. Pursuant to due call and notice thereof, the City Council for the
City of St. Joseph met in regular session, on Thursday, November
5/ 1992 at 7:00 p.m. in City H~ll.
MEMBERS PRESENT: Mayor steven Dehler; Members of the Council Leo
Sadlo, Ross Rieke, Bob Loso, Stephanie Hazen. Clerk/Administrator
Rachel Stapleton.
OTHERS PRESENT: Rose Arnold, Joe Bettendorf, Rollee Mohs, Al Mohs,
Elmer Przybilla, Arnold Lauer, Roman Spanier, Kevin Schirmers,
Nick Froehle, Bud Reber, Ken Hiemenz, Melvin & Aurelia Ruegemer,

Mayor Dehler called the meeting to order and opened a public
hearing for assessment hearing for the Sanitary Sewer Project to
serve 91st Avenue. Joe Bettendorf, City Engineer, discussed the
project and that he would have any property line markers, which
were displaced during construction replaced. He also discussed
the assessment costs. Loso made a motion to approve a
resolution to assess the project for a period of 15 years at 8 per
cent annually, and to approve the assessment role as presented;
seconded by Hazen.

. Nayes: None. Motion carried.
AGENDA: Hazen made a motion to approve the agenda as changed;
seconded by Loso.

CITY ENGINEER REPORTS: Joe Bettendorf discussed the requests for
sewer in the East Minnesota Street area and discussed that a lift
station facility would serve the area. He also discussed how the
costs would be established for current and future users of the
facility. Sadlo made a motion to approve a preliminary study or
feasibility report for sewer and water, to serve the area agreed
on according to the map handout, of East Minnesota Street;
seconded by Hazen.
Ayes: Dehler, Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
MAYOR REPORTS: No report.
COUNCIL REPORTS - SADLO: 1) Sadlo discussed that a large volume of
water was discovered by the DBL Labs lift station area, during the
de-watering for construction. sadlo made a motion to have a
sample to the water tested, as a possible future site for city
wells; seconded by Hazen.
Ayes: Dehler, Sadlo, Rieke, Loso, Hazen.
. Nayes: None. Motion carried.
2) Ross Rieke requested a variance for the easement area of his
property. The City should follow Ordinance #32 (Easement

. Ordinance) and provide for access to current and future utilities.
Future homes adjacent to this easement area will need access for
electricity, and the ci ty wi 11 ,need to get to the sewer manholes
for cleanout purposes. 3) The basement of the house in Millstream
Park has been cleared and filled with fill from Morningside Park
excavation for the parking lot. The labor for this was provided
through the Sentence to Service program. 4) The City could check
with Mrs. Borresch and see if she would release her lot that needs
cleaning up, and check on the costs of cleaning up the lot. The
Sentence to Service program could assist in clearing it. Rieke
agreed to work out a program with Dick and approach Mrs. Borresch.
LOSO: 1) Send a memo to the Police Department that no snowmobiles
are allowed in the park. They should watch for this and enforce
the ordinance. 2) The Park Board met with Peter Rothfork and he
has offered to donate to the City, Lots 6/ 7 , 8/ & 9 of Block 8
of Phase 3 of Northland Addition (Indian Hi 11) . The Council
generally agreed to accept it, but clarified that the Developer
would still be required to follow the subdivision ordinance
requirement for park land contribution. 3) Pondview Ridge
development has not been accepted by the city yet. The
Maintenance Department should plow the streets as the other
streets in the City. 4) The trees in Monument Park have been
planted but there is much vandalism to them, either pulled out or
bent over. 5) The parking lot at Morningside Park is well on its
. way to completion.
HAZEN: No report.
RIEKE: Has the bridge at Millstream Park been fixed yet?
BILLS PAYABLE: The Council reviewed the bills and employees
accumulated comp time and overtime. Sadlo made a motion to
approve the bills as presented, and pay any comp time accumulated
over forty hours, by any employee; seconded by Rieke.
Ayes: Dehler, Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
ANNEXATION REQUEST: Fred Reber, spokesperson for the property
owners requesting annexation from East Minnesota Street requested
that the Council allow annexation of the properties requested
according to the Orderly Annexation Agreement. The Council
discussed the peoples needs with them and informed them that a
study to provide sewer and water has been ordered.
sadlo made a motion to recess for seven minutes at 8:43 p.m.;
seconded by Loso.
Ayes: Dehler, Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
Mayor Dehler called the meeting back to order at 8:50 p.m.
PERSONNEL MANUAL: Hazen stated that she wishes change much of it
. to make it legal. There are many parts that need to be corrected.
RESOLUTION: Loso made a motion to approve a Resolution Concerning
a constitutional Amendment to Create a New Property Taxpayers'

. Trust Fund in Minnesota; seconded by Rieke.
Ayes: Dehler, Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
Sadlo made a motion to approve a Resolution Requesting Revised
Delineation of Census Defined 1990 st. Cloud Urbanized Area
Boundary, which would include the population of the City of st.
Joseph and surrounding urban development. The motion was seconded
by Rieke.
Ayes: Dehler, Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
ROSKE PROPERTY: Mayor Dehler stated that the ballot question
concerning the amount of expenditure for this parcel of property
failed, but Gerry Roske said that the City may work through the
Realtor if still interested in any part of the property. Loso
stated that the City went through the process, of contract,
referendum by petition, and election. Now it is a dead issue.
Rieke stated that this is part of a feasibility study, and will
continue to live through it. Perhaps a lesser price can be
negotiated. Sadlo stated that he would be against condemning
property already in use, to gain needed property, for the City.
Loso stated that what the City has is adequate except for the Fire
Department.
. BONDS - 1983 CLINTON VILLAGE IMPROVEMENT: Monte Eastvold
presented a resolution to call the 1983 Clinton Village
Improvement Bonds. Hazen made a motion to approve the resolution
to call the remaining $75/000 bonds; seconded by Loso.
Ayes: Dehler, Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
BONDS - 1992 UTILITIES - SANITARY SEWER AND LIFT STATION: Monte
Eastvold presented several scenario of financing for the North
Industrial Park Sanitary Sewer and Lift Station and 91st Avenue
Sanitary Sewer. After discussion Loso made a motion to have a
negotiated bond sale for $365,000/ at the next meeting. The
motion was seconded by Rieke.
Ayes: Dehler, Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
EASEMENT REQUEST - ROSS RIEKE: Rieke stepped down from his chair
and approached the Council. He presented a letter to the County
Auditor's Office to request permission to place trees on the lot
line, of the lot adjacent to his property, currently being held by
the State of Minnesota. Ross asked if he would be allowed to
place the trees on the property line of the easement or two feet
inside the easement, if he gets the adjoining property owners'
approval. Loso stated that the easement ordinance does not allow
. it. Ross asked if the Council would grant a variance in this
issue. Loso made a motion to table the issue until there is an
agreement on trees 8, 9/ 10, 11, and 12 with the property owner,
to place them on the lot line; seconded by Hazen. Discussion -
This is tabled until written approval from both property owners is

CANVASS ELECTION RESULTS: The City Council acting as a Canvassing
Board reviewed the results of the November 5, 1992 General
Election. Loso made a motion to approve the results as submitted
by the election judges as follows:

Loso stated that the st. Joseph Recreational Association intends
to come to the next meeting to reimburse the City $11/927 which
. was borrowed by agreement, for improvement of Millstream Park
Softball Field area.

Truth in Taxation recessed date must be at least five days after

PERA REFUND - STATE AID: Sadlo made a motion to refund the Excess
Police State Aid due PERA as required by the state; seconded by
Loso.
Ayes: Dehler, Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
Council agreed to allow planing a team building gathering of
Council and Employees during the holiday season to include the
newly elected officials also.
Loso made a motion to adjourn at 10:14 p.m. seconded by Sadlo.

Star City Commission Ordinance
The following is a sample ordinance which designates a Star City commission. It
is not necessary for communities to have as complex an ordinance as the sample.

ORDINANCE NO. 176
AN ORDINANCE ADDING A NEW CHAPTER 15
TO THE CITY MUNICIPAL CODE ENTITLED
"ST AR CITY COMMISSION"
1. The City Council of the City of does ordain that:
there shall be added to the Municipal Code of the City of
a chapter numbered 15 which shall read as follows:
15.01 Short Title. This ordinance shall be known and may be cited as the
" Star City Commission Ordinance."
. 15.02 Definitions. For the purpose of this ordinance, the following words and
their derivations shall have the meanings as set out herein:
a. "Commission" is the Star City Commission of the City as created by
this ordinance.
b. "Chairman" is the Chairman of the Star City Commission as
provided hereunder.
c. "Vice-Chairman" is the Vice Chairman of the Star City Commission
as provided hereunder.
d. "Secretary" is the Secretary of the Star City Commission as
provided hereunder.
e. "Planning Commission" is the City Planning Commission of the
City of
15.03 Establishment. A Star City Commission is hereby established to be
advisory to the Council and Planning Commission, which Star City
Commission shall have the powers and duties hereinafter set forth.

15.04 Terms of Office. Of the members of the Commission first appointed,
three shall be appointed for terms expiring in January of 1984, and two
shall be appointed for terms expiring in January of 1985. Upon
expiration of said initial terms, future appointees shall serve three-year
terms expiring in January of the appropriate year provided, however,
that members shall continue their terms until new appointments or
reappointments are made by the City Council. The City Council shall
make appointments to the Commission at its second official meeting in
January of each year or as soon thereafter as it desires. Vacancies during
the term shall be filled by the City Council for the unexpired portion of
the term.
15.05 Qualifications. The Commission shall consist of the following: One City
Council member; one Utilities Commission member; and five members
of the community representing, but not limited to, the Chamber of
Commerce, the Improvement Association, Independent School district
Board, Area Board of Realtors, and the general public; also one
representative of the County Ministerial
Association; and one County Commissioner from either District #2 or
District #3. The City Administrator, director of the State of Minnesota
. Job Service Office, and the director of the Job Training Center shall
serve as ex-officio members of the commission.
15.06 Removal of Members. The Council by a four-Í1fths vote of its members
shall have the authority to remove any member of the Commission from
office whenever, in its discretion, the best interest of the City shall be
served thereby.
15.07 Meetings, Officers. The Commission will name its own officers to serve
at its pleasure from the membership of the Commission.
a. Regular Meetings. The Commission shall meet publicly in regular
session at least once each month at a time and place selected by a
majority of its members.
b. Special Meetings. The Chairman or any three (3) members of the
Commission shall have the authority to call a special meeting of the
Commission. Written notice of special meetings shall be given to all
members at least twenty-four (24) hours prior to the time of the
meeting unless the time and place for the special meetings is set at a
regular meeting.

15.08 Commission Staff. The Commission shall receive the staff services of
the City Administrator and approved by the City Council within the
means provided by an appropriations made therefore by the City
COuncil.
15.09 Rules and Procedures. The Commission shall adopt a set of rules to
govern its own meetings and procedures. The rules may be amended
from time to time, but only upon notice to all members that the said
proposed amendments shall be acted upon at a specified meeting. A
majority vote of the Commission shall be required for the approval of
the proposed amendment.
15.10 Absence of Members. Absence from three consecutive regular meetings
without the formal consent of the Commission shall be deemed to
constitute a resignation of a member; and the vacancy thus created shall
be filled thereafter by appointment of the City Council for the remainder
of the tenn of the member so deemed to have resigned.
15.11 Powers and Duties. The Commission shall have the following powers
. and duties:
a. To confer with and advise the Council and Planning Commission on
all matters concerning the industrial and commercial development of
the City.
b. To publicize, with the consent of the Council, the industrial a~d
commercial advantages and opportunities of the City.
c. To collect data and infonnation as to the type of industries and
commerce best suited to the City.
d. To periodically survey the overall condition of the City from the
standpoint of determining whether the City has a community climate
for industry and to detennine the general receptiveness of the City of
particular types of industry.
e. To publicize information as to the general advantages of industrial
and commercial development in a community.
f. To cooperate with all industries and businesses in the city and in the
solution of any community problems which they may have, and to

encourage the expansion, development, and management of such
industries and business so as to promote the general welfare of the
City.
g. To cooperate with the Regional Development Commission in the
undenaking of necessary surveys and studies in the furtherance of
commercial and industrial development.
h. To aid the Council and Planning Commission in the proper zoning
and orderly development of areas suitable for industrial and
commercial development.
1. To develop, compile, coordinate, and publicize information such as,
but not limited to, the following:
1. Existing industrial and commercial concerns with the City, their
addresses, type of business, number of employees, and
whether each serves local, regional, or national markets.
. 2. Available industrial and commercial sites, including number of
acres, approximate price, existing zoning, and proximity to
. trackage and highways.
3. Available buildings for industrial and commercial operations,
including type of building, number of square feet, existing
zoning, and proximity to trackage and highways. (Minn. State
Dept. Form.)
4. Transportation facilities, including railroads, motor carriers,
water transportation, air transportation, and highway facilities.
5. Electric power available.
6. Fuels available for industrial and commercial use.
7. Sewage disposal facilities.
8. Water supply facilities.
9. Community facilities such as fire, police, and educational.

10. Recreational facilities.
11. Going wage rate in the City for the trades, skilled, semi-
skilled, and white-collar workers.
12. Availability of labor.
13. General community attitude toward industrial and commercial
expansion, development, and attraction.

in regard to industrial and commercial expansion, development,
and attraction.
J. To recommend to the Council and Planning Commission policies
and particular actions in regard to industrial and commercial expan-
sion development and attraction.
k. To cooperate with and use the facilities of the Minnesota Deparnnent
. of Trade and Economic Development's Star Cities Program.
1. To cooperate and coordinate with the Improve-
ment Association, the Area Board of Realtors,
and local lending institutions in defining available property and
assembling financing packages for commercial and industrial
prospects.
m. The Commission shall have the power to appoint subcommittees of
a size and nature it may deem necessary and may enlist the aid of
persons and/or organizations who are not members of the
Commission. The Commission shall have no power to make
contracts, levy taxes, borrow money, or condemn property, but
shall have the full power and responsibility to investigate the
necessity and recommend the taking of these and any other actions
related to the industrial and commercial development by the Council
and all other officers of the City responsible to fonnulate the tenns
of and the procedure for taking such action.
15.12 Annual Report. The Commission shall make a report to the City Council
of its activities in December of each year.

15.13 Severability. The various s~tions and provisions of this chapter are
severable, in the event anyone or more of its sections or provisions
shall be found to be invalid or otherwise defective by a Court of
competent jurisdiction, such invalidity or defect shall not operate to
render other sections or provisions invalid.
2. This Ordinance shall become effective upon publication.

2904 Plaza VII Steve Dehler had asked me to prepare a resolution
45 South Seventh Street addressing the timing of connection to the sanitary
Minneapolis, MN 55-102-1620 sewer system. One ordinance provision requires
612,339.9206 connection within 90 days of receipt of official notice

. those regulations have any timing provision.

. RESOLUTION ESTABLISHING TIME FOR
CONNECTION TO SANITARY SEWER SYSTEM
WHEREAS, the City of st. Joseph has recently annexed a
significant number of properties which have been in need of
sanitary sewer services;
WHEREAS, Ordinance 42.7 requires properties producing
sanitary sewage to connect to the City's system within 90 days of
receipt of official notice from the City to connect;
WHEREAS, Ordinance 51.2 requires residential buildings
constructed in the City to connect to sanitary sewer in
accordance with City regulations, where available; and
WHEREAS, the city Council wishes to add some consistency and
standardization to the time in which annexed properties may be
. required to connect to the city sanitary sewer system;
IT IS HEREBY RESOLVED:
1. That properties annexed by the city, containing
structures which produce sanitary sewage, shall connect to the
City's sanitary sewer system, as available, no later than one
year from the date of annexation; except, if the property is
without a septic system which complies with the applicable
regulation of Stearns County, regarding sanitary sewage
discharge, connection shall be made no later than 90 days from
the date of annexation.
2. This resolution shall serve as official notice to
property owners to make connection to the sanitary sewer system
in accordance herewith.

SUBJECT: MONTHLY INCIDENT REPORT
Dear Council Members,
I will be unable to attend this months council meeting as I will
be deer hunting, and on vacation. There might be a couple of questions
on the incident report on two items. The first one is a robbery, this
was reported to our department and investigated. This case has been
cleared as bei~AI"unfoundedl. The reporting party reported that unknown
persons stoppe va car, assaulted him, took his money and left. This person
. was intoxicated, and got in a fight with one of his friends on the way home.
The call however was that of a robbery, and tqat is how it has to be coded
in the incident report. The other item that'lbe of interest is escape/flight
related. This person escaped from an officer after being detained for an
alcohol violation, and fled from the officer. After a short foot chase,
the party was apprehended hiding in a car and was arrested.
Jean Gustin and myself had a meeting with the principal at Kennedy
School relative to a new DARE program for 3rd graders. The school very
much wants the program. It is a 5 week introduction to DARE, 1 hour a
week for three classes. (total officer time 15 hours) We will effect or
impact approximately 115 more kids. We have enough money in the DARE
account, it is at approximately $2,400.00 without counting/using city
funds. This is all the grant/donated money ($2,400.00). If the council
has no objections, we will do this project around Jan, in addition to the
Lab School.
Brad Meyer and myself are currently making the changes recommend by
John Scherer in the reserve by-laws. We should have it ready for the Dec.
meeting.
Enclosed is the letter I sent to J.R.'s & Stueves relative to towing.
Also enclosed is the response form both people. After reviewing the bids,
and assessing our needs, I would recommend Stueves continue our towing.
After two years, I have absolutely no complaints on his towing. He has
the equipmen,t for very bad accidents, and he has extra space available
to store cars across from City Hall.
Also enclosed for your review is the letter you requested me to write
. to the new city residents on 91st ave, and another thank you letter. Thank

It is that time of year again that the police department is tequest-
ing bids for next years police towing. As you know, the police departmen
orders tows for accidents, arrests, blocking traffic, snow removal, etc.
Because of these all encompassing situations, I would like you to pre-
sent your bid with the following factors considered and listed.
1. Basic towing charge
2. Extra costs involved for lock smith, shoveling snow, dollying,
debris clean up, etc.
3. Inside/secure storage availability.
4. Amount of outside storage, how much, where?
. 5. Any special equipment you have, or other abilities you have
to better aid the police department in the areas of towing.
If you have any questions on this matter, or if I can be of help to

Hello, my name is Brad Lindgren, and I am the Chief of Police for
the City of St. Joseph. I would like to officially welcome you to the
city, and apologize for the delay in doing so. As you may already be
aware, the police department gets considerably busier in the fall of
the year.
The St. Joseph Police Department consists of five full time licensed
pOlice officers. As new members to our city, along with other city serv-
ices, the St. Joseph Police Department will be your primary law enforce-
ment agency. This means our department will have the responsibility of
. taking all law enforcement calls from your area. CallS such as accidents
medicals, disturbances, suspicious persons and vehicles, etc. This depar
ment will also conduct all criminal investigations relative to your area,
I.E. burglary, criminal damage to property, theft, etc. In addition to
this, as I'm sure you are aware, our department also provides routine.
patrol, traffic enforcement, etc.
Should you have any questions, or specific concerns you feel this
department should be aware of, please feel free to call, stop in, or
flag an officer down on patrol. Our goal is to provide the best, and
most professional law enforcement service to the citizens of our communit
