Mayor Hosch stated the difference is the contractors cbmmission was dropped from 75% of the cost to 65%. C1erflAdministrator Weyrens it is a good idea to get to know the contractors better before they are approved. Council member Rassier moved to establish an interview rate for each contractor and req est they bring a one paige rate summary. Each interview will be 15 minutes. Mayor Hosch would like to establish a quarterly meeting with eachdepartmentto entertain . co~ents and suggestions. Each department would rotate on the last Thursday of the month at 3 :30 p.m. Council me ber Loso questionswhci would attend, all employees from the department, or just department heads. Mayor I I Hosch stated he would like the department heads in attendance and other employees would be encouraged to attend. . Each department would meet on the last Thursday of their assigned month: Police Department: January, April, July, and October Maintenance Department: February, May, August, and November Administration: March, June, September, and December Mayor Hosch made a motion to meet with each department quarterly accepted. The motion was seconded. by Council member Ehlert; and passed unanimously. Mayor Hosch also stated he will be attending a half cent sales tax meeting with Jim Knoblauch and Larry Meyer at a later date and will have more information in the future. Councilor Reports Loso: Council memberLoso had nothing to report. Rassier: Planning commission: Council member Rassier stated the Planning Commission met on the 5th of February and discussed the street parking near the St. Joseph Laundromat, regarding the yellow curb. They questioned whether it could be removed to allow more parking in the area. C1erklAdministrator stated it may be necessary because it is next to an alley, and state law may mandate it. The matter will be referred to the public works director. Central Ditching: The Planning Commission would like to require that all utilities use one common trench for lines. At this time Steams Cooperative Electric trenches separate1y.EDA Director Carlson also stated the Pond View area is very wooded and the developers will try and save as many trees as possible. Council member Loso feels the company can't be forced to share the same ditching, but would like to have some clarification. Lock Boxes: Council member Rassier also reported the Planning Commission would like to look into reqÚiring all . businesses to store a lock box that would be built into the wall for fire access. Council member Schneider questioned whether this is common for businesses tobve this. C1erkl Administrator Weyrens stated all new bUildings have. this, and are encouraged to be in buildings, but are not mandatory. CORE: Councílmember Rassier stated there will be a CORE Meeting on Wednesday February 21, 2001 at thefrre hall regarding the noise ordinance. Ehlert: Council member Ehlert had nothing toreport. Schneider: Council Member Schneider stated the Park Board will be moving to Monday February 26, 200 I because of Presidents Day. Clerk! Administrator Reports Board of Review: C1erklAdministratorWeyrens stated April 10,2001 at 6:30 the Board of review and equalization has been scheduled. Department Head Reports Water Regulator: Dick Taufen Public Works Director reported one regulator for the water line in the new city hall h~ating system and is covitating.There is a cone em that it could ruin the pump, which was just replaced at a cost of $1,900. Taufen stated the cost to replace the new pump would be $540. Council memberLosomotioned to replace the damaged regulator. The motion was seconded by Mayor Hosch. ClerklAdministratorWeyrens stated the cost would go into the capital expendituresof the building. Taufen also added the regulator is needed to balance the system so it can function properly. The motion passed unanimously. Water Control: Taufen then stated the water treatment plant is having water level control problems for the last year to year and a half. The contractors have come up with a solution to better regulate the iron content: Taufen stated . the cost of the replacement would be $1,846.00 and the service would beperforrned by Tonka Equipment. Council member Loso motioned to approve the replacement part for the water system. . The motion was seconded by ¡ ! . council ember Ehlert. Taufen stated this is. the only sales an~ setup company he kno~s of, most others wither just sell or repair, also since this is a special product for the water system situation h<ire, it would be importantto stick with this company. Mayor Hosch questioned the funding to which Taufen stated it should bein the water fund. Taufen stated in 2003 the road is scheduled to be over1ayed to eliminate the problem of bad seams. Council member Rassie~ questioned why there has been such a problem in.the past. Taufen stated it was probab y just a bad roll, or it co~ld have been cold and rainy which makes the roll extremely difficult to work with. Police. Mayor Hosch stated the current policy should be kept, buttoehcourage the use· of outside businesses. He. feels it is important to store evidence accurately, and as long as there is anoffi¢er willing to do it, the council should promote them. Council member Ehlert secoïded the motion, Mayot Hosch questions how much money is left in the budget for seminars, and if the cost inelu es a1lexpenses. C1erkJAdministratorstated there '1s$l ,034 left, which is enough to cover the cost of the con£ rence. The $260 requir¢d is for the conference and, there is a request for two nights in a hotel as well. Council me er Rassier stated that it is not mandatory to stay for two nights, and that one night will suffice. Mayor Hosch agre s. Chief Gary Will is requesting permission to apply for theCOPS More 2001 tec~ology grant. The City of St Joseph would have to match 25% of the grant. Chief Will would like to use the mo ey to. provide. mobile digItal COInputers in all three cars plus' the hardware for connecting to the Steams County Rec rds Management System. Council member Loso moved to approve Police Chief Will to apply for the CO S MORE Grant. The Pt0tion is seconded by council member Ehlert. Council member Loso requested that prio to accepting the grantthe cOmmitment of the City of St Joseph should be researched further. (d) Recommend acceptance of the Improvements to the City. I 2.5 Cost Escrow. The Developer shall bear the cost of the above noted City Engineenng Services and shall, upon execution ofthis Agreement, place in escrow I with the ¡City cash, bond or irrevocable letter of credit in the amount of$25,000.00 which s~all be applied to the payment of the cost of said services. Should the above amount exceed the cost to the City, the City shall retumto the Developer all unused funds, irleluding accumulated interest. Should expense to the City exceed the above amount,ithe Developer shall reimburse the City for all additional costs before the improvements are accepted by the City. i , i . 2.6 Contractor Retention. Upon approval ofthe Final Plat, the Developer shall contract with a dontractor for the construction of the Plan B Improvements (hereinafter the I 2 installation of street lighting within the Development. Such reimbursement shall . be made within t 4 days of the date of mailing the Citys notice of costs. If such . reimbursement is not made, the Cily may place a hold on all construction or other work related to the Development. or refuse the issuance of building permits until all costs arc paid in full. The City may further declare a default and collect its costs from the security deposited in accordance with Section 2.5 of this Agreement. 4.16 Renewal of Security. If any escrow account or bond deposited with the City in accordance with this Agreement shall have an expiration date prior to the Deve10per's obligations hereunder being complete, the Developer shall renew such security or deposit substitute security of equal value meeting the approval of the City at least thirty (30) days prior to the expiration of such security, Failure to post such alternate security or renew such security shaH constitute a default and the City may place a moratorium on all construction or other work related to the Development, refuse the issuance ofbuilding permits, and declare the entire amount thereof due and payable to the City in cash. Such cash shall thereafter be held by the City as a security deposit in the same manner as the security theret.ofore held by the City. 4.17 Plat Dedication. Upon approval and execution of this Agreement, the City shall approve the fmal plat provided it otherwise meets the requirements of the City's Ordinance governing Subdivisions. If the Plat contains the dedication .of an easement, the use of property within the area of an easement is specifically restricted by pr.ohibiting the c.onstruction of any structure or fence, planting trees or shrubs,.or storing of personal property within the area of the easement which could . delay, restrict or impede access through the easement area by a person or vehicle. 4.18 Additional Terms. The foll.owing additional terms are being made a part of this Development Agreement to continue in force and effect as though they were dedications of the plat, unless according to their terms are intended to terminate earlier: (a) Curb cuts and access t.o Lots 2.and 3 of Block 5, Pondview Ridge Six shall be from 12th A venue only, and shall be located on the south edge (no more than five (5) feet from the south lot line) .of each said Lot. I . ave not checked the costs for such a system, and wbile I am not opposed to doing so, I see several problems use of such a system on noise violations in general. PROCE I URE: I 1. When a person calli requesting that the pOlice respond to open a vehicle with keys locked inside, the officer will resþond if available based on the pending call load. An officer will respond if not otherwise on another call or investigation. An officer will respond to any call where a child is reported .locked inside the vehicle. 2. When the officer arTIves, the officer shall askifthe vehicle is equipped with side panel air bags. . If the vehicle is eq~ipped with side panel air bags the officer SHALL NOT attempt to open the vehicle. Rd. 2) at 9:29, February 22,2001. As he was opening the car door to his pa ro1 car, he noticed a :vehicle approaching to his right about to hit him. He jumped back an a car driven by Br~nda Ann Forner, 340f St. Joseph crashed into the rear of the pa ro1 car. The patrol car was pushed into the back of the car that Officer Janssen had st pped. A 16-year-014 St.Joseph male was in the stopped vehicle. N ' one was injured in the crash, but the patrol car suffered extensive damage. The St arns County Sherif~s office is investigating the crash.
