"Requesting Official" means the person designated by a Party who is responsible for requesting assistance from other Parties. "Requesting pak,,, means a Party which requests assistance from other Parties. I I . ... . (1) The policy shall set forth the circumstances under which aid may be requested and the circumstances under which aid will be provided by. the responding municipality. 4. Control Over Emergencv Scene. The Requesting party shalLbein commandöfthe emergency scene. The police personnel and equipment shall be under the direction and control of the Requesting Party untìlthe Responding Official withdraws assistance. This section does not mean that the Responding Party's personnel will. be considered employees of the Requesting Party for the purposes of payroll and worker's compensation. 5. No Requirement to Respond. Both Parties · understand that police· assistance. will onlybe provided jf such assistance·. does not unduly jeopardize the law and order ürpoliceprotection within the city . who is. requested to respond. Neither Party, nor its police officers, shall be liable to the other Party. for failure to provide police personnel or equipment in response to a call for assistance from the other Party. 6. Withdrawal of Assistance. Whenever a Responding Party has. provided assistance to a Requesting Party, the Responding . Official may at any time recall such assistanc.eor any part thereof when the Responding .Official deems it necessary to provide for the best interests of the Responding Official's own community. Such action will not result in the liability to any Party. 7. Reciprocal Defense and Indemnification. A The intent of the indemnification requirement of this section is to impose on each Requesting Party a . limited duty to defend and indemnify any ResBondingParty for claims arising within the. Re~uesting Party's jurisdiction subject to the limits of the liability. under Chapter 466, Minnesota.Statutes. The purpose .of· creating these reciprocal duties to defend and indemnify is to simplify the defense of liabìlity clai~sby eliminating conflic1ß among defendan1ß, and to permit liability claims against . multiple defendants from a single occurrence.to be defended by a single attorney. B. The. Requesting Party agrees· to indemnify and. defend .against any· claims...·brought or actions filed against the.Responding Party or any officers, employees or volunteers of the Responding Party for injury or deathto any third person or persons, or damage to the property of third persons, arising out of the performance and provision of assistance in responding to a request for assistance by. the Requesting Party. pursuant to this Agreement..Therespondingparty shall be.construed to be "responding to a request for assistance" during. the period of time that the officer is outside of the city limits of the . responding officer in responding to the request. C. Under no circumstances shall a Party be required to pay on behalf of itself and.other Parties, any amounts in excess of the. limits on liability established in Chapter466, . . ...." I I i ! I . Responsibìlity forPersdnnel and Equipment. J ... Responding personnel shall[ be deemed to be performing their regular duties for the Responding Party. Insw-a.nce coverage and any fmancial compensation shall be the responsibil~ty of the Responding Party. Each party shall include such endorsements as may be neededtofulfill the indemnification requirements of Section 7 of this Agreement. ! C. Accidental de~thof a police officer, in the minimum amount of $10,000.00 on the life of its police officers, when engage~in the performance of duty under this Agreement.. No fee shall be charged by the Responding. Party to a request for assistance W1der this Agreement. 11. No Joint Entitv or Partnership. The purpose of this Agreement is to· formalize a law enforcement emergency assistance arrangemeIlt between the City of St: Joseph and the City of Waite Park. The Agreement does not intend, nor does it create, any joint entity or partnerships between the City of St. Joseph and the City of Waite Park. 12. TeTI11ination of Am-eement. Either Party may terminate this Agreement upon 30 days written notice to the other Party. 13. Posting. A copy of this Agreement shaUbe posted at each police department headquarters for each of the Parties that are participating in this Agreement. Transportation Alliance: Hiemenz attended the Transportation Alliance Meeting on December 27,'2000 where road funding was discussed. Representatives from the St. Cloud area will be flying to Washington DC to lobby road funds. New City Hall: Hiemenz reported that he, along with City Staff, performed a walk through of the new City OfficelPolice Facility. The elevator is scheduled to be installed beginning on January 8, 2001. At this time the anticipated move in date is the last week in January. At this time Mayor Hiemenz thanked the members of the community for all their support over the past eight years and he was honored to serve as Mayor for the last four years. Eyery person issued a license shall postin a C()~spiCÍ1ous plac signs informing the public that tobacco will not be sold to. minors. . 243 I I . Section 65.06: SALES OF TOBACCO PRODUCTS. Subd. 1: Underage Sale. No person shall sell, offer for sale, give away, furnish, or deliver any tobacco-related product to any person under. eighteen (18) years of age. Subd. 2: Self-Service. Tobacco may be sold by means of self-service merchandising provided that the self-service displays are located within the line of sight and immediate vicinity of a responsible employee so that the displays can be monitored. Subd. 3: Self-Service Vending Machines. No tobacco may be sold by self-service vending machines,. except where located in a building licensed for on-sale purchase of alcoholic beverages. Section 65.07: CIVIL PENALTIES. Subd. 1: Penalty... Upon a violation by a licensee holding a retail tobacco license of any provision of this ordinance or any provision of a state law regulating the sale or furnishing of tobacco to minors, the City Council may impose civil penalties on the licensee in accordance with the schedule set forth below: 1st violation within the licensing year: Civil fine of up to $100.00. . 2nd violation within the licensing year: Civil fine of up to $200.00 3rd violation within the licensing year: Civil fine of up to $400.00. 4th violation within the licensing year: Suspension or revocation oflicense. Subd.2: Waiver, The City Council may reduce or waive the penalty on the licensee for the sale of tobacco to persons under the ageof18 if the City Council finds that the person who made the sale participated in a training program. Subd. 3: Defense. It is a defense to the charge of selling tobacco to a person under the age of 18 years that the licensee or individual in making the sale requested, received and reasonably and in good faith relied upon proof of age identification in the form of a driver's license, state identification card, passport or military identification card. Subd.4: Hearing. No civil fine may be imposed against a licensee, nor license suspended or revoked, until the City Council has conducted a public hearing after having first given the licensee two weeks written notice setting forth the time and date of the alleged violation, and the time, date and place of the public hearing. Any civil fine assessed against a licensee pursuant to this section must be paid in full within thirty (30) days ITom receipt of written notification of the City Council imposition of the civil fine. Failure of a licensee to pay the fine within that time period shall result in license suspension until payment of the fine. Licensees whose licenses have been revoked may not. be issued a new license within six (6) months ITom the effective date of . such revocation. 244 . ' I ., i . I ection 65.08: COMPLIANCE CHECKS. The City shall conduct random, unannounced inspectifns at all retail licensþe locations to test compliance with state law. He states the topic should be Noise --how itworks and how it affects businesses, home owners, and students. Har~wick stated there is anatmPt to draft a change in the City of Sqoseph's ordinance to look at a possible . wa ing system before issuin~ a violation. --~ Hardwick stated Cory Ehlert and Mary Niedenfuer have a draft in. progress. Hardwick also feels one or both of . these people would be helpful at the next meeting, along with Police Chief Gary Will. Hardwick feels a possible amendment to the ordinance would be to issue a warning before a specific tîme in the evening, and give .the offenders a specific amount of time to cease. Rassier asked if the City of St Joseph police has any plans for St. John's and St. Ben's Senior Disorientation in the spring. Hardwick replied there is nothing yet. The St. John's Senate who coordinates the event does not meet until February and will begin discussion then. Rassier asked for ideas of how to make the relationship better between the students and the police department. Rassier suggested the disorientation committee could come to a CORE meeting and share ideas, possibly in the February meeting. Hardwick stated the committee will just have begun developing a plan in February therefore it would be better to wait until March. Rassier asked whatkind of improvements have been made to contain the students last year opposed to other years. Hardwickst¡lted significant improvements have been made. One for this year is to plan events earlier in the evening opposeq to later. Hardwick also stated instead of blocking the road in front of the La P1ayette it could be moved to in front of Sa1' s. Hardwick stated last year there was a law enforcement grant provided by the state for the event, but it would not be this year. Hardwick then stated there is an effort to remove the artificia11ine, which is if one steps past the curb, they would get a ticket. Rassier states the committee should have a chair to lead discussion and a person to take notes designated for every . meeting as well as others who are 'experts' on the agenda topics, includingaforementionedrepresentativesarnong the attendees. Rassier also suggested there only be .two items on the agenda for eachI11eeting as well as reports, old business, new business, and announcements, which would be a good time for the public forum. Rassier announced the agenda for the February meeting is first the City Noisé Ordinance, which will hopefully include Councilman Cory Ehlert and Police Chief Gary Will, and will discuss a proposed warning system. Rassier stated disorientation will wait until the March meeting. Rassier has volunteered to be the chair of the Core committee, and Judy Weyrens will be the note taker until another is appointed. Announcements Hardwick annòunced this would be the 1astJ- Term the College would be participating in. The future will include two semesters without a J- Term. Kyle Schneider stated he is working on a sòftballtoumament which will include students and residents in the spring. Schneider stated he is currently working with the Park Board make arrangements. The next CORE meeting is scheduled for February 2151 at 6:30 p.m. in the new city hall. . . . At this time the Council will need to appoint a replacement forHiemenz. Loso requested that . the Council appoint Councilor Ehlert as he was' involved in the formation of the original offer to the January 4, 2000 Page 4 of 5 ,. . i ASFM union. Rassierma~e a motion to appoint Cory Ehlert to the negotiating committee for the ASFME contract; seconded by Schneider and passed unanimously. I·! .. Loso stated that each Councilor should have received a copy of the proposed contract as of the end of the last m~diation session. At th~s time Loso stated the Council needs to discuss strategy. Loso made a . motiof to adjourn to a clos~d meeting at 8:06 for purpose of discussing strategy for the mediation scheduled on January 19, 2001.
