3 (c) The Park Board is requesting authorization to purchase a skateboard ramp for the park. The
insurance carrier has requested that all homemade ramps be removed. Kyle has tried to find
another company to purchase the equipment but has been unsuccessful. The League has
recommended Earl F. Anderson and they can provide the certificates needed. For your
information I have included a copy of the letter written by the insurance adjuster.
6. Noise Violation Hearing: The property located at 121 Ash Street East has a history of noise
complaints. The last noise complaint received was June of 2000. Enclosed is the infonnation
from that noise violation. Last year a reference was made to a prior complaint, that violation
occurred in 1998. In addition to the noise violation, the City has twice had to contact the property
manager since May once for a mattress and the second time for garbage.
7. The City Council has scheduled the public improvement hearing for CR 121 on August 29,2001.
Therefore, the Council will need to resolve the issues presented by Joe at the last meeting. For
your convenience I have enclosed a copy.

. Pursuant to due call and notice thereof, the City Council for the City of St. Joseph met in regular session
on Thursday, June 28, 2001 at 7:00 PM in the St. Joseph City Hall.
Members Present: Mayor Larry Hosch. Councilors Cory Ehlert, Bob Loso, AI Rassier, Kyle Schneider.
Administrator/Clerk Judy Weyrens.
City Representatives Present: City Engineer Joe Bettendorf, Public Works Director Dick Taufen, Police
Chief Gary Will, Fire Chief Dave Theisen

Approve Aqenda: Ehlert made a motion to approve the agenda with the removal of itém(b),
Gambling License Approval, from the consent agenda. The motion was seconded by Loso and
passed unanimously.
Consent Aqenda: Loso questioned the Park Board request to purchase cement picnic tables and pads
and if competitive quotes were received. Schneider stated that the proposal present was the lowest price
and the vendor has donated one picnic table. As the Council did not have written quotes Hosch made a
motion to table item (d) Capital Purchase request for picnic tables and pads, until further
information is available. The motion was seconded by Schneider and passed unanimously.
Rassier made a motion to approve the consent agenda as follows; seconded by Schneider and
passed unanimously.

Gamblinq Premise License - St. Joseph Jaycees: Ehlert made a motion approving the Gambling
Premise License for the St. Joseph Jaycess for the following sites: St. Joe Gas & Bait and Sal's
Bar, The motion was seconded by Schneider.

Public Comments: No one present wished to speak.
2000 Audit. JenniferThienes. KDV: Auditor Jennifer Thienes presented the Council with the 2000 Audit.
She stated the City has received a clear unqualified opinion which is the best opinion possible. Further,
they have reviewed the reporting system and it meets all requirements. However, the City did have two
items that are classified as reportable conditions; 1) The City failed to designate Juran & Moody as an
official depository and 2) The Millstream Culvert Improvement and Business Park Seeding Project
documents failed to include a performance bond.
Theines discussed the following with the City Council:
· Undesignated reserve balance is equal to 6 months of expenditures. In addition, the City has
$ 933,000 in designated reserves.
. · Revenue and expenditures are consistent with prior years
· Budget -vs- actual is within guidelines
· Water fund is beginning to cover depreciation and operating revenues are exceeding
operating expenditures.
· Sewer Fund is not covering operating expenses when depreciation is included. ·
· The City should continue to monitor water and sewer rates striving towards covering
depreciation.
· The City should be working to implement the new accounting rules, GASB 34. To help
facilitate the implementation a committee should be established to make the necessary
decisions.
Debt Manaqement Study - Monte Eastvold: Monte Eastvold presented the Council with a revised debt
management study illustrating each bond issue and status. Eastvold stated all the bonds funds are cash
flowing with the exception of the 1992 East Baker Street Improvement. Weyrens stated the Council has
recently transferred funds from a closed bond fund to help alleviate the shortfall.
Eastvold also presented the Council with proposed bond issue schedules for the following projects:
Northland Phase V Improvements; Sewer Capacity/Conveyance; and County Road 121. In reviewing the
current revenue sources for each bond fund, Eastvold stated it is his opinion that adequate revenue can
be diverted to help finance the proposed issues. The Council agreed to review the information and
schedule a finance meeting to continue the discussion on how to finance the proposed improvements.
City Engineer Reports
Capital Improvement Plan: City Engineer Joe Bettendorf stated he is working on the feasibility report
detailing the proposed improvements for 2002. The report will be submitted to the City Council in August,
followed by a public hearing scheduled for September.
County Road 121: Bettendorf informed the Council he will present a revised feasibility report at the July
28, 2001 Council meeting, with a public hearing to be scheduled for late August. Ehlert questioned ·
Bettendorf if the plans have been finalized with regard to the location of the reconstructed road.
Bettendorf stated the County has finalized a design which includes straightening the curve near the St.
Joseph Township Hall.
Pond View Ridqe Six: The improvements for Pond View Ridge Six have been halted due to the recent
rains. Before bituminous surfacing can be installed the roadbed must pass a compaction test. The
additional moisture content has caused the soils to be less than satisfactory when conducting compaction
tests.
Bettendorf reported that in reviewing the grading plans for individual lots it was determined that the
grading plan submitted to Bettendorf is not the same plan submitted with the preliminary plat; therefore,
building permits could not be issued.
Northland Five: Bettendorf reported that the final estimates have been prepared for the improvements to
Northland Five. Unfortunately, the estimate is $160,000 higher than anticipated. The additional costs are
due to the unanticipated soil conditions. Bettendorf stated he is confident with some plan modifications,
the price can be reduced and requested the Council move the bid date from July 10th to July 16th. By
consensus the Council agree to open bids on July 16, 2001 at 11 :00 AM.
The Park Board has requested the developer construct a fence along the eastern edge of Northland Park
(that portion adjacent to Northland Drive). Bettendorf stated that one of his staff has met with the Park
Board and developer, and all were in agreement on the type and location of the fence. This requirement
should be included in the Developer's Agreement.
All Spec Services, Nancy Scott: Building Official Nancy Scott appeared before the Council to further
discuss the need to implement the State of Minnesota Mechanical and Plumbing Code. The
implementation of the code is for fire safety reasons and to ensure appliances/fireplaces/gas devices are ·
installed properly with adequate venting. Scott introduced Roger Scheeler to the Council and stated that
upon the implementation of the Mechanical and Plumbing Code, Scheeler will be the enforcing Official for
the City. Scheeler stated that implementing the Mechanical and Plumbing Code creates uniformity
. between all cities and assures that contractors are building/remodeling homes responsibly, assuring that
life and safety measure are met.
Ehlert questioned the effect of the proposed Ordinance for the installation water softeners and other
appliances. Scott responded that a minimal fee would be collected and they would be inspected. Some'
cities have excluded appliances based on a certain minimum value. That value can range from $ 500 to
$ 3000. Ehlert questioned the effectiveness of the proposed amendment and if it can be enforced. Scott
responded that she has not encountered problems in the other jurisdictions she serves.
Rassier stated that he is not supportive of requiring a permit for all mechanical and plumbing and
encouraged the Council to set a minimum value for which a permit would be required. Therefore,
replacement of appliances such as stoves, dryers and water softeners would not require a permit.
Rassier made a motion authorizing the City Engineèr to draft a proposed Ordinance adopting the
State of Minnesota Mechanical and Plumbing Code and require permitting for such. Further, a
permit would not be necessary unless the improvement/device exceeded $ 2,000. The effective
date of the amendment would be January 2002, allowing Scott adequate time to inform
contractors. The motion was seconded by Hosch and passed unanimously.
Lot Split Request, Renee Zirbes. Renee Zirbes, part owner of the property located at 119 - 3rd Avenue
SE appeared before the Council to request a lot split. Zirbes stated that the property in question contains
approximately 23,000 square feet, but is listed as one parcel. The property is currently used as a group
home and she is requesting authorization to split the property to construct an additional home. Zirbes
reported that the proposed lot split would leave each lot with the minimum lot required, 11,000 square
feet. Weyrens stated that the construction of an additional group home would require a variance, as the
. current Ordinance requires 1000 square feet between facilities. The variance would require a public
hearing which would be held before the Planning Commission.
Loso made a motion to approve the lot split as requested, with the following contingencies:
1. The property owner will submit a certified survey for recording purposes.
2. After the property is split, each parcel must meet the minimum lot size
requirements as stated in the St. Joseph Code of Ordinances.
3. Approving the lot split does not imply that a variance for the second group home is
approved.
The motion was seconded by Schneider and passed unanimously.
Surplus Property, 21 - 1st Avenue NW: EDA Member Mike Deutz appeared before the Council to request
the City retain the property located at 21 - 1st Avenue NW. Deutz stated it was his understanding that the
property was not habitable and questioned why the City is selling a building that they themselves could
not continue to use. He further stated that the EDA Board has recommended the City retain the property
for the following reasons: 1) The property tax gained form the sale to a private individual is insignificant;
2) It is very difficult and expensive for cities to obtain property; 3) Location of the property may be crucial
for any expansion of the water treatment plant; 4) Location of the property is appropriate to alleviate the
parking problem for the downtown area; and 5) Possible sale to a local business to assist with their
expansion.
Hosch stated that he had mixed feelings regarding the sale of the property, but feels it is in the best
interest of the City to sell the property. The proceeds used from the sale of the property could be used to
offset the levy for the new City Hall. Further, Hosch stated that selling the building will not only provide
taxable property to the City, but also allow a business to expand.
. Ehlert stated that the City has a serious parking problem downtown. It was his hope that the old City
Office would be replaced with a parking lot to help alleviate this problem. Ehlert also noted that the
Comprehensive Plan states that there is not adequate parking downtown. Ehlert questioned if the
parking lot for the new City facility could be reconfigured to allow for a municipal parking lot, and ·
encouraged the Council to designate a portion of the land proceeds for such.
Schneider made a motion to accept the high bid of $ 73,000 plus the buyer's premium, for the sale
of the City property located at 21 _1st Avenue NW. The motion was seconded by Hosch.
Ehlert again requested the Council dedicate a portion of the proceeds to be used to help resolve
the downtown parking problems. By doing this the Council would be sending a message that the
City is serious about developing the downtown area.
Ehlert made a motion to amend the previous motion to include dedicating $ 15,000 of the
property sale proceeds to be used to address parking issues in the downtown area. The
amendment was seconded by Schneider.

FIRE CHIEF REPORTS
December 1 , 2000 to Mav 1 , 2001 Fire Report: Fire Chief Dave Theisen presented the Council with the
semi-annual fire report. During the six month period, the department responded to 146 calls, which is
down by 19 calls from the prior period. The following is a breakdown of fire calls by jurisdiction: 1) St.
Joseph Township - 53; 2) St. Wendel Township - 19; and 3) City of St. Joseph - 67.
Ehlert questioned if the department has a mechanism to charge for fire/medical calls. Theisen reported ·
that this is discussed each year and it has yet to be resolved on the State level.
Loso made a motion accepting the six month fire report as presented and authorizing the
expenditure of $ 19,635.00 for the payment of such services. The motion was seconded by
Rassier and passed unanimously.
GamblinQ License Request: Theisen stated the annual fund raiser is scheduled for August 17, 2001 at
the EI Paso. The department is requesting acceptance of an application for exemption from lawful
gambling. Ehlert made a motion to accept the Exemption from Lawful Gambling application from
the S1. Joseph Volunteer Fire Department for an event to be held on August 17, 2001 at the EI
Paso Club and Lanes. The motion was seconded by Hosch and passed unanimously.
PUBLIC WORKS DIRECTOR REPORTS
Truck Purchase: Public Works Director Dick Taufen appeared before the Council to request authorization
to trade the 1971 Ford 1 ~ ton truck for a 1981 GMC. Bill Wasner has agreed to trade in the old truck
and sell the new truck for $ 6,000. The trade in value was estimated at $ 1,000.00. Taufen reported the
1981 GMC is in good condition and the City has been renting the truck during snow season. Loso made
a motion authorizing the purchase of a 1981 GMC 1 % ton truck from Bill Wasner Sales and
Service in the amount of $ 6,000, trading in the City's 1971 Ford. The motion was seconded by
Schneider and passed unanimously.

Affordable HousinQ: The Affordable Housing Committee will be meeting on July 16, 2001 at the Waite
Park City Hall. The main focus will be exploring how to include rehabilitation of older homes in the
affordable housing plan. Rassier requested authorization to attend the meeting on behalf of the City, the ·
Council concurred.

July Meetinç¡ Schedule: Weyrens clarified that the regular Council meeting for July 5th has been
cancelled, with the next meeting scheduled on July 19, 2001. Council meetings will resume the regular
schedule in August.
Certificate of Compliance - 12'h Avenue SE: Weyrens reported that she has been contacted by
developer Bob Herges regarding the lot sale on the corner of 12th Ave SE and Minnesota Street E.
When the closing documents were prepared for this property, it was discovered that their was a gap of
property between 12'h Avenue SE and the property line. This gap was created after the design for 12'h
Avenue was altered, curving the road for development purposes. Since the City does not need the
property, nor does it have any value, as the property is miniscule. Bob Herges is requesting the City Quit
. Claim Deed the property to the property owner on 12'h Avenue SE and Minnesota Street. Ehlert made a
motion authorizing the City Attorney to draft the necessary paperwork to Quit Claim Deed the
property in question to the property owner at 12th and Minnesota Street. The motion was
seconded by Schneider and passed unanimously.
Transportation Planninç¡: Weyrens discussed the need for the City Council and Planning Commission to
review the Transportation Plan. The City has been receiving inquiries for development on the SE section
of the City and it should be determined where transportation corridors should be preserved. Weyrens
suggested a joint meeting between the City Council and Planning Commission facilitated by Bill Hansen
from the St. Cloud Area Planning commission and City Engineer Joe Bettendorf. Loso made a motion
to schedule a joint meeting between the City Council and Planning Commission on August 1st or
August 8th with the Planning Commission to discuss future transportation planning with Bill
Hansen and Joe Bettendorf. The motion was seconded by Schneider and passed unanimously.
Assessor Request for Rate Increase: Weyrens stated that she has received a request from City Assessor
Ollie Lesnick to increase his wage from $ 8.68 per parcel to $ 10.00. The request from Lesnick clarifies
that the rate was last adjusted in 1992. Hosch requested the matter be tabled until further information
can be provided to the Council regarding area wages for assessors. While Hosch stated he is not
opposed to the increase he feels it is the responsibility of the City to verify the market rate for assessors.
Ehlert made a motion to table further discussion on the proposed wage increase for the City
Assessor until July 21, 2001 when area wage rates will be available to the City Council. The
motion was seconded by Hosch and passed unanimously.
City Hall Roof Repairs: Weyrens presented the Council with two quotes to repair the roof on City Hall,
they are as follows:
Horizon roofing $ 2,580.00

Hosch stated that the materials are not comparable, thus causing a greater price difference. The higher ·
quality material would provide a longer life expectancy. Rassier stated that if the roof is in need of
replacement, then the lower bid is the best alternative for the City.
Ehlert made a motion to accept the low price of $ 2,580 from Horizon Roofing to make the
necessary repairs on the City Hall Building. The motion was seconded by Loso and passed
unanimously.

Noise Violation. 115 - 6th Avenue SE. Dan Schmitz: Mayor Hosch stated that the Council has received
notice of an alleged noise violation at 115 - 6th Avenue SE on May 19, 2001. Since the property owner
has not requested an evidentiary hearing, the property owner is acknowledging that a noise violation did
occur. Therefore, Hosch stated the Council will move to the disposition stage and asked the property
owner for any comments he may have.
Dan Schmitz stated the property in question is a duplex with one side rented to a family and the other
side to students. On the evening in question he drove by the property at 6:00 PM and there was nothing
happening, by 11 :00 PM the police had been called. Schmitz stated that he has owned the property for
12 years and in that time has received only one complaint. Schmitz also stated that the property in
violation will be rented to a family next year.
Loso stated that the police report indicated the tenants were cooperative and were cited for the criminal
offense of the noise violation. In his opinion, Loso believed this incident should have been handled as a
. warning.
Rassier made a motion acknowledging that a noise violation did occur at 115 - 6th Avenue SE on
May 19, 2001. Further, the property owner will be fined the administrative fees of $ 150.00. The
motion was seconded by Schneider and passed unanimously.
Approve AQenda: Hosch made a motion to approve the agenda with the removal of item (f) 2001 -
2002 Liquor License from the consent agenda. The motion was seconded by Ehlert and passed
unanimously.

All Spec Services. Nancy Scott: Building Official Nancy Scott appeared before the Council to present the
15t quarter building activity report. Scott stated that she has been working for the City for 3 months and
would like to address the following concerns:
1. Mechanical and Plumbing Code: The City of St. Joseph is one of the few jurisdictions
that does not enforce the Minnesota State Mechanical and Plumbing Code. The
enforcement of the code is meant as a safety measure to assure gas appliances, fixtures
and plumbing are installed correctly.
2. Energy Code: The State of Minnesota has changed the State Building Code requiring
building permits for roofing and siding. Scott stated that she would charge a nominal fee
for such permits and would work with residents doing the work on weekends. Ehlert
stated that he does not wish to stop residents from working on weekends or fear getting
ticketed on weekends because a permit was not secured. Scott assured the Council that
permits could be secured after the weekend and the inspection could be completed at the
same time.
3. Rental Housing Inspections: Scott stated that she attended the meeting conducted by ·
the Rental Housing Inspector and has some concerns. Scott requested clarification as to
who is the Housing Compliance Official; and if it is Rental Housing Inspector Steve
Hagmann, is he responsible to Scott. Hosch and Ehlert stated that it is their
understanding that Hagmann is the Housing Compliance Officer and consults the
Building Official as needed.
Noise Violation. 310 Old Hiçhway 52 - Brian Stançl: Mayor Hosch stated that the Council has received
notice of an alleged noise violation at 310 Old Highway 52 on May 19, 2001. Since the property owner
has not requested an evidentiary hearing, the property owner is acknowledging that a noise violation did
occur. Therefore, Hosch stated the Council will move to the disposition stage and asked the property
owner for any comments he may have.
Stangl stated that he has recently purchased the property at Old Highway 52 and this process is new to
him. The students involved in the incident on May 19 have moved and were not available to be present a
this meeting. Stangl further stated that the first notice he received was a certified letter. He was told that
they could not find his phone number, but they were able to contact him earlier in the day. City Attorney
John Scherer questioned if his lease includes party provisions and loss of damage deposit. Stangl stated
that the lease does not have any provisions for parties and the damage deposit has already been
retained for repairs to the unit.
Ehlert made a motion acknowledging that a noise violation did occur at 310 Old Highway 52 on
May 19, 2001. Further, the property owner will be fined the administrative fees of $ 150.00. The
motion was seconded by Schneider and passed unanimously.
Public Comments: No one present wished to speak
Linda Sniezek, Rental License Request: Linda Sniezek appeared before the Council to request ·
authorization to rent her parents property located at 213 Ash Street East. The Ordinance Amendment in
. September 2000 revised the Ordinance allowing only owner occupied rentarunits in an R-1, single family
zoning district. In February 2000 the City imposed a rental license moratorium to study Fental districts.
During this time Sniezek requested the Council grant a special permit to allow the property at 213 Ash
Street East to be used as a rental unit. Sniezek agreed to adhere to the new policy after the moratorium
was lifted. In December of 2000 Sniezek requested relief from the new Ordinance due to a medical
condition of her tenant. The Council granted relief with the understanding that the special permit expired
in May of 2001.
Sniezek is currently requesting relief from the Ordinance to prevent a financial hardship if the property is
sold, and presented the Council with a letter from her attorney advising her family not to sell the home.
The home has been rented to a family since March of 2000 and the tenants have become members of
the community. Sniezek stated it is her opinion that the Council wanted to encourage families to move to
St. Joseph rather than leave homes unoccupied. She further stated the amended Ordinance may force
elderly residents to sell their homes.
Sniezek's tenant, Cari Habiger approached the Council and requested that the rental license be
continued at 213 Ash Street East. She stated that she has been living in the home since March of 2000
and has chosen to make St. Joseph her home. Habiger stated that it was difficult finding rental housing in
St. Joseph and if the Council does not allow the rental license to continue, she will not be able to live in
St. Joseph.
Loso stated that the Council ruled on this matter in December, allowing the rental license to continue until
May of 2001. Loso clarified that when the original permit was granted, it was understood that it was a
special permit until the moratorium period concluded. Further, Sniezek agreed to abide by the
recommendations of the committee if the special license were extended. Loso stated that in his opinion
the Council was upfront with Sniezek and she agreed to these terms. Therefore, he does not feel any
. relief should be granted, as in doing so the Ordinance will loose integrity.
Roxanne Habiger approached the Council and questioned why the Council does not want to encourage
family rental. Attorney John Scherer stated that St. Joseph has been trying to deal with managing the
rental units within residential neighborhoods. Residents have requested the Council take action to stop
the conversion of homes to student rentals and keep the neighborhoods in-tact. Rental units in
residential areas lead to a majority of problems such as noise, garbage, and lack of adequate lawn care.
The purpose of the new ordinance is to stop or slow down the proliferation of rental units in an R-1, Single
family zoning district. Scherer further clarified that the Council cannot make a provision for family rental
as then it would become discriminatory.
Ehelrt stated that it is his understanding that the purpose of the new Ordinance was to preserve the older
housing stock for single family use. It is his opinion that the request at this time meets the intent of the
Ordinance. The rental unit is being occupied by a family who is a part of the community of St. Joseph.
Ehlert further stated that he feels this property was caught in the middle of the process and the use
should be allowed to continue.
Rassier stated that it is his opinion that the Council should give the Ordinance a chance and granting the
special permit at this time overrides the new Ordinance. Rassier questioned Scherer as to the legalities
of issuing such a permit. Scherer responded that he is uncertain as to how the initial permit was granted,
but instructed the Council to be cautious when considering this matter.
Hosch stated that he too beliefs the property in question was caught in the middle of the Ordinance
change and has some inherent rights. Denying the permit at this time could create a hardship. Hosch
further stated that if the initial request was not made during the moratorium period he would not be
supportive of allowing a rental permit.
. Schneider concurred with Sniezek that an empty house is not an asset to a neighborhood. If the property
remains vacant it begins to look rundown and will become unsightly. Therefore, he feels the best use for
the property in qùestion is to continue as a rental unit.
Ehlert made a motion to extend a Special Rental License to the property at 213 Ash Street East. ·
The license may be renewed annually with the following understanding:
The rental license will cease 120 days after the death of Rose Viehauser, or upon Cari
Habiger moving from the property; which ever comes first. The motion was seconded by
Schneider.

Rental Housinq Inspector, Steve Haqmann: Rental Housing Inspector Steve Hagmann appeared before
the Council to discuss the license process for 2001 - 2002. Hagmann stated that he met with a number
of landlords and discussed the process that will be used for securing a rental license. He stated that this
year licenses will not be issued until all fire safety issues are resolved and completed paperwork and fees
are submitted. Hagmann also stated that all lower level bedrooms will be required to install egress
windows. The landlords present at the meeting requested one year to complete the egress windows as it
is a costly item. Scherer clarified that any extension of fire safety issues should be acknowledged on the
rental registration form along with a deadline for completion. Further, a second inspection should be
conducted to assure that repairs have been completed.
Hagmann stated he would like the Council to change the rental license period to begin October 1 st of.
each year. He stated that changing the date would allow rental inspections to be completed when they
are occupied, thus allowing him to check traffic patterns and occupancy. In addition, he would have the
opportunity to talk to the tenants if they have any issues.
Ehlert stated that he would like to see fire safety issues completed within a time frame such as 90 days.
The landlords are aware they need egress windows for lower level living and they should be installed in a ·
timely manner. He further questioned the logistics of completing the inspections during the school year
as many of the rentals in St. Joseph are student rentals, thereby largely being unoccupied during the
summer months. The vacancy period allows repairs to be completed without disturbing tenants. Ehlert
questioned if the landlords provided any input on the license period. Hagmann stated that the landlords
present requested the rental license period remain as it is currently.
Loso stated that changing the rental license period would have a negative impact to the Noise Ordinance.
Currently any violation of the Noise Ordinance stays with the property during the license period, from
August 15 to August 14. This period also coincides with the school year, making the tenants responsible
for the full 12 month period. If the rental license period is changed, two different groups of tenants may
be impacted by violations.
Hosch stated that it is his preference to keep the rental license period as it is written. He has received
feedback from landlords that it would be difficult to complete major repairs while the rental until is
occupied. Schneider concurred with Hosch.
Rassier stated that as a former rental inspector he would argue that the inspections are easier to
complete without all the tenants present. Some of the major repairs could not be completed while
occupied, and it would be difficult to remove the tenants if the inspections were completed in September
and October.
Loso made a motion denying the request of the Rental Housing Inspector leaving the license
period as stated in Ordinance No. 55. The motion was seconded by Schneider and passed
unanimously.
CITY ENGINEER REPORTS
Capital Improvement Plan: City Engineer Joe Bettendorf presented the Council with the Capital ·
Improvement Plan. The plan includes street maintenance and reconstruction, purchase of additional
. parkland, construction of a maintenance facility, purchase of additional sewer conveyance/capacity, lift
station repairs, and water improvements. The Council needs to review and prioritize the proposed
improvements/ needs. However, Bettendorf noted the additional sewer conveyance/capacity and
reconstruction of the Baker Street Lift station is a priority.
Bettendorf stated the Council should also begin planning for an additional water tower and well field. As .
the City grows this will become a priority issue, and long range planning could prove cost effective when
purchasing additional land.
Rassier questioned if water and sewer lines are replaced when a road is reconstructed; and if so who
pays for the replacement. Bettendorf stated that some of the street projects include pipe replacement as
they are over 30 years old. The proposed plan indicates the property owner will be assessed a portion of
the cost. At the present time the City has adopted a policy assessing property owner 60% of the road
cost and water/sewer replacement.
Councilors discussed with Bettendorf the number of elderly residents that would be affected by the
improvements. Bettendorf stated the City could investigate providing for deferred assessments for
seniors and hardship situations. Weyrens stated the City currently has a provision for deferral and she
will conduct further research before a public hearing is conducted.
The Council agreed to conduct a special meeting on June 13, 2001 at 1 :00 PM to review and prioritize the
Capital Improvement Plan prepared by Bettendorf.
County Road 121/ Colleç¡e Avenue South: Bettendorf stated that he is still reviewing the plans for the
reconstruction of County Road 121. The Council will need to determine the financial impact of the project
and how the project will be financed. At this time it does not appear that any road work will be completed
. in 2001 . It is the intent of the County to prepare all the documents and bid the project for a spring 2002
start date. The Council agreed to discuss this matter in special session on June 13.
Northland Phase V: Bettendorf reported that the feasibility report has been completed for Northland
Phase V and the developer is requesting to move forward with the solicitation of bids. Therefore, Loso
made a motion to adopt the following resolution approving the plans and specifications and
ordering advertisement for bids for the improvements to Northland V. The motion was seconded
by Rassier and passed unanimously.
Resolution Approving Plans and Specifications and Ordering Advertisement for Bids
WHEREAS, pursuant to a resolution passed by the Council on May 15, 2001, the City Engineer, Joe
Bettendorf of SEH, has prepared plans and specifications for the improvement of street and utilities for
the development of Northland Phase V and has presented such plans and specifications to the council for
approval;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ST. JOSEPH MINNESOTA:
1. Such plans and specifications, a copy of which is hereto and made a part hereof, are
hereby approved.
2. The City Clerk shall prepare and cause to be inserted in the official paper an
advertisement for bids upon the making of such improvement under such approved plans
and specifications. The advertisement shall be published and specify the work to be
done, shall state that bids will be opened and that the responsibility of the bidders will be
considered by the Council at 7:30 PM on July 19, 2001 in the Council Chambers of the
City Hall, 25 College Avenue North. Any Bidder whose responsibility is questioned
. during consideration of the bid will be given an opportunity to address the Council on the
issue of responsibility. No bids will be considered unless sealed and filed with thé City
Clerk and accompanied by a cash deposit, cashier's check, bid bond or certified check e
payable to the City of St. Joseph for 5% of the amount of such bid.
Northland Phase V, Final Plat: The Council reviewed the final plat for Northland Phase V. Scherer
advised the Council to include drainage easements on the eastern lots rather than provide for outlots.
The City incurs maintenance costs if outlots are platted and ownership becomes an issue. Scherer
further recommended that the easements include egress/ingress rights. Bettendorf questioned if the
drainage areas will be required to be fenced. The Council agreed to include language that would allow
fencing if liability became an issue.
Rassier made a motion to approve the final plat of Northland Phase V with the following
contingencies:
1. The plat be revised to include easements in the drainage areas. The easement
should provide for drainage and access. Further, it will be the responsibility of the
owner to record the easements.

Northland Phase V, Developers Aqreement: Rassier made a motion authorizing the City
Administrator/Clerk and Mayor to execute the Developer's Agreement for Northland Phase V with
the following additions:
1. Inclusion of the easements as stated above.
2. The developer will stake and delineate wetlands.
3. Fencing will be provided around Northland Park as requested by the Park Board. .
The motion was seconded by Rassier and passed unanimously.
St. Wendel Sewer Expansion: Scherer reported that at a recent Department Head meeting extension of
sewer service to St. Wendel Township was discussed. He presented an idea whereby St. Wendel
Township would install the infrastructure and then contract with the City for services until the property is
annexed. This method would limit the exposure to the City and place the financial burden on St. Wendel
Township. Scherer stated he presented his idea to the City of St. Cloud and they have initially agreed to
consider the matter. The Council agreed to present this information to St. Wendel Township on June
26, 2001 at 6:30 PM at the St. Wendel Township Hall.

Racial Profilinq: Police Chief Gary Will, Jr. reported that the legislature has passed a bill requiring all
cities adopt a policy and train employees in matters concerned with racial profiling. The bill has become
effective July 1, 2001. The training will be paid by the State of Minnesota with the only cost to the City
being travel time. The bill also provides for data collection and will fund those efforts. Will stated that he
will update the Council as more information is available.
Car Detailinq: Ehlert questioned when the 2001 squad will arrive and if the detailing will be the same as
the previous car received. Will reported that all the officers with the exception of one requested new
graphics for the new squad cars. The officers in the department did not have consensus for the design
chosen, but of those with an opinion, the graphic of choice was detailed on the new squad car. Ehlert
requested that before the graphics on placed on the second car some discussion takes place as to what
the City is looking for in graphics. Will agreed to bring the matter back to the Council for consideration.

. PUBLIC WORKS
Bleacher Safety: Public Works Director Dick Taufen reported that he and the Building Official have
inspected all the bleachers for compliance with safety regulations. The Recreation Association has
already repaired the bleachers in Millstream Park to comply with safety requirements. However, the
bleachers at Memorial Park are in need of repair. The approximate cost to fulfill the safety requirements
is $ 1,000 and as this is a safety measure the parts have already been ordered. Ehlert stated that he
would contact the Lions to see if they would assist with funding.
Seasonal Maintenance Workers: Taufen reported that the City accepted and reviewed applications for
temporary maintenance workers. The following individuals were hired to work until August 31,2001:
Erik Schultz, Kyle Kane, Eric Theisen.
MA VOR REPORTS
Affordable Housinq: Hosch requested the Council discuss the proposed Affordable Housing Ordinance
and provide input for the committee. Loso stated it is his opinion that the City has enough affordable
housing and should not participate with the area cities. Ehlert stated that he has concern with the
mandatory requirement that all housing developments contain 15% of affordable housing lots. He further
stated that St. Joseph has affordable housing and believes each City should be rated on their own merit.
The Council reviewed the recommendations of the Planning Commission. Hosch stated that he too has
concern on the mandatory plat requirement and the make-up of the board governing the area of
affordable housing. Rassier stated the Council spent considerable time discussing the matter and
recommended the City respond to the task force with the concerns of St. Joseph.
. Ehlert made a motion authorizing the Mayor to forward the following recommendations regarding
affordable housing to the task force:
a. Clarify the financial analysis of the administrative and program costs
b. Define the members of the "five city panel"
c. Review the cost of city personnel
d. Review the provision of "cash in lieu of construction"
e. Review the provision of mandating every new development to include affordable
housing
f. Consider integration of affordable homes with market rate homes
g. Consider reducing home re-sale clause from 10 years to 5 years
h. Consider implementing a review procedure for all the cities, such as a "scorecard
or tally" that will show the progress of each City with regard to affordable housing.
The motion was seconded by Loso and passed unanimously.
Joint Planninq District: Hosch reported that the Area Joint Planning Committee has re-organized and will
be meeting four times throughout the year. The Committee is comprised of the area Mayors and
Administrators with DeWayne Merrick chairing the Committee.

Park Board: Schneider reported the Fark Board has met with a representative of the League Insurance
Company regarding liability at the skme park, and will continue to review options for operating the park

ADMINISTRATOR /CLERK REPORTS
LELS Contract: Weyrens reported that she has been contacted by the Union Representative for the
Police Union. The current contract expires December 31, 2001 and they are requesting to begin
negotiations at this time. The Council agreed to negotiate the contract as an entire Council and will meet
with the LELS representative on July '11, 2001 at 5:00 PM. After receiving the proposal the Council may
consider establishing a sub committee for purpose of negotiation.
Comprehensive Plan: Weyrens requested authorization to solicit funding for updating of the
Comprehensive Plan. Ehlert made a motion authorizing Weyrens to seek funding to assist the City
with the updating and review of the Comprehensive Plan. The motion was seconded by Hosch
and passed unanimously.
City Office Facility - Roof Repair Estimates: Weyrens reported that she has received two quotes on
repairing the roof. One company has submitted a written quote in the amount of $ 4,000. The second
company submitted a verbal quote at approximately $ 2,000. The Council requested Weyrens secure .
both quotes in writing and submit them to the Council at the next meeting.

Dear Mr. Taufen,
A r~quested loss control survey was recently conducted concerning the above referenced location
for the city of St. Joseph. This was in conjunction with the city's participation in the League of
Minnesota Cities Insurance Trust (LMCrr) property, liability and workers' compensation program.
. The purpose of my visit was to assist the city in the reduction of potential loss through loss control
and risk management activities.
As you requested, I am planning to attend the city of St. Joseph's Park Board meeting on Monday,
May 21, for the purpose of presenting loss control advice on skate parks. Please let me know where
the meeting will be held and how long you would like me to speak on the subject.
As a result of my loss control survey, I have several loss control recommendations which can assist
the city in minimizing the potential for loss.
1-5/01 Post Safety Rules
Written safety rules should be developed and posted for the skate park. The rules sign should
include the rink's hours of operations, required safety equipment such as protective headgear,
kneepads, etc. and any prohibited acti vities.
Some cities have used signs with a positive spin such as "For Your Safety". The sign should
be written in large bold letters with a contrasting background and posted at all entrances of
the facility.
2-5/01 Prohibit Homemade Equipment
The city should prohibit users of the facility from bringing in any homemade equipment such
-- as ramps and lor jumps. The city could ultimately be held liable for any design defects in
-- such equipment.

Commercially manufactured skate park equipment should be purchased from a reputable
manufacturer of such equipment. The city will then have some recourse if there is a potential
product liability claim against the city.
3-5/01 Conduct Documented Inspections
The city should conduct periodic documented inspections of the Skate Park to assure that the
park remains in good condition. Inspection items should include signage, surfacing and all
skate park equipment. Regular inspection and maintenance activity will help to display that
the city is doing a reasonable job of safely maintaining the facility.
The long-term benefits and successes that can be enjoyed by a cooperative, self-insurance
organization depend upon serious and careful consideration of loss control recommendations. In that
context, we ask that you keep us informed of the steps you take to address this loss control
recommendation. Therefore, please respond within 60 days of your receipt of this letter regarding
the status of how you intend to respond to this loss control recommendation. ·

I would like to send Pete to the Intoxilyzer School when a spot is available at the BCA. Cost
for the class is $200 plus weeks lodging in St. Paul. Classes fill fast so the actual date he
would go is uncertain at this time. The next available date is October 15-19, 2001 followed
. by November 26-30, December 10-14, January 14-18,2002 and February 4-8,2002.
We have $735 in the DWI forfeiture/civil penalty account that can be used only for DWI
enforcement, training and related equipment. We will be receiving another $800 in the near
future to that account as well.
I would request that the money come from that fund.

Alan Rassier proposed suspension or revocation of the rental license for the above referenced
property. This action is being taken because of an alleged violation of Ordinance
No. 102 of the St. Joseph Code of Ordinances. This violation is alleged to have
arisen out of an incident on July 14, 2001 (copy enclosed) .
. The St. Joseph City Council will review these allegations and consider appropriate
action, including a suspension or revocation of your rental license, for up to a period
of twelve months. The meeting will be conducted on Thursday, August 2, 2001 at
8:00 p.m. in the St. Joseph City Hall, 25 - College Avenue North.
At that time you are entitled to a hearing to be conducted in accordance with
Minnesota Statutes 14.57 to 14.70. This hearing will be for the purpose of
determining whether or not the alleged violation did in fact occur. At that hearing.
you have the right to cross examine witnesses and present evidence on your
behalf. The proceedings will be video recorded. Based upon the evidence
presented, the Council will then make a determination as to whether or not the
alleged violation did in fact occur.
If you wish to have an evidentiary hearing of this type, you must contact the City
Clerk/Administrator in writing at least seven days prior to the scheduled Council
meeting. If a request for hearing is not received by the City Clerk/Administrator at
least seven days before the hearing, you will then be considered to have waived
your right to have an evidentiary hearing and no evidentiary hearing will be
scheduled. A waiver of this right to hearing will be equivalent to an admission of the
basic allegation (s) alleged herein and reported by the complaining party.
If you waive your right to hearing, or if an evidentiary hearing is conducted and the
Council determines that a violation did occur, then and in those events. the Council
. will proceed immediately to consider a disposition, which may include

OFFENSE: Noise complaint
At approximately 0028 hours, Saturday, July 14, 2001, myself and Officer Pete Janssen
were dispatched to a loud party complaint at 121 East Ash Street, St. Joseph, MN 56374,
in Steams County. The dispatcher advised that it is an anonymous complaint as the caller
was afraid to leave their name.
At that time I was in front of212 E. Ash St. with two females who had just left that party.
From my location I could hear loud music and loud voices coming from the area of 121
E. Ash. Officer Janssen and I arrived in front of the house, and from the roadway we
could hear the very loud music and loud voices. We could see many people inside
through an open curtain in the front window. We could also see shadows of people
moving around on the second floor. There were a few people who were leaving the
house and walking down the street, but they were not making any noise. .
Vi e went to the front door to talk to a renter, but no one would answer the door. We then
went to the east side door. There were no lights on outside and it was quite dark causing
us to use our flashlights. There were about five or six people at the east side door with
plastic beer cups. I asked if any of them were renters here. They all said that they did not
live here. I then asked them for LD.'s and a couple of people walked away. Officer
Janssen stayed at the door while I followed them and checked on several people in the
back yard. I then went back to the east door. Everyone except two males who were still
by the door went inside the house and closed the door. Officer Janssen knocked on the
door and asked for a renter several times but no one would answer. I could see several
people through the window near our position. They were looking out the window at us,
so I asked them to open the door and get a renter. One of the males who stayed outside
volunteered to go inside and find them. He said he thought there were two renters here.
Officer Janssen then went to his squad car to telephone Chief Will to advise him of the
situation of uncooperative party attendees. I also advised him to request back-up, since
we may have to get a search warrant for the residence. At approximately 0045 hours a
male came out of the house and said that he is a renter. I advised him of the noise
complaint and I asked him for his LD. He gave me his Minnesota driver license which
identified him as Andrew Carl Walz, 05-05-1981. At that time Officer Janssen came up
to us and said someone had told him that Blake Edward Elliott, 02-19-1981, also a renter,
is inside the house. Officer Janssen told him the party is over, everyone would have to
leave, and to go inside and find Elliott. Walz came outside and stood for a few minutes. .
During all this time we could hear many people inside the house talking and yelling, but
the music had been turned down. Walz then went back inside the house.

. Waite Park Police Officers Tom Jensen and Katie Wedel then arrived to assist us. Walz
came outside after another ten minutes and said that he still couldn't find Elliott.
Someone outside by the steps said that Elliott is in the house. Walz said he would go
inside and find him. Thereafter Walz came out with a male who identified himself as
Elliott. He said that he doesn't have his I.D. with him, and Officer Janssen identified him
from a previous contact with him.
We told them that the party is over and everyone would have to leave. They went back
inside and closed the door again. A few people came outside, were I.D.' d and then left.
In all twelve citations were issued for underage consuming (see ICR's). After about
twenty people came out Walz and Elliott came out and said they couldn't find anyone
else. Officer Janssen and I were then given permission by them to accompany them into
the house to make sure everyone was gone. In the basement several windows were open
and the curtains were pushed outward as if people had crawled out through the windows.
We found a door that was locked from the inside. While Officer Janssen stayed with
them at the door, I went outside to see if there was a way into the room. I found a
window into the room, which was open and the curtains were also pushed outward as if
people had crawled out. I then looked in the room and no one was inside. While I was
outside I checked the other windows on the north and west side of the house. I saw that
an upstairs dormer window was open. Next to the dormer, hanging onto the overhang,
. was a male. I told him to get back inside the house. He stated that he didn't want to. I
told him that either he could come down or I would call the fire department to get him
down. He then complied and went into the house, Officer Janssen then went upstairs
with Walz and Elliott and found several more people hiding in a bedroom and an attic
area.
After the house was cleared I brought Walz and Elliott to my squad car. I issued Walz a
citation for the crime of noise ordinance violation. I cited Elliott for underage
consuming, Walz had not been consuming. I told them that the manager Tim Borresch
would be notified of the civil noise violation. We then left the scene.
Officer Janssen and I went to to the Police office at that time to call the rental manager,
Tim Borresch. Officer Janssen advised Borresch of the civil noise violation and to expect
a notice in the mail from the St. Joseph City Office.

PRELIMINARY PARAGRAPH:
0 On 06/25/00 at approximately 0310 hours Officer Jean Gustin and I were dispatched to a loud
noise complaint at 121 E Ash St and found the residence in violation of city ordinance.
OFFICER OBSERV A TION/ ACTION:
0 Dispatch advised us that they did get the name of the complainant, however they wished to
remain anonymous.
0 After being dispatched to the call, Officer Gustin responded to the north side (back) of the
residence and as I came in on 3rt! Ave NE from Minnesota Ave.
0 As I turned on to 3rd Ave NE from Minnesota (heard someone yell from the area we we¡e
. responding to.
0 As I was pulling up to the residence I noted that there were still lights on inside the house.
0 This allowed me to see several people inside the residence.

OFFICER OBSERV A TION/ ACTION: .
0 I noticed that some of the individuals inside the residence were holding plastic beer cups
filled with a brown/tan liquid.
0 I also noticed several people on the eastside of the residence standing on the steps.
0 These individuals were also holding plastic beer cups.
0 As I was standing on Ash St in front of the residence I could hear the people standing on the
east steps talking very loudly and yelling at times.
0 I estimate the total number of people present at the residence to be from 15-20.
0 As I then walked through the front yard the front door of the residence opened.
0 When the door was open, I could hear a loud music coming from living room area.
0 I then walked to the eastside of the residence and met with Officer Gustin who had walked
from the back.
0 Officer Gustin told me that she could also hear the loud voices well off the property.
0 I then asked the group standing on the steps to get someone who rents the house.
0 Two males came forward and stated they were staying at the house.
0 I identified the two by drivers license as Christopher Cyril Ducharme OS/22/78 and
Anthony David Zimney 06/19/78.
0 I informed the two that they were in violation of the city's noise ordinance and that they
would have to clear the party out.
0 As Officer Gustin and I were talking to Ducharme and Zimney, I noticed that most of the
people present at the party went into the house and shut off the lights.
0 After speaking with Zimney and Ducharme it was unclear to me if they actually currently
lived at the residence because they advised me that they were on the lease but not currently
living at the house. .
0 I then told them to get any other people out of the house that currently lived there.
0 Two more males claimed to be living at the house but not on the lease.
0 They were Andrew Paul Lien 08/28/78 and Michael Anthony Jennings 06/19/75.
0 I also advised them that the house was found in violation of the noise ordinance.
0 I did also identify Kevin Michael Sullivan 06/07/78 who was standing with the others.
0 We then cleared the area.
0 I attempted to notify both the owner of the house as well as the manager of the house.
0 I left messages advising of the violation with both parties and finally did contact Tim
Borresch.
0 Upon asking him for a current list of tenants he stated that they did not have one.
0 I have not received a current list as of the time of this report.
0 Several days later I did speak with the complainant regarding this violation.
0 She stated that she called the complaint in because the individuals were both talking loudly
and she could hear their stereo inside her residence.
0 She also noted that it was 3:00 a.m. and she had kids trying to sleep.
0 The complainant did not want her name released and only gave it to dispatch because the
dispatcher seemed adamant at getting it.
DISPOSITION:
0 Renters will be issued citation for noise violation as soon as I received verification from the
property owner as to who they are.
0 Forward copy to City for Council meeting.

NOISE VIOLATION HEARING - 121 ASH STREET EAST: Mayor Hiemenz called the
hearing to order at 7: 14 p.rn. William Tallman, property owner, had not requested an evidentiary hearing
and represented himself. He told the Council ofhis expectations of his renters and to make them aware of
the concerns of the neighbors. Two of the renters were in attendance and stated they were not aware of
the volume of noise emanating from their residence.
Mayor Hiemenz asked the renters to address the statement from the police report "Don't open the door,
they can't do anything." The renters in attendance stated thè person that said that was not in attendance.

Loso stated there is a history of cómplaints on this rental unit Tallman responded that he believed there
were two violations in the 94-95 year with the last violation being May 1995.

Niedenfuer questioned if the renters were aware of the noise ordinance, to which they responded they
were.
Tallman questioned the orange notification sign placed. on the door discussing a second violation may
result in license suspension or revocation. He was told the policy has been changed since the signs were
printed although the signs get noticed as is the intent. Currently a first violation may result in a fine or
license suspension or revocation.
Ehlert discussed the lack of maintenance on the property, resulting in the City mowing the lawn. He
stated that awareness of the need for property maintenance was raised during prior years. Student renters
have been encouraged to be good responsible neighbors by helping their neighbors.

Twit questioned the Police Officers if the fact that the door was not answered when they first knocked was
a concern. Officer Meyer stated it was a concern, but no tickets were issued He stated the no~ was not
extremely bad.
Ehlert made a motion to consider this violation a warning with an acknowledgment to the renters that any
similar incident within one year will be dèalt with more severely. Further, the property owner shall be
required to reimburse the City for the adminimative, police and legal costs incurred due to the complaint
The motion was seconded by Loso.

I THEN NOTIFIED OFFICER BRAD MEYER TO COME TO MY LOCATION. AS OFFICER
MEYER TRIED TO GET SOMEBODY TO ANSWER THE DOOR I WENT TO THE OFFICE
TO TRY ~ND FIND A PHONE NUMBER FOR THE PROPERTY OWNER. I WAS
UNSUCCESSFUL IN FINDING A LISTING FOR THE OWNER OF THIS HOME.

1. Call to Order. Pursuant to due call and notice thereof, the City Council for the City of St.
Joseph met on Thursday, August 21, 2000 at 7:00 p.m. in the St. Joseph City Hall.
Members Present: Cory Ehlert, Ken Twit, Mary Niedenfuer, Bob Loso; Clerk-Administrator
Cari Schmidt and Deputy Clerk Judy Weyrens. Members absent: Mayor Kenneth Hiemenz.

2. 8:00 Noise Violation- 121 East Ash - Acting Mayor Twit opened the hearing. This hearing is
for a noise violation at 121 Ash Street East on June 25, 2000. He stated that the owner, Mr.
William Tallman has not requested an evidentiary hearing. This waiver of the hearing is the '
equivalent to an admission of the basic allegation alleged.
Mr. Tallman, the owner of the property addressed the Council. He stated that he wasn't
present the night of the incident, so he can't dispute whether or not the violation occurred. In
the lease that his tenants sign, there are specific prohibitions against violations of City
ordinances, parties and kegs. Mr. Tallman stated that he has a manager that lives in town,
Tim Borresch. Mr. Borresch was not called the evening of the incident. If he had been called,
this incident might have been avoided altogether. Schmidt stated that the police report
indicates that Mr. Borresch was contacted. Mr. Borresch stated that there were three calls in
two days. If he had been called the first time, he thinks he could have prevented the other
. incidents from happening.
Chief Will stated that the officers did call Mr. Borresch. They left a message that evening, but
got a hold of him on Monday. Mr. Borresch disputed this saying that he was home and has a
machine. Mr. Tallman stated that he hired Tim to be the manager and had he been given the
opportunity, he would have dealt with the situation. .
Twit stated that regardless of who was called when, there was still a noise violation and that
is what they need to deal with. John Quinlivan, attorney for Mr. Tallman, stated that they
weren't in a position to stop the second incident as they didn't know about the first one. They
want to be neighbor friendly and want to work with the City to achieve this. They didn't ask
for an evidentiary hearing because they had no knowledge to dispute whether it did or did not
happen.
Chief Will stated the first violation was at 5:00 in the morning. The officer did not issue a
violation for that incident. The second incident involved two houses. While they were at the
first house, everyone left the second house. The normal method of operation for the Police
Department is to issue a violation. The residents were actually lucky that the police didn't
issue one the first time. The report indicates that the residents were not argumentative and
that they cooperated fully with the officers.
Ehlert stated that normally a violation is always given, so he agrees that they were lucky that
one wasn't issued on Friday night. There are some communication issues that need to be
worked on but that is neither here nor there. Hindsight is 20/20 and we need to work from
here. The goal is to stop the noise.
Mr. Tallman stated that he has spoken with the neighbors over the years and requested that
. they call him or the manager if there is a problem. Ehlert stated that he may want to do this
again as new people move into the neighborhoods every year.

Niedenfuer made a motion to assess administrative costs and fees of $150 and the $162 ·
legal fees to date. Loso seconded the motion.
Ehlert stated that with each of these violations, the fine we give sets a precedent. He is
concerned that we have given fines in almost all previous cases. Why not here? Last time
we gave a $200 fine. Niedenfuer amended her motion to include a $200 fine on top of the
$162 legal fee and $150 administrative fee. Ehlert seconded the motion and the motion
passed unanimously.

Enclosed you will find a preliminary assessment roll for the County Road 121 Improvement. I
would like to review this with you at the July 19 Council meeting. I have several items to
consider:
Lines 1 and 20: I show a street assessment for the Church and the parking lot based on Vz of the
length of the long side, because these are comer lots. When Minnesota Street was reconstructed

The southerly building at 104 College Avenue So. does not have water main in the street in front
of the property, though I believe it is currently connected to city water.
Lines 3, 4, 34, and 35: By applying the past fonnula for multiple dwellings to the apartments,
some of the buildings will be assessed for less than half of their respective units. For the Campus
Villa Apartments, the number comes out to 3 units for each 8-unit building. For the 8-unit
apartments down by 295th Street, three of the buildings would be assessed 4 units and one would
be assessed at three units. Should we cap the reduction at half of the units? A copy of the policy
used is enclosed.
Lines 15, 19,27,38, and 41: Should the frontage for street assessment to single family homes
be capped at, say, 165 feet?
Lines 24, 25, and 32: Should we be assessing cemetary property for street improvements? I have
a call into John Scherer on this item. My guess is that it is not assessable since there is no
increase in market value. The water assessment for the two church cemeteries is to provide city
water for irrigation.

Hookup Fees: Bettendorf discussed the current hookup fees for water and sewer. The formula
needs to be revised to make provision for hotels and lodging houses. In addition, a provision
needs to be included when land use changes, requiring additional services. This issue CAme ot
light when linnemann's Store was converted into a lodging house. Bettendorf stated that the
revised proposal would charge a hookup fee based on the number of occupants. The following
is the reVised proposal:
Single Famìly Residence One Unit
Multiple Family Residence
1. The first four occupants One Unit
2. The next 15 occupants One unit per five occupants or
fraction thereof
3. All occupants thereafter . One unit per six occupants or
fraction thereof
. Includes apartments, group homes, boarding houses, retirement complexes. dormitories, etc.
The number of units is based on the number of potential occupants based upon a certificate of
occupancy issued by the City.
Commercial/Industrial One Unit for every 500 gal/ons
Per day or fraction thereof.
. An additional connection fee will be levied if the average annual flow increases more than 20
percent (but at least 500 gallons per day) over the initial fJow. Additional flows in succeeding
years are subject to additional connection fees. The fee amount will equal the established
connection amount (less inspection charges) in effect on January 1 of the year that additional
flow is generated. and shall be applied in accordance with the formula in effect on January 1 of
the year that the additIonal flow is generated. A credit to the levied connection fee will be given
for flows which do not go to the sanitary sewer if said flows are metered separately. Any
property undergoing a change in use which may result in an increase in water usage may be
subject to a re-computationof the connection fee in accordance with these formulas.

Dear Leon:
I have reviewed your proposed assessment for sanitary sewer instaIJed as a part of this summer's
project and will recommend to the City Council that it be reduced from 4 units to 2 units. My basis
for making this adjustment is outlined below.
The City recently established a policy for sewer and water hookup charges (not assessments) to be .
paid for apartment buildings that is based on maximum occupancy as certified by the Building Official.
The policy states that there will be one hookup charge (currently $2,085.00) for the first 4 occupants,
and one hookup charge per 5 additional occupants up to 15 additional occupants. I wiIJ propose to
the City Council that this formula be applied in calculating your assessment, with a projected
occupancy of 1 occupant per bedroom.
Assuming you have four apartments, each of which have two bedrooms, your building has a total of
8 occupants for calculating the assessment. The first 5 occupants yield one assessment unit, and the
remaining 3 occupants yield a second assessment unit. The change is summarized below:
Original Assessment
Sanitary Sewer 4 units @ $5,340.00 = $21,360.00
Trunk Sewer Charge 4 units @ $350.00 = $1,400.00
Water Service 4 units @ $500.00 = $2,000.00
Proposed Assessment
Sanitary Sewer 2 units @ $5)40.00 = $10,680.00 .
Trunk Sewer Charge 2 units @ $350.00 = $750.00
