Rental LCHUs are units 55 a) whose maximum monthly rent is no greater than 30% of the monthly income of 56 households earning 50% of the area median income 57 b) which must be rented as LCHUs for at least the first 20 years of life of each 58 unit. 59 C. Each city 60 1. is free to employ whatever methods it judges to be most effective in meeting this 61 15% commitment. 62 a) These methods could include alterations in zoning and planning requirements, 63 fee reductions or other financial incentives, a requirement that all 64 developments include a minimum percentage of LCHUs, or other means; 65 2. will be an active participant in the Life Cycle Housing Subcommittee of the Joint 66 Planning District Board, which will propose to the Board the specified price point 67 and maximum rent and will continue researching, monitoring, and formulating 68 , proposals to assist in addressing area affordable housing needs. 69 a) The Subcommittee will comprise . 70 (1) One member appointed by each city; 71 (2) One member appointed jointly by the counties of Benton, Sherburne, and 72 Stearns; 73 (3) One member appointed by the Central Minnesota Builders Association; 74 (4) A representative of a non-profit housing agency appointed by the Board 75 (5) A representative of area realtors appointed by the Board 76 (6) A representative of area bankers appointed by the Board 77 (7) A representative of the public appointed by the Board. 78 3. will by February 15th of each year issue to the Board and the other cities a public 79 report on 80 a) the results of this commitment over the previous calendar year, 81 b) the results anticipated for the current year, and 82 c) for any city which has not met the 15% commitment by the end of the second 83 year of the Agreement, a description of the city's plan for the· coming year for 84 meeting that commitment. 85 D. The commitment to ensure the construction of 15% LCHUs will take effect 86 immediately after the cities and the Joint Planning District Board approve this 87 Joint Powers Agreement. 88 1. The life Cycle Housing Subcommittee will issue a public annual report 89 summarizing the results of this Agreement across the five cities and will caution 90 any cities that fail to reach the agreed-upon goal. 91 2. The Board and the participating cities acknowledge that no decision made at one 92 time can bind the Board or a city council later in time. Nonetheless, since the . 93 cities are committed to solving the affordable housing problem and since the two 94 major options available are the "voluntary" approach represented by this Article 2 , 06/11102 , , ! , i 95 and a mandatory .ordinance (requiring a minimum percentage of LCHUs in every '6 residential develo1pment), each city which.)s a party to this agreementformally ~)7 states its intention to move to a mandatory ordinance if the 15% outcome for the 98 city is not achiev~d under this Agreement by a date five years áfter the approval 99 of this Agreemen10r sooner if deemed neces~ary~ 100 a) In determining the percentage of LCHUs constructed in any city, earlier years 101 with more thar 15% LCHUs can be counted with lateryears, up to.a time span 102 of 5 years. ! 103 104 105 106 II.
