Commission for the City of St.. .J oseph met in special session
on Monday, September 23, 1991 at 7:00 p.m. in the St. Joseph
City Ha 1 I .
Members Present: Chair Hub Klein. Members of the Commission
Sr. Kathleen Kalinowski, Linda Sniezek, Hub Klein, Kurt
Schne i de r, Dan Nierenga.rten, Donald "Bud" Reber. Deputy
Clerk Judy \-Jeyrens.
Others Present: Counc i 1 Liaison Bob Loso, City Attorney John
Scherer, City Engineer Joe Bettendorf, Rick Heid, Tony Heid,
Bob Schuh, Al Ka I 1 a, Margie Ka lla.
Preliminary P la.t - Pond View Rid~e: Rick Heid, developer of
Pond View Ridge, appeared before the Commission for
preliminary plat approval of his a.ddition. The re-drafted
p12l.t Mr. Heid presented eliminated a I I but 15 driveways on
the proposed 12th Ave SEe Mr. Heid indicated that those lots
\\lhich have a driveway onto 12th Ave SE wi I 1 a I I have turn
arounds on them so the residents wi I I not have to ba.ck out
onto 12th Ave SEe
City Engineer Joe Bettendorf questioned the area designated
for dra i n2l.ge, as to whether or not that would be I a.r ge
enough. t1r. Bettendorf discussed \1lÍ t h Commission the future
extension of 12th Ave SE onto CASH 75. For the extension to
be successfu 1, the City wi 1 I have to purchase right of \\lay.
Commissioner Sniezek discussed the importance of placing a
sidew2l.lk along 12th Ave SEe
Reber made a motion to recommend Counc i 1 approval of the
preliminary plat of Rick Heid, Pond View Ridge Addition, as
presented. The plat wi I I include an eight (8) foot sidewalk
along the westerly side of 12th Ave SEe The motion was
seconded by Hiemenz.
Ayes: Klein, Ka.l inowski, Sniezek, Schneider, Hiemenz,
Nierengarten, Reber.
Nayes: None. Motion Carried 7:0:0.
Sr. Kathleen made a motion to des i gna. te the money received in
lieu of parkland, to be designated for exclusive use in park
development for Morningside Park. The motion wa.s seconded by
Sniezek.
Ayes: Klein, Kalinowski, Sniezek, Schneider, Hiemenz,
Nierenga.rten, Reber.
Nayes: None. Motion Carried 7:0:0.
F i n2l. I Plat - Northland Addn. : Terry Schmid appeared before
the Planning Commission to seek final plat approval of his
development known as Northland Addition. Mr. Schmid
presented the final maps a.nd a lis t of the protective land
covenants. Northland wi I I be developed in three (3 ) phases,
each ten ( 10) acres.
Ci ty Attol'ney John Scherer discussed with the Commission
that a portion of the proposed plat is on a. parcel of
property that is currently zoned agricul tural. Before the
plat, a.s presented, can be approved, the portion that is
zoned agricultural must be re-zoned to R-1. Mr. Scherer also
discussed the protective covenants that pertain to the
minimum size requirements, and requested Mr. Schmid to change
the one a.nd one half (1-1/2) story main living level to 1300
square feet, and the two (2 ) story main living level to 1500
square feet.
f1r. Scherer is 03.1 so \I/orking with Mr. Schmid in securing the
easements for future road right of \.¡ay.
Nierenga.rten made a. motion to recommend Council approval of
the final plat of Northland Addition, Terry Schmid Developer,
with the following contingencies:
1. The Developer wi II have the plat re-dra.wn to exclude
Lots 1, 2 and 3, all of Block 5. (A I I that part
South of Elm Street)
2. Execution of a Developer's Agreement as agreed upon
by and between the City, City Attorney, Ci ty
Engineer and the Developer. The Developer will also
provide the City Attorney with the Title Opinion and
Mortgage Interest.
3. The Protective Covenants wi I I be included in the
Covenants and wi I I include a. provision that the
protective land covena.nts c&nnot be amended unt i I a
minimum of 51% of the property is developed.
4. Execution of an agreement providing the City with a
dedication of a. North/South access, as agreed upon
by and between the City, City Attorney, City
Engineer and Property Owners.
The motion was seconded by Sniezek.
Ayes: Klein, Kalinowski, Sniezek, Schneider, Hiemenz,
Nierengarten, Reber.
Nayes: None. Motion Carried 7:0:0.
Nierengarten made a motion to recommend Council approval
requiring the developer to make payment of cash in lieu of
park land. the money received should be kept in escrow so
that park land for the a.rea can be purchased at a later time.
The motion \lias seconded by Sniezek.
Ayes: Klein, Kalino\llski, Sniezek, Schneider, Hiemenz,
Nierengarten, Reber.

Membership During Tenure: As requested by the City Council,
the Commission discussed the requirements for membership of
the planning Commission. Commissioner Hiemana stated that
since the Code of Ordinances currently allows the Planning
Commission a two mile radius oP ,jurisdictfr~n, the member€}ll.l:~
requirements should be consistent with that radius. Hiemana
made a motion to recommend the City Council revise Ordinance
25.1 to include a provision that members must live within a
two (2) mile radius of the Corporate Limits of the City of
St. Joseph. The motion was seconded by Kalinowski.
Ayes: Klein, Kalinowski, Snieaek, Schneider, Hiemana,
Nierengarten, Reber.
Nayes: None. Motion Carried 7:0:0.
Chair Klein adjourned the meeting at 9:50 p. m.
