Pursuant to due call and notice thereof, the Planning Commission for I
the City of St. Joseph met in regular session on Monday, May 3, 1993 at
7:30 p.m. in the St. Joseph City Hall
Members Present: Chair Hub Klein. Members of the Commission Sr.
Kathleen Kalinowski, Linda Sniezek, Andy Brixius, Kurt Schneider, Dan
Nierengarten. Secretary of the Commission Judy Weyrens.
Others Present: Mike Schnobrick, Nelson Lance, Ron Philippi, Steve
Dehler, Jean Dehler, Al Ste I hnach, Mark Lambert.
Special Use Request ~ Al Stellmach: Chair Klein called the public
hearing to order at 7:30 p.m. The purpose of the hearing is to
consider a request for a special use permi t . This permit would allow
for the constr~ction 183 cold storage units. Zoning Ordinance 52.21
subd 4 states, -"All industrial uses shall require a special use
permit. It The property is legally described Lot 003; Block 001, Neu
as
Addition. The request for special use has been submitted by Ai
Stellmach, 562 Saukview Drive, St. Cloud, MN 56302 and Steve Hoffmann,
255 - 5th Avenue N, Sartell, MN 56377.
Mr. S tell ma c h spoke on his behalf. He stated that his plan includes
multiple phases, and he is seeking approval for only the first phase at
this time. Phase one consists of 40 mini storage units, 10' x 20' .

When asked about the ability to meet the railroad and City setback
requirements, Mr. Stellmach stated that he has enough property to
comply with the setbacks. However, he will redesign the future phases
as they do not meet the requirements.
Kalinowski made a motion to approve phase one as requested. The motion
died for a lack of a second.
Commissioner Schneider questioned whether the Commission should table
the matter until all the members have had a chance to review the plans
and view the proposed site. Nierengarten made a motion to table
further discussion. until all the members have had a chance to review
the plans. The motion was seconded by Nierengarten.
Ayes: Klein, Kalinowski, Sniezek, Brixius, Schneider, Hiemenz,
Nierengarten.
Nayes: None. Motion Carried 7:0:0
The hearing was closed at 8: OO"p .m:. and will be re-opened on June 7,
1993 at 7 : 30 p. m .
Variance-Request ~ Nelsön Lance: Chair Klein opened the hearing at 8:00
p.m. The purpose of the hearing is to consider a request for a two (2)
foot variance on the side yard setback in a Single Family, R-1 Zone.
St. Joseph Code of Ordinances 52.16 subd (b) states that the side yard I
set back from a garage/accessory building shall be five ( 5 ) feet. The
property is legally described as Lot 8 Block 1 ; Loso I Second Addition.

The request for variance has been submitted by Nelson and Angela Lance,
121 - East Minnesota Street, St. Joseph, MN 56374.

Mr. Lance spoke on his behalf. He stated that he currently has a
single garage and a lean-to on his property. In an effort to clean up
his property and provide security for his possessions, he would like to
build a two stall garage and tear down the existing buildings. Because
the lot is long and narrow, Mr. Lance is requesting a two foot variance
on the side yard setback. By allowing the two foot variance, Mr. Lance
will be able to construct a larger concrete pad. The concrete pad will
provide adequate space for turning around.
After reviewing the plans, the Commission determined that Mr. Lance
owns enough property to support the two stall garage. Sniezek made a
motion to recommend Council approval the two foot variance as
requested, based on the following findings:
1 ) St.J-oseph Code of Ordinance No. 52.7 subd 2(a)
Mr. Lance owns a long narrow lot, with the house being
located in the front portion. Currently the property houses
a single garage and a lean-to.
In granting the variance, Mr. Lance has agreed to demolish
the existing buildings. The new garage would provide safety
and security to the Lance .

2) St. Joseph Code of Ordinance No. 52.7 subd 2(a)
The proposed variance will not impair an adequate supply of
light and air to the adjacent property, or diminish or impair
established property values within the surrounding area.
Based upon these findings, the Planning Commission recommends that
the request for a two ( 2 ) foot variance on the sideyard setback in a R-
1 zone be approved. Approval shall be on the following conditions:
1 ) None.
The motion was seconded by Nierengarten.
Ayes: Klein, Kalinowski, Sniezek, Brixius, Schneider, Hiemenz,
Nierengarten.

Mark Lambert- PURD Application: Mr. Lambert appeared before the
Planning Còmmission to ~ake ~pplication for a PURD development. St.
Joseph Cod~ of.Ordinanc~ No. 52.18 subd subd 4(c) states that Multi
Family Dwelling units shall be required to utilize the PURD procedural
process excluding the PURD requirement for acreage. Mr. Lambert stated
that he would like to construct a 15 unit apartment complex. The
Planning Commission accepted his PURD application and scheduled the
hearing for June 7 , 1993.
Steve Dehler ~ Building Permit: Steve Dehler appeared before the
Commission to request authorization to apply for a building pe rmi t to

remodel Linnemann's Store. Mr. Dehler and his partner, Brad Lindgren,
have secured contract with St. John , Prep School to provide living
a s
quarters for female students attending the Prep Schoo 1 . The Store wi 11
be converted into a lodging house, with 18 people living in the lower
level and 12 students living in the upper 1 eve l. The plans include 2
students per bedroom, a common living room and a common kitchen.
Commissioner Kalinowski questioned whether Mr. Dehler has adequate
parking and if he rents his parking lot to the .American Legion. Mr.
Dehler stated that he currently has a non-exclusive agreement with the
Legion and is compensated for that agreement. However, parking space
is not guaranteed.
After discussion, the Planning Commission determined that 20 parking
spaces would be required for the volume of renters. The Commission
discussed at length whether or not Mr. Dehler had to pave and strip his
parking lot. Mr. Dehler stated that due to the costs involved in
paving the lot, he currently has no plans to do so.
Commissioner Brixius felt that i t is important that the parking spaces
be marked. I f the Legion has an event, and the renters come home, what
will assure them a parking space? Mr. Dehler stated that if i t becomes
a problem, he will cease the agreement with the Legion. The Commission
generally agreed that unless parking spaces are marked and designated
people other than residents will continue to park in his iota
The Commission agreed to seek legal opinion regarding the designation
of parking spaces and the possibility of making the building permi t
conditional upon the paving of the parking lot.
Nierengarten made a motion authorizing Mr. Dehler to make application
for a building permi t . Application is contingent upon the
recommendation of the Ci ty Attorney, John Scherer! with regard to the
designation of parking. The motion was seconded by Sniezek.
Ayes: Klein, Kalinowski, Sniezek, Brixius, Schneider, Hiemenz,
Nierengarten.
Nayes: None. Motion Carried 7:0:0
Minutes: Kalinowski made a motion to approve the minutes of the March
1 , March 16 and April 5, 1993 as presented. The motion was seconded by
Brixius.
Ayes: K l-e in, Kalinowski, Sniezek, Brixius, Schneider, Hiemenz,
Nierengarten.
Nayes: None. Motion Carried 7:0:0
Comprehensive Plan Update: A special meeting has been established with
the Ci ty Councìl on May 13, 1993. Since not all the Planning
Commissioners can be present, the following are alternative dates:
May 21 , May 22, May 23.
New Business
Hearing Request: The Sisters of the Order of St. Benedict have
requested the City to consider allowing a special use permit to allow

up to five members of the Order to live in a residential zone. After
reviewing the correspondence from the City Attorney, a hearing will be
conducted on June 7 , 1993.
Alley Vacation: Dale Victor, owner of Sunset Industries is requesting
approval to vacate the portion of the all ey behind his business located
at 417 1st Ave NW. The Planning Commission will review the process
involved in vacating the all ey and respond to Mr. Victor.
House Location: The Commission discussed mechanisms to control the
placement of houses on vacant lots. After discussion, the Commission
requested additional information as to the types of requirements that
can be applied.
The meeting wets adjourned by general consensus at 10:30 p.m.
