Pursuant to due call and notice thereof, the Planning Commission for
the City of St. Joseph met in regular session on Î'"1onday, December

Others Present: Counc i 1 Liaison Stephanie Hazen. Peter Giroux, Roger
Steichen.
Approval t1i nutes: Hiemenz ma.de a motion to approve the minutes of the
November 4, 1991 planning commission meeting as presented; seconded by
Reber.
Ayes: Klein, Kalinowski, Sneizek, Schneider, Hiemenz, Reber,
Nierengarten.
Nayes: None. Motion Carried 7:0.
\far ia.nce Request .::.. Gene Scherer: C ha. i r Klein reconvened the va.r ia.nce
he8.ring to 8.llow the construction of 8.n accessory building to exceed
the maximum square footage. Mr. Scherer is requesting a. sixteen (16)
foot val" ia.nce, and the property is located at 30 - 1st Avenue
Northeast. The Commission discussed the criteri8. for grantinE! a

va.r ia.nce a.s established by the St. Joseph Code of Ordinances 52.7
subdivision 2 (copy a.tt.ached) .
Commission Reber questioned the precedence that would be est.ablished by
grant.ing the variance as requested. From reading subdivision ':> Reber

b) deprivation of rights commonly enjoyed bv other properties.

Based subdivision 2 a-a, Reber made a motion to deny the val" i a.nce
request of Gene Scherer which would a.l I 0\1/ him to exceed the maximum
square f 00 ta.ge of an accessory building. The ga.rage ca.nnot exceed 800
squa.re feet. The motion \I/as seconded by Hiemenz.

Ro¡:;er Steichen: Roger Steichen, owner of Gar):' s Pizza., ca.me before the
Commission to discuss the possibility of applying for a building permit
to construct. a. new bui lcJ.ing for C1 ëI. r ~:/ ' s Pizza on the lot located between
the existing store and Bo Diddley·s. The majority of business for
Gary's is ta.ke out, a.nd parking is not a problem. At this point in
time, Mr. Steichen is checking into the fea.sibi I ity of constructing a.
new store. Chao i I" Klein qlJestioned the loca.tion of the utility lines on
the proposed lot a.nd suggested tha.t Steichen contaçt the Pub lie Works
Director before f i na. 1 plans 3.re drafted. I t \v.3. s the genera. I consensus
of the Fla.nning Commission to approve the idea of building on the
vaca.nt lot, a.nd before any cons t. rT_~C: t i on! the building inspector and
Pub lie ivoi'ks Di i'ectoi' must be contacted. Additionally, if the lot wi II
be sp lit it must be brought before the City Counc i I for the i r·
consideration.

Subdivision Check Lic::t· City Engineer Joe Bettendorf drafted a schedule
for developers to fo I ¡ ow for platting property. The Commission
discussed the schedule and recommended cha.nges. The changes wi ¡ I be
