As· most of tou are aware, we are approaching the one year anniversary of employment for Gary. It is ~tandard for the Council to conduct aperformance review of a department head before comp1etion of the one year employment anniversary date. The Personnel Policy allows the Council to conduct performance review to coincide with the employment anniversary date. Gary'sanniv'ersary date by his memo is April17, 2000. 1 i When Cari was reviewed the Council contacted the séarch company who assisted with the hiring to dèv~lop a format and assist with the process. Since the Council did the hiring for the Police Chief k committee should be established to set the format 1 In discussind this matter with John Scherer it was his recommendation to appoint a committee of the Police Gommissioner· and one..Senior Council Member who was involved in the hiring process along with the City Clerk/Administrator. Therefore, aUhis time we are recommending I the Council authorize the formation of a sub-commi~ee consisting of Mayor Hosch, Councilor Bob Loso, Clerk/Administrator Judy Weyrens and City Attorney John Scherer. SECTION 17 PERFORMANCE & COMPENSATION REYIEWS 17.1 Performance Reviews A supervisor is continuously evaluating the employee's job performance. Day-to-day interaction should give an employee a sense of how their supervisor perceives their performance. However, to avoid haphazard or incomplete evaluations, the City of St. Joseph conducts a formal review once a year for each employee. Performance reviews will be conducted annually by the employee's supervisor to coincide with the employee anniversary date. Completed performance evaluation forms must be submitted to the Personnel Committee thirty days prior to the employee's anniversary date. The City Council will review the performance evaluations no later than the employee's anniversary date. New employees may be reviewed more frequently. A review may also be conducted in the event of a promotion or change in duties and responsibilities. During formal performance reviews, the supervisor will consider the following things, among others: · Attendance, initiative and effort . · Quality and quantity of work · Attitude and willingness · Knowledge of work · Conditions under which the employee must work The primary reaSOn for performance reviews is to identify the employee's strengths and weaknesses in order to reinforce their good habits and develop ways to improve in their weaker areas. This review also serves to make an employee aware of and to document how their job performance compares to the goals and interests and future goals. An employee's supervisor is interested in helping them to progress and grow in order to achieve personal as well as work-related goals -- perhaps he or she can recommend further training or additional opportunities. In addition to individual job performance reviews, the CitY of St. Joseph periodically conducts a. review of job descriptions to insure that we are fully aware of any changes in the duties and responsibilities of each position, and that such changes are recognized and adequately compensated, which may include upgrading or downgrading a position. 32 . Jim Graeve questioned the intentofthe meeting and stated it is his opinion that the meeting is negative in nature with Councilors expressing unsubstantiated claims. He feels that for the first time the City has a Police Chief that will warn residents rather than ticket them. Further, the Police Chief takes time to have a monthly call in show so people can express concerns. Ken Twit questioned whether the meeting was advertised, why there is not an agenda or Council packet available and whether or not this meeting should. have been a closed meeting. Weyrens stated that the meeting was posted and an agenda had been mailed to all persons requesting such. As far as a Council packet, their was no information for this meeting. Weyrens stated the purpose of the meeting was to have some positive communication between the police department and City Council. The meeting was not established for disciplinary action ora performance review. For example, recently the fines for parking tickets was increased and the Council was not informed of such. '~~ Loso stated his main concern is the image of the Police Department and the negative comments he is receiving. He stated that many people will not come forward with complaints due to the fear of retaliation. People feel more comfortable approaching a Council member, remaining anonymouS. Will stated that he cannot follow through with complaints if he does not have enough information. Will again stated that he would sign complaints if people would come to him. Dwight Pfannenstein stated that it is important for the Departmentand theCouncilto have open communication and everyone needs to get along with each other. If there is a problem it should be addressed immediately. Pfannenstein stated as an officer he understands the importance of following . procedure and making sure everything is done right. Ehlert stated that when the City hires an employee they state that they will become involved in the community and actively participate in civic groups. Although this does not happen all the time, it is encouraging to see employees involved in community events outside of their employment role. Will stated that he has every intention of being part of the community. Further, Will stated it is an injustice to the civic group if you cannot be an active member. As time permits he will be part of the civic groups. Rassier stated he is glad the Council had this opportunity to talk to the Police Chief and stated the Council needs to continue to communicate not only with the Police Department but all the City departments. Ehlert expressed concern that morale is at alow level and nothing is being done to improve conditions. He feels the Council needs to find a way to remedy the situation. Over the years, Rajkowski Hansmeier has accumulated many documents within our files relative to the City matters. The files thatwe have maintained with respect to the City are City property and would be transferred to a successor law firm ifthe City would change representation. But our ability to effectively locate the documents stored within our computer system, including the codification of the St. Joseph ordinances, would be compromised. There is true value in a continued relationship, recognizing the fact that we continue to perform in the manner which meets or exceeds the expectations of the City. The experience of our law firm is not limited to municipal issues. Rajkowski Hansmeier has extensive of experience in other areas of practice which routinely come into play while representing a City, such as employment law, real estate, contract and insurance. Because of our years of representing the City of S1. Joseph,. our relationship is more than that typically found with a client. Tom Jovanovich and I have taken a personal interest in the . successes of the City ofSt. Joseph and concerns of its citizens. Although neither of us live in St. Joseph, we continue to take an interest in the events of the City. Tom and I are actively involved in the St. Joseph Chamber bfCommerce. The law firm has. volunteered its time and services in providing seminars to the police and council, attending meetings relative to City/student concerns, providing legal services at no cost when the construction of a recreational facility was explored, and other matters. When serving the city attorney, we adhere to the principal that it is not ourrole to set City policy. Rather, we are to assist the City in implementing policy and carrying out the directives of the City Council within the parameters of the law. We believe that it is appropriate to advise the City Councilor staff of situations where policy may be implemented more effiCiently or in a manner less likely to cause future legal concerns. We also feel that it is important to protect the elected officials and City staff from action which may prove to be detrimental to the City or themselves. At the present time, our hourly rate for civil work performed on behalf of the City of St. Joseph is $90.00 an hour for partners, $85.00 for associate attorneys and $50.00 an hour forlegal assistants. Criminal prosecution is generally billed at the same rates although for some matters (such as preparation of a criminal complaint or. appearance at a pretrial) there is a set fee. Criminal prosecution is subject to a monthly fee cap of$2,500.00. In other words, monthly fees for criminal prosecution will not exceed that amount. If the actual time was less than that amount, the City would then be charged the lesser of the two amounts. Section 51.1: PERMITS REQUIRED, No person shall erect, alter, wreck, or move any building or part thereof within the City of St. Joseph, without first securing a building permit The application for a building permit shall be accompanied by a plan showing the dimensions of the lot to be built upon, including applicable setbacks, the size and location of the building upon the lot and any accessory buildings to be erected, the use to which the intended building is to be put, and the estimated cost thereof. If the proposed building complies with the Minnesota State Building Code and the regulations adopted by the State of Minnesota, as well as all of the ordinances of the City of St. Joseph, the City Building Inspector shall issue a permit therefor conditioned upon the applicant's compliance with all State laws and City ordinances. Allpermits shall be co-signed by the City Clerk and all additional permits necessary shall be obtained at that time. Building permits shall not be required if the work to be performed is limited to the following: replacement of windows, repair or replacement offntè'rior or exterior doors, shingling or reshingling of a roof, siding or residing, interior remodeling not involving the removal or . relocation of an interior wall. A permit· shall be obtained for the construction or reconstruction of an Accessory Building as defined in Ordinance 52.4 Subd. 1. '.. Section 51,2: SEWER AND WATER HOOK UP. Capital Improvement Program: Bettendorf reported that he along with Dick Taufen and Jim Marthaler have been reviewing the televising tapes of the sewer system. To date they have reviewed the SE portion of town and the sewer lines look good. This part of town is the new developments and as they move to the older portion of town it is anticìpated to find areas needing repair. Vacation of City Offices _ 21 _ 1 st Avenue NW: Taufen questioned the Council as to their intent for the remaining fixtures in the City Office and Police Department. Taufen stated in his discussions with the police Chief the office equipment in the Police Department would not be moved as it is all junk. . The City needs to determine how the surplus property will be disposed, through a City auction or participation with Steams County. The Council agreed to dispose of any surplus property through the Steams County Auction, This list of surplus property should be submitted to the Council after it is established. Taufen questioned if the Council would like attached furnishing removed from the City Office for auction and who will determine what is worth selling. Councilors discussed the possibility of walking through the facilities to assist with the determination of surplus property. After considerable discussion the . A few weeks ago, a resident who was starting up a business to deal with vehicle lock-outs . . and residentiallOCkjOUts appr~ached me. . '. Last year we unlocked approxImately 100 vehICles. We unlocked 14 m January thIS year. We receive requests!rrequently and it does take time sometimes as much as a Yo to work on a fingle vehicle. In aqdition, new vehicles with side airbags require equipment we do not have to safely open. Throb police officers in the US were killed last year attempting to open such I ehicles fÌ'om the fOje of the metal bar striking their heads when the airbags deployed. rhe question before the council today is, do we want to continue to provide free vehicle . nlocks incompetitiqn with existing businesses? teams County Sheri~s Office does do vehicle unlocks when the deputy is available and has t e proper equipment~ I do not know of any other agency around us that stiII does them. qther communities in!
