1. T e Township of St. Jos~ph and the City of St. Joseph have entered into an Orderly Annexation
A eement approved bythe Municipal Board February 6,1998 asOA-524,and ,pursuant to Section 7,
S bdivisio~ B, Paragraph 3, states if the owners of 100% of the parcels of property in the affected area

hre petitioned to annexi, the City Council will, as an agenda item at their next regular meeting, review
th petition for consideration of annexation.

Hiemenz opened the! public hearing and stated that the Township Board was also present to
discuss this item. Hiemenz asked City Engineer Joe Bettendorf to do a brief presentation
about the costs of the 121 project. Bettendorf reported that he revised his estimates for
County Road 121. The overall cost has dropped 1.1 million dollars. This was due to three
factors. First, the proposed annexation now stops at the south property line oftheTownship
hall. In his earlier eS,timatehe assumed that the annexation would include land down to Jade
Road. This reduces the amount of County Road within the city limits and therefore City
. participation in the c?st. Second, he eliminated 295th .Street and.1 03rd Avenue from the
project. Under the reyised project, we will stub out sewer and water at 295th, and that's it.
Finally, this project has been reduced to one force main, instead of two. Bettendorf explained
that he also eliminated the deferred assessments that were related to the Meyer farm on the
east side.ofthehigh~ay. Most of the farm's frontage is unbuildable, and therefore have
rolled this cost back ,into the overall street assessment This is why the street assessment
wentfrom $44.00 p~r foot to $51 per foot

Bettendorfstated thatthe grant application will ask for approximately $798,860 to offset City
costs and abate assessments. The District State Aid Engineer has reviewed our City's street
layout and wants the City to designate part of 121 as aMunicipal State Aid Street. Thiswill
allow the use of statø aid funds to offset some of the street costs, if we choose to do so.
Bettendorf reported that the grant should be successful and has been called an excellent
application already. I With the. funds, the City's cost would drop considerably and the Council
could decide to use ,its MSAfunds to offset the other costs. The application has to be in by
October 1 st and we won't hear until February or so. Bid letting is set for March so we should
have plenty of time.¡ Bettendorf also indicated that he is trying to tie that small piece of
College Avenue between Minnesota Street and CR 75 into the County project as well. The
revised cost splits bfeak out as follows for County Road 121, sanitary sewer, water main and
the.lift station: $585,000 for the. County, $1,055900 assessed, $968,300 for the. City fora
grand total of $2,609,200. The projected assessment splits without the grant assess $29, 120
to the..Township,$375,835 to SL Bens, $756,560 for currentcity cost and $650,945 for City
Residents.Withthe[grant, the numbers decrease significantly for the City: $351,000 for
current costs and $f 11,740 for future development costs.

'HÎemenz stated thaUhe City Council andSt. Joseph Township Board have to approve the
annexation for the project to move forward. The petition includes 24 properties.

Loso made a motion that the City Council for the City of St. Josep'h hereby resolves

1) The City finds that the owners of at least 60% oUhe rea/estate parcels

2) The City approves the annexation of the real property described in the

attached Exhibit A. I
3) Upon approval of the petition for annexation orth~ property described in
attached Exhibit A by the Town Board of the Town of St. Joseph, the petition
and a certified copy of this resolution shall be de/~vered to the State Planning
Office. I
4) This resolution has been 'approved pursuant to th1eJoint Resolution for
Orderly Annexation adopted by the City and Tow~ of St. Joseph on
December 18, 1997 and December 29,1997 respectively.

Twit seconded the motion and the motion passed unanimously, with Council member Ehlert
abstaining from the vote. The Township Board stated that they would Vote on the annexation after
they hear about the grant program.

Re: After Hqurs Sales at Loso's Pub
O~ Monday Novemberi6, 2000 at 2:00 a.m., Officer Janssen observed three people inside of
LOfo's Main Street Pub. He could see alcohol on the counter and that two people, who were
as an off-duty employe~ and her boyfriend, drinking from them. The case is being referred to
thi city attorney for
. Tne employee stated she didn't care and was going to quit anyway. While this was her
att~tude, this is the violation this year.
o May 31 st at 1 :50 five people were seen in the business and they ran out the back
w en Qfficers entered. They were not charged nor was the bartender at that time. This
in ident was the packet that you received during license renewals.
o September 14th'at a.m., two employees were cited for after hour sales and four
pap-ons were cited for in the bar after hours. The council received notice at the next
council meeting but not discuss or take action at thattime.

review is an alarm ordinance. I have talked it over with Dave, the Fire Department

agrees with it, find in fact this places into law what they are doing for false fire
. alarms in the qity.

(A) Alarm Ad~inistrator means' a Person or Persons designated by the governing
. authority to ~dminister, control and review alarm applications, permits and Alarm
Dispatch Re'quests.

(B) Alarm Business means the business, by an individual, partnership,' corporation or
other entity pf selling, leasing, maintaining, servicing, repairing, altering,
replacing, m:oving, installing or Monitoring an Alarm System in an Alarm Site.

(C) Alarm Dispatch Request means a notification to the police or fire dispatch by
the Alarm B:usiness that an alarm, eithermanual or automatic has been activated
at a particular Alarm Site.

(D) Alarm Review Board shall be the city council for police alarms and the fire "
board for fil"e alarms.

(E) Alarm Site :means. a single premises or location served by an Alarm System. or
systems. Each tenancy, if served by a separate Alarm System ina multi-tenant

(1) an alarm installed on a vehicle unless the vehiþle is permanently located at
a site; or
(2) an alarm designed to alert onlytheinhabitant~ofapremises that does not
have a sounding device which can be heardoq the exterior of the· Alarm
Site.

(G) Alarm User means any Person, firm, partnership, corporation or other entity. who
(which) uses an Alarm System at its Alarm Site.
(H) Chief means the Chief of Police of the City or an aut~orized representative.
(I) Conversion means the transaction or process by whidh one Alarm Business
begins Monitoring of an Alarm System previously mÖnitored by another Alarm

Business. ' .
(1) Duress Alarm means a silent Alarm Signal generateø by the manual activation
of a device intended to signal a crisis situation requiripg police response.

(K) False Alarm Dispatch means an Alarm Dispatch Request to the dispatch center,
when the responding officer finds no evidence of a criminal offense or attempted
criminal ()ffense after having completed a timely inve~tigation of the Alarm Site
or no fire has been detected. An Alarm Dispatch Reqµest that is canceled by the
Alarm Business or the Alarm User prior to the time t~e responding personnel
reaches the Alarm Site shall not be considered a False Alarm Dispatch.

(L) Holdup Alarm means a silent Alann Signal generated by the manual activation
of a device intended to, signal a robbery in progress. '
(M) Keypad means a device that allows control of an Alarm System by the manual
entering of a coded sequence of numbers or letters. .
(N) Monitoring means the process by which an Alarm Bu'siness receives signals from
Alarm Systems and relays .an Alarm Dispatch Reques~ to the city for the purpose
of summoning police or . fire response to the Alarm Site.
(0) . One Plus DureSs Alarm means the manual activatio~ of a silent alarm signal by
enteringata Keypad a code that adds one to the lasfdigit ofthenormal

SECT ON 3.· PERMIT REQUIRED; APPLICATION; FEE; TRANSFERABILITY;

FALSE STATEMENTS.
(A) No Alarm User shall operate, or cause to be operated, an Alarm System at its
Alarm Site vrithout avalíd alarm permit issued by the Alarm Administrator after
January!, 2901. A separate permit is required for each Alarm Site.
· (1) A sp~cìal classification shall be required for an Alarm System equipped
for Duress Alarm.

(B) There wíll be no fee for an alarm permit.
(C) Upon receipt of a completed applícation form, the Alarm Administrator shall
issue an alaqu permit to an applícant unless the applicant has:
(1) faile? to pay a fine assessed underSection 11 or,

(2) had ~n alarm permit for the Alarm Site suspended or revoked, and the
viol~tion causing the suspension or revocation has not been corrected.
(D) Each permitlapplícationmust include the following information:
(1) the name, address,~nd telephone numbers of the. gersonwho\Víll be the
perffiit holder and be responsible forthe proper maintenance and operation
of th~ Alarm System and payment of fees assessed under this article;

(B) A tenant of ~n apartment complex shall (ilso obtain an alarm permit from the
Alarm Administrator before operating or causing the operation of an Alarm
System in th~ tenant's residential unit. The annual fee for this permit or the
renewal of this permit shall be the same as the fee for a residential Alarm Site.

(C) For purpose~ of enforcing this article against an individual residential unit, the
tenant is responsible for False Alarm Dispatches emitted from the Alarm System
in the tenant's residential unit.
SECT ON 3.2 ALARM SYSTEMS·IN APARTMENT' COMPLEXES -
FURNISHED BY THE APARTMENT COMPLEX AS AN

· AMENITY.
I
(A) If the' owner:or property manager of an. apartment complex provides Alarm
Systems in each residential unit as an amenity, then the owner or property
manager of tþ.e apartment complex shall obtain a master alarm permit from the
Alarm Administrator. The annual fee for this permit and for each renewal of this
permit shall be $10 dollars perresidential unit per year. All units, whether

occupied or pot, shall be included in calculating the required fee.
I
(B) For purpose~ of assessing fines and enforcing this article, the master alarm permit
holder is responsible for payment of fines for False Alarm Dispatches emitted
from the Alarm Systems in residential units.
(C) The owner or property manager of an apartment complex shall obtain a separate
alarm permi~ for any Alarm System operated in a nonresidential area of the
apartment complex, including, but not limited to, common tenant areas and office,
storage and equipment areas. An annual fee fodmch a permit shall be the same as

the fee for a residential Alarm Site.

SECTION 4. PERMIT DURATION AND RENEWAL.
A permit shall, expire one yearfromthedate of issuange,and must be renewed .
annually by submitting an updated application and a p;ermit renewal fee to the
Alarm Administrator. The Alarm: Administrator shalllnotify each Alarm User of
the need to renew thirty (30) days prîöt to the expirati~moftheirperm:it./·Itis the
responsibility of the Alarm User to submit an applicatton prîor to the permit
expiration date. Failure to renew will be classified as µse of a non-permitted
Alarm System and citations and penalties shall be ass¿ssed without waiver.

SECTION 5. PROPER ALARM SYSTEMS OPERATION AN:Q MAINTENANCE
(A) An Alarm User shall:
(1) maintain the premises and the Alarm System in a manner that will
minimize or eliminate False Alarm Dispatches~ and
(2) make every reasonable effort to respond or cause a representative to
respond to. the Alarm System's location within lone hour when notified by
the city to deactivate a malfunctioning Alarm System, to provide access to
the premises, or to provide security for the prefises, and .
(3) not manually activate an alarm for any reason other than an occurrence of
an event that the Alarm System was intended tb report.

(B) An Alarm User shall adjust the mechanism or cause tne mechanism to be adjusted
so that an alarm signal audible on the exterîor of an A,arm Site will sound for no
longer than ten (10) minutes after being activated (or fifteen (15) minutes for
systems operating under Underwrîters Laboratories, I:q.c. standards 365 or 609),
,
(C) An Alarm User shall have a properly licensed Alarm Business inspect his Alarm
System after (2) False Alarm Dispatches in a one yearlperîod. After (3) False
Alarm Dispatches the Alarm User must have a properly licensed Alarm Business
modify the Alarm System to be more false alarm resistant or provide additional
user training as approprîate.
SECTION 6. . MONITORING PROCEDURES.
(A) An Alarm Business performing Monitorîng services shall:

(1) not request dispatch for police or fireresponse:durîng the first week after

installation of anAlarm System, but rather use that week to train the
Alanp User.on propecuse. of the Alarm System unless extenuating
circu~stances necessitate immediate requests, for response. as'determined
. by the Administrator.

(2) report alarm signals by using telephone numbers designatedby;theAlarm
Adm~nistrator;

(3) attempt to Verify every alarm signal" except a dures~orhold up alarm
activ~tion before requesting a police response to an alarm signal;
(4) communicate Alarm Dispatch Requests to the city in a manner and form
determined by the Alarm Administrator;

(5) comrhunicate verified cancellations of Alarm Dispatch Requests to the city
in a manner and form.determined by the Alarm Administrator;

(6) ensure that all Alarm Users of Alarm Systems equipped with Duress
Alanrt are given adequate training as to the proper useofthe Duress

(B) The Alarm 1dministrator shall:

of Alarm Dispatch Requests;

SECTION 7. DUTIES OF ALARM BUSINESS.
(A) After passa~e of this ordinance, Alarm Businesses shall not program Alarm
Systems so ~hattheyare capable of sending One Plus Duress Alarms. Alarm
Businesses rhay continue to report One Plus Duress Alarms received from Alarm
Systems programmed with this feature prior to the passage of this ordinance.
However, after passageofthis ordinance, when performingaTakeover or

Conversion an Alarm Business must remove the One Plus Duress Alarm
capability frbmthe Alarm. System being taken over or converted.

SECTION 8. ALARM SYSTEM OPERATING INSTRUCTIO~S.
An Alarm User shall maintain at each Alarm Site, a set of written operating
instructions for eachAlarm System.
SECTION 9. ALARM DISPATCH REQUEST RECORDS.
(A) The personnel responding to an Alarm Dispatch Request shall record such
information as necessary to permit the Alarm AdminiStrator to maintain records,
including, but not limited, to the following informatiop:

(1) identification of the permit number for the Alapn Site;
(2) identification of the Alarm Site;
(3) arrival time at the Alarm Site and dispatch rec6ivedtime;
(4) date, and time;
(5) weather conditions; ·
(6) area and/or sub-area of premise involved;
(7) name of Alarm User's representative on premi~es, if any;
(8) identification of the responsible Alarm Businefs, and/or;
(9) unable to locate the address.

(B) The responding personnel shall indicate on the dispatch record whether the
dispatch.was.caused by a criminal·offense, an attempt~d'criminal offense, fire,
medical problem, or was a False Alarm Dispatch.
(C) In the case of an assumed False Alarm Dispatch, the responding personnel shall
leave notice at the Alarm Site that the agency has respionded to a False Alarm
Dispatch. The notice shall include the following information:

(2) the identification number of the respondingpetsonnel, and;

(B) In addition, any Person, operatíng a non:'permitted Alarm System (whether
revoked, suspended or never acquired) wíll be subject to a.cítation and assessment
of a level 6 fee for each False Alarm Dispatch, in addition to any other fines. The
Alarm Administrator may waive this addítional fine fo~ a non-permitted system if
the Alarm User applíes for a permit within ten days aft~r such violatíon.
(C) Alarm Dispatch Requests, caused by actual criminal offense, wíth evidence of a
criminal attempt, or evidence of a need for fire respons~, shall not be counted as a
False Alarm Dispatch.
(D) The Alarm Administrator may reinstate a suspendedp~rmít upon receipt..of
acceptable evidence that the cause has been addressed ~d appropriate corrective
action has been taken as outlíned in Sectíon 14. .
SECTION 12. APPEAL FROM FEES.
(A) An Alarm User may appeal assessment of a fee to the Álarm Review Boardby .
filing a written request for hearing setting forththe rea~ons for the appeal within
ten (10) days after receipt of the fine. The filíng of a re~uest for an appeal hearing
with the Alarm Review Board stays the assessment of~he fee until, the Alarm

(B) The Alarm Review Board shall conduct a formal hearing and. consider the

for which tIle alarm permit is revoked. The Fire Chief may refuse fire response to
an Alarm Dispatch Request at an Alarm Site for which the alarm permit is

(D) If the alarm permit is reinstated pursuant to Section 14, the Alarm Administrator
may revoke ,the alarm permit if it is determined that 2 subsequent False Alarm
Dispatches 9ccur within sixty (60) days after the reinstatement date.

SECT ON 14. APPEAL FROM DENIAL, SUSPENSION OR REVOCATION OF A
PE lIT: i
· If the Alarm; Administrator denies the issuance or renewal of a permit, or suspends
or revokes al permit, he or she shall send written notice of his action and a
statement o~ the right to an appeal, by certified mail, return receipt requested, to
both the applicant or Alarm User and the Alarm Business.
The applica~t or Alarm User may appeal the decision of the Alarm Administrator
to the appropriate Chiefby filing a written request for a review setting forth the
reasons for the appeal within twenty days after receipt of the notice from the
,
Alarm Admfnistrator. An Alarm Business may submit the request for review on
behalf of an ìAlarm User.
Filing of a request for appeal shall stay the action by the AlarmAdministrator
suspending or revoking a permit until the Chief has completedhislher review. Ifa
request forâppeal is not made within the twenty-day (20) period, the action of the
Chief is final.

(B) AlarmUserS shall be entitled to a hearing before the Alarm Review Board, if

(3) submits a certification from an Alarm Business, that complies with the
requirements of this article, stating that the AI~nn System has been ~...
inspected and repaired (if necessary) by the Alann Business.
SECTION 16. VIOLATIONS
Violation of sections 3, 3.1 and 3.2 of this ordinance shall be deemed a misdemeanor. ·
Violation of any other provision of this ordinance shall be deemed a petty misdemeanor.

Re: 90-Minute Parking Change Request by Sunset Manufacturing

Tom Skaheh of Sunset Manufacturing has requested some type of change in the 90
minute park:ing in front of his business. He has people occasionally there for more
than 90 miriutes.
. He is asking for someway to allow them to issue a pennit of some type for the
servicepersþns who visit his business.

A couple of!options:
1
1. Removelthe 90-minute parking. This may cause people to park there all day and
not all0'Y business patrons to stop there.
2. Change it to pennit parking in a couple of spaces with the rest at 90 minutes.
I
3. Leave it as it is.
I do not kno~ the history of the 90-minute zone. Tom said thatthe signs went up
when the building was built.

A preliminary lightiþg design for the industrial park along Joseph Street has been
completed. It consi*ts of five 150W Cobrahead lights on existing poles. As in the past
Stearns Cooperative: Electric Association has allowed two payment options for the
constructionoffaciÜties. Regardless of the payment option chosen a usage charge will

Mr. Walz is constructing a new garage on his property. Mr. Walz is requesting a
COUNCILORS variance to the e~terior buildingmaterial requirements which states that the material

wit Stucco. Mr. Walzis requesting a variance to use lap siding on the garage. The color of
Mary Niedenfuer the siding will match the house color. However, there was an issue regarding the
square footage requirements of the lot. Apparently, there.is a misunderstanding of
where the lot liner is with the neighbor. I beli7ve Mr. Walz was going to hire a survey to
clean up the lot lip.e. I suggest that this be brought up at the meeting. Based on the
requirementsof~variance and this project, I have recommended the Planning
Commission ap~rove the variance.
Tom Borresch Variance
Mr.. Borresch is considering the renovation and addition to a facility he owns on County
Road #75. The b~lÍlding is located next to GM Drilling. The Highway 75 Business
District requires tþat 50% of all four sidesofa facility consist of brick or similar
material. . Since Mr. Borresch is proposing an addition to the facility, the entire building
must be brought iµto compliance with the Ordinance. . Mr. Borresch is requesting a
Variance to the Ordinance as he wishes not to place any brick or similar material on the

structure.

In addition, the intent of the Ordinance is to create a corridor to the community that is
attractive and thislhassupportfi'om the City Council, Chamber of Commerce, EDAand
HCP. .Mr. Borres\;h has an alternative by replacing the siding on the structure as it
exists. The City does not require a permit for this activity as stated in 51.1 of the
Ordinance.. Remdmber, financial concerns of the property owner, by law, is not a
hardship to grant ~ variance. ,Based on the requirements of a variance and this
project, Ihave r~ommended the Planning Commission deny the variance.

Pond View RidlZe Six Final Plat
· .BobHerges, RlckHeid, and Gregg Stroeing will ,be presenting the final plat for Pond
View Ridge6.!1 have enclosed a copy of the final plat for your review. As required by
Ordinance, the Planning Commission must recommend to the City Council approval or
denial of the Final Plat. In addition, the Planning Commission must submit via a letter
of transmittal td the City Council making a variation to the minimum lot width on Lots
1,2, and 30f Blbck 5 as stated in the subdivision ordinance. This issue is the only

remaining road~block that may hinder the approval of the plat. Joe Bettendorf will be
submitting a Ie er to the Planning Commission regarding any issues that need to be
resolved. After ¡speaking with him today, Joe informed me that there isn't anything that
is a big concern~ Dick Taufen is concerned with Outlots A and B regarding ownership
of the parcels. That needs to be addressed.

Based on prior 'discussions of the plat and in ..elation to the three lots on
Minnesota Stre¢t, I have recommended thatthe Planning Commission grant a
variation to ,the plat via a letter of transmittal and recommend approval of the

By res¡01utìon of the St. Jo~eph Chy Councìl, the following procedure is to be followed on the
grading portion of all futur~ developments:
A. Nd building permits lm issued untìl site grading for the developmentphase has been
1Pleted and approve~.
. B. ,..' 'en thesìte gradingJas been completed:
1. Developer shall Jiave a RegisteredLand Surveyor verify site grading has been completed
according to the approved site grading plan submitted wìth the, preliminary plat documents.
2. Elevatìons shall þe taken on all lot corners" all building pads, and on drainage breaks,
pondiJ;lgsites, dìtbhes, and swayles. Arrows shall show how the lot is to drain.
3. The Developer shall submit a. copy of the approved ,. grading plan' showing the "as-built"
elevations to the City.
4. The City wìll verify ìnformatìon., If everything matches the original grading plan, the as-
buìlt gradingpla4 becomes the approved Development Plan.
C. Before Buìlderis giv¢n a building .permit, the· Developer shall have a Registered Land
s~eyor submit a Cq1¡ficate of S"f"ey si)owing proposed elevations (or. lot corners,the
b I ìlding pad, and side and rear lot lines; these elevatìons must agree wìth the approved
Development Plan. Provide drainage arrows, showing how the lot is to drain. Indicate
p~oposed elevatìons. for grade . at the front, rear, and at the lookout/walkout levels of the house
bring builL The certificate mustshowall.easements and setbacks for the house being built.
\]hen this Certificate pas been checked and approved by the City, a building permit can be
issued, subject to othe~ terms and conditions of the Developer's Agreement.
D. I en the house has b~en completed and the lot restored to final grade, but before it is sodded
0 seeded, theBuil~er'sSurveyor shall provide an "as-buìlt" Certificate of Survey
. d cumenting the fina~ in-place elevations and setbacks. If these elevations agree with the

1. SJephanie reviewed. pricing for Propòsal Request No.2 that was electrical modifications required
because the existing conditions were unclear. We dis~ussed the electrical engineer reviewed the
pricing said it was a fair assessment of the work requested. Those present approved the

2. Stephanie reviewed pricing for Proposal Request·No. 5 that included carpeting and painting the
remaining areas of the building as was requested 'by the City Council at the interior finishes
meeting on 28 September 2000. There was' much discussion regarding carpeting' th-e 'existing
storage area BI6. Those present approved the Proposal Request and agreed the existing carpet
should remain in the: storage area B 16, and the existing break: room B04 should have new carpet

3. Stephanie reviewed pricing for Proposal Request No.7 that included the addition of four wall
outlets and two flusn mounted floor outlets in the open office area 106 as requested by the City
at the previous constÌuction meeting. Those present approved the modifications. , "
4. Stephanie,reviewed pricing for Proposal Request No. 11 that included the drywall 'work required.
to bring the baseme~t corridor up to code. We also reviewed pricing for Gopher State ,Proposal
Request No, 13 that included fire caulking the existing penetrations in the basement exit corridor
as required by code. Those present approved both of these modifications~
5, Stephanie reviewed pricing for Gopher State Proposal Request No. 14 that included relocating
the door and window to the' council chamber B06 to allow for the revised design of the council .
table. She noted th+ original price for the council table remained the same. Those present
approved the modifications. ,
6~ Cory asked about thè available contingency after these modifications. Stephanið noted from the
information she had I from the City, on the budget dollars available,' the amount of contingency
after these modifications was $22,955. Judy noted that this amount would need to be reduced by
$7300 fòr property ~es. .
