5. I have included bills payable to have end of the year
bills approved for 1992.
8 . c) Mark Lambert will be at the meeting to address the
hookup fees again. I contacted both Joe Bettendorf and
John Scherer. They will both be there about 7:30 for this
issue. Bill Fahrney, of Economic Development Partnership
stated that, regretfully, this is not in their realm.
Their purpose is to assist in getting industry and
business to increase jobs.
11. Joe Bechtold and Anna Reischl wish to present the
. Council with a quit claim deed for approximately an acre
of land by the old dump. This is property owned by the
Township and ( I believe) formerly used as a dump by both
the City and Township residents. John Scherer is
informed of this, and I understand he has reservations,
on accepting this parcel. He will give counsel at the
meeting.
12. Mark Zimmer will appear for The LaPlayette to allow
gambling there again. Because of gambling violations,
almost a year ago, no gambling was all owed in the
LaPlayette, for one year. His year of no gambling is
nearly expired.
13. This number was inadvertently omitted, and I did not
notice it until the copies were made.
14. a) These are the year end licenses, a copy of them is
enclosed.
b) Ray Bechtold has requested to carry over two days
vacation into 1993. He currently has four days left,
but intends to use two days prior to the end of the
year.

Pursuant to due call and notice thereof, the City Council for the
City of st. Joseph met in regul~r session, on Thursday, December
3, 1992 at 7:00 p.m. in City Hall.
MEMBERS PRESENT: Mayor Steven Dehler (arrived at 7:25 p.m.);
Members of the Council Leo Sadlo, Ross Rieke, Bob Loso, Stephanie
Hazen. Clerk/Administrator Rachel Stapleton.
OTHERS PRESENT: Daniel Nierengarten, Bud Reber, Stuart Goldschen,
John Welsh, Mark Lambert, Judy Weyrens, Dick Taufen, Iver
Linnemann.
Acting Mayor Sadlo called the meeting to order at 7:00 p.m.
AGENDA: Loso made a motion to approve the agenda with additions;
seconded by Hazen.
Ayes: Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
MINUTES: Hazen made a motion to approve the minutes of the
November 19 meeting as presented; seconded by Loso.
Ayes: Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
~LLS PAYABLE: Hazen made a motion to approve the bills payable
or December, as presented by Deputy Clerk Judy Weyrens; seconded
by Loso.
Ayes: Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
Judy also discussed with the Council that the Police Department
has had computer problems and has lost data. She requested tape
backup equipment, to serve the Police Department and city office
computers. Hazen made a motion to approve the tape backup
equipment at a cost of $900; seconded by Rieke.
Ayes: Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
Sadlo discussed the past request for timers to turn the Christmas
lights on and off. Loso made a motion to approve the purchase of
seventeen timers at a cost of $272, the cost to be distributed
over various applicable departments. The motion was seconded by
Hazen.
Ayes: Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
COUNCIL REPORTS - LOSO: 1) The matter of $11,927 which was
donated by the Recreational Association, for the Recreation Center
Fund " was referred to the Park Board for their recommendation at
~e last Council meeting. The Park Board recommended that those
.onies be transferred to the Park Development Fund according to
the previous contract. Loso made a motion to transfer the $11,927
to Park Development Fund and to accept the Recreation Center
Committee's request to retain the balance of the monies in the

Recreation Center Fund for the purpose of a recreation center.
The motion was seconded by Hazen.
Ayes: Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
2) Loso also read a newspaper article concerning Hibbing's
violation of the open meeting law, and the penalties which were
imposed. Concerning the Roske property situation or any matter,
the council should make sure that all laws and statutes are
followed. Rieke felt that we should have attorney present at more
meetings. He also felt that many other matters should have legal
council at meetings. Hazen and Sadlo also felt that legal council
at a portion of each meeting would be appropriate. 3) Loso also
inquired about the location of a tape from a closed meeting, held
March 5, 1992, which the Clerk was not present. The tape is not
in the city office. Loso stated that he understood that the Mayor
has the tape, and requested that it be returned prior to the Mayor
leaving office.
HAZEN: No report.
RIEKE: Rieke presented an old title opinion, for property located
on the Northwest corner of Minnesota street and Sixth Avenue NW.,
and stated he has an old abstract for the property, also. An
agreement with Mrs. Borresch may be worked out which would allow
4Ithe City to clean up this property, as a benefit to the community.
Dehler arrived at 7:25 p.m. and assumed the Chair. He apologized
for his tardiness, which was due to bad weather conditions.
SADLO: 1) Avon Bank has title to the property, which is next to
the City maintenance shop property, and was used by the Mill. The
asking price has been reduced but it is sti 11 to high, because
this property has been used for a private dump in the past. This
property would have to be cleaned up, before the City would take
possession of it. 2) Fire calls for the second half of the year
were presented. There were 64 calls at a cost of $4,453, plus
fire drills and officers salaries at a total cost of $8,773. 70%
of the calls were medical and 30% were fire calls. Sadlo stated
that there is a need for an adequate fire hall and adequate
parking for the volunteer firefighters. Response time is
important and can be affected by parking problems.
3) The facility for the sanitary sewer project for the North
Industrial Park area will be running in December. A water well
will be dri 11 ed for water supply for the facility.
MAYOR REPORTS: 1) Mayor Dehler brought up the need for a tape
backup for the Police Department computers, and timers for turning
the Christmas lights on and off. (These matters has already been
addressed.)
2) S.~Moira and Mayor discussed property sites for future City
4IIell sites. Dehler has asked the Clerk and Engineer to prepare a
ritten request for st. Benedicts to offer property sites of their
propertYr for sites to consider for future wells. They do not
wish to release any of the property to the west.
3) Roske property - Dehler asked for discussion of the proposed

contract for the Roske property. Loso stated that the original
petition called for public hearings, which the City did not honor,
and for a referendum. The City should honor the request for
public hearings. The ballot question asked two things, if the
city should purchase that property and if the City should pay up
to $150,000 for it. Minnesota statute requires that the City bow
to the wishes of the voters. Also the statutes do not allow any
contact with money down prior to providing for notification and
petition for referendum. Minnesota statute may not even allow
this issue to be brought up within six months of the voters
turning it down. Rieke asked if the Mayor had consulted the City
Attorney on this mat teL The Mayor stated he did not, and wished
to wait until '~ was approved for legal consultation. Dehler

stated that the voters had voted on a different contract.
At this time Dehler made a motion to enter into a legal agreement
to purchase the Roske property for 130,000 based on a five year
contract. Rieke seconded the motion, with the stipulation that
the City Attorney advise and approve this .¡..'

other discussion - Sadlo stated that the voters denied this issue
by 100 vote spread. 500 voted positively, yet no resident has
asked him, nor have they asked anyone he knows, to have the City
411hqUire this property. All contacts have been negative.

against it.
Dehler stated the importance of the Council's working together for
the good of the people.

OLD BUSINESS - PERSONNEL POLICY MANUAL: Hazen presented a draft
of the completed personnel policy manual and would like to have
the Council members and City Offices go through the document, for
truth. She has already been shown a correction to page 39 for
sick leave. After necessary corrections are made she stated she
would like to have the attorney go through it and have the manual
in place 1-1-93. Sadlo asked on annual evaluation program. Hazen
stated that she would like to have each employee evaluated once a
year, and that she has received forms for this purpose. Council
could bring their copies with corrections back to the special
meeting, for Hazen to make corrections, and then have John review
it. Dehler stated that a responsibility should be assigned to
specific needs. Hazen stated that she referred a lot to check
with the City Offices, because she did not know who to refer
responsibilities. Also, as a final document, an I-9 form is
attached, which is required. The City currently is doing this for
all new employees. This requirement may be for all employees.
She stated that she spent a lot of time on it but wishes to have
~ach one go through it for correctness. This should be reviewed
nnually and she has it on Work Perfect, which she will give to
the City offices. The corrected manuals are to be reviewed by the
9th and back to Hazen.

TREASURERS REPORT: Sadlo made a motion to approve the treasurers
report for October; seconded by Loso. Discussion - Hazen stated
that a column is to be included for transfer information.
Ayes: Dehler, Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
Council discussed having the assessor at the Truth in Taxation
hearing. Dehler stated that the property valuation hearing is in
the spring at the Board of Review meeting. Also the assessor lS
responsive to those who call him about valuations.
STAR CITY: Dehler stated that the Chamber of Commerce should give
a presentation to the City Council in January. The Council
members had not had an opportunity to review the information.
Hazen stated that Cold Spring has recently become a star city, and
they may be able to provide some information. Dehler stated that
the Chamber may wish to use them as a resource.
OPEN TO THE PUBLIC: Bud Reber asked if the hookup fees to
utilities is $2,285. This amount includes water and sewer hookup,
inspection fees, and water meters. Reber stated this is quite
high compared with area cities. Rieke stated that this is one
area where we can calculate our costs, and he is a proponent of
recouping our costs, when they buy into the utility systems.
~ehler reminded the Council to consider park development planning,
for next year, for the lot in Clinton Village, purchased by the
city, for future access to the Tot Lot by Park Terrace.
Rieke stated that he received a call from a developer who
constructs twin homes, to see if there would be interest ln our
community.
Hazen made a motion to recess for 15 minutes, at 8:10 p.m.;
seconded by Loso. Discussion - Dehler invited all in attendance
to the Nutcracker to be performed at the BAC, at the College of
st. Benedict.
Ayes: Dehler, Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
Dehler reconvened the meeting at 8:25 p.m.
MINUTES: Rieke made a motion to reconsider the minutes of the
November 19 meeting, and change 2) under his report on page 2139,
that "It would be very difficult to clear the property of liens
and judgements and will be a challenge and time consuming. He
also requested to review other portions of the minutes with the
tape of the meeting. The motion was seconded by Sadlo.

APARTMENT PROPOSAL: Mark Lambert discussed with the Council that
he is getting his financing in place, for his apartment proposal,
through a conventional loan. He stated that he would like relief

from the high hookup costs, of $1,800 per unit. He felt this
amount will break the financing on the project. Sadlo felt that
he should be required to pay hookup charges like everyone else.
Dehler stated that other apartment complexes had to pay the
charges that were established at the time they were constructed.

constructed to allow for growth. The utility improvements were
financed with hookup charges incorporated into the formula.

Rieke felt that we should study the matter with the City Engineer,

the December 17 meeting, and to have the consultants bring back
recommendations; seconded by Rieke.

~PACT STUDY GROUP: The Council discussed the Impact study Group,
ich is a small group doing a study of the impact of the college
on the city, and the benefits, values, and costs to the city, and
costs of city services to the college.
CLERKjADMINISTRATOR REPORTS: 1) Lose made a motion to approve the
attendance of the Water Superintendent at Water Conference in st.
Cloud; seconded by Sadlo.
Ayes: Dehler, Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
2) Sadlo made a motion to approve a transfer of the Cigarette
license of the st. Joseph Liquor Shoppe, from the old facility to
the new facility; seconded by Hazen.
Ayes: Dehler, Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
Lose made a motion to approve the following matters; seconded by
Hazen.
1) Application for Payment - Sanitary Sewer (North Industrial
Park) Contract 1 S. J. Louis Company, of $113,110.80.

2) Application for Payment - Water System Improvement (Water
Tower) Contract I I , - CBI Na-Con, Inc. $14,012.50.
3) Surplus property - C 800 Ford TrucK was advertised for sale.
One bid on it from Bill Wasner for $636.00, was received.
4) Jerry Hirschfeld has invited the Council etc. to a tour and
. open house at MCO on some date prior to December 24th. The
Council is to select the date. The time will be at 4:00 p.m.
Council selected Honday, December 7th.

CAPITAL OUTLAY REQUESTS: Clerk/Administrator presented two
capital outlay requests from the Street Department. 1) Council
considered the request for a 1975 -1980 Snow Plow Dump Truck, to
put a $250 deposit down to hold the request until the summer or
fall of 1993. The actual cost will be $15,000 to $19,000. They
agreed to place the matter on the next agenda, and consider it,
with budget information available. 2) Rieke made a motion to
approve the request for a new power hack saw at a cost of $199;
seconded by Hazen.
Ayes: Dehler, Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.

.pursuant to due call and notice thereof, the city Council for the
City of st. Joseph met in special session, on Wednesday, December
9, 1992 at 7:00 p.m. in City Hall to conduct a Truth in Taxation
budget hearing.
MEMBERS PRESENT: Mayor steven Dehler; Members of the Council Bob
Loso, Stephanie Hazen. Clerk/Administrator Rachel Stapleton.
OTHERS PRESENT: Judy Weyrens, Arthur J. Reber, Marie C. Reber,
Daniel Nierengarten, Bud Reber, Hub Klein, Claudette Klein, Brad
Lindgren, Ken Hiemenz, Edmund Kraemers, Ronald Eiynck, Tom H
Klein, stuart Goldschen.
Mayor Dehler called the hearing to order and gave a presentation
with visual overheads, and handouts, of the information. He
discussed the proposed budget, of 676,597, Hith a proposed levy of
246,000 which would provide a net levy of 142,629, with HACA and
Equalization Aid. He discussed that the gross levy lS 26,013
greater than last years levy, which is 11% over last years levy.
The proposed expenditures are 53,397 less that last years budget.
He also discussed services provided, sources of revenue, and
comparison to other cities.
Hub Klein asked how administration budget could decrease by
4It30,000, and how the police budget can be cut. 15,000 was
udgeted for elections for 1992, which included new election
equipment, and plus other cuts, for administration, The Police
Department budget for 1992 included a computer system, and there
were other general cuts.
Why the levy was increased and expenditures were decreased was
asked. Because anticipated interest revenue on fund balances has
decreased by one half, and last years budget included reserved
money for equipment expenditures. The Council has agreed to allow
Capital outlay budgeted amounts not spent in 1992 to be carried
over into the 1993 budget.
other issues discussed were that the City lS now required to pay
sales tax to the state; annexed property requires city services,
but the city is always a year in arrears in receiving tax revenue.
HACA, LGA, Equalization Aid, were discussed.
Edmund Kraemers discussed the increase in property valuations, and
the effect it has on property tax. Bud Reber stated that the
County has adopted a new manual, according to the Assessor, so it
has changed the valuations. Valuation questions may be addressed
at the Board of Review meeting in the spring. The budget hearing
is to discuss the services provided, and financed through the
,
levy.
~oso stated that the State will be returning about 8% additional
GA dollars to the cities. Our city could reduce the levy by
about $26,500. The city should self impose a 3% levy limit.
Dehler stated that the past 3% levy limit was incl uded in a

formula which allowed a much greater levy than 3%. He also stated
that we are probably withip the 3% increase, using the previous
formula. Loso also stated that the budget could be reduced by
5,000 by deleting the category "Proposed City Complex." Dehler
stated that approval for Economic Development Partnership dues
needs to be addressed in the budget. Dehler made a motion to
change the budget to allocate 7,500 for dues to Economic
Development Partnership, to be taken from the Proposed City
Complex category. The motion was seconded by Hazen.

Hazen made a motion to approve the 1993 budget as follows, with a
certified levy of 240,000; seconded by Dehler.

SUBJECT: MONTHLY REPORTS
Dear Council Members,
In addition to the (Nov. ) monthly reports please find enclosed the
following items. Two of the items will require council approval·.
The first item is the Police ReserVè Unit. A copy of the new by-laws
are enclosed with John Scherers additions put in. He had several ideas,
and they were positive changes. Also as requested by the council are the.
applications for thè four mèmbers each has had contact with the department
4IÞ and has been riding along in the past. I will contact each and try to have
all attend this council meeting along with Officer Meyer who will be the
Liaison Officer.
The other item is washing the squad. We have about 3 washes left at
the SA station. We purchased 100 washes and have a fleet code there. This
has lasted us for two years. I spoke td Bob Krebsbach and he indicated that
they would sell us another 100 washes for the same price of $1.80 each. This
is the wash, wax, and dry we have now. I think this has worked well, and
would like to purchase another 100 washes.
The other items are for your review. We received two thank you letters
this past month. The first one was for our response to a medical and came
with a plate of cookies(I seemed to have misplaced the cookies) and the other
one is relative to a D.A.R.E. talk Jean & I gave to the J.C. 's (they also
donated $400.00 to D.A.R.E.)
Some of you have commented to me that the business owners really like
the information the police share with them in connection to cases that may
effect their business's. Enclosed is one of the several items sent to local
business's relative to this topic, it is a check forgery case we are working
on, and sent out; this past week.
Another item, and for your review, is a letter I wrote to Jeff Young
congratulating him on a good job he did over this past weekend when a party
form St. Cloud pulled a knife on a St. John's student here in St. Joseph.
Finally, enclosed is the F.B.I.'s release of law enforcement officers
killed in the line of duty for the first half of 1992. As you will note in
past incident reports, our department responds to many of the same types of
calls these officers were when they were killed. F.Y.I.

blank check. are .till outstanding, and are now currently being torge4
around the area.
The victim lost her purse in Feb. of 1992, and reported it to th1.
department. The checkbook however, (see copy of check) was not:in her
purse. The forged checks on this account have now shown up, and' were
written in Nov. of 1992. I
As ot this date, there are still 10 checks left outstanding. The
checks are drawn off of TAMMY JEAN BOERBOOM account of METROPOLITAN FEDERAL

If anyone, male or female att~mpts to write, pass, or has these cheeka,

Dear Jeff,
In speaking with you over the weekend, and after reviewing the arrest
reports relative to TODD MICHAEL BRAUCKS, I wanted to take a min~te to say
congratulations on a job well done.
As you are aware, the presence of the squad car coming through ,~"." ,il
the alley was enough to make the suspect put away his knife and leave the
confrontation. You were alert to the gathering, and instead of driving past,
you stopped and inquired as to what went on. You then gathered suspect(s)
4IÞdescriPtions, direction of travel, etc. and relayed this information to
. Officer Erickson. Your search of the area turned up all four of the suspects,
in both vehicles. Your stop of the suspects revealed the perpetrator, the
weapon used, and lead to the arrest in this incident.
Jeff, you did a fine job in this Cdse. From being on patrol and alert
to the situation, to the arrest, and in your follow up investigation, in-
cluding victims statements and the use of photo line ups. In our jOb it
is too easy to just say its part of the jOb, and it is, I would like to
add however; JOB WELL DONE.

Twenty-four law enforcement officers were killed
feloniously in the line of duty during the first six months of
19~2, according to preliminary national figures released today by -. .--
FBI Director William S. Sessions. This year's semiannual total
was much lower than for January through June, 1991, when 44
officers were slain.
Firearms continued to be the weapons most often used in
the slayings of officers. During the first half of this year,
. handguns were used in 14 of the murders, rifles in 4, and a .,
"
shotgun in 1. One officer was killed by a bomb explosion, and 4
were intentionally struck by vehicle~.
Geographically, 14 officers were slain in the Southern
states, 6 in the Western States, 3 in the Midwestern States, and
1 in the Northeastern states.

Fourteen officers were slain during arrest situations. I
Among the 14, 6 were attempting to prevent robberies or apprehend
robbery suspects: 3 were attempting to apprehend burglary
suspects: 2 were involved in drug-related situations: and 3 were
attempting arrests for other crimes. Four officers were killed
upon responding to disturbance calls: 4 while enforcing traffic
laws: and 2 while investigating suspicious persons or
. circumstances.

· Five officers were wearing body armor at the time of

their deaths, and 1 was killed with his own weapon.
All of the 24 killings have been cleared by law

enforcement agencies. An additional 29 officers lost their lives
due to accidents occurring during the performance of their

A. CHIEF OF POLICE:
· THE ONE PERSON WHO IS IN CHARGE OF ALL POLICE ACTIVITIES, BOTH REGULAR AND

D. LIAISON OFFICER:
A REGULAR, FULL TIME, LICENSED POLICE ' OFFICER OF THE ST. JOSEPH POLICE
DEPARTMENT SO DESIGNATED BY THE CHIEF OF POLICE TO CARRY OUT THE POLICIES
AND TRAINING OF THE UNIT IN HIS ABSENCE.
C. CAPTAIN OF RESERVES.
THIS IS AN APPOINTED POSITION BY THE CHIEF OF POLICE, WHOSE TERM RUNS
INDEFINITELY AND CAN ONLY BE TERMINATED BY THE CHIEF OF POLICE. THIS
INDIVIDUAL'S JOB WILL II\CLUDE, BUT NOT LIMITED TO, THE TOTAL OPERATION,
FUNCTION, AND SCHEDULING OF THE RESERVE UNIT. rHlS INDIVIDUAL IS

OF THE POLICE RESERVE UNIT.

CAPTAIN OF RESERVE) BY THE CHIEF OF POLICE. THEIR TERMS OF OFFICE ARE
INDEFINITE NATURE AND CAN BE TERMINATED BY THE ACTION FROM THE CHIEF OF
POLICE.
· THE SERGEANTS WILL BE IN COMMAND OF A SQUAD OF PATROLMEN. -'IE/SHE SHALL BE

CHIEF OF POLICE. MEMBERSHIP SHALL CONTINUE DURING GOOD FAITH PERFORMANCE
OF DUTIES AND MAY BE DISCONTINUED AT THE DISCRETION OF THE CHIEF OF
POLICE. AFTER COMPLETING THIS PERIOD, MEMBER WILL BE CERTIFIED BY THE
CHIEF OF POLICE.
E. ALL APPLICANTS' AND OR MEMBERS MUST BE IN GOOD PHYSICAL CONDITION AND GET A
GENERAL PHYSICAL OF FAMILY DOCTORS O.K..
F. ACTIVE MEMBERSHIP SHALL REQUIRE PRESENCE AT A MINIMUM OF ONE (1) MEETING

THE CHIEF OF POLICE. HAS lHE RIGHT TO PLACE ANY RESERVE OFFICER ON INACTIVE

ANY RESERVE OFFICER FOUND GUILTY OF ANY OF THE FOLLOWING BREACHES OF CONDUCT

Dear Rachel.
I have enclosed invoices for cost incurred or advanced on
the sewer line project as follows.
1) Reimbursement of advance:
· The Helland/Backes/Hirschfeld partnership advanced the
City of st. Joseph $20,000 to start the engineering
drawings on the sewer project. We are now requesting
reimbursement for this advance as the project was
approved. We would like to be included, at your earliest
convenience, in the payout of costs on the project. The
check should be made out to the Helland/Backes/Hirschfeld
Partnership.
2) Legal Description:
During the annexation process Paul Wellen & Associates
prepared the overall legal description of the properties
being annexed. I had DBL Labs originally pay this bill
in the amount of ~311.ûO but it is really part of the
total project cost. So we are requesting that the
project contingency fund reimburse DBL Labs in the amount
of $311. 00.
