Item ~ b); Ed Tschida Phase II Grant Application
Ed Tschida has offered to assist completing the phase II
Grant Application and has reminded us that the
application is due very soon.

A list of applicants 1.S included in your packet for
review.
Item ~ d); Policy regarding requests for street sanding
Recently CSB has called in a request for streets to be
sanded. Questions regarding who has the authority to
I make these requests or report poor conditions.
Item ~ e): Water Shut off - 111 College Ave North
The home on this property is currently being demolished
and a request has been made to disconnect water service
to the property. The Superintendent of Public Works is
requesting to make the necessary repairs at the City's
expense.
Item ~ i): Policy Book
The Policy Book has been indexed and reorganized.
Copies will be distributed to the Maintenance and Police
Departments soon.
Item ~ ~ Hook-up Fees - DBL Labs
Request for review of fees charged to DBL Labs.

Item 12.. b): 111 College Ave N - Mark Lambert
See letter in packet. Mr. Lambert is referring to the
allowances made for property zoned R-3¡ although his
property lies in a General Business Zone. Mr. Scherer
has been given a copy of this letter for his opinion.
Item 16: City Attorney Reports
Copies of a letter RE: Sal's Bar have been included in
your packet. Information has been forwarded to Mr.
Scherer RE: wage and benefit proposals as revised by
Council at the December 9th meeting.
Additional Notes:
I After Mr. Scherer reviews the 1994 Wage Proposal the
Council will need to authorize the City Clerk and Mayor
to execute the Police Federation contract.

Pursuant to due call and notice thereof, the City Council for the City
of st. Joseph met in regular session on Thursday, December 2,· 1993 at
7:00 p.m. in the st. Joseph City Hall.

Bills Payable: Deputy Clerk Judy Weyrens presented the Bills payable,
purchase order requests, and overtime. Councilor Hazen requested that
the Police Chief respond as to why it was necessary to have three (3)
officers on patrol on Thanksgiving Day. Loso requested clarification
as to why the Police Chief was called out on a juvenile case, (why
couldn't the officer on duty handle the situation). Hiemenz made a
motion to approve the bills payable, check numbers 19004-19068,
purchase orders 1008, 1009, 1083, 1084 and the overtime. The motion
was seconded by Rieke.

Mayor Reports
. Street Li~hts: Mayor Reber stated that he was in error and the street
lights are already installed along 91st Avenue.
Snow P1owin~: Public Works Director discussed a potential safety
problem behind Sal's. The property owner has pushed all the snow to

one hill, causing a blind spot in the alley. The City Offices are
directed to send a letter to the property owner requesting the snow to
be removed and plowed to a different location in the future.
Hookup Fees: Mayor Reber stated that the Hookup fee formula needs to be
adopted by the Council. The Council was in general agreement that the
formula has already been adopted. The matter wi 11 be discussed further
during the Engineer reports.
Dennis stueve: stueve's Garage has presented a plan as to the storage
of snowbirds. Mr. stueve plans to park the cars along the west edge of
the parking lot. Councilors expressed concern as to whether this area
would be used for the storage of wrecked cars. If the parking of
wrecked cars becomes a problem, the Council wi 11 reconsider the matter.
House Numbering System: Mayor Reber indicated that he has received a
ca 11 from a resident who is building in Pond View Ridge. He feels that
the street number assigned to his property is in error. Loso made a
motion to adopt the street numbering proposal as presented by Officer
Meyer. Officer Meyer is also appointed as the official responsible for
numbering property in the City of st. Joseph with the assistance of the
Fire Chief and stearns County Emergency Services. The street numbering
proposal should be implemented as soon as possible. The motion was

House Numbering Ordinance No. 31: Hazen made a motion authorizing the
City Attorney to draft an amendment to the street numbering ordinance
as he advised, seconded by Rieke.

Street Lighting Request: The Counc i 1 has received information for the
placement of street lights along East Minnesota Street and 91st Avenue,
along newly annexed property. A proposal has been received from
Stearns Cooperative & Mayor Reber requested that all Council members
review the proposed plan so that a decision can be made at the next
meeting. Additionally, the City Offices should send a letter to
Stearns Cooperative requesting additional information and exact costs.
This matter wi 11 be placed under Old Business.
COUNCILOR REPORTS
Ross Rieke
CORE: The CORE Committee met on November 29, 1993 and discussed another
event for community relations. The event is in the planning stages and
is scheduled for February 5, 1994, possibly at Sexton Hall. Community
4IÞDialogue wi 11 be the focus and the title of the event. It is hoped
that by hosting the event at st. John's a different audience will
attend. The CORE Committee is hoping to reach different audiences
throughout the year.

Stephanie Hazen
Parking Issue: Hazen discussed the "No Parking" signs that have been
placed along the west side of College Avenue North. She requested that
a memo be sent to the Police Department as a reminder to enforce the no
parking in this area. Mayor Reber stated that the intersection has
improved greatly since trucks have been provided with a loading zone.
Bob Loso
Snow Fence Request: Monument Park has been vandalized by snowmobiles.
Loso is recommending the placement of snow fence along the north and
south side of monument park to preserve the trees. Loso made a motion
authorizing the expenditure for the placement of snow fence along the
north and south side of Monument park, and to direct the Maintenance
Department to insta 11 the fence. The motion was seconded by Hiemenz.

Warming House Attendants: Loso requested the Council authorize the
staffing of the warming house effective December 13, 1993. Loso stated
that the ice will not be ready, but the sliding hill is being used.
Rieke made a motion to open the warming houses on December 13, 1993 as
. requested. The motion was seconded by Hazen.

Maintenance Building: Loso questioned the status of the request for
additional maintenance storage. Mayor Reber stated that he informed
the Public Works Director to present the Council with a sketch as to
the requested maintenance storage addition.
Ken Hiemenz
Planning Commission: The Planning Commission met specially on Monday,
November 29, 1993, to discuss the following:
1- Approved the building permit request of Drs. Styles and Cotton
to add on to their existing dental office.
2. City Engineer Joe Bettendorf appeared before the Council
to discuss the realignment of County Road 133.
Street Lighting: Councilor Hiemenz stated that he has received many
compliments on the street lighting on Minnesota Street.
CLERK/ADMINISTRATOR REPORTS
Vacant Lot Como1aints: Sue Karnik, 1011 Able Street East, has
complained about the vacant lot adjacent to her property. The property
has been collecting rubbish and is a habitat for rodents. The City
. Offices are requested to send a letter of compliance to the property
owners. The Council also discussed the policy on complaints of this
nature. They were in agreement that the Council only needs to react on
matters of this nature when compliance has not been met.

Gas Proposals: The Council will need to address the fuel suppliers for
1994, as one of the suppliers has ceased operation. Currently they are
operating under a three year contract, with each supplier under
contract for four (4) months. This matter will be discussed at the
December 16, 19993 City Council meeting.
street Lightin~ Proposal: Discussed during Mayor Reports.
Fire Report: The Council accepted the Fire Call report from June 1 ,
1993 to December 1 , 1993. During that time, the Fire Department has
responded to 72 calls, 56 medical and 16 Fire. Loso questioned whether
the Fire Department submits a bill to those being assisted. Counc i lor
Rieke agreed with Councilor Loso, and requested that the city Offices
research this matter. Mayor Reber felt that the cost should include
not only the fire wages, but also depreciation and liability insurance.
The Council also addressed the possibility of discussing the billing
matters with Murphy Ambulance. After a lengthy discussion, the Council
agreed to place this matter under old business more information until
can be obtained. The Fire Department should also be contacted for
their input. In the research gathering phase, surrounding Cities
should be contacted for their policy. Loso made a motion directing the
City Offices to send a letter to the League of MN Cities, requesting
any information they have with regards to charging for fire/rescue
. services. The motion was seconded by Rieke.

Financial Transfers: The City needs to transfer money to the Debt
Service fund for the 1993 Bond Issue, as required. The recommendation
is as follows:
20,000 from Water
50,000 from Sewer
30,000 from Debt Service
Additionally, the Bond Issue for the Water Storage Facility required
the City transfer money from the water fund to the Water Storage Debt
Service Fund. The recommendation is as follows:
10,500 from Water
Hiemenz made a motion approving the transfers as recommended; seconded
by Loso.

Assessor Reouest: Ollie Lesnick has requested an increase in salary of
$ 295.25 annually, based on additional property being annexed. The
Counc i 1 stated that the Assessor is paid per property, and felt his
request was reasonable. Hazen made a motion to approve the request as
. presented; seconded by Rieke.

Board of Innovations Grant: Stapleton stated that the City received a
response from the Board of Innovations for the grant submitted with the

Township. The application faired in the top and they suggested that
the City and Township make application for the second phase grant. The
information has been forwarded to the Township.

BUILDING OFFICIAL REPORTS
Stapleton stated that Mr. Euteneuer has been expressing concern as to
his position with the City and if he will be retained for services in
1994. Hazen made a motion to advertise in the official paper that the
City of st. Joseph is accepting proposals for Building Official for
1994. Proposals must be received by the City Offices no later than
December 14, 1993. The motion was seconded by Loso.
. Discussion: The Council has already received a proposal from Dale
Haug. The City Offices should request a proposal from
OMNI Building Inspection.

Dale Haug Reports - Fence Complaint
Fence Testin!=!: Mr. Haug stated that he has been contacted by the
Clerk/Administrator, Rachel Stapleton to research the testing procedure
of wood material. He has contacted Twin City Testing, and they will be
getting back to him on Monday, December 6, 1993. Mr. Haug stated that
he also contacted Braun Intertec who can do chemical testing for both
pinta and creosote. A sample of the wood would have to be cut and
tested. The fee for this service is $450.00. The only way to
determine if the material contains chemicals is to conduct testing, it
cannot be done visually. The older the wood, the less chemical
presence on the outside.
Mr. Haug stated that he hasn't had a chance to review the Ordinance,
but the City must be consistent in materials that are allowed in
building. Pole barns can embody materials which contain creosote, is
that a 11 owed in the City? Retaining walls also can contain such
material.
.Fence Location: Distance is always a question during construction. The
property pins are only accurate the moment the surveyor places them.
When a property owner shows the building official the property lines,
he must accept them as accurate. If there is a question by neighbors
it will then become a civil matter and they must take their own action.

Fence Heiqht: Loso questioned how the fence height is determined when
the terrain is not even, and if it is permissible to raise the terrain
to add height to the fence. Mr. Haug stated that this is a gray area.
The current fence ordinance allows a maximum fence height of 7', is
7'4" out of line? If a property owner purchases 4' material and after
the fence is constructed parts of the fence exceed 4', is it in
violation? Councilor Loso questioned whether a property owner can birm
the terrain to meet the requirement. Mr. Haug stated that too is a
gray area and generally is not permissible.
Mr. Haug stated that it is important for the Council to review the
fence Ordinance to see if changes are needed. The Ordinance should
allow for a variance procedure. Councilor Hiemenz felt that the
Ordinance didn't need to be changed and the provisions are in place.
Mayor Reber stated that this is an issue that will not be resolved at
this meeting, and should be placed under old business for the next
meeting. Also, Mr. Haug should present two written quotes for testing
of the wood material.
CITY ENGINEER REPORTS
~ater Tower Illumination: City Engineer, Joe Bettendorf, discussed the
udget for the water tower project. The total budget for the storage
facility is 1,253,000. As of today, with the contracts paid, $
1,241,000 has been expended, with a balance of $ 11,982. The cost of
illuminating the water storage facility is approx. $10,000.00. Due to
the amount of vandalism that occurs on ground level beams, the
recommendation is to place the lights on poles. The beams are very
carefully planned and the equipment is very sophisticated. Councilor
Hazen questioned the time frame for completion. Mr. Bettendorf stated
that the lighting could be installed as soon as the frost is out in
spring. Loso made a motion to accept the proposal to install the
lighting for the water storage facility as presented. The expenditure
will be taken out of the water storage facility. The motion was
seconded by Hiemenz. Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.

DBL Labs Assessment Role: As discussed at the assessment hearing, GM
Drilling questioned the amount of their assessment in relation to the
distance of the service line that would be required. Because of the
shape of the lot, the service line was placed at the East corner and
when the property connects to the sewer main, the service line will
need to be approximately 400 to 500 feet. This is significantly longer
than any other property. Due to the unique shape of the lot, and the
distance of the service line that would be required, Rieke made a
motion to reduce the assessment of GM Drilling, Parcel Number 84-53734-
011 from $ 4,566.00 to $ 2,326.50. The motion was seconded by Hazen.

old Hiqhway 52: Mr. Bettendorf presented the Council with the
feasibility report for the reconstruction of Old Highway 52. The

project would also include a watermain modification and put a larger
overflow on Birch street. Total cost of the project is estimated at
$ 95,000, with only $10,000 assessable. This would be a 429 project.
However, since the total assessments attribute to less than 20 percent
of the total cost, this project could not be bonded for. Council Rieke
questioned whether this would be a good time to discuss a buffer along
the Western edge of Old Highway 52.
Mayor Reber requested that all Councilors review the proposal and be
ready to discuss the feasibility of the project on February 3, 1994.
At this meeting a decision will be made as to whether or not the
project wi 11 be constructed.
DBL Hookup Charge: Mayor Reber requested that Mr. Bettendorf review
with the Council the status of the hookup fee for DBL Labs. Mr.
Bettendorf stated that when DBL approached the City for services, they
indicated that their daily flow would be 9,000 gallons per day. Their
hookup fee was based on this number. After reviewing the current
pumping records and discussing the matter with a representative of DBL
Labs, it was determined that the actual flow per day is 16,000 gallons.
The Council must determine how to proceed with the fee. Mr. Bettendorf
stated that DBL did already contribute a significant portion to the
project, 75%, and whether or not it would be appropriate to increase
.their fee.
Councilor Loso stated that he felt that DBL Labs should be charged on
the 16,000 gallons. Representatives from DBL Labs appeared before the
Counc i 1 this summer and stated that they would be changing to a dry
operation, using less flow. At that time they were told that the flow
would be reviewed and be billed accordingly. Councilor Hazen agreed
that their fee should be adjusted, but would not be opposed to
averaging the usage. Rieke agreed that the fee should be reviewed.
Mayor Reber disagreed and felt that the agreement with DBL Labs stated
they would pay a hookup fee based on the projected usage of 9,000
gallons and that is what we should bill them. Additionally, he felt
that DBL has paid a large enough portion already. Loso made a motion
authorizing Mr. Bettendorf to write up the hookup fees for DBL Labs.
The motion died for a lack of a second.
Councilors Hazen and Rieke requested the one year history be reviewed
and calculate the average. After a lengthy discussion, the Council
instructed the City Offices and the City Engineer to review all the
correspondence ~nd present it at the next Council meeting.
Linnemann's Inn: Hazen made a motion instructing the City Offices to
send a bill to the Linnemann Inn for the hookup fees as established.
The motion was seconded by Hiemenz.

Ordinance Amendment ~ ~ and Procedure of Council: The Council
questioned the status of the amendment. It was determined that
additional information was being requested from the City Attorney.
Hiemenz stated that the Council should write it as they would like to
see the Ordinance. Loso made a motion to table indefinitely the
Ordinance Amendment on the Organization and Procedure of the Council.
The motion was seconded by Reber.

Hiemenz made a motion that the Council should bring their ideas to the
December 16, 1993 City Council meeting and be prepared to make a
decision. The motion was seconded by Hazen.

City Attorney John Scherer offered the services of his firm to conduct
a short seminar on harassment in the work place. This seminar would be
free of charge to the City and he recommended that all department
heads, Council Members and employees attend. Hiemenz made a motion to
4IÞaccept the offer of Donohue and Rajkowski to conduct a harassment
seminar to be attended by all employees and Council Members. The
motion was seconded by Hazen.

Plumbin~ ~ Heatin~ Inspector: Tabled
Job Descriptions: Mayor Reber stated that he has some problems with
some of the job descriptions. Rieke stated that this discussion could
take time and it should be tabled to another meeting. Loso made a
motion to establish a special meeting date before December 16, 1993,
and to have available the job descriptions and corresponding data. The
motion was seconded by Hazen.

The Counc i 1 established the meeting for December 9, 1993 at 7:00 p.m.
Reali~nment of County Rd 133: Mayor Reber stated that he will be
meeting with Vic West Steel on December 9, 1993. The meeting will also
include the City Engineer, Joe Bettendorf, and Bill Fahrney from the
st. Cloud Economic Development Authority. The purpose of the meeting
is to discuss the possible realignment of County Rd 133.
Fence Construction Complaint: Discussed during Dale Haug's report.
4IÞROW Property Acquisition Request: US West has indicated that they may
have conduit in the Right-Of-Way. The City has requested a location be
made.

Sign Obstruction: 3rd Ave SE & Ash: Waiting for report from the Public
Works Director.
Linnemann Inn: Councilor Loso requested that this matter be tabled
until the February 3, 1993. Hazen made a motion to accept the
recommendation of the City Attorney, and request the property owners of
the Linnemann Inn to appear before the Planning Commission. The
property owners should bring to the meeting the plans for the parking
lot. The motion was seconded by Loso.

Policy Book: The City staff is indexing the book.
Molohon Suggestions: Tabled until December 9, 1993.
ADA Prioritization Plan: A special meeting will be scheduled in January
1994.
Building Inspector Proposal: This matter was discussed under Building
Official reports.
RR Crossing ~ 1st Avenue NE: Residents on the north side of town have
been requesting the railroad crossing be opened up on 1st Avenue NE.
.BY opening up the railroad crossing, another ingress/egress would be
provided for Northland Addition. City Engineer Bettendorf stated that
the intersection had been closed because it was a blind intersection.
The Council agreed to authorize the City Engineer to check into the
possibility of obtaining another crossing. However, the Council did
not want this intersection as a priority intersection. It would be
more beneficial to the City if a crossing could be obtained for the
realignment of County Rd 133.
Street Qy Railroad: The question arose as to whether or not the street

Wage Negotiation Interim Report: Council Hiemenz presented a proposal
for wage and benefit compensation for 1994. The Truth in Taxation
hearing requires that the proposed wages and benefits be discussed.
Hiemenz made a motion to accept the report for the purpose of the Truth
in Taxation hearing. Any wage or benefit increase for 1994 will not
exceed the proposal presented. The motion was seconded by Rieke.

Pursuant to due call and notice thereof, the city Council for the City
of st. Joseph met in special session on Thursday, December 9, 1993 at
7:00 p.m. in the st. Joseph City Hall.
Members Present: Mayor Donald "Bud" Reber. Members of the Council Ross
Rieke, Bob Loso, Stephanie Hazen, Ken Hiemenz. Deputy Clerk Judy
Weyrens.
Others Present: Brian Klinefelter, Ray Bechtold, Brad Meyer, Jean
Gustin, Mary Generous, Jim Marthaler, Jeff Young, Dick Taufen.
The purpose of the meeting is to consider matters relating to wages and
benefits.
Council Hiemenz presented the wage proposal as drafted by the personnel
committee. Part of the proposal identifies and defines exempt and non-
exempt employees. The personnel committee is requesting the following
positions be classified as exempt: Clerk/Administrator, Public Works
Director, Police Chief and Deputy Clerk/Accountant. As exempt
positions, employees would not be eligible for overtime pay and
compensatory time would be paid at straight time.
Mayor Reber questioned the callout policy and would like to see the
.minimum time change from the current two (2) hours to one (1) hour.
After one hour, the employee would be paid for actual time worked at
the rate of time and one half.
Jim Marthaler and Ray Bechtold explained that it is not very often that
they are called out, but is an inconvenience when they are. When new
facilities are added, such as the water storage facility and a new 1 i ft
station, ca 11 outs are greater. Bugs must be worked out of new systems
and they cannot be avoided. Also, when called out, it is usually in
the early hours of the morning and an inconvenience.
Hazen made a motion to establish the callout po 1 icy as follows:
An employee called back to work sha 11 be compensated for a minimum
of one hour at time and one half. The motion was seconded by Loso.

compensatory time, it is important to place some restriction as to the
length of time accrual will be allowed. Discussion fluctuated between

from the pay period in which it is earned.

regularly scheduled meetings. Hazen and Hiemenz stated that work
schedules should be made to include established meetings. The exempt

The Counc i 1 changed the discussion to policy regarding non exempt
employees. The positions not listed as exempt sha 11 be defined as non
exempt. Hiemenz stated that FLSA (Fair Labor Standards Act) allows
accumulation of compensatory time to a maximum of 240 hours, with
police and fire accumulating 480 hours. Loso stated that he feels the
40 hour maximum currently in place is sufficient. Mayor Reber
questioned the legality of some of the issues. Hazen made a motion to
adopt the following definition of a non exempt employee:
a. All positions not classified as exempt sha 11 be defined as non
exempt.
b. Non exempt employees sha 11 continue to be paid at a hourly
rate.
c. Non exempt employees sha 11 receive compensation in the
form of "compensatory time off" for over time hours s/he
. actually works in excess of 40 hours in a seven day workweek
at the rate of one and one-half times the regular rate of pay.
d. A 11 non exempt employees can accrue a maximum of 100 hours
of compensatory time (67 hours of actual work) except for
those employees working in a public safety activity [Law
enforcement], an emergency response activity [Law enforcement,
fire or rescue personnel], or a seasonal activity may accrue
not more than 200 hours of compensatory time (133.50 hours of
actual wor k) .

The Council requested clarification from the City Attorney, John
Scherer on the legality and his opinion of the following definition:
e. For those employees engaged in law enforcement activities who

compensation is required under section 7(k) until the number
of hours worked exceeds 43.
Hazen made a motion to further define the non exempt employee as:
f . Non exempt employees can use compensatory time in one (1) hour
. increments, with prior approval.
g. Non exempt employees MUST use the compensatory time within

h. An employee who has accrued compensatory time and requests

The Council discussed the proposed cost of living increase of two (2)
percent. Councilor Loso stated that the budget has already been set
and the City cannot increase the levy. Rieke stated that while the
budget has been set, he would like to see the employees receive a
raise. Mayor Reber concurred. He also stated that he would like to
.see the two (2) percent increase determined on the total payroll pool
and divided equally among all the employees. Loso concurred.
Officer Young stated that he would like to see the wages increase added
to the individual steps. The city spent time and resources
establishing a pay scale, which was approved by pay equity, and it
should be kept in line. If the increase were pooled the gap would
decrease between the classifications of positions.
Mary Generous stated that is was her understanding that the wages would
be pooled every other year. By rotating the increases the step system
would remain in tact.
Councilors Hiemenz and Hazen requested that the step system be changed
to a merit system and lengthened to a period up to twenty two (22)
years. Hazen stated that currently the steps are automatic and she
feels that merit should be attached. Councilors Rieke and Reber felt
that the steps should be yearly. If an employee has not performed to
receive a step, then the Council/Department Head needs to review the
performance.
Mayor Reber stated that he feels that the Council is not in a position
to evaluate the employees. The Council is not aware of most of the
daily functions, and does not have the resources to evaluate them.
.Hiemenz made a motion to increase the wages for 1994 2% based on their
current salary, and employees eligible for a step increase will be
advance one step. The motion was seconded by Hazen.

request, with the exception of the individual's birthday, which is a
holiday. Hazen made a motion to pay the police department time and one
half for all holidays worked. For the purpose of definition of
ho1 idays, they are as 1 i sted in the 1993 wage and labor agreement
between the City of st. Joseph and the st. Joseph Police Officers
Federation, article 9. The motion was seconded by Rieke.

Sick Leave Pav: The Police Federation has requested change the accrual

Dental Insurance: Employees expressed concern should the policy be
increased at employee's expense. Police Federation requested any
increase in dental insurance coverage to be paid by the City. Hazen

Health Insurance Cap: Hiemenz requested the Council reconsider the
health insurance cap. The current cap is cumbersome to calculate and
uses more time then savings. Currently the employees contribute 15% of
the premium based on the 1992 rates, and the entire increase of 1993.
Hiemenz made a motion to change the insurance cap to where the City
will contribute 81% of the premium and the employee will contribute 19%
of the premium.
Loso made a motion to amend the motion to make the effective date of
the change in insurance cap to July 15, 1994; seconded by Hazen.

Awards: Councilor Hiemenz presented a request for an incentive awards
.program, recognizing employees for outstanding work. Mayor Reber
favored the program and discussed a recent example. A resident had
contacted him about the snow plowing and the amount of snow in front of
her property. Mayor Reber informed the Maintenance Department who
removed some of the snow. After the snow was removed, the resident
contacted Mayor Reber to commend the maintenance department. Hazen
made a motion to implement an incentive awards program; seconded by
Rieke.

Hazen requested that a copy of the new policies be distributed to all
the employees. Rieke made a motion directing the City Attorney to

were drafted for the pay equity study. Hazen stated that the job
descriptions were written for the position, not the person currently

employees were requested to complete a survey which indicated what they

were currently doing. The descriptions were a combination of the
survey response and future needs of the position.
Dick Taufen questioned the education requirement in the Public Works
Director's Position. The requirements as listed would not allow for a
employee who is currently working for the City to advance unless they
went back to school. While education is important, it is also
important to have some experience. Taufen requested the Council
consider allowing experience to be substituted for education. Also,
Taufen stated that for the position a class c water operators 1 i cense
is required by the state of Minnesota. Additionally, for the position
of Wastewater Operator a class c wastewater license is required.
Hiemenz made a motion to adopt the job descriptions as drafted with the
following corrections:

DISC Social Style Instrument. Each of the two sessions would cost
$400.00. Mo10hon also suggested that the City budget annua 11 y $150 per

budget of $1,800, with $ 800 being used during the first quarter of

Dear Sir,
I would like to take this opportunity to present myself
to you as a candidate for building official for the City of
St. Joseph. I have enclosed a resume for a quick overview
of my background. In addition to the work experience noted,
I currently handle the inspection service for St. Joseph
Township.
When a municipality establishes a permit fee structure,
it is important that the fees cover the costs of the
I service. Fees are intended to also cover a share of
administration and overhead costs. Therefore, the City of
St. Joseph should establish some overhead costs and decide
how much a builder or owner should pay for a permit.
Estimating the costs of a construction project is done by
various means. I will establish the following policy:
1 ) When provided, contract prices will be honored.
2 ) Owners estimated costs will be used (if obvious it
is not possible, adjustments will be made).
3 ) State average construction costs are published
annually. Adjustments for each community are used
for estimating costs of projects.
The fee schedule provided represents options availab12
to the city. The following is my sU';J'gested fees for a
$50,000.00 permit.

I Subd. 8: The provisions of this Subsection shall be in addition to any requirements
established by applicable federal, state or local laws and regulations, and shall not be construed
to relieve any liability or obligation imposed by such laws and regulations.
Subd. 9: Any person operating a private sewage disposal system who wishes to discharge
waste products to the St. Joseph Wastewater Disposal System resulting from the treatment of
domestic wastewater only shall obtain permission from the Superintendent of Public Works prior
to the discharge occurring.
Section 42.4: BUILDING SEWERS AND CONNECTIONS.
Subd. 1: No person unless authorized shall uncover, make any connections with or
disturb any public sewer or appurtenance thereof, unless and until a Sewer Connection Permit
and an Excavation Permit are obtained from the City Clerk. Fees for each of these permits
shall be established by the City Council, and the Excavation Permit shall be subject to the
provisions of Ordinance No. 5ì.
Subd. 2: Any person connecting to the sewer system shall pay a sewer hook-up charge
(connection charge) as authorized by Minn. Stat. § 444.075, Subd. 5. Tne sewer hook-up charge
shail be based on an equitable formula incluàing the replacement cost of the then existing
Wastewater Disposal Facilities and the amount of past indiviàual assessments levied to finance
construction of the facilities. The sewer hook-up charge may be aàjusted from time to time by
resolution of the City Council. and separate charges may be established for various types of
users as deemed appropriate by the City. Sewer hook-up charges shall be paid to the City Clerk
in full prior to connection to the system.
Subd. 3: All costs and expense incident to the installation, maintenance, repair,
replacement, and connection of the building sewer to the sanitary sewer main shall be borne by
the owner. Tne owner shail indemnify and holà harmless the City from any loss or damage to
the public sewer that may directly or indirectly be occasioned by the installation of the building
sewer.
Subd. 4: A separate and independent building sewer shall be provided for every
building, except where one building stands at the rear of another on an interior lot and no
private sewer is available or can be constructed to the rear building through an adjoining alley,
courtyard, or driveway. Tne building sewer from the front building may be extended to the rear
building and the whole considered as one building sewer, provided that the City shall require a
written agreement between the property owners as to the share or the costs of construction and
maintenance which each will contribute.
Subd. 5: Old building sewers may be used in connections with new buildings only when
they are found, on examination and test by the City, to meet ail requirements of this ordinance.
Subd. 6: The size, slope, alignment, materials of construction of a building sewer, and
the method to be used in excavating, placing of the pipe, jointing, testing, and backfilling the
trench, shall all conform to the requirements of the building and plumbing code and to
- applicable City specifications. In the absence of code or City provisions or in application
thereof, the materials and procedures set forth in appropriate specifications of Water Pollution

Dear Council Members:
As many of you may have already noticed, I have contracted for
the demolition ot·the house .'located·' at 111 College Avenue
(formally, the "Gamades Property"). I presently do not have any
immediate plans for the property but thought it best to remove the
two structures on the land to eliminate the unsightly appearance
they created.
It is my hope that I will be able to find a commercial user
for the land. I have talked with a couple of fast-food restaurants
- both of which indicated an interest in the property but would not
immediately commit to the site. Should I ultimately fail to find
, a commercial user for the property, however, I may request a
special use permit to construct apartments on the site. It is
clearly not my first choice, but I do not know of any other options
if a commercial user is not found.
To this end, I am requesting that the city Council allow me
to "bank" the demolition credits I will receive for taking down the
two structures. Section 52.18, Subdivision 6(e) of the st. Joseph
Ordinance, provides an allowance of two dwelling units per
structure when an existing dilapidated structure is razed in
redeveloping the property. In the event I do redevelop this site
as a residential mUlti-family residence, I would like to be able
to use these allowances to off-set the demolition costs I am now
, ,
~~currlng.
If I were not so committed to a commercial use of the
property, I would simply submit a proposal for apartments on this
site, have the site plan approved, and thereby eliminate the need
to bank these credits. However, before I follow this course of
action, I would like to fully explore the commercial possibilities
of the property while at the same time preserve all of my options
in redeveloping the property. Please help me in this task by
approving my request to bank the allowances for the two structures
until I have found another use for the site.

A. A hearing is held by t.he County in spring to discuss property
valuation which determines the tax assigned a property. Your
I propert.y tax reflects not only t.;ity taxes; but also those
assigned by the County and School District. Further,
valuaticm is determined by the City Assessor, Ollie Lesnick,

increase. After review of the resident's tax statement it was
decided that a nineteen (1~%) percent increase in City taxes
based on an increase in valuation in the amount of $3,000
seemed excessive and perhaps an error had been made.
Ha;¿en asked for clarification of the levy and what it represents.
Weyrens explained that levy reflects the number of dollars requested
from the State to support the budge t. The amount levied to the State
for the City of St. J'oseph is $1::)7, :.342. The levy includes the amount
necessary to support the l'J'J2 bond issue. At this point the budget may
not ble.: increased, but the levy may be decreased.
Q. Al J::ich: How do the City taxes compare to Albany? 'rhe
population is about the same.
A. Mayor Heber responded that we have not done a comparison with
other cities except in regard to wages. Weyrens referred to a
bulletin prepared by the State of Minnesota entitled
Understanding Your Property Tax which illustrates property tax
uf cities in Minnesota. Some cities of comparable population
were Melr'ose and Granite Falls.
I W. Al l::ich: Why can't we get more money from the college'?
A. As mandated by t.he state the property held by t.he convent and
college is tax exempt. The presence of the college and
c:onven'L in the community provides benefits to include: payment
for water and sewer services, patronizing local businesses,
and payment of assessments for improvement projects.
IJ. Al l::ich: But when they buy proper·ty it is taken off the tax

A. Yes, but the City has no control over property being removed
from 'Lhe tax roll when purchased by the convent aT' college.

Dear Raohel,
Reoently, I have had the opportunity to review the Board of Government Innovation and Cooperation's
comments regarding the city and town's Part One AppJication. On Monday, December 13th, I contacted
Pati Maier at the Board to discuss the application. The biggest area that the application could have
gained points was in question no. 3. The application received 4 out of a potential 10 points. The
reviewers apparently did not believe the proposed oooperation effort would be of significant benefrt to
other local units of government. The Part Two application provides a second opportunity to address this
, concern if the decÎsion is made to submit a Part Two application.
The question the city and town must ask itself at this time is - should a Part Two Application be submitted?
First, let me review the numbers to give you a sense of the competition. Of the 57 applications submitted
for Cooperation Planning Grants, 25 received a score of 32.9 or above and were requested to submit a
Part Two Application. 18 received a score of 26 and above and were encouraged to submit a Part Two
Application. In speaking with Patj Maier she believes approximately 40 Part Two applications will be
submitted. The Board is committed to spending $375,000 on eligible oooperation planning grants. Based
on the number of applications and the amount of money available 10 - 15 applications should be funded.
This means that the city/town would have 25 to 33% chance of receiving funds.
The second point to be considered is the scoring for the Part Two app1ications. The score received by
an applicant on a Part One application is not a consideration in the review of a Part Two application. All
eligible applications are considered. On December 21 st, the Soard of Government Innovation and
Cooperation will meet to set its criteria for review of a Part Two application. Upon request these review
criteria will be released to any applicant. The open application process plus knowing the revÎew criteria
În advance means that the city/town has an equal chance to receive final round funding.
Another important factor to be considered is the city and town's desire to go forward with some form of
a cooperative planning program regardless if the State provides the funding. If this is the situation the Part
Two application becomes a detailed work: program for a cooperation planning program. If the citý and
town are interested in such a program. understanding the work which would be involved is extremely
benefioial regardless of the funding source. Essentially this is work whioh must be done in any event if
the city and town are going to proceed with a cooperative planning program.

A final point to consider is the political support the application can receive from area representatives. I

Dear Ms. Stapleton:
I have calculated the charges associated with providing street
lighting for Minnesota St. and for 91st Ave.
As we had previously discussed, there is basically two options
available to you for Minnesota St. They are: a) wood poles with
cobrahead luminaires¡ and b) fiberglass poles with cobrahead
luminaires. I have provided costs for both of these options. Each
of these options includes eight (8 ) ft. aluminum mast arms with 150
watt High Pressure Sodium lamps.
, Using wood poles would match the surrounding landscape of wood
poles, however I suspect in the future we will see the fiberglass
poles used more universally. We are to install underground wire to
serve all lights. This will mean plowing of the wires in the road
right-of-way and the tunneling of four driveways along the south
side of the road.
At this point the required easements to serve these lights have
been verbally agreed to by the property owners. I will also talk
with Joe Bettendorf concerning future projects and the proper
placement of these lights.
Also included are the costs to convert the four (4 ) existing
luminaires on 91st Ave. We will plan on installing eight (8 ) ft.
mast arms with 150 watt High Pressure Sodium lamps at the same
locations as the existing security lights. These costs reflect a
full credit for the existing fixtures. This part of the project can
be completed this winter if you desire.
The charges associated with this project can either be paid up
front by the city or we can pay for the construction and then bill
you a monthly facilities charge. This facilities charge is based
on a percentage of the construction costs and is a continuous
charge that is payable indefinitely along with the monthly usage

Enclosed please find a proposal to administer the building code in
your city for 1994. This proposal is structured with an alternate
to administer the plumbing and mechanical codes. The appropriate
fee schedule and application forms are included in each.
I Omni Building Inspection is located in suite 230 of the Marketplace
Office Complex in downtown Waite Park. Services include a full
time office support staff: office manager, inspector, assessor,
plumbing/mechanical inspector and plan review personnel. We have
two incoming phone lines (with voice mail) including fax service
and cellular phones for field communication.
Having served as your building official, I would be able to provide
continuity on existing projects under construction. Monthly
reports and statements will be submitted to the City Clerk's office
prior to the first monthly meeting. Any individual building permit
fee that exceeds $300.00 will be submitted in thirds. I will also
be available to appear at a monthly council meeting to discuss
building permit activity.
