Joseph met in regular session, on Thursday, September 3, 1992 at 7:00 p.m. in City Hall. MEMBERS PRESENT: Mayor Steven Dehler; Members of the Council Leo Sadlo, Ross Rieke, Bob Loso, Stephanie Hazen. Clerk/Administrator Rachel Stapleton. OTHERS PRESENT: Judy Weyrens, Monte Eastvold, Joe Bettendorf, Bud Reber. Loso made a motion to approve and adopt the resolution awarding a $475,000 General Obligation Water Revenue Bonds of 1992, to FBS Investment Services Inc. The motion was seconded by Hazen. Ayes: Dehler, Sadlo, Rieke, Loso, Hazen. 4IÞ Nayes: None. Motion carried. AGENDA APPROVAL: Hazen made a motion to approve the agenda as corrected; seconded by Rieke. Ayes: Dehler, Sadlo, Rieke, Loso, Hazen. Nayes: None. Motion carried. MAYOR REPORTS: No report. COUNCIL REPORTS - RIEKE, HAZEN, LOSO: No report. SADLO: The installation of the water mains in the water project is going well. There has been a change in the route of the installation of the water main, so that the contractors have a full week for Minnesota street. Sadio also discussed the proposed improvement for Minnesota street next year, and requested more information on the proposed Beautification Project, to be combined with it. BILLS PAYABLE: After discussion of a bill for work done in the Baseball Park and associated bills, Rieke agreed to work out an agreement of understanding with the St. Joseph Baseball Association, and clarify the requirements and policy of the City. . Sadlo made a motion to pay the bills as presented; seconded by Rieke. Ayes: Dehler, Sadlo, Rieke, Loso. Nayes: Hazen. Motion carried. Hazen made a motion to recess at 8:09 p.m.; seconded by Loso. The Mayor reconvened the meeting at 8;22 p.m. 91ST AVENUE SEWER PROJECT: Joe Bettendorf, City Engineer, discussed the 9ist Avenue Sewer Project. The project includes trees and sod, but is set so they can be deleted from the project. The Council agreed that only trees which are destroyed by the project will be replaced. An informational meeting will be held on September 17 along with bid consideration, and to call for an assessment hearing. FIRST AVENUE AND ELM STREET NORTHEAST: Council agreed that these streets would not be enhanced, in restoration from the water main installation. Only replacement material would be installed. CSAH 75 SiGNAL PROJECT: This project still is not closed out. The striping must be redone. Federal projects take years to close out. Also discussed were proposed Pond View Ridge and DBL lift stations. DBL LABS AREA ANNEXATION AGREEMENT: Council discussed a proposed annexation agreement with the Township; for the area of DBL Labs. Items of concern were when the City would receive tax revenue; sharing of cost of fire protection for . the area. Hazen made a motion to authorize the city engineer to begin plans and specs for a proposed sewer line and lift station to serve DßL Labs & MOO, and advertise for bids to be opened on September 11 and considered September 17: seconded by Sadlo. Ayes: Dehler, Sad 1o, Rieke, Loso, Hazen. Nayes: None. Motion carried. MiNNESOTA STREET: The Council discussed with the Joe, the proposed improvement of Minnesota Street, with the County. They also discussed the proposed Beautification Project. Suggested was that a representative from the Cha~er meet with the Council and Planning Commission to present and discuss the plans. BAKER AND 7TH STREET iMPROVEMENT: Hazen made a mot i on to ho 1 d an assessrnent hearing on the Baker Avenue and 7th Street Project on October 1 at 7:00 p.m.; seconded by Rieke. Ayes: Dehler, Sad 10, Rieke, Loso, Hazen. Nayes: None. Motion carried. ßALLOT QJESTJQNS: Council considered proposed ballot quesLlons on purchase of property for future city facilities. Hazen made a motion to place the following question on the ballot after checking the correctness of the terms of the contract: .. Should the City of st. Joseph purchase 10.6 acres of real property located west of County Road 75 (also known as the Susan Roske property) by a five year Contract for Deed for a price not to exceed One Hundred Fifty Thousand Dollars ($150,000)?" and to prepare informational 4IÞ material to be made available to the Dublic. A statement that the information in available at the city offices will be Dublished in the Newsleader and St. Cìoud Times. The motion was seconded by Rieke. Ayes: Dehler, Sadlo, Rieke, Hazen. Joseph met in special session, on Tuesday, Septerrber 1, 1992 at 7;00 p.m. in City Hall. MEM3ERS PRESENT: Mayor steven Dehler; Marbers of the Counci 1 Leo Sadlo, Bob Loso, Stephanie Hazen. Clerk/Acininistrator Rachel Stapleton. OTHERS PRESENT: Bradley Lindgren, Bruce Lindgren. The purpose of the meet i ng was to go through the budget. Mayor Dehler called the meeting to order at 7:00 p.m. He asked Chief Lindgren to discuss with the Council, a proposal by Janelle P. Kendall, for legal criminal prosecution, which would be a part time salaried position, at $15,000 for st. Joseph. The request is for a two year contract. This proposal is dependant on Sarte1l, Waite Park and st. Joseph a 11 agree i ng to accept the propos a 1 . The Counc il a 1 so discussed with Ch i ef Lindgren, the Po 1 ice budget and proposed budget cuts. The Council allowed salary for four full time officers, and a part time officer, which is also the D.A.R.E. officer. Chief Lindgren also stated that he did not expect the D.A.R.E. program any cost to the City, but wou 1 d be funded through grants and fundra i sers . The Council went through the all the categories of the general fund budget and cut as they fe 1 t appropr i ate to reduce the tax 1 evy to an acceptab 1 e arrount. They recommended that the City send out Requests for Proposals for the 1992 . audit to several auditors; install a phone in the back roam of the Annex building; steam clean the carpets in the city hall and annex buildings; get time controlled thermostats for city buildings, to save energy; establish the assessors salary in relation to the volLrne of work, on a per card basis, which will allow for a fair increase with the growth of the City. Council generally agreed to include an introduction statement that although items are included in the budget, if the revenue is not available the Council will reconsider the needs of the City as budgeted. City policy that all items over $50 need Council approval will prevail. Also, even though items and requests are included in the budget, in light of the costs and changing needs, the Counc i 1 may recons i der any need, dur i ng the budget year. Pursuant to due call and notice thereof, the City Council for the City of st. Joseph met in special session, on Thursday, September 10, 1992 at 7;00 p.m. in City Hal ì. MEMBERS PRESENT: Mayor Steven Dehler; Members of the Council Bob Loso, Stephan i e Hazen. Clerk/Acininistrator Rachel Stapleton. OTHERS PRESENT: Ralph Traut, Edwin Merkling, Michael Sworski, Dick Taufen, Stuart Go 1 dschen, Pau 1 Chr i stensen . The Mayor called the meeting to order at 7:00 p.m. and closed the meeting for interviews for the maintenance position. Edwin Merkling,. Ralph Traut and Michael Sworski were interviewed for the position. After the interviews the Council agreed to offer the position to Ed Merkling if he will allow a background check and other information. The Council recessed at 8:25 p.m. The Mayor reconvened the meeting at 8:35 p.m. AGENDA: Loso made a motion to approve the agenda; seconded by Hazen. Ayes: Dehler, Rieke, Loso, Hazen. Nayes: None. Motion carried. . ANNEXATION AGREEMENT: The Council considered the revised agreement with st. Joseph Township, which allows provisions for the annexation of an area by DBL Labs & f"ro. They requested that the agreenent state that any tax revenue generated by future growth would be city revenue. Fire protection costs should be in proportionate shares in the years 2 through 10, based on 1992 valuation. The 1992 valuation should be included in the agreement. Hazen made a mot i on to approve a resolution to allow the annexation of the area described as: and the annexation agreenent with st. Joseph Township with the above inclusions; seconded by Rieke. Ayes: Dehler, Rieke, ~oso, Hazen. Nayes: None. Motion carried. 1993 PROPOSED BUDGET: After discussion Loso made a motion to approve the 1993 proposed budget at $676,597 expenditures with a proposed levy of $246,000, which would allow a 2% contingency for the General Fund. The mot ion was seconded by Hazen. Ayes: Dehler, Rieke, Loso, Hazen. Nayes: None. Motion carried. Rieke made a motion to hold a Truth in Taxation public hearing at 7:00 p.m. on Wednesday, Decanber 9 at 7: 00 , and on December 11 at 7: 00 p. m. if additional time is needed. The motion was seconàed by Hazen. Ayes: Dehler, Rieke, Loso, Hazen. Nayes: None. Motion carried. . LEAGUE OF MINNESOTA CITIES REGIONAL MEETING: Dehler made a motion to allow up to two Council members to attend the Regional Meeting at Clara City on September 24; seconded by Loso. September 10. 1992 RESOLUïION: Rieke made a rrotion to approve a Residential Antidisplacernent and Relocation Assistance Plan under Section 104(d) of the Housing and Community Development Act of 19ï4, as Amended. Loso seconded the rrotion. Ayes: Dehler, Rieke, Loso, Hazen. Nayes: None. Mot ion carried. ELECTION SIGNS: Rieke made a rrotion to approve the quote or Joe Prannenstein or $200 ror constructing signs for the precincts for elections; seconded by Loso. Ayes: Dehler, Rieke, Loso, Hazen. JOSEPH, MINNESOTA 56374 (612) 363-8250 EMERGENCY 911 DATE: Sept. 17, 1992 TO: The St. Joseph City Council FROM: Chief Lindgren SUBJECT: MONTHLY REPORTS Dear Council Members, Please find enclosed the monthly incident report for the month of Aug. 1992. It reflects a fairly active summer month of incidents the police department responded to. t mayor may not be abie to attend Thursday council meeting. For the first two weeks of Sept. the pOlice department has issued citattons, and or arrested nearly 70 persons. A majority of this is for college age alcohol related violations. In addition to this, last weekend there were . approximately 8 large parties in town, with up to 500 people attending one party alone. This Thurs. & maybe Fri. (depending on Thur. results) we are going to do more "stings" at the party houses. I see no other real altern- ative, and believe the situation will get worse as the year progresses with- out a police response. There are several reasons I am informing you of this. I may not be at this weeks council meeting. There are costs involved, 'overtime, under- cover wages, & monies to purchase illegal beer. We are on line with the budget, and I believe most of the officers, will take the overtime in compo time, but there might be some claims for overtime pay. We are all aware of the memo from the city relative to overtime, and this is the reason I am informing you of our planned activities. If any council member feels we should not proceed with this, please advise me and I will try to cancel, and we will have to address the matter at a later date. Thank you. There are also two letters attached to this report, one is another thank you letter, and the other is a letter and cheek the police depart- ment received from Metro Bus for the 1st place (juvenile) DARE entry in our 4th of July Parade. The City and Township had previously agreed to contribute the sum of Twelve Thousand Dollars ($12,000.00) each toward an engineering study to determine the feasibility of utility service to areas of the Township located near the City. In light of the annexation of the Property by the City, this . engineering study will have a significantly reduced benefit to the Township. The total of the 1992 real estate taxes payable to the Township was $17,060.23. The City agrees to pay the Township the following amounts based upon the stated percentage of 1992 payable real estate taxes: . The City shall assume street and road maintenance and snow plowing as' well , . . . as all other municipal services upon the date of annexation except for fire protection which the City shall assume as of January 1, 1993, and thereafter. e) In the event real estate taxes payable in 1993 are received by the Township due to the fact that the annexation was not completed prior to the Township levy of taxes, the Township shall deliver to the City the tax revenue derived from the Property less the $11,089.15 payable by the City to the Township pursuant to paragraph 4a above. One-half of this amount shall be retained by the Township from the first half tax receipts, with the remainder retained from the second half tax receipts. 5. Taxes for certain parcels of the Property are currently delinquent. If and when these taxes are received, any tax which . was originally payable in 1992 or prior thereto shall be the property of the Township (along with applicable interest and/or penalty) . 6. In the event the City subsequently annexes the Township parcel bounded by County Road 133 on the south and bounded by the City limits on the west and north, then the Township shall receive a portion of the tax revenue equal to a percentage of the - real estate taxes , payable in the year said annexation occurs for a period of ten (10) years following the year of annexation. The Township shall receive all the tax revenues in the year of annexation. This money can always be used by the Park Commission at any time. Contract have been received for tarring the parking lot in Morningside. . Water fountain is in at Centennial park.
