Mayor Bud Reber called the meeting to order at 7:00 p.m.
EAST MINNESOTA STREET - 91ST AVENUE IMPROVEMENT: Mayor Reber allowed questions
from those in attendance. Joel Vogel asked the sequence of annexation and
bidding the project. Joe Bettendorf stated that they would run concurrently.
Mr. Vogel asked about the mechanics of the bidding process. Mr. Bettendorf
told the group that a call for bids is publicly advertised, opened and the
Counc i 1 considers them and normally accepts the lowest responsible bid. Mr.
Vogel asked if the City would pick up any portion of the cost of project.

ture growth. He asked if the City ever rejects all the bids. probably not
the lowest bid is a responsible bid and is not considerably higher than the
engineers estimate. Mr. Vogel also asked if the project could allow the
property owners to re-seed and restore, in order to lessen the cost of the
project. Mr. Bettendorf stated that he could write up the specs with that as
an option. Mr. Vogel asked if their service lines could be installed by
digging a trench at the property lines and have services installed to the two
properties from the one trench. Mr. Bettendorf stated that this would be
allowed with a separate service to each property. He also asked about service
line installation and cleanouts. Mr. Bettendorf stated that the service lines
and cleanouts would have to be installed according to code.
Gerry Klaphake stated that the people are uncomfortable going into this
project, not knowing what it will cost. Joel Vogel asked about the roadway
ditch being built up by Dan pueringer's. Joe B. stated he would look at it.
Dan Pueringer asked about the width of the trench. Joe B. stated that it would
not be any wider than necessary.
Bob Kappes asked about the relationship of the bids to the amount of the bids
passed on to the property owners. The bid amount is passed on to the property
owner without marking it up. The property owners will be assessed the amount
of the bid along with engineering and financing costs.
Mark Thyen asked if water and sewer would run under the road. Joe B. stated
tìíes it would, without tearing up the roadway. Sewer would probably be run
irst, because it is deeper.
oel Vogel stated that he is not righting annexation but he would like to get
more than ten months use out of his septic system. John Scherer stated that
after notice is provided that a property owner must hook up to city sewer

John stated that Joel's situation is extreme and the Council
may need to make an independent decision for each situation of this type.
Fred Reber stated that annexation of these properties has been addressed by the
state Municipal Board 17 or 18 years ago, so the question of annexation should
not be an issue. He also asked if the Council could defer any assessments.
John Scherer stated that deferred assessments are not an option for property
outside the City. Deferred assessments are allowed for undeveloped property or
old age.
Bob Kappes asked if the home owners could finance the project themselves. John
stated that the City is the financing mechanism for the project. The
assessments may be paid in full by the home owners after the assessments are
imposed.
Mark Thyen asked how engineering and financing can be about 30% of the project.
Joe B. stated that the engineering is about 18% to 20% which includes the
planning and inspections. Financing is the balance. Interest accrues from the
time of the project until the assessments are received by the City, and this
cost has to be covered. Chuck Scherer asked if the assessments were paid
upfront in full, couldn't it bring down the cost of financing. John Scherer
stated that bonding is regulated by law. The City has to have mechanisms in
place to pay the bonds. Mark Thyen asked if the City knew how many property
~ners could uofront the assessments, if the assessments could be decreased.
hn Scherer stated that the City would need the money in the bank prior to
nding, before we could adjust the assessments because of upfronted money.
Kevin Schirmers asked if the City's cost for oversizing includes their share of
engineering also. Joe B. stated that the costs are spread throughout the
project, and pro rated accordingly.
Gary Heltemes asked if the time line is still the same. Joe B. stated that if
a decision is made tonight on the project, the time line will stay as proposed.
Dan pueringer asked if he could hook up his service line to the main on the
north side (Lynx Road) of his lot. Joe stated that he would have several
options to look at, because he has a corner property. Dan also asked if
Pondview Ridge will get assessed. Joe stated that provisions were made for it
in the plans. All properties which benefit now or as they are developed will
participate in the costs, either now or with hookup fees. No one gets a free
ride.
Jane Reber asked now that Whispering pines is out of the project, will the rest
of the project be absorbing their costs? Joe stated that the current
assessments for this project won't change much, and that down the road
Whispering Pines will have to pick up their share of the oversizing. Smaller
projects are usually more costly.

e there requirements for septic abandonment? Joel Vogel stated that this is
gray area. He had checked with County, MPCA, and the City, and there are no
clearcut rules for closing septic systems.
Fred Reber asked why the city does not finance this project itself and then let

the property owners pay the city. Chuck Scherer stated that the City should
let the property owners pay upfront in order to lessen the financing costs.
John Scherer stated that the city will look at prepayment as a means to collect
interest payments prior to collecting assessments. Also the City would need to
have assurances of the amount of prepayments it would receive. He also stated
that the home owners that wish to prepay assessments, should begin financial
arrangements now, because the window for payment to the city will be small.
After a suggestion from the floor to take a short recess to discuss this issue
with neighbors, Loso made a motion at 8:00 p.m. to recess for ten minutes;
seconded by Hazen.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
The Mayor reconvened the meeting at 8:10 p.m.
Joel Vogel asked how many years the terms would be and who makes that decision.
Mayor Reber stated that the decision would be made by the City Council, and
they would try to impose acceptable terms.
Fred Reber asked about the mechanics of the home owner borrowing for their
portion of the project and save financing. John Scherer stated he would look
into it.
tll[zen made a motion to accept the project with a 15 year assessment term;
conded by Rieke. Discussion of when it is necessary to set the terms. Hazen
withdrew the 15 year term, to be set at a future date and rephrased the motion
to include the area of the project was established to be Minnesota Street from
the current eastern limits to 91st Avenue, 91st Avenue from Lynx Road south,
and the properties of Styles and Cotton Dental Office and Walstrom's residence,
and the three parcels of Whispering Pines of Gary utsch, James Klein, and Gary
Heltemes, as recommended by the City Engineer; Rieke concurred.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
Loso made a motion to give the property owners the opportunity for each one to
pay his share of the project, with the City Attorney's clarification of the
legal allowances for this type of financing. After discussion of the time
allowances, (Joe Bettendorf felt that financing should be in place by August
1st) and the need to clarify the state statute requirements, Loso withdrew his
motion.
Jane Reber asked about the time line. Joe B. stated that the project will be
bid the first week of August, with construction beginning late August or early
September. Monica Stanger asked if they would get water this year. Joe B.
stated that water will come down Minnesota Street, with sewer down the back.
If any property owners should want special consideration they should make a
formal request to the Council.
tlltemenz made a motion to authorize the Mayor and Clerk to enter into a
solution to Amend the Joint Resolution for Orderly Annexation between the
City of st. Joseph and the Township of st. Joseph, to include the project
area, and authorize approval for annexation. The motion was seconded by Rieke.

Hazen mace a motion to approve a Resolution Ordering the Improvement and
Preparation of Plans for the East Minnesota street Sewer Project; seconded by
Loso.

AGENDA: Hazen mace a motion to approve the agenda as increased; seconded by
Loso.

MINUTES: Hiemenz made a motion to approve the minutes of the May 17 and May
20, 1993 meetings; seconded by Hazen.

CITY ENGINEER REPORTS: ï) Joe B. discussed with the Council that the contractor
for the well installation by the DBL Lift station will need a time extension.
This will be presented at the next meeting along with a change order. 2) A
change order will be presented at the next meeting for a door style change on
1II[e water tower, and they may need a two week time extension. 3) City
ficials will have an opportunity to determine where the lettering should be
aced on the water tower, next week. The painters will assist in marking the
ower so that it can be viewed from the entrances to the City. The City
officials may drive to the entrances to determine which way the "st. Joseph"
lettering wi 1 1 face.
Loso made a motion to approve a resolution authorizing an application for a
grant to install a walkway in Morningside Park; seconded by Rieke.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
MAYOR REPORTS: 1) Mayor recommended that the maintenance department paint the
trim white on the City Hall Annex. Hazen made a motion to approve the
recommendation; seconded by Loso.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
2) The Mayor reported that he had a call asking if the City is at all
interested in purchasing the Lymann Hull property. Loso made a motion that the
City is not interested in purchasing the property; seconded by Rieke.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
3) The City Administrator is to send a letter to Mr. Phillips on a problem
created on 7th Avenue when his neighbor had dirt hauled in, and wanted to place
tIIf in a low area of her property. The letter will state that the City will not
lock natural drainage. City Engineer stated he had talked to Mr. Phillips and
and the attorney will advise the City on this matter.
4) Loso made a motion to take the recommendations of the City Attorney
concerning a letter from a Mr. Able which was sent to the Members of the

Counc i 1 concerning actions of the Police Chief; seconded by Hazen.

Nayes: None. Motion carried.
COUNCIL REPORTS - RIEKE: No report.
HAZEN: No report.
LOSO: The Park Board recommended and Loso made a motion to approve
installation of signing the entrances to Morningside Park with "No Motorized
Vehicles in Park". Signs will be placed at the North entrance and at the
Northwest entrance. The motion was seconded by Rieke.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
HIEMENZ: Hiemenz asked who on the Council is supporting the concept of a
regional airport, as reported in the st. Cloud Times. No one on the Council
stated that they supported this concept, nor has there been a request to
support it.
BILLS PAYABLE: After discussion of the bills payable Hiemenz made a motion to
approve the bills payable as presented; seconded by Hazen.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
1IIÞso made a motion to approve cleaning of the computers in Administration, Fire
partment and Police Department, six computers at $19 each; seconded by Rieke.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
Mayor Reber presented a proposal to move the radio in the City offices. Hazen
made a motion to approve moving the local government band radio from the
Clerk/Administrator's office to a centrally located area in the City offices,
at a cost of $160; seconded by Rieke.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
TREASURER'S REPORT: Deputy Clerk Judy Weyrens gave the May treasurer's report.
Hazen stated that she had talked to the Chief about the D.A.R.E. category
being overexpended. He had stated that they have a couple fund raisers
planned. Hazen made a motion to approve the Treasurer's Report as presented;
seconded by Rieke.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
OLD BUSINESS:
Hiemenz made a motion to approve the proposal of Weber Abatement, of $250 for
removal and disposal of asbestos waste from the water treatment facility;
seconded by Loso.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.

Hazen reported that Judy is re-keying most of the Personnel Policy manual

because of retrieval problems. ~udy will have this completed soon.
Mayor Reber stated that he has asked Public Works Superintendent Dick Taufen to
prepare his recommendations on snow removal in the business district.
Rental housing fees for duplexes has been charged as for two separate
residences. Recently a duplex property owner questioned this policy, and
requesting that the charge be as for two units. The City Attorney recommended
clarifying the ordinance for fees for duplexes, by resolution. Hazen made a
motion to have the City Attorney prepare a resolution clarifying that duplexes
are two separate units at $50 each, for rental fee charges. The motion was
seconded by Hiemenz.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
Hazen made a motion to follow the attorney's recommendations and until this
resolution is adopted fees charged shall be interpreted as a two unit building
($60), but there shall be no refunds from prior years.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
The Mayor presented a proposed ordinance change, as requested by the Chief of
Police. Council aqreed to consider this at the next meetinq.
~EN TO THE PUBLIC: Art Reber discussed his concern of exc:ss speed of traffic
n his alley_ He requested that the Council consider installation of speed
bumps. City Attorney stated that in an alley, there would probably not be a
concern of damage to vehicles from speed bumps. Loso discussed that drainage
and snow removal should not create much of a problem. Rieke made a motion to
authorize city maintenance to install a speed bump in the east/west alley of
Block 13, Original Townsite of st. ~oseph; seconded by Hiemenz.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
Art Reber also discussed garbage and unmowed rental property problems.
ALLEY VACATION: Council considered a request of Dale Victor, Sunset Supply, to
vacate an alley located between Date Street East and Elm Street East, which
lies west of First Avenue NE between Lots 5, 6, 7, and 12, 13, and 14, Blocks
23 of Loso's Addition. Rieke made a motion to set a hearing, as required by
state statute, for ~uly 1, 1993; seconded by Hiemenz.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
EASEMENT REQUEST: Ross Rieke stepped down from his chair to approach the
Council. He again addressed his previous request to relocate trees, which are
currently towards the center of the easement area of his property. He has
received approval from Betty pfannenstein to place trees on her lot line,
~arence Fischer has recently purchased the other adjoining lot. Rieke
equested to be allowed to relocate the trees on the lot line adjoining Betty
annenstein's property, as allowed by ordinance, and to relocate trees up to
two feet from the lot line, within the easement area, adjoining Clarence
Fisher's property. Loso felt that the trees could cause maintenance problems
in the future. The City Attorney stated that maintenance of the sewer line in

the area can not be accessed as it was in the past. He also suggested that a
letter is sent to the property owners of the easement area, a couple weeks
before access is needed, stating that the City will be using the easement area,
and the property owners need to clear 'J.. Rieke expressed willingness to allow
1 L. city passage to service the sewer facility on his fro~ his property. Hazen
made a motion to allow the Clerk/Administrator to issue a permit to allow Ross
Rieke to relocate trees, on the lot line, by Betty pfannenstein's property, and
up to two feet from the ' . .,. adjacent to Clarence Fischer's property, in
,01: i lne, the easement area of Rieke's property, pending written approval as required,
and subject to Easement Ordinance section 32.5. The City reserves the right to
remove the trees at what ever time it is necessary to service the sewer
facility. The motion was seconded by Hiemenz.

CLERK/ADMINISTRATOR REPORTS: 1) The auditor requested a time to present the
audit to the Council. The Council generally agreed to set a special meeting at
a time convenient for both the Auditor and the Council Members.
2) Counci 1 considered the policy which provides that vacation time allowed is
for the benefit of the employees general welfare, and is to be taken as time
off. In order to accomplish this, the City's previously established the policy
that vacations would tentatively be scheduled prior to March 31 of each year,
~d the department heads would submit the schedules to the Clerk/Administrator.

iginal submission, if plans change, and it is agreed to by the department
ead. Council generally reaffirmed this policy and requested that a memo is
sent to the departments that have not yet turned in vacation schedules, with a
copy to the Council.
3) Counci 1 discussed the request to accept the i~provements of Northland phase
One. John Scherer stated that he has received a deed to be filed, for Outlot A
for Phase One and Outlot B for Phase Two. He would like to review this matter
further and make a recoTmendation to the Council The Counci 1 genera 11 y agreed
to place this matter on the agenda for the next meeting.
4) The Counci 1 considered information and a quote for excess 1 iabi 1 ity
insurance coverage (umbrella policy). After discussion with the City Attorney,
Hazen moved to leave the insurance coverage as it is presently, with a letter
to the Fire Chief requesting him to show them why the Fire Department wishes
more coverage. The motion was seconded by Loso.

Nayes: None. Motion carried.
4) The Council considered a proposed agreement which cites the guidelines for
mutual use of the city and st. Ben's water systems. Mayor Reber recommended
support of the agreement. Loso made a motion to approve sending the agreement
to Sisters of the Order of st. Benedict, for their consideration; seconded by
Rieke.

tllkMBLING LICENSE APPLICATION, Loso made a motion to approve a renewal Gambling
'cense Application of the st. Joseph Jaycees to conduct gambling at Sal's Bar
& Gr;ll, effective August 1, 1993; seconded by Rieke.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.

POLICE RADIO: Rieke made a motion to approve the grant application and
purchase of a new portable radio at a cost of approximately $800 with grant
reimbursement of $275, City's net cost is approximately $525; seconded by
Reber.
Ayes: Reber; Rieke; Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
Discussion - Loso requested information on why each officer needs their own
radio. He felt the officers could leave the radios in the Police Office and
check them in and out when they are on duty. Hiemenz commented the officers
are subject to being called to duty from their home and an report directly to
an incident and be in communications without the need of coming back to the
office first. Reber requested that a memo is sent requesting that the Chief of
Police justify taking the radios home.
At ten O'clock the Mayor extended the meeting for ten minutes.
COMPOSï AREA: Clerk/Administrator received a request to open the compost area
on a weekday evening. Council considered the request and asked the
Clerk/Administrator to see if the employees who are the operators of it would
be available and agreeable to it. Rieke suggested considering that individuals
~o ne~d to use it could make private arrangements with the operators of the
ompos~ area.
ARTMENTS: The renter's have requested new carpeting, and the existing
carpeting is worn. Mayor Reber stated he would look at it and report back.
Loso made a motion to adjourn at 10:07 p.m.; seconded by Hazen.

Dear Mr. Lindgren, March 24, 1993
Thank you for taking the time to talk with me on the telephone
last week. As per our conversation, I have a great deal of
interest in law enforcement. Since Brian E. Nelson, deputy with
the Washington County Sheriff's Dept. has been my primary contact
with the world of law enforcement, and since he has been doing
undercover narcotics work for the past several years, I feel my
need for involvement with law enforcement has been curtailed to the
point where I must look elsewhere. I have ridden with him as an
observer a few times, but since I don't know the 1I1ingoll of the
drug pushing/using perp's. he deals with, I am afraid that there
exists the possibility that I could do more harm to his efforts
than good.
Several years ago, I underwent Red Cross First Aid and CPR
training. I have not been recertified since, but have had numerous
opportunities to put what I had learned into practice by having the
uncanny IIluckll of having been the first person, not involved in,
but to arrive at several automobile accident scenes. It,has been
my experience that I tend to be cool, calm and collected whi le
, administering first aid, reserving the release of my 'gut'
reactions for a period of time following the situation, always
taking the time to allow myself do so without embarrassment or
shame. I look forward to brushing up on my first aid/cpr training
with the assistance of your department.
I turned 40 today, and aside from the fact that I'm carrying
a few pounds more than I should, I believe I am in excellent
health. I am 6'411 tall, and currently weigh 223 pounds. My ideal
weight is around 210. wi th a little exercise and the increased
activity that spring's impending arrival brings, I should have no
problem getting back down in the vicinity of my ideal weight.
I have my own pair of smith & Wesson cuffs, a PR-16, (a
smaller version of the PR-24,) and a willingness to learn. I
believe I would be an asset to your department and look forward to
meeting you and your staff.

further contact from you regarding st. Joseph Police Reserves, and
am in hopes that you could put my particular assets to good use.

COMMUNICATION IS ONE OF THE MOST IMPORTANT ASPECTS OF
POL I CE WOI;:I<. THE ABILITY TO EFFECTIVELY FACILITATE HIGH
QUALITY COMMUNICATIONS BOTH, WITH THE PUBLIC AND WITHIN OUR
DEPARTMENT AND CITY, IS ESSENTIAL. THE COUNCIL HAS BEEN VERY
I HELPFUL IN ACCOMPLISHING THIS TASK WITH NOT ONLY PORTABLE
I:;:ADIOS, BUT IN UPGRADING OUR PHONE SYSTEM; THE CAR PHONE, AND
NEW MOBILE RADIOS IN THE SQUAD CARS, ETC.
THE PARTICULAR REASONS FOR EACH OFFICER HAVING A
PORTABLE RADIO ARE AS FOLLOWS: .
tHo AN IMPORTANT CONSIDERATION IS THAT IT FIXES
RESPONSIBILITY ON EACH OFFICER RELATIVE TO CARE AND
MAINTENANCE OF THE UNIT. IT ELIMINATES EXCUSES SUCH AS THE
PORTABLE WASN'T WORKING RIGHT WHEN THE CALL OR PAGE CAME IN,
OR IT WASN'T FULLY CHARGED, ETC. WHEN THAT OFFICER IS
RESPONSIBLE FOR THAT UNIT, AND THERE IS DAMAGE TO IT, I WILL
GET THE ANSWER TO WHAT HAPPENED, NOT IT WAS BROKE WHEN I WENT
TO USE IT. BY BEING RESPONSIBLE FOR IT, THE LIFE OF THE UNIT
SHOULD BE CONSIDERABLY LONGER THAN 5 PEOPLE USING IT.

TO GET TO THE SQUAD AND REPORT TO THE SCENE, AS OPPOSED TO
CHECKING INTO THE OFFICE AND CHECKING IN WITH DISPATCH. THIS

TICKETS ARE A PROBLEM FOR US. AT TIMES WE ARE SENDING OUT
BETWEEN 50 AND 100 LATE NOTICES. MOST PEOPLE PAY AFTER THE
FIRST NOTICE. HOWEVER, THERE ARE MANY THAT WE HAVE TO SEND
SECOND AND THIRD NOTICES TO.
(DUE TO THE VOLUME OF TICKETS WE ISSUE, NEARLY 700 LAST
YEAR ALONE. WE TRY VERY HARD TO STAY ON TOP OF THE LATE
ONES, SEND MORE THAN ONE NOTICE, ETC. SO AS NOT TO TIE UP THE
COURT, OFFICERS OVERTIME ATTENDING COURT, AND THE EXPENSE OF
THE CITY ATTORNEY'S TIME IN PROSECUTION COSTS. AFTER THE 3RD

SEC. 2.06. LIMITATION ON COUNCIL MEMBERS.
Subd. 1. Prohihition on individuRl counc1l menilier involvement
in city admin:f.str<1tioñ. As individuals. council members have noadminis-
trative authority and shall not give orders or otherwise supervise city
employees unless the council specifically directs them to do 50 and this
direction is not otherwise precluded by Minnesota law or city ordin~nce.
Knowledge of the prohibitions contained in this Section is imputed to all
council membet5.
Subd. 2. Penalties. Any council member who violates Section
2.06, Subd. 1 is guilty of a misdeme~nor and upon conviction thereof
shall be reõponsiblc to the city for all reasonable prosecution costs,
including, but not limited to. attorney's fees.

To whom it may concern:
I am writing to request a variance regarding the city water and sewer project being
placed along 91st Avenue. Due to the fact that my current septic system is less than one
year old (installed August, 1992), I would like to propose that my system is not to be
connected to the sewer at this time.

I will be more than happy to pay the assessment for this improvement, however, I am
- looking at a window of ten years or less. When and if I sold the property, chances of
connecting to the system within ten years would be likely.
Thank you for this consideration. I would like to be placed on the agenda for the June
17, 1993 meeting to personally address this.

I. INTRODUCTION
The purpose of this document is to set forth the terms and
conditions under which the Central Minnesota Initiative Fund
(Fund) will award grant funds to City of st Joseph (Grantee) to
complete the Community Initiative Award project.
II. RESPONSIBILITIES OF THE CENTRAL MINNESOTA INITIATIVE FUND
A. The Fund hereby agrees to grant a total, not to exceed $1,000
for the period of July 1/ 1993 to October 31, 1993 and to
provide limited assistance to the Grantee as needed in the
management of this project.
B. Payment will be made by the Fund upon receipt of this signed
grant agreement.
C. The Fund reserves the right to discontinue, modify or
withhold the total amount of this grant, or any payment
thereof, if in the judgement of the Initiative Fund such
action is necessary to comply with requirements of the law.
D. The Fund reserves the right to distribute any written or
video materials resulting from this effort and further
reserves all rights pertaining to copyright of these
materials.
- E. The Fund will assist in making project results available to
interested communities and organizations throughout the Fund
service area of Central Minnesota.
III. RESPONSIBILITIES OF city of st Joseph (Grantee) :
A. Grantee hereby agrees to carry out this project and to use
the grant funds only for the designated purpose as described
in the grant application submitted to the Fund. Expenses
for such activities will be reimbursed only if incurred
during the term of the award (see section "A" above) . The
Grantee further agrees to obtain consent if any substantial
deviation from said grant application is proposed.
B. Grantee hereby agrees to maintain its books and records to
show, and separately account for the funds received under
this grant, and to maintain records of expenditures adequate
to identify the purposes for which grant funds have been
expended.
C. Grantee hereby agrees to permit the Initiative Fund, at its
request, to have complete access to the Grantee's files and
records for the purpose of making such financial audits,
verifications, and investigation as it deems necessary
concerning the grant, and to provide the Fund access to the
names and addresses of people who have derived benefit from
funded activities for evaluation and to assist in assessing
future efforts/impacts. In so far as providing such
information does not cause the grantee to violate the Data
Practices Act, the Fund will expect compliance unless
otherwise negotiated at the time this grant agreement is
executed.

E. Grantee hereby agrees to repay to the Initiative Fund any
portion of the grant which is not used for the purposes

lawsuit or any proceedings before any federal, state, or
local administrative agency, which may be initiated against
it.

G. The undersigned Grantee hereby agrees to provide the Fund
with any written or video materials resulting from this
grant and such materials shall contain the following
statement: "This project was funded in part by the Central
Minnesota Initiative Fund a public charity largely supported
by the McKnight Foundation."
IV. REPORTING RESPONSIBILITIES OF GRANTER:
A. Grantee hereby agrees to submit the following information:
1. A final narrative report shall be due by November 30, 1994
. This report, evaluating the project/ will detail
activities and accomplishments based on the goals and
objectives of the project results.

2. A financial report detailing project expenses against the
established budget are due on November 30, 1994.
3 . Any other information relating to the project/ as may be
requested from time to time.
B. Grantee hereby agrees to cooperate with the Fund in
complying with all evaluation' requirements set forth by the
McKnight Foundation or the Central Minnesota Initiative Fund
Board of Directors.

Request for Hearing - Impound Lot: Jeff and Mark Hinnenkamp appeared

before the Con1ffiission to discuss possible uses for the property located
behind the City Maintenance Shop, known as the Lyman Hull property.
Jeff stated that they would like to purchase the property for the use
of an impound lot and new/used auto parts. The St. Joseph Code of
Ordinances requires a Special Use Permi t for all uses in an Industrial
Zone. The Commission discussed the access to the property. After
discussion, the Corrunission scheduled a public hearing for July 12, 1993
.at 7:30 p.m.
Commissioner Schneider arrived at 7:30 p.m.
Al Stellmach - Special Use Permit: Chair Hub Klein reconvened the
-
public Hearing at 7:30 p.m. The purpose of the hearing was to consider
a special use permit to allow for the construction of 183 mini storage
units. The property is legally described as Lot 003; Block 1 Neu
Addition.
Al Stellmach stated that he is only requesting approval for the first
phase which consists of 40 mini storage units. The parking area will
consist of crushed granite. As requested, Mr. Stellmach presented a
landscaping plan for Commission review.
After reviewing the plans, the Commission determined that all the
setbacks were being adhered to. Kalinowski made a motion to recommend
Council approval of the special use permi t as requested, based on the
following findings:

Based on these findings, the Planning Commission recommends that the
ìequest for special use for mini storage units in an industrial zone be
approved. Approval shall be on the following conditions:

allows for such special use permits for institutions of a religious
eleemosynary or philanthropic nature. The property is located in a
residential, R-l zone. The property is located at 105 - 2nd Avenue SE
- and is legally described as Lot 1 , Block 4 ; E 132' of Lots 1 & 2, Block
4. . Loso s 4th Addition. The request for special use has been submitted
~ by the Sisters of St. Benedict.
S . Moira Wild spoke on behalf of the Sisters of the Order of St.
Benedict. She stated that they are in the process of purchasing the
home. The residence will accommodate four or five members of the
order.
Mayor Reber stated that as an affected property he has no objections to
the request. He has also had an opportunity to discuss this matter
with the City Attorney who has recommended that the City grant the
request.
Nelda Lampher, 28 - 2nd Ave SE questioned what would happen to the
house when the Convent of St. Benedict no longer needed the house.
Would they (Convent), be allowed to rent to five students or sell the
house for student rental.
Commissioner Brixius stated no. r f the Commission approves the
requests, a provision will be made so that the special use would

Nelda also questioned that tax status of the house. She feels that the
City has nothing to give away and cannot afford to continually have
houses removed from the tax rolls. They are receiving all the benefits
- that homeonwers do, only they don't have to the tax.

Commissioner Kalinowski stated that the College and Convent of St.
Benedict have contributed financially in other ways. In the past
they have paid for 50% of the Wastewater operations, contributions
have been gIven to the Fire Department to update fire equipment, as

well as participating in other Ci ty costs. Therefore they have been
paY1ng taxes.
Mayor Reber stated that recently the College/Convent of 5t. Benedict
has allowed the Ci ty to use their water tower while construction 1S
in progress for the new City Tower, He also confirmed that St.
Benedicts does contribute to the City of St. Joseph.
Ken Twit, 213 Able Street East, stated that the neighbors have no
objections to the Sisters of St. Benedict uS1ng the house, but they
currently have a large number of rental properties in the neighborhood.
r f 1n the future this house would be sold, they would not like to see
the house turned into student rental. Mr. Twit stated that they, the
residents, will be living their for 20 years and are looking for some
assurance to protect their neighborhood.
Commissioner Brixius read the letter from the City Attorney and
stated that a provision will be included in the Special Use
approval to provide assurances.
Dennis Stueve, 1 1 1 Able Street East, questioned S. Moira as to what
precipitated the need for the Sisters to purchase another home in St.
Joseph. r t is his understanding that the convent population 1S
decreasing, and questioned the need for housing off campus.
. S. Moira stated that the Sisters of St. Benedict are located in
three regions. There IS a need to house the Sisters within these
three regions, St. Joseph being one of the regions. While it is
true that the number of women entering the convent is declining,
more of the Sisters are coming back to these three regions and need
housing.
She also stated that the focus 1n the Convent is changing. More
emphasis 1S directed toward continuing education and much of their
space is utilized for workshops and retreats.
Finally, providing Sisters the opportunity to live 1n smaller
groups is more in tune with the Rule of Benedict.
After a lengthy discussion, Brixius made a motion to recommend
Council approval of the Special Use Permi t to allow up to five ( 5 )
members of the Benedictine Order to reside at the 105 - 2nd Ave SE,
based on the following findings:
1 ) ~ Joseph Code of Ordinance 52. 16 subd lLRl
Special Uses shall be allowed to institutions of a religious
eleemosynary or philanthropic nature.
2) A religious community is very akin to a family, and therefore
the proposed use IS basically the same as a single family use.

the Planning Commission to discuss the possibility of operating a flea
market in an industrial area. o'v1r . Fouquette owns property along CSAH
75, near County Road 134. I t is his intention to operate a flea market
every other weekend. All oÌ the exhibitors would be outside, us i ng set
up tables. St. Joseph Code of Ordinances states that all uses In an
Industrial area s ha 11 be by special use.
The Commission discussed the possible parking problems and if a flea
. market could be allowed in an industrial area. They also discussed how
to determine the number of parking spaces required. After discussion,
i t was determined to receive legal opInIon from the City Attorney

Mark Lambert spoke on his behalf. He has recently purchased the Lyle
Grieger property, 404 1 s t Ave NE. His intention is to construct an
apartment building with 15 units to house 60 students. The final
decision on the type of apartment building has not yet been made. The
unit will be s imi 1 ar to the Campus Villa apartments.
Commissioner Lesnick questioned whether or not a sidewalk would be
provided for the residents. Mr. Lambert stated that their would, as he
wants to provide a safe place for the residents.
. Mr. Lambert stated that all the apartments would have a private
entrance into the building.
Mike Deutz questioned the number of parking spaces provided. Mr.
Lambert stated that his plans include 3.25 parking stalls per unit. He
IS also checking into the mechanics of a parking perml t system. With
the number of students residing in the buildings, parking will have to
be controlled. A perm i t system would only allow a specified number of
vehicles to be parked by the '... I f a student wished to have a
unit-So
vehicle síhe must purchase a permit. In the case that all the permits
have been purchased, the occupant would not be allowed to park a car by
the units. Mr. Lambert also stated that he has a contract with a
local bus company to transport the students to the College four times a
day. Hopefully this wi 11 eliminate some of the need for individuals to
have cars.
Mike Deutz felt that the Corrnni s sian should look at the current
Ordinance and possibly increase the required parking. The majority of
renters In St. Joseph own cars, and parking could become a problem.
Mayor Reber questioned Mr. Lambert on the installation of a fence. At
the public hearing for the Campus Villa Apartments, Mr. Lambert stated
that he would fence the property to try and curb the overflow of
students into residential lawns. Mr. Lambert stated that SInce the
hearing in 1989, the neighborhood has changed significantly. More of
the houses have been sold for rental. His current plans do call for
fencing, but not to the extent that was originally planed in 1989. The
fence wi 11 be constructed down both sides of Cedar Street and on one
side will go back to the railroad tracks.

Marlin Eich questioned what the speed 1 imi t will be and if it will be
posted. Mr. Lambert responded that he will post the speed limit at 10
mph and possibly add speed bumps. The way the parking lot is designed,
it is questionable if cars can even drive safely at 10 mph.
Nierengarten made a motion to accept the preliminary plans as
presented, and recommends approval by the City Council. Preliminary
approval accepts two possible types of apartments. Alternate A
includes three levels with five apartment units on each floor.
Alternate B is a tower unit with private entrances for each apar tmen t .
Each unit would contain three levels. The motion was seconded by
Kalinowski.
