sufficient size, shape,
location, and topography for park and recreational purposes or must
contain unique features that are important to be preserved.
Subd.4: Cash in Lieu of Land. If in the judgment of the City Council, the area proposed
to be dedicated is not suitable or desirable for park/playground purposes, because of location,
size or any other reason, the City Council may require in lieu of land dedication, a payment to
the City of a sum equal to a fee established by the City Council.
a) Cash Dedication Fee: In determining the dedication fee when the Council
requires a cash in lieu of fee, the following formula shall apply:
1. Single Family $ 914 per lot
11. Multiple Family $ 975 per lot
111. Commercial $ 2% of average land value
IV. Industrial $ 2% of average land value
For the purposes of this section, the average fair market includes an average of un-improved land
values, prior to the installation of improvements, as of the date of the final plat.
· Subd. 5: Partial Dedication and Partial Payment. The City may elect at its sole discretion
to receive a combination of cash, land, and development of the land for park use. The potential
cash donation generated by the dedicated land and/or the value of the development of land shall
be calculated based on the fair market value of the land no later than at the time of final approval. .
That amount shall be subtracted from the cash contribution required by the Subsection above.
Subd.6: General Requirements.
a) Land to be dedicated shall be reasonably suitable for its intended use as
determined by the City and shall be at a location convenient to the public to be
served. Factors used by the City Council in evaluating the adequacy of proposed
park and recreation areas shall include size, shape, topography, geology,
hydrology, tree cover, access, and location.
b) The applicant shall confer with City Staff and the City Council at the time the
preliminary plat is under consideration, to ~ecure a recommendation as to the
location of any property that should be dedicated to the public, such as parks,
playgrounds or other public property. The preliminary plat shall show the location
and dimensions of all areas to be dedicated in this manner. Such contribution
requirement recommendation(s) will be sent to the Planning Commission for
review and comment and subsequently to the City Council for its approval.
c) When a proposed park, playground, recreational area, or other public ground has
· been indicated in the City's official map or Comprehensive Plan and is located in
whole or in part within a proposed plat, it shall be dedicated to the approximate
governmental unit. If the applicant elects not to dedicate an area in excess of the

land required hereunder for a proposed public site that the City feels is in the
public interest to acquire, the City may consider acquiring the excess land through ·
purchase, condemnation, or negotiation.
d) Land area conveyed or dedicated to the City shall not be used in calculating
density requirements of the City Zoning Ordinance and shall be in addition to and
in lieu of open space requirements for planned unit developments.
.
e) Where private open space for park and recreation purposes is provided in a
proposed subdivision, such areas shall not be used for credit against the
requirement of dedication for park and recreation purposes, unless the City
Council finds it in the public interest to do so.
£) The City, upon consideration of the particular type of development, may require
that a lesser parcel of land should be dedicated due to particular features of the
development. In such cases, a cash contribution shall be required above the land
dedication to insure that compensation is received for the full amount of the
impact on the City's park and trail system.
g) For subdivisions incorporating a mixture ofland uses and/or densities, the park
dedication fee shall be determined by applying the appropriate dedication for each
use as identified in this section.
h) Park cash contributions are to be calculated and established at the time of final ·
plat approval. The Council shall require the payment at the time of fmal plat
approval or at a late¡- time under terms agreed upon in the development
agreement. Delayed payment may include interest at a rate set by the City.
i) Cash contributions for parks and trails shall be deposited in either the City's Park
Fund or multi-purpose trail fund and shall only be used for park acquisition or
development, and trail acquisition or development as determined by the City.
Additionally, said funds may be utilized anywhere within the City park and trail
systems.
j) Wetlands, ponding areas, and drainageways accepted by the City may not be
considered in the parkland and/or cash contribution to the City.
k) Property being re-platted with the same number of lots and same number of
dwelling units shall be exempt from all parkland dedication requirements. If the
number of lots or the number of dwelling units is increased, or if land outside the
previously recorded plat is added, then the park land dedication and/or park cash
contributions shall be based on the additional lots and on the additional land being
added to the plat. If the additional land does not create additional lots, then each
one-third (113) acre added shall be considered a new lot for purposes of
calculating the dedication requirements.
1) When land is dedicated and deeded to the City for park purposes, it shall be the ·
responsibility of the City to maintain such dedicated property.

m) Land dedication to the City shall be in the form of lots or outlots with approved
· lot and block numbers.
n) Parks bordered on one (1) or more sides by existing creeks or streams shall ensure
access to the park is provided from an arterial roadway or collector street and that
pathways that allow emergency motorized vehicle traffic within the park are
present.
0) Parking areas shall be established on land adjacent to the required parkland area,
sized to meet the needs of the planned facilities. Criteria reviewed shall include
the area the park is intended to serve (neighborhood, entire city), the nature of the
park (passive recreation, specific use) and the facilities contained within the park
(e.g. ball fields, picnic areas, tennis courts, play areas, etc). Said parking areas
shall be dedicated to public use and shall not be included in the required land
dedication. The City may complete improvement of said parking area.
p) The Developer shall be responsible' for grading and seeding of required parkland,
to City specifications.
Subd..7: Required Improvements: Developers shall be responsible for making certain
improvements to their developments for park, playground, trail and open space purposes:
a) Areas to be dedicated for public park, trail or ponding shall be brought to a
· suitable condition by the subdivider prior to acceptance by the City. All dead
trees,. trash, junk, unwanted· structures or other similar undesirable elements shall
be removed at the developer's expense.
b) Provide finished grading and cover of at least four (4") inches or more of topsoil
on the park site. In addition, the developer shall be responsible for seeding the
park with a mixture approved by the Public Works Director. No park dedication
credit will be given for this work.
c) Sidewalks or trails shall be constructed in certain right-of-ways, as suggested by
the City Council within the development. Further, each subdivision must connect
to the established trail system through the construction of sidewalks or trails. This
improvement shall be the responsibility of the developer. These sidewalks or
trails shall not be utilized toward park dedication requirements.
d) Trails that are part of the recreational system and are outside of the right-of-way
and public properties, shall be utilized toward park dedication, as long as the trail
is dedicated to the City in the form of an easement.
Subd.8: Maintenance of Private Open Space. In the event certain land areas or
structures are provided within the subdivision for private recreational use or as service facilities,
the owner of such land and buildings shall enter into an agreement with the City to assure the
. continued operation and maintenance to a predetermined reasonable standard. These common
· areas may be placed under the ownership of one of the following depending upon which is most
appropriate:

a) Dedicated to the public where a community-wide use would be anticipated.
b) Applicant's ownership and control. ·
c) Property owner's association ownership and control, provided all of the following
conditions are met:
1. The property owners association must be established prior to the sale of
any lot.
2. Membership must be mandatory for each owner and any successor in
interest.
3. The open space restrictions must be in perpetuity, not for a given period of
years.
4. The association must be responsible for liability insurance, local taxes and
the maintenance of the recreational area and facilities.
5. Landowners (homeowners) must pay their prorated share of the cost, and
any assessment levied by the association then can become a lien on the
property in accordance with law.
6. The association must be able to adjust the assessment to meet changed ·
needs.

Dear Mr. Lambert:
I am in receipt of your letterdated June 1, 2004. With regard to the first paragraph, your calls were
returned. With regard to the second paragraph, Northland Drive was in place long before you began your
development.
You will recall, during the planning stages of your development I suggested you contact Dorian Davidson
to arrange to turn excess excavation material from your site into fill for his site. This is called "balancing
the site" and is the usual and customary practice in commercial development. Dorian needed the material
but apparently couldn't meet your terms. You retained the excess material, and now you have a high site
. with long steep slopes.
Your Engineer submitted an unsigned, undated grading plan that shows an existing elevation of 83.75
where Elm Street intersects Northland Drive. On another grading plan dated June 9, 2003, he shows a rim -
for the two catch basins west of Elm Street of 84.4. These catch basins were designed to take the water
coming downhill from your dirt road to the west. The contours going up your dirt road to the west show
the water being conveyed to the sides of the road so it can be intercepted by the two catch basins in
question. These catch basins were never designed to pick up drainage from Northland Drive.
Finally, the Developer's Agreement dated July 15,2003 and signed by you, states in section 3.11 "The
City Council has approved a plan for the Project and Lot Two to drain to the City holding pond on Outlot
B, Northland Plat One and Outlot A of Northland Second Addition."
The comments in my letter dated May 26, 2004 stand. I am available to meet with you Thursday
afternoon, if you feel that would be helpful. Please bring along a copy of your MPCA storm water permit
as I do not have a copy on file. Thank you.

On behalf of the City of Little Falls and the League of Minnesota Cities, I would like to invite
you to the League's Regional Meeting to be held from 2:30-8:30 p.m., July 29th, at the Initiative
Foundation. We are very excited to host this meeting and are looking forward to seeing old
fuends and colleagues and meeting new ones.
The League has prepared an information-packed agenda for this meeting. Hear about the city's
role in handling meth labs, emerging issues in Data Practices Act and open meeting law, and fire
department management and liability issues. Also, get a review of the past legislative session and
a preview of upcoming issues.
· We invite you to share your opinions, ideas and suggestions to help the League prepare for the
2005 Legislative Session, and to bring stories about your city's recent éhallenges and successes.
You may come at any time to any portion of the program that best suits your city's needs.

This letter is to make you aware of a discussion held at our last St. Cloud Area Joint Planning
District Board meeting related to each member's 2005 budget.
Ithas become evidentthat the State grant funds supporting the District have been nearly
. exhausted. Under the District's Joint Powers Agreement, your entity is obligated to fund 1/9th of
any necessary expenditures incurred by the District.
Fortunately, the total cost of operating the District is usually less than $1,000. The major
expense for the District in 2004 was the payment of the District Board's liability insurance
premium (approximately $900). I have no reason to believe that expenses in 2005 will be any
different. Therefore, I would suggest that you include in your 2005 budget an amount not
exceeding $200 to fund your share of these future incidental expenses incurred by the District.
If you have questions regarding this letter, please do not hesitate to contact me or your
representative on the District Board;
