AGREEMENT REGARDING ANNEXATION
This agreement is entereq this ~ day of , 1992,
between the City of st. Joseph, hereinafter referred to as the
"City", and st. Joseph Township, hereinafter referred to as the
"Townshiplt.
WHEREAS, certain property located in the Township has
petitioned for annexation to the city,
WHEREAS, the annexation of tAis property would result in a
loss of tax revenue to the Township,
WHEREAS, the City and Township wish to lessen the impact of
the loss of tax revenue in consideration for the Township
. dropping any opposition to the annexation.
THEREFORE, in consideration of the mutual promises contained
herein, the parties agree as follows:
1. This agreement pertains to th@ property described in
attached Exhibit A, and no other property. For purposes of this
agreement, the property described in attached Exhibit A shall be
referred to as the II Property" ,
2 . The City and Township agree to immediately cooperate to
achieve the annexation of the Property by the City.
3. The city and Township had previously agreed to
contribute the sum of Twelve Thousand Dollars ($12,QOO.00) e-açh
toward an engineering study to determine the feasibility of
utility service to areas of the Township located near the city.
. In light of the annexation of the Property by the City, this
engineering study will have a significantly reduced benefit to
the Township. Therefore, the parties agree that the Township's
.
. contribution toward the cost of the engineering study shall be
reduced to Four Thousand Dollars ($4,000.00) . The remainder of
the cost of the engineering study shall be assumed by the city.
4. a} Following annexation, the city and Township shall
share tax revenue generated by the property from 1993 through
2002, the Township shall receive a portion of tax revenue equal
to a percentage of the 1992 payable real estate taxes to the
Township. The total of the 1992 real estate taxes payable to the
Township was $17,060.23. The City agrees to pay the Township the
following amounts based upon the stated percentage of 1992
payable real estate taxes:

b) One-half of the annual payment shall be made on or before
July 1, with the second one-half made on or before December 1 of
each year beginning in 1993 and continuing through 2002.
c) The Township shall continue to provide street and road
maintenance, fire protection and snow plowing for the Property
through the end of 1992. The city shall assume municipal
services in 1993 and thereafter.
. çl) For the purpose of determining the contribution of the
Town and City toward cooperative fire protection, the Property

shall be considered to be part of the Township through 1993 when
allocating the cost of fire protection between the city and
Township.
e) In the event real estate taxes payable in 1993 are
received by the Township due to thé fact that the annexation was
not completed prior to the Township levy of taxes, the Township
shall deliver to the City the tax revenue derived from the
property less the $11,089.15 payable by the city to th~ Township
pursuant to paragraph 4a above. One-half of this amount shall be
retained by the Township from the first half tax receipts, with
the remainder retained from th~ second half tax receipts.
. 5. This agreement shall not directly affect annexation of
any other property nor bind the parties with respect to other
property located within the Township.
6. The undersigned acknowledges that they are authorized by
their respective governing bodies to execute this agreement.

SUBJECT: POLICE BUDGET (INFORMATION)
Dear Council Members,
There are three items I wish to bring to your attention for
your information and consideration in approving the 1993 budget.
I offer you this information as all three items may very well come
up in 1993, and it has an impact on the police budget. I believe
it is my responsibility to make you as informed as possible.
. 1. Police salaries, old vs. new step system. The new step
system effects each officer with the exception of Jean, she is
currently on the new system. The police department is on line
with the 1992 budget, with 50% expended for the 6 months of 1992.
If each officer is placed on the new step system at their current,
1992 status, it will increase the salaries by approximately $5/700.00.
This DOES NOT include any step increase for 1993, or any cost of
living increase in 1993. At the last budget meeting, salaries were
increased by $ 2/597.00 from 1992 to 1993.
2. Legal fees: The offer for a shared prosecutor is contingent
upon two other cities, and as of this date it looks like waite Park
may not go along with it (3 to 2). I could talk to John Scherer, and
see if they would shoot us a contract price vs. the unknown price of
the hourly rate, please advise on this subject.
3. Training: Hopefully this should be fine. However, for 1993
an increase of $500.00 to salaries in the event we need to train another
DARE Officer could be considered. I have spoken at leng~th to Jean con-
cerning her current and future status with the department. Although with
DARE, secretary duties, and part time patrol, she comes close to full
time, but without the benefits and a regular set schedule. (she is still
an "at will" employee) In reality, DARE Officers are in high demand around
the state, and Jean is an excellent officer. It is hard to believe (as much
as I would like to) that Jean would not take a better job at a larger dept.
. if she were offered one before 1994.

Dear Rachel:
. Recently the City of Sartell was approached by Janelle Kendall who
is offering to provide criminal prosecution services to Sartell,
Waite Park, and St. Joseph. In her letter, she indicates that she
would only be able to provide the criminal prosecution services at
the fees quoted if all three cities participated and contracted
with her.
The City of Sartell is interested in participating in this arrangement
and is wondering whether your city is interested in this arrangement
as well?
The City of Sartell has not yet committed to Ms. Kendall as we wish
to solicit bids from other local firms, however the city is very
interested at looking at different arrangements for criminal
prosecution services to lower costs.
Please let me know whether or not you are interested in this type of
shared criminal prosecution services.

Thursday, September 24, 1992 at the Community Room/City Hall. Councilmen

The afternoon program, beginning at 2:30 p.m. will cover a variety of Byron Ahrenholz

subjects during a roundtable discussion, including solid waste programs, Robert Shinnick
"what cities around the state are doing" and the ne\. Transportations
Utility Fee.
At 3:30 p.m. a discussion will cover fire relief association activities
and at 4:00 p.m. a presentation will address council/staff relations
and the need for performance appraisals. Because of the importance of
this subject, the League is asking that at least one elected official
from each city is present.
4IÞThe afternoon program, concluding at 5:00 p.m. will be followed by a
social and then dinner at 6:15 p.m.

Following a welcome to our city from the mayor, LMC President Larry
Bakken will address the audience regarding the organization's focus for
the coming year. After the President's message, the League will present
its new video followed by a discussion of legislative matters, including
the status of the process to develop a new local government aid (LGA)
formula. The meeting will conclude with door prizes, including a free
registration to the 1993 annual conference in St. Cloud.
To make reservations for your city, please return the enclosed registration
form as soon as possible. In case of concellations, please notify June
Swanson by September 18, 1992. Your city will be billed for those who
did not attend and did not cancel their reservations by the cancellation
date.
