So, we are. on the agenda for April 6, 2004 at 8:30 PM. This is the same night as the Board of Review but we should be done before that. The 2003 Auditisunderway and should be finished by the end of the A dit week. The auditors have noted thattheSt. Joseph Fire Relief Association and St. Joseph Recreation Association have been using the Federal Identification Numbe~ for St. Joseph. While. this practice has been going on for a number of years, it is not longer permissible. ¡ Therefore I will be contacting both agencies and informing them of the I requirement and requesting that they be contact the IRS and obtain their own numbers. J int·'Meeting March 22, 2004 at 7:00 PM is the joint meeting with St.Joseph Township PI'anning Commission The Planning Commission will be conducting a special meeting on Wednesday, March 24,2004 at 7:00 PM. In their review of the mÍnutes they cannot find where the minutes of Fe ruary 26, 2003 where ¡,approved. Therefore, at this time the Council will need to consider the minutes. · Pursuant to due call and notice thereof, the City Council for the City of St. Joseph met in special session on Wednesday, February 26,2003 at 7:30 AM in the St. Joseph Fire Hall. .. Members Present: Mayor Larry Hosch. Councilors Gary Utsch, AI Rassier, Dale Wick, Ross Rieke. Administrator Judy Weyrens. Others Present: Police Chief Peter Jansky. " ,',. Mayor Hosch closed the meeting at 7:30 AM to conduct the performance reviews of the City Administrator and Police Chief. At 8:20 AM the meeting was opened. Hosch summarized that it was the consensus of the City Council that both the Administrator and Police Chief met or exceeded performance standards as established by the Council. Therefore they have both received favorable performance reviews and the Council must determined the wages for 2003. Mayor Hosch presented the Council with a salary survey of Cities for the position of Police Chief and Administrator. In reviewing the current wages of the City employees in the same positions, the Police Chief is paid within the average range while the Administrator is paid below the median. Hosch further stated that the wages of the Administrator are far below the average and the City should consider establishing a step program to advance the wages of the position to that of other Cities. Hosch stated that he has projected that the position must be advanced 8% each year for a period of three years. At the end of the three year period the wages of the St. Joseph Administrator should be similar to that of other Cities. Based on favorable performance reviews, Hosch made a motion to increase the wages of the Police Chief by 3.5% and continue to pay his monthly health club premium and to increase the wages of the Administrator by 8%, with 3.5 attributed to the cost of living and 4.5 attributed to pay equity adjustment. The motion was seconded by Rassier. Discussion: The Council was in general agreement that the Administrators wages should be . increased by 8% for a period of three years to bring the position pay into conformance with other Administrators. Public HearinQ - Ann1al Storm Water Permit City Engineer Joe. Bettendorf stated that the City is required annually to cbnduct a public hearing regarding Storm Water Management. Changes in Legislation required t~e City to complete an MS4 NPDESII Permit. The permit requires an annual meeting to review'thelBest Management Practices as included in the permit and to assure required policies and monitoring are in place. Bettendorf stated in his opinion the City has met or . . I . . . exceed the goals outli\ned in the permitfor 2003. Bettendorf presented the Council with the following summary of changes undertaken by the City to manage drainage i~sues: · All new const~uctio. n is required to fence the street perimeter of the property to prevent erosion on thé streets. · Property fenc~d during construction can only have a24' entrance and the entrance must be rocked a ~idth of 10 feet and length of 30 feet. · The City has entered into an agreement with Inspectron to provide 40 hours of Building Inspection Service per week. This change is allowing the City to become more . aggressive wifh enforcement. 1 Draft March 4, 2004 Page 2 of 5 Bettendorf presented the Council with the detailed summary of the M4 Permit which identifies all · the goals for past, present and future. Since the permitting process was a new requirement, Legislature allowed Cities to phase in the complete requirements. Therefore on the summary it can be noted that some of the items are not scheduled to be completed until 2007. As this is a public hearing, Mayor Hosch opened the floor to the public. No one present wished to speak and the hearing was closed at 7:10 PM. Rassier questioned when the City begins working on the items outlined for completion in 2007 such as Woodland Preservation. Hosch encouraged the City to start the process to preserve woodland so we do have the same situation happen that occurred in Forest Ridge. Bettendorf concurred and stated that all developments should be required to maintain green space and the City should begin the process for establishing the requirements. CITY ENGINEER REPORTS State Aid Street Desionation: Bettendorf stated that due to the growth of the City and recent reconstruction projects, the City has an additional 1.34 miles of roadway that can be designated for State Aid Funding. Before additional roads can be designated, the State Aid Engineer must approve a proposed route. Therefore, Bettendorf stated that he has forwarded his recommendation to the State Aid Engineer and when he responds the matter will be brought back to the Council for approval. Bettendorf proposed adding the following sections of roadway for possible State Aid designation: 1. Field Street - CSAH 2 (Minnesota Street West) to County Road 121 (College Avenue South) - .90 miles 2. 4th Avenue NE - County Road 134 (Minnesota Street West) to CSAH 75 - .15 miles 3. 1ih Avenue NE - Baker Street East to CSAH 75 - .29 miles. · Wick questioned if the East Corridor (Field Street/88th Avenue) could be included for State Aid mileage. Bettendorf stated that any designation of State Aid Funds must be within the City which is receiving State Aid. At this time the area questioned by Wick is located in St. Joseph Township. Bettendorf stated that the City will have the ability at a later time to change the designation, but it is important to designate the maximum mileage allowed. ~-'~~~~~~ ~~~--~~_.~~~---" Chanqe Order #1- East Baker St. Lift Station: Bettendorf presented the Council with a Change Order for the East Baker Lift Station. During construction of the Lift Station the contractor excavated around an old power pole and during the process it was discovered that the pole could not be safetly anchored. Therefore, the contractor had two choices - replace the overhead power pole or place the power line underground. Since the City requires all new developments to place the power lines underground, a decision was made to do the same for this project. Therefore the contractor incurred additional cost. Hosch questioned Bettendorf why this is being discussed at this time if the change has already been completed. Bettendorf stated that typically change orders are approved before the work is completed. The exception to this rule is when they are in the field and there is not time to bring the matter to the Council for approval. Procedurally the Council still needs to approve the Change Order and the funds will be expended from the Trunk Sewer Fund. Wick made a motion authorizing the Mayor to execute Change Order #1 for the East Baker Street Lift Station, authorizing the payment in the amount of $ 4,664.38 to R.L. Utilitv Extension - 295thStreet & 103rd Avenue: Bettendorf reported that as the Council is aware, there are two new hoµsing developments that are being considered adjacent to 295th Street. These two developmiimts would leave an island areawithout water and sewer services. The Council should consider inviting theresidentstoan informational meeting to see if there is interest or ne~d for utility services., Providing services with the two developments would not only be cost effective but ~fficient as well. Bettendorf stated that he is in the process of completing the review of the project~ and his comments will include the need to provide an additional access from Morningside AC1es to the property to the south. The Council questionrd if the area being discussed could be annexed without petition. Weyrens stated that the prope~y being discussed is part of the service area set to expire in 2007. Therefore, if annexation would occur, the City would need to receive a, petition from at least 60% of the property owners within the affected area. Once the petitions are received the City and Township would conduct a public hearing, which would ultimately determine if the property should be annexed. The City has the, ability to annex this property without petition in January 2008. Utsch and Hosch conburred that the residents should be invited to an informational meeting to find out if the residents would be in favor of the annexation. Bettendorf stated that before, an informational meetinQ is scheduled the Council should order the Feasibility report as the first question residents will ask is what will the improvements cost. I Rassier made a motion to approve the Resolution ordering the Feasibility Report for the proposed improve~ents to residents abutting 29Sth Street and a portion of 103rd Avenue. I Transportation Planniha: Bettendorf presented the Council with a first draft of a future Transportation Map for St. Joseph. The map illustrates Field Street aswelLas the proposed relocation of CR 2 to CSAH 75 and the north EastlWest corridor. Bettendorf stated that sinceSt. Joseph is experiencing rapid growth, the Council should begin ,to discuss future corridors so that the right-of-way can be preserved while it is vacant land. The map prepared is a best guess of where the roads might be located. Bettendorf stated that in laying out the corridors, he attempted to avoid wetland areas and areas not suitable for road construction. I Hosch stated that he does not favor the CR 2 bypass as illustrated on the proposed map. In his opinion people will have to make,an efforUo drive through St.Joseph and it should be just the opposite. It should bel more difficult to get around SLJoseph.Rassierand Rieke disagreed with Hosch and stated that it is important to look at the best traffic design as this road will need to serve the future for many years. While both agree that they would encourage the traffic through St. Joseph, the best d~sign for traffic flow should be reviewed. Bettendorf stated that he can . design alternatives and then the City should begin discussing the proposed routes with the residents to see what Will be supported. As such, St. Cloud is requesting each participating community to project their needs. Therefore, St. Joseph needs to consider the possible expansion to St. Wendel Township. Rieke questioned how far into the future the City of St. Cloud is planning, to which Bettendorf responded 20 years. The need to expand again will be driven by development and Engineers try and plan facilities for 20 years. The Council was in general agreement to meet with the St. Wendel Township Board to discuss if they are still interested in receiving services for a portion of the Township, and if so, what timeframe they will need the services. Weyrens will contact St. Wendel Township to establish a meeting date. MAYOR REPORTS Federal Transporation Study: Hosch reported that the St. Cloud APO Full Board is requesting that both Corridor Studies submitted by St. Joseph be funded in fiscal year 2007. While the studies did not make the funding level of the Technical Advisory Committee or the Executive Committee, the Full Board reduced the amount of another project so St. Joseph would receive funding. COUNCIL REPORTS UTSCH PlanninQ Commission: Utsch reported that the Planning Commission conducted two public hearings on March 2, 2004 to consider amending the Comprehensive Plan for two planning districts to allow for the construction of R3 dwelling units. The Planning Commission was hesitant to allow the amendment without changing the R3 Zoning regulations requiring the developer to . complete a PUD and Special Use Permit process for developments with 12 or more units. The PUD process would allow the City to enter into a Development Agreement for a specific project and if the project changes, the developer must start the process all over. Therefore the Planning . Commission has scheduled a special meeting for March 24, 2004 for the amendment to the R3 Zoning District, project specific PUD and Special Use, Rezoning Request and Amendment to the Comprehensive Plan. Wobeqon Welcominq Center: The dedication for the Wobegon Welcoming Center has been scheduled for April 30, 2004. In addition the Carmel Roll Bike Trip will leave from the Wobegon Center on May 1, 2004. Bicycle Friendly Application: Wick reported that he has completed and submitted part 1 of the application for Bicycle Friendly Communities. Wick stated that he is in the process of completing part 2, which has a submission deadline of March 19, 2004. Park Board: The Park Board has met and is in the process of reviewing the park dedication fees and will be meeting with the Planning Commission for possible modification. Wick also stated that there is a bill before the Legislature that would limit how Park Dedication Funds are expended and could have a negative impact on St. Joseph. The Park Board also met with representatives from the St. Joseph Township Park Board and the Stearns County Parks Director. The main discussion item was the proposed Park along the Sauk River. Cloud Area Planning Organization (APO) for FY 2007IFY 2008 federal funding consideration. At their February 26th meeting, the APO Policy Board approved $200,000 of FY 2007 federal funding for a combined corridor preservation study within these two corridors (see attached table and map). In order for these federal study funds to be awarded by the APO, a resolution is needed from the . Stearns County Board and St. Joseph City Council agreeing to provide-the 46 percent ($171,000) local match, since this is more than the minimum 20 percent local match for federal projects. Additionally, a resolution is needed from both agencies agreeing to construct a phase of this corridor within ten (10) years from the date that federal study funds are obligated. If a phase of the corridor is not constructed within this time period, the Minnesota Department of Transportation (MnD0T) ,,~ill.. require that,th~ $200,000 of. federal fi.mdin~be, reirnbwsed. Suggested language for both resolutions is attached. Please coordinate adoption of these resolutions between your two jurisdictions and forward signed copies to the APO at your earliest convemence. Please keep in mind that MnDOT State Aid and the Federal Highway Administration (FHW A) must authorize obligation of the federal study funds prior to the awarding of a consultant contract. "Overmatch" of Local Funds for the Following FY 2007 Federal Project: St. Joseph North and West Corridors Preservation Study: St. Cloud City Limits to CSAH 3 & CSAH 3 to CSAH 2 WHEREAS; Surface Transportation Program (STP) funding authorized within the Transportation Equity Act for the 21 st Century (TEA-21) has been apportioned by the United States Congress to Minnesota for State and local transportation needs; and WHEREAS; the Minnesota Department of Transportation (MnDOT) has allocated FY 2007 STP funding to eight (8) Area Transportation Partnerships (ATPs) within Minnesota to be expended by MnDOT and local jurisdictions; and WHEREAS; the St. Cloud Area Planning Organization (APO) has received a $1.95 million target of FY 2007 STP funding from the District 3 ATP for programming locally sponsored federal transportation projects within the APO Planning Area; and WHEREAS; the APO has recently awarded Stearns County and the City of St. Joseph $200,000 of STP funding in FY 2007 for the St. Joseph North and West Corridor Preservation Study; and WHEREAS; the federally required local match for this study is twenty (20) percent; and WHEREAS; in order to leverage more federal transportation projects, and fully utilize the APO's $1.95 million STP target, the APO is requested that Stearns County and the City of St. Joseph . provide a forty-six (46) percent local match, or $171,000 for this study. " The Boys and Girls Clubs of Central' Minnesota has conducted programs in St. Joseph since 1986. The KIDSTOP Program at Kennedy Elementary School is a program of the Boys and Girls Club and currently serves over 60 children each day. The Boys and Girls Club has KIDS TOP in all elementary schools of the St. Cloud, Sartell andSauk Rapids School Districts. At Kennedy KIDS TOP children in grades K-6 have the opportunity every week-day after school and all day in the summer months to choose positive activities such as casual and team sports, recreational games, educational and personal development activities, arts and crafts, homework help, · leadership development programs, field trips and much more. Although partial funds for this evening program were provided by the City of S1. Joseph for the first five years of the program, the City was not able to contribute to this program for the 2003-2004 program year. Funds for the program have been raised by the Boys and Girls Club. Currently the Boys and Girls Club has provided information to the City Clerk, Judy Weyrens, responding to her request for the Boys and Girls Club to provide the St. Joseph Summer Recreation Program. " I I After the events of September 11th, some North Carolina businessmen Were contacted by local law enforcement to develop a program, for corporate sponsorship of sponsor- themed government vehicles. This was an attempt to get \, t~e vehicles the department needed, they only had one vehicle for every three Officers. At thattime, George W. BYSh, Prési~ent of the United States of America, made a riquest to promote homeland security. It was obvious that the call had to be answered and thereby the I" program was formed. \ I The new program allows any appropriate sponsor (no alçohol, tobacco, firearms, gaming or any other inappropriate sponsor) to advertise on government vehicles. They contract with Government Acquisitions for advertising and Government Acquisitions donates the fUllY equipped vehicles to the government entities. THe program gives the government entities the vehicles and equipment they need to provide homeland security / . protect and serve in their community without having to ob,tain government funding or raising taxes. M~ny departments are driving vehicles well over 100,000 miles and the vehicles are breakiñg down. Is there a conflict of interest between the government agencies and the sponsors? No. There is not a conflict of interest, because the agency does not contract with and does not receive any money from sponsors. The contracts are with and the funds are paid to Government Acquisitions and Government Acquisitions donates the vehicles to the agency. 2. Will having sponsor recognition on government vehicles somehow bring ridicule to th~ agencies? No. We've spoken with departments that have had local sponsors on their vehicles for years; a local car dealer donates a vehicle and the department gives them sponsor recognition. Remember: one of the automobile manufactures donating vehicles to the New York Fire Department after 9/11. Those vehicles have sponsor recognition and public opinion was extremely favorable. The DARE program dresses-up vehicles for School Resource Officers and the department uses them to protect and. serve our children at school. If you talk to most "working" law enforcement, fire, rescue and other government personnel, they'll tell you that they love the program and so does the general public. If the American free enterprise system can assist the government while building business in our communities, it only makes perfect sense to do so. Everyone agrees, that when you have an emergency situation at home with your family and you dial 911, it is vital that the department has enough vehicles to respond in a timely manner and they don't break down on the way, that the Officer shows up, fully equipped and ready to protect and serve. The least of our concerns is that the vehicle has sponsor recognition. From a sponsor's prospective, they are able to be there for you and your family, by helping to equip the officer to provide public safety. Everyone wins! The program is a way for businesses to obtain brand recognition and point of sale activity while giving back to the public by supporting homeland security, law enforcement, fire, rescue and other government agencies.
