JOSEPH Rachel Stapleton NOTES TO THE COUNC I L MEMO DATE: October 18, 1993 TO: Members of the Council FROM: Rachel Stapleton 9a. Report in packet. 9b. Letter in packet. 9c. Information sent in packet for the October 7th meeting. 9d. The minutes of the October 7 , 1993 Council meeting address the CORE Committee as a volunteer committee, and suggested that the Secretary should not have been preparing thank you notes for that Committee. . The CORE Committee was established in the summer of 1990, in response to community problems. The Council established the status of CORE as a subcommittee of the Council, with a Council liaison, and the Clerk/Administrator as a member to keep the records for the committee, and send information and notices. The Council felt this is an important committee and in order to ensure permanence they provided CORE the Clerk/Administrator's office to retain permanence of the Committee. The Police Chief is a permanent member of the committee also. Therefore, I felt that it was appropriate for my staff to prepare thank you notes for the success of Community Day, which was a CORE sponsored event. If the Council's focus of the CORE Committee has changed, please clarify the status of the CORE Committee, and the degree of involvement the Council wishes the City to provide. 14d. NSP is responding to the 5th Avenue NW request and Stearns Electric is preparing a plan for the East end. 14f. Information in packet. 14g. Information in packet. 14h. Information was in your October 7 packet. Joel Vogel called me and stated that he is against prohibiting biking, roller blading, etc. on the streets. 14l. Information in packet and proposed ordinance copy was in an earlier packet. 17. Noise complaint hearing for property at 27 Second Ave. SE. Gary Terwey, property owner, has not yet responded. 18. Report was passed out at the October 14 meeting. 19. Joe Bettendorf will discuss hookup fees and project updates. Mike Sullivan of Colin Peterson's office will come to the Council meeting at 7:45 p.m. to answer questions and provide you with any information he may have on the Metropolitan Statistical Area. Also in your packet is information 1) to planning commission members participating in decisions relating to issues which personally effect you. 2) Sale of platted park property information 3) Purchase of property from CSB . Mark Lambert has informed us that he has already installed a fence in the area of question. steve Dehler asked that the spring and fall cleanup include all city properties. Marlys Sebasky stated that she was very please with the fall cleanup.s - - I· ,- . , . . LEAGUE OF MINNESOTA CITIES 1993 REGIONAL MEETING PROGRAM Report to the Council october 7 , 1993 . Bob Loso and Rachel Stapleton attended the League of Minnesota cities Regional meeting at Avon on october 7 , 1993. A panel of presentations by representatives of State Departments were given. Minn. Dept. of Trade and Economic Development - Gerald Wenner stated that the State is establishing State Economic blueprint goals for economic development within the state. These goals will assist the Star cities in fulfilling their goals. He also discussed challenge grants through the McKnight foundation and the availability of other programs through DTED for various projects. Department of Public Safety - Don Hubert discussed the ISTEA funding, which is a funding mechanism very different from MDOT funding in the past. Also he discussed that they will do contract maintenance for cities as time and . funding will allow. He stated that cities should allow two years advance notice for Cooperative funding agreements for street and road projects. They are more sensitive to local business needs during projects, and try to plan detours without disrupting local business. Minn. Pollution control Agency - Larry Shaw discussed that MPCA is attempting to be a more supportive agency, by trying to help with the pollution problems rather than "to go in with guns blazing " Open burning is not legal if . there is garbage service in the city, but this requirement exempts a short period of time for leaf burning. MPCA's function in spi 11s is to assure that it is cleaned up in an efficient manner. Larry also stated that they encourage fire departments not to get out the hoses when there is a sp ill. The spi 11 should be contained and ca 11 the spi 11 hotline. MPCA has no more grants. The petro fund reimbursement requirements allow 90% reimbursement if the tank is registered with the State and the report of leakage must be reported within 24 hours of the discovery of the leak. LEAGUE OF MINNESOTA CITIES INSURANCE TRUST - Tom Grundhofer discussed that the LMCIT is doing very we 11 . They handle - property casualty, workers camp, and health insurance for cities. Coverage changes 1 ) Petro fund supplemental coverage is an . . ~ . . optional coverage. This allows fu 11 coverage on costs not covered by the petro fund coverage. 2) Also optional is limited defense of open meeting law claims. The optional coverage is 1 imi ted to $20,000 at an 80/20 participation. The City I s share is 20% and this is reimbursable coverage. The City may hire their own attorney. On November 15th the LMC I T will get involved in personnel claims at an ear 1 i er stage. (At a claims made stage.) Joint Powers coverage for an entity may be put on after a claim is made. This coverage is limited to $250,000 if retroactive. The amount of coverage is $600,000 if the Joint Powers entity is named in the insurance prior to the claim. Claims to report to property casualty is 1-800-618-0484. Sexual harassment training is available to the cities. Ell en Longfellow, an attorney with the League wi 11 give a presentation for $75 for a two hour session. Tom Grundhofer, of LMC IT , also stated that the open meeting law requires notice be given for meetings. For emergency meetings notice should be given as a minimum, to the media. Emergency meetings should only be ca 1 1 ed in a true emergency. . Tom Grundhofer also stated that the open meeting law also applies to sub committees of the counci 1 . This means that all authorized committees, whether a citizen appointed committee, Counc i 1 committee, with a quorum of the Counc i 1 or not, probably requires notice, and that an open meeting be held. TRUTH IN TAXATION - Hearings are an opportunity to get information to the citizens on the services provided and the cost of the services. Also the city may provide information on the increase in statutory costs to the city. Required this year is the cost of compensation costs as a percentage of the total proposed budget, and the number and budget for independent contractors. Sarah Hackett gave a presentation on the services and benefits the League provides. I have discussed this matter with the Stearns County Board at their Regular meeting on October 5th. -- "- Stearns County does not object to the realignment of County Road 133 to a new alignment connecting with 12th A venue Southeast within the City of St. Joseph. The County would be willing to designate this alignment as County Road 133, but would, however, undesignate the existing county road which would revert to the City as a city street. It is currently policy that the County does not participate in acquisition of right of way within city limits, therefore, the County would not participate in the acquisition of this right of way. Further, since existing County Road 133 adequately meets the County's needs in serving the travelling public, we would not be interested in participating in construction costs for the realignment. The County would, however, be willing to except future maintenance costs of the realigned County Road 133 once designation has been transferred. If a decision is made to proceed with the realignment of County Road 133, a decision will have to be made relative to the left turn lane constructed into Sherer Trucking's facility. It would be my opinion that upon vacation of the park, the City runs the risk of title reverting back to the party who originally platted the property, or his heirs or assigns. Therefore, before proceeding with the vacation, I would recommend that the City approach the party who initially filed the plat and seek a Quit Claim Deed transferring any interest which he or she may have in the property to the City. In that fashion, with the vacation of the dedication, title would accrue in the City and the City would then have marketable title to pass on to a third party upon sale. A Warranty Deed provide a warranty of title which may become an issue if there are any claims asserted against the property at a later time. r suggest that you these concerns with the Mayor and Council and let me know how you would like me to proceed. I certainly do not want to make this transaction more formal or complicated than it need be, but at the same time, I want to see that the City is protected in this transaction. CORE COMMITTEE MINUTES September 1 , 1993 The CORE Committee, a community relations committee of the Community and City of st. Joseph, met on Wednesday, September 1 , 1993 at 7:30 p.m. in the City Ha 11 . MEMBERS PRESENT: Kathryne Cooney, Bud Reber, Jenni Novak, Linda Sniezek, Marge Lesnick, Mary Popp, Nelda Lampher, S. Brian Spain, Dennis Stueve, Stuart Goldschen, Rachel Stapleton. Chair Kathryne Cooney called the meeting to order and everyone introduced themselves. COMMUNITY DAY: The minutes of the May 10, 1993 meeting should be changed to reflect the Liturgy on Community Day will be at 10:30 a.m. Dennis Stueve asked to have Community Day explained. Chair Cooney discussed the background and purpose. Linda Sniezek reported on the vocal groups to perform, and stated that Ne- . Tee has the information on the bands he has 1 i ned up. The 1 i turgy committee wi 11 provide refreshments after the liturgy service. The DARE bus is scheduled to be there. Informational booths for organizations will be set up. Mayor and Council wi 1 1 be available to meet and greet. The Chamber of Commerce will provide and serve watermelon. Dennis Stueve suggested a charge for the booths. In the past the Chamber of Commerce held a Spring F 1 i ng and October fest to raise funds. The general consensus of the group was that the purpose of this event is to build community rather than to raise revenue. The group discussed who would be responsible for the brats, and agreed to see if Bob Prom could grill them. Mayor Reber stated that the Meat Market would probably work with us to get the brats at a discount. Mary Popp stated that the planning for the 1 i turgy service is done, and suggested because of the time constraints, to scale down the plans for this years event. Next year . s Community Day could build on the plans of this years. The group agreed to scale down this years plans. Nelda Lampher stated that the quilters will set up an Amish - qu i 1 t . - The 4th of July committee wi 11 set up tables and booths. The Rod and Gun club will plant a tree. Other discussions were on crafts, DARE bus, food (watermelons . , " . . and brats) , buns - S. Brian will check if st. Ben's and st. John's could provide part of them. Setting up a sound system wi 1 1 be checked into. Mary Popp will contact P. J. Tracey. other items discussed were a pop corn machine and fa.ce painting, advertising and ending time. Portable toilets will be needed. The CORE Committee agreed to meet at 7:00 p.m. on September 6 to finalize plans. The meeting was adjourned Rachel Staplet n Clerk/Administrator . - '- 1\ '~._-'. . . CORE COMMITTEE MINUTES September 20, 1993 The CORE Committee, a community relations committee of the Community and City of st. Joseph, met on Monday, September 20, 1993 at 7:00 p.m. in the City Hall. MEMBERS PRESENT: Bud Reber, Jenni Novak, Linda Sniezek, Nelda Lampher, S. Brian Spain, Dennis Stueve, Tillie Wasner, S. R. Nithy, Brad Lindgren, Rachel Stapleton. The purpose of the meeting was to evaluate and finalize Community Day. Linda Sniezek reported that everyone she contacted has donated to this event. Ne-Tee stated that the people of st. Joseph are very generous. He requested that the balance of the donation from st. John's Senate is returned to them, because it was donated with the understanding that if all the money is not needed the balance will be returned. It was agreed to send Thank You cards to all who donated, or . participated in the success of Community Day and to put a thank you in the Newsleader. The group discussed the need to find ways to get the st. John's and st. Ben's students to attend. The goal of the event is to promote community and interdependence in the community. Brad Lindgren asked to consider starting the event next year at 5:30 p.m. on Saturday evening in order to get more student participation. There was discussion of current problems from house parties. The City Attorney is looking into ways to prosecute the individual's who are responsible. Brad Lindgren stated that the students could be charged civilly on the noise complaints. Brad also stated that the police do not take action on parties until someone calls in a complaint. There is a problem with 1 itter this year also. Brad stated that the students are much more blatant than in past years. Ne-Tee stated that students could work with the police as volunteers to help control these problems. Enforcement is not strong enough and students could help contro 1 . S. Brian asked if there is any way the college administration could help. Mayor Reber stated that the main reason the CORE was formed was because of the irresponsibility of a few students. It would be good to see other students working to help make - them all responsible. - Ne-Tee will put Chief Lindgren on the next agenda for st. John . s Senate meeting, and Mary Popp will put him on the agenda for the next SAB meeting. t ~~ . . . . . s. Brian suggested more sma 11 er events may be what the students need.
