OBJECTIVE:
I have been encouraged by the Minnesota Dept. of Health (Plumbing Unit)
to pursue a Plumbing and Heating Inspection position, to ensure qualified
inspections for the Saftey and Health of the consumer and community.
At the present many surrounding smaller cities and jurisdictions are
using untrained and unlicensed personnel for Mechanical inspections. I
feel the inspector should be as or more qualified that the workers in --the
field. To make on time and creditable inspections as not to delay the
..... building schedules and process.
with the ever present possibility of contamination of Municipal water
.- supplies, I have completed a training course (American Backflow Pre-
i vention Association) for testing certification of mechanical back-
, flow devices.

Dear Mayor and Council Members,
As I review the conversation at the meeting of July 1, 1993
relative too our request in a reduction of the hook up fees
assessed to our companies, I wanted to summarize the points of
. issue expressed at the meeting.
1) Hook up fee:
I acknowledge the comments made by your attorney
regarding the nature and factors relative to the
hook up fee.
2) Disproportionate share of costs:
Your attorney also acknowledged that we did pay a
disproportionate share of costs from a standard
municipal improvement.
3) Excess interest cost:
I have enclosed a copy of the amortization cost of
debt with an interest rate of 8% and 6.39%. The
interest rate differential is a standard procedure to
protect a municipality in the event that the citizens
default on special assessments. In the assessment to
the properties of DBL and Mca the city also received
the signed personal guarantees of Jerry Hirchfeld,
Bob Helland and Dick Backes to protect the city by
having full claim to the personal assets of the
aforementioned individuals. The attorney for the
city of st. Joseph drafted up the guarantee
documents.

I feel that the city has three options in reviewing the hook up
fee of $14,400 (subject to a correct meter reading to be done in
the coming weeks):
A) Charge Jerry, Bob and Dick $14,400 (subject to
correct amount)
B) compromise the above issue and charge 1/2 of the
hook up fee -$7,200 (subject to correct amount)
C) Delete the hook up charge

EMPLOYEB DENTAL COVERAGB
The League of Minnesota Cities offers a pooled self-insurance
program of employee group dental benefits to Minnesota cities.
The plan is administered by DCA, Inc.
BENEFXTS LMCIT offers two different packages of dental benefits
for cities. Plan II uses slightly larger deductibles, and was
introduced in order to provide a lower-cost option. Larger
cities can also specify their own customized package of
benefits. Both plans divide benefits into three classes:
"Preventive services" such as routine examinations, cleanings,
fluoride treatments, bitewing and full-mouth X-rays are fully
covered under both Plan I and Plan II.
. "Basic services" includes services such as other X-rays,
extractions, fillings, oral surgery, anesthetics, endodontics,
root canals, space maintainers, sealants for children under 14
years of age, and denture repairs, etc. Under Plan I, basic
services are 80% covered, subject to a $50 lifetime deductible.
Plan II covers basic services at 80%, subject to a $50 annual
deductible, with a limit of three deductibles per family per
year.
"Major services" such as inlays, crowns, bridges, and dentures
are 50% covered, subject to a $50 annual deductible under both
Plan I and Plan II. The limit of three deductibles per family
per year also applies to major services under Plan II.
Preventive, basic, and major services are subject to a $750
annual maximum under Plan I, and a $1000 maximum under Plan II.
Family orthodontic coverage is also available as an option.
This provides 50% coverage, subject to a $50 deductible under
either plan. Plan I has a $1500 lifetime limit on orthodontic
benefits. Plan II's limit is $1000.
COSTS Different rates apply to metro and non-metro cities,
reflecting the difference in dental costs. These monthly rates
. will apply through June 30, 1994.

OTHER BENEFIT OPTIONS cities with employee groups of 25 or more 4IÞ
also have the option of specifying their own customized package
of dental benefits. When a customized package is requested, an
individual rate for that city will be calculated.
ELIGIBILITY The LMCIT dental plan is available to all of the
League's member cities. For any city, the group of employees
entering the program may be any of the following:
A) all city employees; or
B) any organized bargaining unit within the city; or
C) any other defined group of 2 or more employees
(e.g. clerical, police, public works, etc.)
In order for any of these groups (A, B, or C) to be eligible,
the !ollowing criteria must be met:
1) If the city pays all of the premium, 100% of the
eligible employees in the group must enroll.
2) If the city pays any part of the premium, 75% of the
eligible employees in the group must enroll.
3) The city must pay at least 50% of the total premium. 4IÞ
4) If dependent coverage is selected, at least 60% of
the eligible dependents must be enrolled.
5) A person already covered as a dependent under a
spouse's coverage will not be considered to be an
"eligible employee" in calculating whether the above
percentages are met.
HOW IT WORKS Each participating city pays its monthly premium
to LMCIT. From these funds, LMCIT purchases reinsurance to
protect against unusually high claims; pays for program
administration; and pays the claims of the employees of the
member cities. The remaining funds are invested, further
reducing the cost of the program. The rates charged are
calculated to include an amount sufficient to cover all
estimated claims incurred during the coverage period. Thus,
part of the premium will be held as a reserve for claims
incurred but not yet paid at the end of the period.
A COBRA administration service is also available to member
cities of the dental plan as an option. Under this plan, DCA
will handle all required notices and other aspects of COBRA
administration on the city's behalf.

LEAGUE OF MINNESOTA CITIES INSURANCE TRUST
HEALTH, LIFE, AND DISABILITY COVERAGE
The League of Minnesota Cities Insurance Trust offers cities a
package of employee health benefits through a joint self-
insurance plan administered by DCA, Inc. The brokerage and
consulting firm of Willis Corroon also provides certain services
to LMCIT. To complement the health coverage, life insurance is
provided by Minnesota Mutual, and disability coverage by Fortis
Benefits. The LMCIT health benefits plan has been self-insured
since 1983.
BENEFITS
Smaller cities For cities with fewer than 25 employees, a
. standard benefit package is offered. Each covered individual
pays a $150 calendar year deductible. No more than three
deductibles are charged against any family per year. The city
can also choose a $300 or $500 deductible, at a reduced cost.
After the deductible is satisfied, the plan pays 80% of the next
$3500 of the individual's covered medical costs, and 100% after
that, up to a lifetime limit of $1,000,000. The plan includes
all benefits required by statute, including maternity, chemical
dependency, etc. The plan incorporates a number of features
designed to help hold down the cost of coverage, including a
second opinion requirement for surgery, and the MedTrac
pre-admission review and evaluation service described below.
DCA also handles all COBRA notices and administration on behalf
of the city.
MedTrac MedTrac is designed to reduce costs through careful
monitoring of the necessity of hospital admissions, the length
of hospital stays, the accuracy of hospital bills, and
timeliness and quantities of hospital services. The only
requirement is that the patient make a call to MedTrac before
any scheduled surgery or hospital admission.
Larger cities cities with 25-100 employees can specify a benefit
package tailored to their needs. COBRA administration and the
MedTrac service are also available as options. The LMCIT
. program is not presently available to cities with more than 100
employees.
Transplants All LMCIT plans cover "experimental" heart, lung,
heart-lung, liver, pancreas, and bone marrow transplants.
ELIGIBILITY .
Full-time and part-time employees working at least 16 hours per
week are eligible for coverage, subject to the city's own
eligibility rules. Council members can also be covered,
provided the entire council is enrolled. For groups of 10 or
fewer, 100% participation is required; for larger groups, 75% is
required. Admission of a city to the small-cities program is
subject to medical underwriting of the city's employee and
dependent group.
RATES
Through June 30, 1994, monthly rates for cities with fewer than
25 employees are:

cities in the small-cities plan which have had high claims in
the past and which are expected to continue to have
higher-than-typical claims in the future will be placed in a
higher rate tier. Rates for these cities are 10% higher than .
rates for other small-city members.
Rates for cities with 25 or more employees are based partly on
the city's own experience and partly on the pooled experience of
the LMCIT group, and reflect that city's own benefit package.

regularly reviewed by an actuary to help assure that adequate
funds are available to meet LMCIT's liabilities.
LMCIT's cost of operation is very low. Administrative,
reinsurance, and actuarial costs total about 12% of the total
premium; the remainder is available to pay claims. .
HEALTH CLAIMS PROCEDURES
Claims are paid through DCA's Minnetonka office.

. RETIREES
The statutes now require cities to give their retirees the
option to continue health coverage through the city group.
Retirees under age 65 must be permitted to remain in the city's
group at the same premium rates as active employees. For
retirees over age 65, the city can offer different benefits at
different rates from the active group. LMCIT offers two options
cities can use for retirees over age 65: a Medicare supplement
plan, and a Medicare-coordinated version of the city's standard
plan for active employees. A coverage plan designed for
retirees who are not covered by Medicare is also available.

LIFE INSURANCE
Term life insurance is provided by Minnesota Mutual at the
following monthly rates:

SHORT TERM DISABILITY COVERAGE
Short-term disability insurance is available from Fortis
Benefits. Benefits are payable on the first day following
injury, or on the eighth day of sickness. The benefit equals
two-thirds of the weekly wage, to a maximum of $100, $200 or
$3-00 per week. The monthly premium is $4.50 for a $100 per week
maximum benefit, $9.00 for a $200 per week maximum benefit, or
$13.50 for the $300 per week maximum.

Ordinance to address this issue. My proposal is

Finally, with the occurrence of a second violation¡ the matter
would simply be charged as a petty misdemeanor which is non-
criminal but still carries a monetary fine of up to $200.
I still have some questions in my mind as to the logistics of
enforcing an ordinance of this nature. I think there should be a
system for reporting a violation. There should be a system to
initially determine whether or not a violation occurred. As you
can see, I am suggesting that the Mayor or acting Mayor be
designated as the individuals to whom a violation is reported.
Initially, the violation should be referred to the Council as a
group to consider the allegation and issue a warning if it is
substantiated. The Council may not feel comfortable in acting in
that capacity and passing judgment on one of its own. If that is
the case, other alternatives would be to leave the matter in the
hands of the Mayor or acting Mayor to determine whether or not
there is a violation and issue a warning, or to immediately refer
it to the City Attorney or acting City Attorney to investigate
and either warn or prosecute.
A question also arises as to who investigates a second violation.
Before a second violation can be charged, there will have to be
. at least some type of initial investigation to determine the
facts sufficient to support a petty misdemeanor charge in court.
I suppose the proper investigating authority would be the Police
Department since the Police Department investigates other
allegations. Again, because of a conflict of interest, the
Police Department may want to bring in the Sheriff's Department
in to investigate.
Finally, a question arises as to the prosecutorial agency.
Normally¡ our office prosecutes any petty misdemeanor or
misdemeanor criminal charges occurring within the City. On some
occasions, where we have known the person charged or where
matters have involved police officer's conduct, we have referred
the allegations to an independent attorney for consideration of
charges. That may be most appropriate in this case so as not to
jeopardize the working relationship existing between our office
and any City Council members.
I would certainly ask the City Council to review my proposed
ordinance and offer any suggestions or comments. To be perfectly
honest, I am not altogether comfortable with an ordinance of this
nature. I would certainly hope that it would never have to be
used; and in the case of our current Council members, I believe
that to be the case. But I can also see the other side of the

issue and the need to have some type of procedure to deal with
the Council member in the future who attempts to circumvent the
authority of a Council as a whole while acting on his own.

ORDINANCE 21: ORGANIZA TIONS AND PROCEDURES OF THE CITY COUNCIL.
Section 21.1: MEETING DATES (First and Third Thursday). The City Council shall hold
regular monthly meetings on the first and third Thursday of each calendar month at 7:00 p.m. unless
a different time is set by the Council. Any regular meeting falling upon a legal holiday may be
rescheduled by the Council to another date near the date originally scheduled for meeting.
Section 21.2: SPECIAL MEETINGS. Special meetings of the City Council may be called by
the Mayor on oral notice to the Clerk or by any two members of the Council in writing filed with the
Clerk at least 24 hours prior to the time specified for such meeting. The City Clerk shall
immediately notify each member of the Council of the time and purpose of the meeting by telephonic
notice to each member, if he or she can be found, and if not, notice to an adult known to reside in
the abode of the Council member. Special meetings may be held without such notice when all
members of the Council are present in person, or when the absent members have consented to the
holding of said meeting. Any special meeting attended by all the members of the Council shall be a
regular meeting for the transaction of any business that may come before such meeting. The City
Clerk shall also give notice of special meetings to the local media and post notice at City Hall.
Section 21.3: AGENDA. An agenda of business to come before the City Council shall be
. prepared by the City Clerk on the Monday immediately preceding the regular City Council meetings.
The Clerk shall furnish each member of the Council with a copy of the agenda prior to the Council
meeting and as far in advance of the meeting as time for preparation will permit. Any person
desiring to be heard by the Council shall make his or her intention known to the Clerk not later than
one week prior to the Council meeting, and shall inform the Clerk of the substance of the matter to
be presented so that it can be included in the agenda. Any matters not so presented shall not be
considered by the Council, unless the Council is satisfied that the omission of said item from the
printed Agenda was inadvertent, or the matter is of such urgency that Council, by unanimous vote,
suspends the rules for the consideration of the matter.
Section 21.4: ADDRESSING THE COUNCIL. Each person addressing the Council shall be
limited to five minutes, unless further time is granted by a majority vote of the Council. All remarks
shall be addressed to the Council as a body and not to any member thereof. No questions shall be
asked or a council person except those presented through the presiding officer.
Section 21.5: CONDUCT AT MEETINGS. Any person making personal, impertinent, or
slanderous statements, or who shall become boisterous while addressing the Council, shall forthwith
be barred from further audience before the Council by the presiding officer unless permission to
continue be granted by a majority vote of the Council.
Section 21.6: SERGEANT AT ARMS. The Chief of Police or such other member or
members of the Police Department as the Chief may designate, shall serve as Sergeant at Arms at the
Council meetings upon the request of the Mayor. When serving in this capacity, the officer shall
maintain order and decorum at the meeting, and act at the direction of the presiding officer.

. Section 21.7: COUNCIL MEMBERS AUTHORITY.
Subd. 1. No Council member, when acting as an individual, may formulate policies, exercise
City powers or direct the actions or conduct of City employees, except under the following
circumstances:
a) The individual is specifically authorized by the City Council to take such action or
engage in the conduct.
b) The individual is delegated authority to act on behalf of the City by a specific
Minnesota Statute.
c) The individual is delegated authority to act on behalf of the City by a specific City
Ordinance.
Subd. 2. Any violation of Section 21.7.1 shall be reported to the Mayor, or if the Mayor is
the alleged violator, to the Council member who has been appointed to serve as acting mayor. The
alleged violation shall be transmitted to the Council for consideration. Upon the first finding of a
violation, the violator shall be warned. Any subsequent violations of a similar nature by the Council
member shall constitute a petty misdemeanor and shall be prosecuted as such. If found guilty, the
Council member shall also reimburse the City for the reasonable costs of prosecution.
Subd. 3. Any council member taking any action against a City employee in retaliation for
reporting a violation of this Section shall be guilty of a separate petty misdemeanor offense.
. Section 21.8: PENALTIES. Any person who shall violate any of the provisions of the
ordinance shall be guilty of a misdemeanor; except a violation of Section 21.7 shall constitute a petty
misdemeanor.

system, the notice of connection shall be delayed for five years
less the number of years (broken down to the nearest whole month)
since the septic system was constructed. Therefore, if the
system is two years old, sending of notice to hook-up would be
delayed for three years ( 5 minus 2). Upon receipt of notice, the
property owner has one year within which to hook up to the
system. Therefore, for a brand new system, the property owner
could have up to six years within which to connect.
3. The City may require immediate connection to the system if
any of the following circumstances occur:
a) The private septic system fails to meet City and County
standards at any time during the period when notice is
delayed.
b) The property is sold by the person requesting the delay
of notice.
c) Connection is deemed necessary for the purpose of
. protecting public health.
4. Even though connection is delayed, the property will be
currently assessed with assessments due and payable like
they would be for other properties unless the property
qualifies for deferment under some other law.
S. As such time as connection is required, the property owner
will pay the connection fee which is applicable at the time
of connection; the property owner will not be able to pay a
lower hook-up fee which may have been applicable when the
services were first available.
Rachel, if the City Council is interested in adopting a procedure
of this nature, they can probably just pass a resolution adopting
the guidelines set forth in this letter. The City Council would
also be free to modify the time frames outlined herein to
whatever they feel would be appropriate.

4. Once this figure is determined and communicated to the
property owners, they will have a period of time within
which to deliver to the City a certified check! cashier's
check or bank money order in the full amount determined to
be their share of the costs. The property owners will be
advised of the amount and the date on which payment must be
received by the City shortly after receipt of construction
bids. The money will have to be received several days
before bids are taken for the bonding.
5. For any properties where prepayment is not received by the
deadline! the City will borrow for their share of the
construction costs with capitalized interest figured into
the borrowing and the full amount of the cost to the City
assessed against the property. Although the assessment may
be prepaid before it actually accrues interest, prepayment
after the bonds are sold will involve the additional amount
of capitalized interest.
