Hosch Program application for the proposed municipal sanitary sewer collection and water distribution system improvement in St. Joseph. Applicant and recipients 2002 Small City Development Program Public Hearing City of St. Joseph September 20, 2001 Single Purpose Public Facilities Grant Application must be received at DTED October 1,2001 Funding notification will occur in March of 2002 Slides - Program Budget, Assessments, Low Income Limits Program Purpose - To provide decent housing, a suitable living environment, and expanding economic opportunities, principally for persons of low and moderate income. Grant funds provided thru HUD Cities under 50,000 in population are eligible to apply. National Objectives: 1. Benefit low and moderate income people. (must meet one) 2. Eliminate slum and blight. 3. Eliminate urgent threat to public health or safety. Eligible projects in three categories: 1. Housing grants 2. Public facility grants 3. Comprehensive grants . Maximum Public Facility grant is $600,000 Project length is typically 2-3 years Grant money is distributed as costs are incurred. Construction plans will be put together this fall and the project will be bid this · coming winter. Construction is scheduled to begin in spring of 2002. Earlier in the process, your neighborhoods were included in the project. After a number of informational meetings, it was determined that a majority of you living on 295tb Street and 103rd Avenue did not want to be included in the project. Individual reasons may vary, but the most common concern expressed was the cost of the projected assessments and hookup charges, and the additional cost to run the utilities into your homes. Weare sending this memorandum to you asking if you want to reconsider being included in the project. If you do not, that is fme and we will proceed with the project as it currently stands. If you do wish to reconsider, the City needs to know soon so that we can include you in the process. A new petition would have to be presented to the City Council, and a public hearing would have to be held for your neighborhoods. The choice to reconsider is yours. We simply want to make the opportunity available to you one more time since the project is moving forward. If you do want to reconsider, please contact Judy Weyrens, City Administrator, at 363-7201. Subject: 2002 Small City Development Program Public Hearing Attached for public hearing participant comment and City Council conside.ation is a summary of proposed project activities and budget for the City of St. Joseph's FY 2002 application for Small City Development Program funding. A summary of the project funding source being applied for, the Small City Development Program, is attached. . The project is a Single Purpose Public Facilities program that proposes to abate assessments to a 32 unit apartment complex and eight income eligible households located along the County Road 121 project area in St. Joseph Township. Income eligibility was detennined by a Conununíty Development Survey performed in July of 2000. The total SCDP request is $425,480. St. Joseph's financing portion of the project is $1,618,720. Other funds leveraged, County road funds, totals $585,000. The total project co~t is $2,629,200. A public hearing is required prior to submitting the application for funding. Attached for City CO\1IlcÎ1 considerdtion is a resolution authorizing submission of the funding request. Also attached are the complìnuce areas that the City wì1l need to agree to prior to receiving a fmal grant agreement The application is due to the Department of Trade and Economic Development by October 1,2001. Cloud would like to propose a new and . more efficient program for the collection of residential solid waste within the city ofS1. Joseph. This system is called Automated Collection and has actually been around for 10 years or so. This new way of picking up refuse involves an entirely different type of collection vehicle of which you will see in the video. BFI of S1. Cloud has a residential customer base of approximatly 7000 homes, of which over 90% are now automated.. Some of the advantages of this new system are, appearance of all uniform carts on collection day, all carts are on wheels and are easily wheeled to curb. All carts have attached hinged lids to prevent them from blowing around on windy days, Residents would no longer have to purchase their own cans, Much easier on the driver, ability to pick up more stops with less risk of back injury, trucks are lighter than packer trucks. In order to implement the automated collection system, BFI would have to supply and maintain carts to all homes within the city of S1. . Joseph. I can purchase 68 gallon carts for around $40.00 each. This Agreement made and entered into this 1st day of January, 2000 by and between Browning Ferris Industries (hereinafter referred to as "BFI"), party of the fIrst part, and the City of St. Joseph, a Municipal Corporation, party of the second part. .- , It is hereby agreed by and between the parties as follows: 1. From January 1, 2000 to December 31, 2002 the party of the fIrst part is hereby employed to operate a refuse collection service, serving all the residences, excluding the non owner occupied rental units and business places, in the City of St. Joseph, Minnesota. In providing said service the fIrst party shall: (a) Collect refuse of all owner occupied residences in the City of St. Joseph. The residents shall have a choice of one of two services. First, there will be a limit of two (2) thirty (30) gallon containers or the equivalent thereof and not to exceed (50) fIfty pounds per container. (No 50 gallon barrels) The residents also have a choice to partake in a bag system. The bags will be available to the residents to purchase for $3.00 per bag from the supplier. Any residents who so choose, may at the beginning of anyone billing period elect to convert to the bag system and will be required to remain on the bag system for one year. The hauler will have sole responsibility for the dispensing of bags, tags and labels and for the billing and collection for the residents who choose the bag system. Containerslbags are to be placed at the rear end of all lots having alleys or reasonably near the street on lots not having an alley access. The party of the second part shall only be responsible for billing for the base service, any other service will be billed for by the party of the fust part. The party of the fust part will contract with residents separately for extra pickups, construction debris and yard waste, at the individual residence. Absolutely no tires, batteries, drain oil, paint or chemicals can be picked up, . " (b) Use a compactor truck for refuse pick up service. (c) Dispose of all refuse at such places where the fust party can lawfully dispose of the same at the fust party's expense and not at the expense of the City. The party of the first part wiII provide a disposal plan which will minimize the total amount of mixed municipal solid waste which is land filled to 35% or less by weight through processing or delivering the mixed municipal solid waste : to a processing site. (d) Collect all refuse once each week, the established pickup day being Thursday. The party of the fust part shall continue to provide service each and every Thursday, but shall however, have the right to change said days of pickup upon giving written notice to the second party and obtaining second paIi'¡'s consent. The fust party shall publish notice in the St. Cloud Times for any approved change seven days prior to the change and the First party shall have broadcast said change on the following radio stations: WJON, KSAM, KS95. (i) To indcIr.nify the City ofSt. Joseph from any and all claims or demands for damage to person or property arising out of or in any way connected to the performance by the party of the fIrst part of the requirements of this agreement and to carry insurance satisfactory to the second party, naming the second party as co-insured providing coverage for damage to property in the sum of$100,000 and injury to anyone person in the sum of$200,000 and injury to more than one person arising out of one occurrence in the sum of $300,000, said insurance covering fIrst party and second party for any activities arising out of fIrst party's performance of this agreement, and provide second party with a certifIcate of insurance. 2. If the performance by the fIrst party of the services herein provided shall be commenced in the middle of the month, and service provided shall be for less than an entire calendar month, the sum to be paid the fIrst party shall be prorated and the fIrst party shall be paid onJy that part of the month in which the service is actually provided. 3. Every owner of a multiple famiJy dwelling shall suppJy facilities for the sanitary and safe storage and/or disposaJ of rubbish and garbage. In the case of single, two family or multi-family dwellings of three units or less, the disposaJ of rubbish and garbage shall be by the hauler contracting through the City in accordance with the terms and conditions of the city contract. For all other properties, the owner shall contract with a refuse hauling and disposal company which fumishes appropriate containers for on-site storage of rubbish and garbage and pick up at least bi-weekly. 4. The fIrst party shall not be obligated to provide said service in any areas until plowed of snow by the second party, but then shall provide said service in the amount of pickups where the parties to be served have cleared snow to provide access for first party to the containers to be picked up. 5. FROM: John Thom, WfWW Specialist DATE: September 11,2001 RE: Cost estimate for tower mixers Dick: I contacted Gene Jones Jr. with Maguire Iron from Sioux Fa1Js SD for prices on the mixers for the tower, He has installed several of the mixers in towe~ and he indicated that the cost of one installed in your tower would be in the range of about $7,000.00. This did not include the electrica.l for the mixer, my ~timate for this would be about $1,200.00. Gene questioned the need for a second mixer, because of the amount of water moved by a single mixeL He added that you could install the hardware for two at this time run this winter and then install the additional One next year if needed If you take this approach the wire size to the top of . the tower should be sized to handle both mixers at this time. A nmning light for the mixèT would have to be a current relay along with a test light installed at the base of the tower. The reason for this is that the circuit will be energjzed at all times and if the motor is running there will be a CU11'ent flow to close the relay for the light. The light should have a push to test switch to test the bulb on the controller. Gene indicated that the mixer could be installed this fall without a problem. Hosch Dear Mr. Velline: COUNCILORS The City Council has had an opportunity to review your request for a reduction in the purchase price Bob Loso of the City Hall Annex based upon the short delay in closing because of title issues. You are seeking Cory Ehlert compensation for lost rent, additional legal fees and apparent inconvenience of schedule a contractor. Kyle Schneider Alan Rassier In analyzing your request, the City Council has reviewed the Purchase Agreement. Closing had been scheduled for July 27,2001. Under the terms of the Purchase Agreement (I refer you to that section commencing on line 62), the City is responsible for providing proof of title in the form of an Abstract. You have the right to review the Abstract and communicate any objections to title. That was done. The Purchase Agreement provides that in the event title is not marketable at the date of closing, the Seller shall have an additional 30 days to make title marketable. Therefore, pursuant to the terms of . the Purchase Agreement, closing would have automatically been extended to August 27, 2001. The Purchase Agreement goes on to state in line 81 that the buyer and sell may by mutual agreement further extend the closing date. It is the City's position that the parties had in fact agreed to extend the closing date while the title problems were being addressed. At no time had you, as buyer, exercised any right you may have had to declare the Purchase Agreement null and void. At the present time, the City stands ready, willing and able to close on the property. An updated Abstract was delivered to your attorney more than a week ago. An environmental study and other requested documents have been sitting in my office available for your review for several weeks. The Purchase Agreement goes on to state that neither party shall be liable for damages to the other for any delay or failure to provide title. Your remedy would have been a cancellation of the Purchase Agreement. That right was not exercised. The City has taken the necessary steps to provide good title and is now willing to close. In addition, the City Council made note of the fact that there had been no application for a Conditional Use Permit for the property. A buyer may submit an application for Conditional Use Permit based upon the interest created by a Purchase Agreement. Since the Conditional Use Permit process takes a minimum of two months, the property would not have been available for rental for at least two months. It is believed that many repairs to the premises would have had to have been completed before a rental license would be issued. Therefore, it is the position of the City Council that any delay in closing did not result in any loss of rental income. . Mr. Robert Velline September 17, 2001 . Presumably, fees incurred with title examination would have been expenses realized regardless of~ny problems. With this said, the City Council is willing to give some recognition to your concerns and make some accommodation. The City is agreeable to reducing the purchase price by the, sum of $ 1,200.00 (one month rent for apartment unit No.1 and temporary housing unit No. I) in consideration of the delays. This reduction also represents the City's desire to have you as a resident. Although the City has been approached by other buyers willing to meet your offer, it is the City's preference to see your plans come to fruition. If you are willing to close on the property, with this adjustment, please contact Mr. Imholte to schedule closing. As you are aware the Council will need to approve any employment terms. This approval is scheduled for Thursday evening. Therefore, please review the following and call me if you have and questions or concerns. Also, a full copy of the St. Joseph Personnel Police will be made available for your review. Employment Terms . Position: Police Chief Employment Status: Exempt, not eligible for overtime or compensatory time. Annual Salary: $ 53,000.00 Introductory Period: December 1, 2001 - December 31, 2002. During this time employment will be "at will". During this time if employment is terminated without cause you shall be entitled to 60 days of severance pay. After the successful completion of the introductory period, termination shall be for cause only. At the end of the introductory period, the annual salary shall be adjusted by 5% upon the completion of a favorable performance review, and thereafter subject to negotiation. Vacation: 2 weeks of vacation will be credited to your benefit bank and you will earn an additional 1.53 hours of vacation per pay period for the first year. The second through the sixth year you will earn 4.61 hours per pay period (3 weeks) and thereafter you will accrue vacation stated in the St. Joseph Personnel Policy. Sick Leave: 160 hours of sick leave will be credited to your benefit bank. Sick leave is earned at 8 hours per month with a maximum accrual of 720 hours. Sick leave credited to your bank must be earned in arrears before additional time can be accrued. If you leave employment before the bank is earned, the hours not earned will not be paid. . Six month review: The Council will perform an interim review after six months and upon completion of a favorable review the Council may consider an increase in salary. . CITY OF ST. JOSEPH BENEFITS Health Insurance The City pays 80% of the medical insurance premium for family or employee coverage. The City insurance carrier is Principal Mutual Insurance and is a PPO. Waiting period- 30 days. Dental Insurance The City pays 80% of the dental insurance premium for family or employee coverage. The insurance carrier is Principal Mutual Insurance and provides for full dental coverage. The maximum benefit per year is $ 2,000.00 and requires a deductible of $50.00 per office visit, excluding preventive care which is paid at 100%. Waiting Period - 30 days. Life Insurance The City provides each employee with a $25,000 life insurance policy which is paid by the City. Disability Ins The City pays 100% of the premium for full disability insurance. The insurance carrier is UNUM. Coverage also includes limited spousal disability insurance. Waiting Period - 6 months. Sick Leave Each employee earns eight (8) hours of sick leave per month and can accumulate up to 720 hours. Retirement All full time employees are required to belong to PERA Health Club The City pays 100% of the employee membership fees at Suburban Health Club Uniforms The City shall provide the following basic uniform for new personnel: One cap each - summer and winter style; Two pairs of shoes; One jacket; One overcoat; Three shirts each - summer and winter style; Three pants each - summer and winter style; One pair gloves; Two ties. As a uniform allowance, the employer shall make direct payment to approved vendors for uniform items purchased by an employee. The uniform expenses paid by the employer per year shall be in accordance with the St. Joseph Police Union (LELS) contract. For the year 2001 that amount shall be $ 505. Any uniform purchases in excess of the above stated amounts shall be an expense of the officer. The Employer shall designate at least two approved vendors. New employees shall not accrue a uniform allowance until completion of their six month probationary period, new officers shall be entitled to a uniform allowance prorated for the remainder of the calendar year in which the introductory period ends. Conferences/Dues Within Budget considerations, the City will pay for dues and related membership costs and conference attendance to the Minnesota Chiefs of Police Association (MCPA) and International Police Chiefs Associations (IPCA).
