MEMBERS PRESENT: Mayor Donald Bud Reber; Members of the Council Ross Rieke, Bob Loso, Stephanie Hazen. Clerk/Administrator Rachel Stapleton. MINUTES: Hazen moved to approve the minutes of the July IS, 1993 - meeting with corrections as follows; seconded by Loso. BILLS PAYABLE: Judy Weyrens presented the bills payable and overtime and comp time for the month of July. After review, Hazen made a motion to require that the Council will review and approve all overtime prior to payment of it; seconded by Loso. Ayes: Reber, Rieke, Loso: Hazen. Nayes: None. MAYOR REPORTS: . 1) Mayor Reber requested that Chief Lindgren introduce the candidate fd'fill the vacant position of patrol officer. Chief Lindgren intròduced Brian Klinefelter to the Council and stated that he supports the Police Hiring Committee's recommendation to approve him for the position. Hazen made a motion to accept the Police Hiring Committee and Chief's recommendation to approve Brian Klinefelter as Patrol Officer; seconded by Rieke. . Ayes: Reber, Rieke, Loso, Hazen. Nayes: None. Motion carried. Rieke made a motion that Officer Klinefelter begin at base pay, during the evaluation period, according to the Police Officers Federation contract; seconded by Hazen. Insurance coverage 1.S $500 deductible. 3) Mayor Reber asked Rachel about the status at purchase orders. Rachel stated that she has discussed ordering the forms with the office staff. Mayor Reber requested that the forms are ordered and the system implemented as soon as possible. 4) Mayor Reber requested that weed notices are sent to property owners of Pondview Ridge Addition, the property north or Pondview Ridge, and Northland Addition. Loso suggested and moved to approve any future grass cutting due to ordinance violations will be done by hiring a private contractor to mow the weeds on the property in violation. Hazen seconded the motion. Ayes: Reber, Rieke. Loso/ Hazen. Nayes: None. Motion carried. 5 ) Mayor Reber provided information he received from APO on the Minnesota Road Research Project which lS located parallel to 1-94 approximately 40 miles northwest or the Twin Cities. '7 and for 1995 are $4,207. ...),Q.....,I 6) The College of st. Benedict offered the City of st. Joseph a parcel of property adjacent to the eastern boundary of the City. It is a parcel of 1. 05 acres which includes an area or proposed future roadway for access to CSAH 75. Mayor Reber stated that the portion of the parcel whi ch wi 11 not contain +-' roadway could be sold for a business \.-ne site. Loso stated that the proposed roadway could be protected by adopting a transportation plan. Hazen made a motion to approve purchase of the parcel of property, at a cost not to exceed $15,000, with the source of funding to be established at the next meeting; seconded by Rieke. Ayes: Reber, Rieke, Loso, Hazen. Nayes: None. Motion carried. 7) Mayor Reber questioned why the Council eliminated some parking spaces on Second Ayenue, at the last meeting. Hazen stated that the parking spaces were recommended to be removed by the Planning Commission for· better visibility at the intersection. Rieke stated that there ar~ state specirications ror parking requirements at controlled intersections, as l.S Second Avenue and Minnesota street. 8) Mayor requested that memos are sent to employees arter meetings, prior to sending them the minutes. 9) Mayor Reber recommended appointing Deputy Clerk Judy Weyrens as a member or the star City Commission in Dlace or the Clerk/Administrator, 4Itause it is anticipated that the tim~ it will require could effect e work in the orfice, that is required of the Clerk/Administrator. 10) Mayor Reber requested approval of the Council to allow a committee .. himself, former Mayor Mike Loso, and City Attorney John Scherer to or conduct a fact finding study of information with employees and meet with the employees involved, then will bring the information back to Page 2290 August 5. 1993 . CITIZEN REQUEST: Eric Hansen appeared before the Council to the request City's assistance in an Eagle Scout project to stripe the st. Joseph Parish parking lot. planned date for the project is August 14. He is asking to be allowed to use the equipment and for City assistance in using it. Loso asked if this lS appropriate use of city equipment. After discussion Hazen made a motion to approve the request subject to approval by legal counsel; seconded by Rieke. Ayes: Reber: Rieke, Loso, Hazen. Nayes: None. Motion carried. COUNCIL REPORTS - RIEKE: Rieke reported that he had received a callan the fence located on the right of way property: on East Eaker which the City has required removal. He has not had time La go and look at it, but will. HAZEN: The Joint Operating Fire Board held a meeting and considered the following: 1) Received a grant oÍ $300 Íor the air van which will be stored at Cold Spring. Rachel will do the paper work for it. 2) 17 .. efighters took defibulator training and all passed. 3) Keith and dv are continuina to work on OSHA reauirements for blood borne - - - pathogens, and are staying within their budget. 4) The fire antenna was moved. 5) Dick lS checking with other Fire Departments concerning additional liability lnsurance. Stephanie will bring inÍormation back to the Council table when Dick reports his findings. 6) The old fire siren will be disposed of: after Dick checks on historical value of it. 7) The Fire Chief and Assistant Fire Chief were approved to attend the Fire Chief's convention in st. Cloud. 8) The Fire Board approved a 5% increase across the board for the 1994 budget. Hazen made a motion to accept the 5% increase of the Fire Budget to include $5:812 for OSHA requirements; seconded by Rieke. Loso made a motion to table the budget lncrease until the Council considers the full budget; seconded by Hazen. Ayes: Reber, Rieke, Loso: Hazen. Nayes: None. Motion carried. 9) Dave Hinnenkam~ came to the Fire Board meeting and discussed the financial reports of current and past. years with the Board. After discussion of the differences in methods of cash basis and accrual accounting th~ Fire Board generally accepted the differences in balances. 10) Hazen presented employee evaluation forms and made a motion to approve and implement their use for one year; seconded by Loso. Discussion - The Personnel Committee will reVlew other forms for next Year. ~ Ayes: Reber, Rieke, Loso: Hazen. Nayes: None. Motion carried. Hazen requested that the Rachel set up a meeting for August 24 or 25 to coordinate with the Department Heads for Stephanie and Ken to go over the form. Hazen made a motion that by August 24 all employees write Paae ""'2Sl August 5, 1993 . down their day to day duties and put them in sealed envelopes and give to the Personnel Committee; seconded by Rieke. Ayes: Reber, Rieke, Loso, Hazen. Nayes: None. Motion carried. The time schedule in the personnel manual will then be followed, for use of the evaluation forms. LOSO: I) Loso presented quotes from two companies for installing a sidewalk in Monument Park to finish that project. Loso made a motion to approve the low quote of Concrete Plus of $511.50 for installation of a sidewalk 33 feet by II feet in Monument Park. Source of revenue is the Park Development Fund. Hazen seconded the motion. Ayes: Reber, Rieke, Loso, Hazen. Nayes: None.> Motion carried. 2) The slide was recently removed from Centennial Park when the other playground equipment was removed. Removal was for safety precautions. 3) Loso asked the status of getting a new plow truck which was approved in the past. FIRE RELIEF ASSOCIATION: Ken Twit appeared before the Council and presented the report of the financial condition and requirements for ~4 for the st. Joseph Firefighters' Relief Association, with ~edules I and II. He requested the City's contribution, for the 1994 Dudget, to the st. Joseph Firefighter's Relief Association lS $7,622. This is at a pension level of $950 per year as previously established. He discussed the calculations and problems with the state Auditors Office. Ken agreed to get corrected figures to the Clerk/Administrator by Monday. OPEN TO THE PUBLIC: steve Dehler discussed that he saw no problem with the division of church and state, in the matter of the Eagle Scouts request, unless there is a complaint. 2) The Linnemann Inn had a Special Use permit hearing and it was determined by the Planning Commission that neither a Special Use permit nor a Variance was needed. He requested that if anyone knew of any laws, ordinances, or special rules that will affect his project, please let him know. He stated he will abide by the laws and rules, but needed to know of them during the Planning process. He felt there should be more communication between the Building Insp~ctor and the Fire Inspector, prior to inspections. He discussed the layout of the Li~nem~nn Inn and that 30 people will be living there.'.C~uncilor Loso questioned Mr. Dehler as to the classificatio~ 61 his property. Mr. Dehler stated the property use, for his purpo~e'is a lodging house. Parking will be provided at a three spaces for five people which will require ten spaces. The parking lot is gravel at perhaps a Class five, but will install a layer of dust proof granite type chips. There was further discussion on the need for bituminous surface. but Dehler felt the ordinance does not ~uire it. He also stated' that according to State definitions the ~ility will be considered a hotel rather than a lodging house. Hazen made a motion to recess at 8:20 p.m.; seconded by Loso. Page 2292 · August 5, 1993 Mayor Reber reconvened the meeting at 8:34 p.m. ALLEY VACATION: Torn Skahan and Dale Victor appeared before the Council to clarify and ask the Council to reconsider their request for vacation of the portion of the alley which separates their properties. They stated that their future building construction plans include construction over the alley property. Loso made a motion to vacate the East portion of the alley locat~d between Date street East and Elm street East, which lies west of First Avenue NE, and between Lots 5,6,7, and 12, 13, 14, Block 23 of Peter Loso's Addition. This is in the public interest to retain jobs in st Joseph and to increase the net tax capacity oft.he city. Prior to filing of the vacation, an agreement obbligato current and future owners of the property to allow for snow removal, as required by the City, will be executed. The motion was seconded by Rieke. Ayes: Reber, Rieke, Loso, Hazen. Nayes: None. Motion carried. Dick will provide Rachel with his needs for snow removal from the remaining allyway, in order for Rachel to get an agreement written, signed and filed. tIlRTMENT COMPLEX: Mark Lambert appeared before the Council to request consideration of a recommended change in a requirement of the Special Use permit. The Planning Commission held a hearing on August 2, 1993 to consider reducing the height and areas of required fencing of his property at North Park Addition, Lots 1 & 2. Lambert stated that because of the change in the neighborhood since the Special Use permit was granted the focus of the need for the fence has changed. Rieke and Loso had been contacted by Ken Jacobson who lS willing to assist in the cost of fencing to six feet adjacent to his property. Mark also discussed a small isolated parcel of property which he owns in order to retain the possibility of future access from First Avenue NE to the apartment complex. Hazen moved to accept the recommendations of the Planning Commission and relieve Mr. Lambert of the six foot fencing requirement. Instead of the six foot fence, the following fencing is recommended for approval: 1. No fence along ~he west side of the property. 2. A four -foot fence along the south 200 feet of the east side and a six foot fence òn the remaining portion of the east side"¡,_ The motion wa~secònded by Rieke. Discussion - Mr. Lambert agreed to meet with pro~erty owners interest~d in the fence being placed adjacent to their property. Ayes: Reber, Rieke, Loso, Hazen. Nayes: None. Motion carried. ~DOOR LIQUOR: The Council considered the application of Mark Zimmer for the La Playette, Inc. for an outdoor liquor permit for an event to be held August 29, 1993. Loso made a motion to approve the application with the usual requirements for outdoor liquor permits; seconded by Rieke. CITY ENGINEER REPORTS - WATER SYSTEM IHPROVEMENT - CONTRACT I I : Joe Bettendorf, City Engineer reported on the Water Tower project. He stated that the weather is slowing the project because the temperature and humidity must be within certain ranges for painting. He presented application for payment Number .., to CBI Na-Con Inc. Loso made a motion I to approve application for payment Number 7 to CBI Na-Con Inc. J..n the amount of $74,480; seconded by Rieke. Ayes: Reber, . Ri eke / Loso: Hazen. Nayes: None. Motion carried. WATER SYSTEM IMPROVEMENT CONTRACT I: Joe presented final application for payment to S. - J. Louis to close out the project. He noted that although the contract prlce was approximately $366,000 and the total payments were nearly $50,000 less: the contractor did a good job. HazeD made a motion to approve Application for Payment Number four to S. J. Louis Company seconded by Loso. Ayes: Reber, Rieke, Loso: Hazen. Nayes: None. Motion carried. WEST MINNESOTA STREET IMPROVEMENT: Joe presented application for .ment ~~mber 1 to Hardrives, Inc. Joe stated that he has written a letter 'Co the contractor stating that an extension on the contract may be difficult to get, because of the work scheduling. Hazen made a motion to approve Application for Payment Number 1 to Hardrives, Inc. of $62,950.70. The motion was seconded by Rieke. Ayes: Reber, Rieke, Loso, Hazen. Nayes: None. Motion carried. Joe discussed tank removal of tanks found in the street area in front of Stueve's Garage. Solberg Enterprises, which lS certified in underground tank remova I : contract agreed to remove and dispose of the tanks, as required by PCA regulations. Solberg removed the tanks to his disposal site. The Council considered if the cost of the removal, $847.50, is a City cost or property owner cost. The property owner can get reimbursed at -90% from the Petro fund but it takes about a year. The Council tabled the matter: to. old. business at the next meeting. CHURCH PARKING L.OT ENTRANCE: There has been proposed by st. Joseph's Church Committee- to change the location of the entrance to the parking lot. This wi 1·1 . be considered along with the beautification project. OLD BUSINESS PERSONNEL POLICY MANUAL: Hazen reported that the Personnel Committee 4f with John Scherer and his proposed changes will be incorporated to the manual. The Personnel Committee will present it for approval en the changes are made. SNOW REMOVAL BUSINESS DISTRICT: Council received information from Dick on snow removal and agreed to consider this at the next meeting after time to review the information. PLUHBING\HEA?TNG INSPECTOR POSITION: Council agreed to retain this matter under OLD BUSINESS for the next meeting. Ä_MENDMENT TO THE BUILDING INSPECTOR CONTRACT: Loso made a motion to approve the amendment to the Building Inspector's contract with an ~ition to the contract which clarifies .... contracting parties. WATER AGREEMENT: Due to the restructuring at St. Ben's physical plant: the proposed \;.Jater agreement with them will be considered at a later date. PARKING LOT ANNEX: Rachel stated that Hardrives has been notified that the proposal to install a parking lot has been approved. Loso suggested that the lot be extended to meet the driveway by the Legion: and run it all the way to the west end of the lot: remove the hedge and the fence. Council agreed to look at the area: and make a decision at the next meeting: pr1.or to installation of the parking lot. MOWING OF WEEDS: -Counci I requested this item be dropped from Old Business. '. Council was reluctant to allow this matter to be placed on that agenda without time for the Council members to review the Planning commissions recommendations. 8) The City has been notified that the Physical Plant at St. Ben's has been turned over to the College. 9) PURCHASE ORDERS - Copies of the proposed ~ . Chief of Police has been consulted on this matter and Reber reported that he would not be adverse to it. MEMBERS PRESENT: CITY COUNCIL - Mayor Donald Bud Reber; Members of the Council Ross Rieker Bob Losor Stephanie Hazen. Clerk/Administrator Rachel Stapleton. Mayor Reber called the meeting to order at 7:00 p.m. and stated that the purpose of the meeting is to go over the 1994 budget. The Council discussed went through the draft of the budget on a line item basis. The Council was generally supportive of including a capital outlay item of a laptop computer for use at council meetings. The health insurance cap was established at 1993 figuresr and Council requested that all the budgeted amounts for health insurance be adjusted to provide for the cap at 1993 levels. General consensus was to make use of the services provided by the League more for legal information. . Council requested that the high gas usage for the City Hall Annex is investigated. Rieke made a motion to have the oil changing type servicing of the Patrol cars done by outside contractr for more cost effective use of city maintenance. The motion was seconded by Hazen. Ayes: Reberr Rieker Losor Hazen. Nayes: None. Motion carried. Rieke stated that earlier this summer the City sent a letter to the property owners of the easement between Park Terrace and Clinton Villager stating that the maintenance department would be going through the easement to service the sewer main. The City Maintenance Department has not yet gone through the easement to service the main. Rieke suggested that the city maintenance use the street cleaner more. Council generally agreed that since the City owns the equipment to clean streetsr it should be used more frequently. .Also they agreed that street cleaning does not have to require overtime. No parking could be set up using cones or suchr the night before intended cleaning. . The intention is for the hockey rink to be moved this summer. Council generally agreed to have the gas turned off to discontinue the maintenance fee. Hazen requested that maintenance check the new fence in Morningside Park. There is something hanging on it. Page 2297 . ~_. \ August 12, 1993 . Council discussed planting more trees. Mike Sworski, as Park Maintenance person, could put together a plan to plant a few trees each year. Council also considered contracting out the maintenance of parks, and may consider this option in the future. Team Building and social functions were discussed. Rieke felt that team building efforts are important to the welfare of the employees. Reber stated that he does not feel this is an appropriate use of tax money. Council agreed to include street Improvement project for old Highway 52 in the budget, for street Maintenance. Council agreed to budget for a new well, and look at contracting out more services, including snow removal. Rieke made a motion to get a proposal from a cost accountant to do an indepth study of the costs of various city operations. The motion was seconded by Loso. Ayes: Reber, Rieke, Loso, Hazen. The rights of the City under this subdivision shall be in addition to any other remedial or enforcement provisions of this ordinance. Subd. 5: No person shall discharge or cause to be discharged directly or indirectly any storm water, surface water, groundwater, roof runoff, subsurface drainage, unpolluted cooling or process water to any sanitary sewer unless there is no prudent and feasible alternative and unless as approved by the City. Subd. 6: Storm water and all other unpolluted water shall be discharged to a storm . sewer, except that unpolluted cooling or process water shall only be so discharged upon approval by the City and the user may be required to obtain a NPDES Permit from the MPCA. Motion carried. FIRE CHIEF'S REPORT AND OLD BUSINESS: a) Cold Spring fire Department is working on the air van. DNR has provided each department a $300 matching grant. Cold Spring will be sending us an invoice for $600, which must be paid before the grant paper work is sent in. Rachel will 4IÞ submit the application for funds to DNR, by September 30th . deadline. Bechtold made a motion to approve the payment of $600 to Cold Spring for st. Joseph's share of the air van; seconded by Hazen. Ayes: Bechtold, Hazen, Taufen. Nayes: None. Motion carried. b) The Defibulator and Jaws of Life have been received. Seventeen firefighters received training on the defibulator Training was given by Murphy Ambulance pèrsonnel at no charge to the Department. Jaws training will be next month. Joe Prom will donate all the cars. c) Keith Gruber and Randy Torberg have been working o~~,the OSHA requirements for occupational exposure' to blood borne pathogens. Some of the things have been ordered and some need to be ordered yet. They have stayed under the $2,500 limit. d) The communication antenna has been.mo~ed by Granite Electronics at a cost of $1,100. . e) The exhaust fan is installed in the 'Fire Hall but needs to be wired. Dick will contact an individual to wire it. f) Dick is waiting for information from other departments on liability insurance. He stated that he has been informed it is necessary to have a greater level than the state liability limit for cities which is $650,000. g) The annual maintenance has not been done, yet but expect it - to be done by fall. - BUDGET: Chief Dresented a DroDosed budaet for 1994. which shows approximaie increase ;f ~%. JOSEPH Rachel Stapleton REGION III MCFOA MEETING AUGUST 12, 1993 Tom Thelen of the League of Minnesota cities discussed the status of HACA, Equalization and Disparity Aid, and that they are being incorporated into Local Government Aid. Therefore the LGA for 1994 will appear higher by these amounts. Also there is a provision in state law to allow for unallotment. If revenue is a shortfall, then the state may cut a percentage, by line item. The $2.00 garbage tax is just the tip of the iceberg. Internships for Cities were discussed and promoted by the League. The Fall Reaional meetinas will have the state Aaencies . represented-this year. MDOT, DTED, MPCA, MNPS will all be there to discuss and answer questions. This meeting is for elected officials and Clerks, to update on the changes in laws and policies. Rich Knowlton discussed investment methods to get better yields and interest rates. He also showed graphs which showed rates from the 1800's. Kermaine Bender of Berkley Administrators discussed Managed Care. This is a new program for Worker's Compr which is supported by the state. Purpose is to reduce size of claims and get workers back to work. Employers have choice õf plans if providers have more than one plan. A refund on the premium from Workers Comp will be coming back to the Cities in September. It will be about 20% of the 1992 premium. This is a report on a meeting I attended. Q Rachel - . .
