Joseph met in special session on Tuesday, August 9, 2005 at 5:30 PM in the SI. Joseph City Hall.: 1 i Members Present: Mayor Richard Carlbom. Councilors AI Rassier, Ross Rieke, Dale Wick, Renee I Symanietz. Administrator Judy Weyrens. ! Others Present: Public Works Director Dick Taufen, Police Chief Pete Jansky, City Engineers Joe Bettendorf and Tracy Ekoia. Northland Heiahts Development Aoreement: Weyrens presented the Council with the final draft of the Development Agreement for Northland Heights. The Council tabied this matter on August 4, 2005 so! that ail the requirements can be detailed and reviewed by the Council. The Agreement presented I includes the Park Dedication Fee, Storm Water Fee and a provision allowing deferral of the watermai17 along Jasmine Lane between Northland Plat 8 and Northland Heights. While the a portion of the. I watermain is deferred, the Developer is required to pay any financing costs associated with the delayed assessment. Lumber One representative Chad Carlson questioned the Parkland Dedication Fee included in the Agreement and if the figure represents only Phase One. Weyrens responded that the figure is for the' entire development. The agreement will be amended reducing the Park Dedication Fee to phase oné only. I Rassier made a motion authorizing the Mayor and Administrator to execute the Development 1 Agreement between the City of 81. Joseph and Lumber One for the construction of Improvements for a plat entitled Northland Heights. The motion was seconded by Rieke and passed unanimously, Board of Review: Weyrens reported that Stearns County has offered to assume the duties of the Bo~rd of Review and Equalization for all Municipalities and Townships. The County is requiring a three year commitment if the responsibilities are assumed. Weyrens stated that the County Board of Review I consists of professionals with a background in real estate. Rieke made a motion to surrender the I· power of the Board of Review and Equalization to Stearns County for a three-year trail period. The motion was seconded by Wick and passed unanimously, . , Northland Heiahts. Neaotiated Bond Sale: Weyrens presented the Council with a Financial Advisory Agreement by and between the City of St. Joseph and Northland Securities Inc for bond services for the Northland Heights Bond Sale. The bond sale has been scheduled for September 1, 2005. Rassier I made a motion authorizing the Mayor and Administrator to execute the Financial Advisory ¡ Agreement by and between the City of St. Joseph and Northland Securities as presented. The motion was seconded by Symanietz and passed unanimously. I Weyrens presented the Council with a resolution authorizing the Competitive Negotiated Sale of$ I 2,775,000 General Obligation Bonds for the Northland Heights Improvement. The City has issued both Public Sale Bonds and Negotiated Sale and has relied on the expertise of Northland Securities to determine which method is best. Typically Public Sale Bonds are used for large projects. Rieke made a motion authorizing the Mayor and Administrator to execute resolution 2005-19a providing for the Competitive Negotiated Sale of $ 2,775,000 General Obligation Improvement Bonds. The motion was seconded by Wick and passed unanimously. I I Budaet 2006: Weyrens stated that the first draft of the 2006 budget will be ready for distribution on I August 17. Part of the budget discussion for 2006 should include facility planning. The current City Hall is nearing capacity and if an additional staff person is added in administration, desk space will become an issue. Weyrens stated that additional staff is needed in administration as she has been overwhelmed the past months. While the City has been adding one staff position each year the hire rotates between Maintenance and Police. Weyrens stated that she has contacted Springsted, a firm specializing in Municipal Services, who could assist the City with the organization structure for today and the future In DRAFT August 9, 2005 Page 2 of 2 addition, the study would include a comparable worth study, a study the Council agreed to complete with both unions. The City of Waite Park is currently using the same firm for re-organization and a comparable worth study and are satisfied with the performance. . Rassier stated that he was part of the negotiating committee for the LELS contract and the City did agree to complete a comparable worth study. Weyrens stated that if the Council accepts the proposal of Springsted a detailed work plan-will be provided. With regard to space needs, Weyrens stated the Council needs to determine where the City will expand. Some of the options for expansion include: 1) adding a second level to the existing City Hall; 2) remodeling the former City Hall located on 1st Avenue NW for a police station; 3) construct a new police station adjacent to the Maintenance Facility on 15'h Avenue NE. Weyrens stated that before facilities can be considered a space needs study must be completed. Rassier questioned if the City has funds available for a study to which Weyrens responded no. Wick concurred that facilities must be planned, but it becomes an economic issue. The Council agreed to discuss this matter again after the preliminary budget is completed. Rassier made a motion to hire Sprin9sted to complete an Organizational review of all City Departments and prepare a Comparable Worth Study. The motion was seconded by Rieke and passed unanimously, Donations: Weyrens reported that the State Auditors Office requires that all donations received by Municipalities must be accepted by the City Council. The Women of Today have donated $ 1,000 for the purchase of a camera for the Police Department. Before the money can be expended the Council must accept the donation. Rassier made a motion to accept the donation of $1,000 from the Women of Today for the purchase of a 35 mm camera for the Police Department. The motion was seconded by Wick and passed unanimously, Adioum: The meeting was adjourned by consensus at 6:50 PM Judy Weyrens Administrator I Attachment: Yes or No REQUEST FOR COUNCIL ACTION Ordinance Amendment - In Lieu of Ordinance DATE: September 15,2005 Administration ORIGINATING DEPAR1MENT DEPARTMENT APPROVAL AGENDA ITEM Ordinance Amendment - Authorize the Mayor and Administrator to execute the Ordinance Amendment for the "In Lieu" of assessment and cause the same to be published. PREVIOUS ACTION During the improvement hearing process the Council discussed how to equitably assess the large . lots located in the improvement area. Typically front footages are assessed; however, the Council agreed. 0 defer the assessment cost on certain improvements until the property is developed. For the City to assure that the assessments can be collected at a later time, an Ordinance needed to be created to establish a fee "in lieu" of. Please notice that the Ordinance is parcel specific. This Ordinance has been reviewed by the Attorney and Engineer and is ready for adoption. RECOMMENDED COUNCIL ACTION Authorize the Mayor and Administrator to execute the Ordinance Amendment as presented. FISCAL IMPACT Assures the ability to collect the fees when and if the property develops. COMMENTSIRECOMMENDATIONS ORDINANCE An Ordinance Relating to Sewer and Water Connection Charges in Lieu of Assessment Section --.01: In-Lieu-of-Charoe Established. The City of St. Joseph has initiated the 2005 Hill Street & 3"' Avenue Improvement Project ("Project") which benefits certain properties located within the City of St. Joseph. In order to arrive at a reasonable, fair and equitable distribution of the costs of the Project among the properties which the Project has improved, the City hereby establishes a system of connection charges known as "In-lieu-of charges" (also referred to as "Connection Charges") to properties which have not been specially assessed for the cost of the Project in proportion to the front footage of the Project which abuts such property, as well as to properties which have been specially assessed on a unit basis but which use on said property may intensify in the future such that a charge equivalent to one or more unit charges is equitable. Section --.02: In-Lieu-of-Charoe for UnderdeveloDed and UndeveloDed ProDerties. The following properties below have not been specially assessed for the costs of the Project in proportion to the front footage or area of the Project which abuts such property. Upon development of said properties described below, each such property shall pay a Connection Charge in the amount specified below prior to connecting any portion of such property to the City's sanitary sewer or municipal water system (collectively, "City Utilities"), or, if such property has been otherwise penmitted to connect to City Utilities, said Connection Charges shall be paid prior to the time any additional connections shall be made to the City Utilities. Connection charges shall be due and payable at the time of Final Plat of any subdivision; or at application for, and prior to issuance of, a building penmit in any instance where the use of the land changes and the parcel is subdivided. Such Connection Charges when due and payable may, in the discretion of the City, be specially assessed against the property to which said Connection Charge applies. a. Subdivisions with Outlots. In the event any portion of any parcel affected by this section is subdivided into one or more outlots that are capable of further I subdivision and are otherwise reasonably suitable for future residential I development, Connection Charges shall not be due on such portions of property until such time as said portions are replatted as non·outlots. In such event, the Connection Charges detailed in Section 2 of this ordinance shall be applied to the non-outlot portion of the property on a proportionate basis at the same ratio of the total square feet of non-outlot property being platted or subdivided to thß total square feet of all property on any such plat or involved in such subdivision. , Section -.04 Annual Adiustment of Connection Charaes. The Connection chargeb shall automatically increase by 3.5% per annum. The cumulative annual increase in the I Connection Charge shall not exceed the cumulative annual percentage change of the overall assessed market value for all residential properties in St. Joseph as determined by the City's Assessor as measured from the date this ordinance becomes effective to the date payment of the Connection Charges for such propêrty comes due. Section --.5 Properties which are further subdivided in the future. A Connection I Charge in the initial amount of $ _$1 0,145.41 shall become due prior to.the connection to City Utilities upon the further subdivision of property as identified in Section 2. Said $ $10,145.41 Connection Charge shall apply to each new lot created upon which a principal use is ' established. The City Council may by resolution from time to time increase or decrease said $ 10,145.41 Connection Charge consistent with the change in any Consumer Price Index compiled by the US Government that the City deems appropriate. i Section --.06 Severabilitv. If the provisions of any section, paragraph, or sentence of this Ordinance shall for any reason be held to be unconstitutional or invalid by an court of 1 competent jurisdiction, the provisions of the remaining sections, paragraphs, and sentences I shall nevertheless continue in full force and effect. Section --.07. Repealer. All ordinances, or portions of ordinances, in conflict herewith are hereby repealed to the extent of such conflict. ' Section --.08 Effective Date. This Ordinance shall be in full force and effect from after its passage and publication. Adopted by the Council this day of ,2005. Viewing the consultant's concept of the collector road path leaves me breathless to say the least. The entire city of St. Joseph needs to take a good look at their priorities and vision for the future. St. Joseph and the monastery have been places with a great and long history of rural, healthy and home- town support forlife. I see that the business establishments, the commercial development on Co. Rd. 75, the need for safe drinking water, for green space would all be negatively affected. And I the noise and pollution that would be the result of such construction would change the chatacter of this great place in central Minnesota. If this proposed Collector Road were to be constructed, it would separate the monastery and college from our sacred woodland, wetland and restored prairie, Safe and free access to the woods and the walking trails that the Sisters, their guests, thousands of students and residents of St. Joseph now enjoy would be cut off. Communing with nature in this way would be silenced. I Such a road, were it to be built, would bring traffic very close to the monastery's Spirituality 1 Center. This isa place where the monastic community offers to our neighbors, our families and friends a place of quiet for solitude and reflective prayer. The Spirituality Center is also a place, where groups and individuals come to discover and to practice responding to the God-hunger in their lives and in our world. The increased noise and pollution of a road so close would make i~ very difficult if not impossible to continue this major ministry of the monastery. , The path of the proposed road is also very close to CSB student housing, the Benedicta Arts 1 Center and CSB sports fields. Having a road so close would endanger the students, the athletesi their families and visitors who attend cultural and athletic events. I strongly urge other alternatives for this road to be considered. We do so many things in the Dame of "progress" to help us get someplace faster. I live in a community much larger than St. Joseph and only this summer has a four-lane road gone through our community. It always was Hwy. 55, but now that Hwy. 55 is four-lane. This road wasn't sent through some residential property or farm property around the city so traffic could get somewhere faster. Yes, we do have traffic as we travel ITom one side of the community to the other. Like St. Joseph, our community is growing very rapidly. I appreciate the filct that our city administrator, mayor, and council members have respected the already established businesses and private property along this corridor of Hwy. 55. I urge the planners ofS1. Joseph to do likewise and allow St. Benedict's Monastery and the College ofS1. Benedict property to remain intact. As a college student I remember the many walks into THE woods. We could appreciate nature, enjoy the fà1l colors, see wildlife, relax a bit and think in a quiet place away ITom the busyness of a college student's life. When I visit S1. Ben's I know what a gift THE woods are. The Sisters and students enjoyed and do enjoy the woods. How can someone take this away ITom them, expecting them to be separated by a busy road ITom THE woods - the woods that are so much a part of St. Benedict's? The Monastery and College have done much to maintain historic buildings, to have wetlands and prairie, to be environmentally conscious. Car and truck traffic moving so closely to St. Benedict's land would be a great disservice to all who through the years have done so much to make the area what it is. Box 668 St. Joseph, MN 56374 Dear Ms. Weyrens, I just read Bill Durrwachter's letter to the Editor in the Friday, September 2, 2005 edition of the Newsleader. His last line stated: "If you agree with this assessment, write or call your Council members and tell them so." I am writing to let you know that I agree with Mr. Durrwachter's assessment. I am not a Luddite or against progress. I believe that the City of St. Joseph needs to grow, change and respond to new needs. However, growth for growths' sake without serious consideration of the implications of growth does not seem wise. The motto of St. Joe is "Tomorrow with Tradition". Have we defmed what the Tradition is? Will "Mega-Mart or Fast Food heaven" enhance or impair this tradition? St. Cloud has enough eating places and mall areas. We do not need to duplicate. I did an informal survey of several college students, asking them how big they would ¡ like the city of St. Joseph to become. The, students unanimously responded: Keep the small-town character and rriendliness of St. Joseph. I believe one of the challenges of St. Joseph is to maintain its unique character. As green spaces, farm lands, woods and wild life are disappearing rapidly through development and commercialization, we in St. Joseph have a tremendous opportunity to provide an alternative to concrete roads and huge buildings. We can provide the beauty of nature, a community that still knows one another arid a haven from the noise, pollution and disengagement that comes rrom being too big. For these reasons I am opposed to the Field Street road, and ask that you use your best thinking powers to fmd another solution to the traffic congestion. This way of being calls for creativity and an awareness of the sense of this place we call St. Joe. It is my hope and prayer that the St. Joseph City Council will provide this kind ofleadership. I was shocked to hear of the proposal to build a corridor that would run through the monastic and college campus. I oppose the construction of this road and wanted to write to you in your role as a city admi:histrator and tell you of my concerns. On a personal level, I am a graduate of the college and oblate of the monastery and visit St. Joe several times a year. I have always enjoyed the rural, small town nature ofSt. Joe and feel that it would be jeopardized by this road. I personally use the monastic woods, spirituality center and grounds when I am there on retreat. It would be a real loss to the solitude of the monastery to place a road in the midst of this space that many of us who don't live there call sacred and retreat to as a means of spiritual renewal. But of more concern to me is the welfare, spiritual and physical, of the sisters who live there on a daily basis. The sisters consider the woods and prairie a sacred space and their means of natural, spiritual refreshment. I would be truly concerned ¡fthey, especially the elderly among them, would have to cross a busy, fast-paced corridor. It would be a violation of their sacred space, no less than if you would put a busy walk-way through their chapel. I encourage you to oppose this corridor that dissects the monastery and college land and look for a way that does not endanger the sacred nature of the monastic campus or the rural nature of St. Joseph. I understand the need for developing a better transportation infrastructure for a growing St Joseph population. I also understand that alternative proposals have not been fully explored by design teams that are hired ITom outside of St Joseph. I would ask that you consider the alternative proposals more carefully. I was recently at a funeral in Richmond where a cousin ITom Wisconsin commented, "The ride was easy and smooth, except when you get to this area!! It is almost impossible to get through St Cloud." I am suggesting that the problem of traffic needs in St Joseph is much larger than St Joseph and the plan needs to consider traffic much farther North or South than the proposed road. The way St Joseph is expanding, the bigger picture demands a collector road much farther out if building continues at this rate. At a deeper level I have been working here for years and every day I look out to our fields and woods as part of my work at our Spirituality Center. It has been part of my work to invite those coming to our monastery for retreats ITom the ITenzy of everyday life to spend time in these areas for quiet and peace. Nature provides spiritual nourishment for retreatants, so they can return to their work and life with more balance. To take this gift of nature, the rural flavor away from St Joseph, would be to take from all of St Joseph something that nothing else can replace. Our Spirituality Center is for those that come for spiritual nourishment to our monastery in St Joseph, MN and this land and space gives them what they are looking for. All this says nothing about my own personal love of our land, the fields and trees. These God-given treasures of nature that we have tried to preserve for posterity should be seen as necessary to St Joseph as a whole in order to preserve its very character as a lovely place to live.
