HomeMy WebLinkAbout1993 [08] Aug 02 - August 2 , 1993 Pursuant to due call and notice thereof, the Planning Conunission for the City of St. Joseph met in regular session on Monday, August 2 , 1993 at 7: 30 p.m. in the St. Joseph City Hall. Members Present: Chair Hub Klein. Commissioners S . Kathleen Kalinowski, Linda Sniezek, Marge Lesnick, Dan Nierengarten, Andy Brixius, Kurt Schneider. Council Liaison Ken Hiemenz. Secretary of the Board Judy Weyrens. Others Present: Mayor Donald "Bud" Reber, Stephanie Hazen, Mark Lambert, Dean Wick, Merle Jersak, Rachel Stapleton, Dan Marrin, Marlin Eich, Joe Miller, Tim Henze. Special Use Request - College of St. Benedict: Chair Klein called the hearing to order at 7:30 p.m. The purpose of the hearing is to consider a request for a Special Use Permit. This permi t would allow the construction of an ingress/egress to the College of St. Benedict. St. Joseph Code of Ordinances 52.22 states that streets and alleys which provide a means of ingress and egress to or from the institution shall require a special use permit. The property is legally described as follows: That part of the Northwest Quarter of the Northwest Quarter in Section 1 5 , and that part of the North Half of the Northeast Quarter in Section 16, and that part of the South Half of the Southeast Quarter in Section 9, and that part of the Southwest Quarter of the Southwest Quarter, in Section 10, all in Township 124, Range 29, Stearns County, Minnesota, lying South of the existing corporate limits of the City of St. Joseph, lying West of College Avenue and lying North and East of the following described line: Commencing at an iron monument at the Northwest corner of said Section 15; thence along the North line on an assumed bearing of East, 661.35 feet; thence South 00 degrees 10 minutes West a distance of 1207 feet; thence bearing East 660 feet, more or less, to a point on the East line of the Northwest Quarter of the Northwest Quarter, in said Section 15, said point being the point of beginning of the line to be described; thence bearing West along the previously described East-West line and its Westerly extension, a distance of 3300 feet, to a point lying due South of the Southwest corner on Lot 5, in Auditor , Subdivision No. 4, according to the recorded plat thereof, s Stearns County, Minnesota; thence due North to the Southwest corner of said Lot 5 and there terminating. LESS AND EXCEPT: The South Thirteen ( 13) rods of the East Sixteen and Two-thirds ( 16 2/3) rods of the North Twenty-four (24) rods of the Northwest Quarter of the Northwest Quarter ( NW 1/4 NW 1/4) of Section Fifteen ( 15 ) in Township One Hundred and Twenty-four (124 ) North, of Range Twenty-nine (29) West and containing One and One-third ( 1 1/3) acres more or less; - AND The Easterly Sixteen and Two thirds ( 1 6 2/3) Rods of the Southerly One and Four Tenths ( 1 . 4 ) Rods of the Northerly Eleven ( 1 1 ) Rods of the Northwest Quarter of the Northwest Quarter (NW 1/4 NW 1/4 ) of Section Fifteen ( 1 5 ) In Township One Hundred Twenty-four (124) North or Range Twenty-nine (29 ) West, according to the U.S. Government Survey thereof. The request for Special Use has been submitted by the College of St. Benedict, 37 College Avenue South, St. Joseph, MN 56374. Dean Wick spoke on behalf of the College of St. Benedict. Mr. Wick indicated that the College is in the process of constructing a new entrance to the College off County Road 1 2 1 . Plans include the construction of walkways along both sides of the road and two circle drives. Commissioner Kalinowski questioned whether Mr. Wick had contacted the St. Cloud Area Planning Organization with regards to the location of the proposed roadway. Mr. Wick stated that he has contacted Bill Hanson of the APO, but Hanson could not indicate the exact location of the roadway. Mayor Reber stated that at a recent APO meeting, Mr. Hanson stated that the proposed roadway through the College of St. Benedict IS negotiable. The two starting points are not negotiable, but within the campus it IS undetermined. Mr. Jersak, representative of the College of St. Benedict, questioned the Commission as to what need the APO IS basing the proposed road on and what the time frame for construction is. Chair Klein stated that the purpose of the road is to direct traffic off Minnesota Street. At this point it is unknown as to when and if the road will actually be constructed. The Commission questioned Mr. Wick as to the location of the proposed entrance and why it is does not coincide with the proposed roadway. Mr. Wick stated the following for the College , decision reasons s as to the physical location of the roadway: 1 . The proposed road is planed as a minor arterial, and with that certain restrictions apply. The College would not be allowed to have any access to or from the road. 2. Preserve the integrity of the Presidents house. 3. Leave enough land for future development. After discussion, Brixius made a motion to recommend approval of the special use request of the College of St. Benedict allowing the construction of an ingress/egress on the above described property. Approval is based on the following findings: 1 ) ~ Joseph Code of Ordinance No. 52.22 subd 1 The following uses shall require a special use permi t based on the procedure set forth in this Ordinance. a) Streets and alleys which provide a means of ingress and egress to or from the institution. 2) The College is aware and has been informed of the proposed roadway included in the Transportation Plan, as drawn by the St. Cloud APO. The proposed roadway is in the 2010 plan and is proposed to go through the College of St. Benedict. Based on these findings, the Planning Commission recommends that the request for special use for an ingress/egress in an Education and Ecclesiastical District be approved. The motion was seconded by Sniezek. Ayes: Klein, Sniezek, Lesnick, Nierengarten, Brixius, Schneider. Nayes: None. Abstain: Kalinowski Motion Carried 6: 0: 1 The hearing was closed at 8:00 p.m. Dan Marrin: Dan Marrin, owner of the 8 plexes, 300 and 304 Old Highway 52, appeared before the Planning Commission to discuss zoning requirements to change the property from rental units to Townhomes. In the past the property was rented to students, and the units suffered extreme damage each year. Mr. Marrin is requesting to split the property into eight units and sell them individually as Townhomes. Liaison Hiemenz stated that Mr. Marrin must meet the minimum square footage requirements before splitting the property. All the Commissioner present indicated that the change in property would be an asset to the neighborhood. Chair Klein stated that before the Planning Commission could make a determination, legal counsel must be sought. If after discussing the matter with the City Attorney a hearing is needed, the Commission will meet on August 23, 1993. Special Use ~ Relief of Fencing Requirements: Chair Klein called the public hearing to order at 8:20 p.m. The purpose of the hearing was to consider relief from certain fencing requirements of the November 1990 Variance. The City Council granted a fifteen foot variance on the rear yard setback conditionally. The property owner was required to construct a six (6) foot fence along the entire west side of the property, a four foot fence along the south 200 feet of the east side and a six foot fence on the remaining portion of the east side. The property is described as Lot One ( 1 ) and Lot Two ( 2) ; North Park Addition. The request has been submitted by Mark Lambert, 101 -East 5th Street, Suite 910, St. Paul, MN. Mark Lambert spoke on his own behalf. In 1990 Mr. Lambert appeared before the Conm1Íssion requesting a variance on the rear setback. The variance was granted conditionally due to neighborhood opposition. At the time of the Variance the neighborhood was mainly single family. However, since that time, most of the property owners have changed hands, with the property being converted to rental units. Additionally, Mr. Lambert has purchased the property adjacent to the new apartment complex. Due to this change, Mr. Lambert is requesting that the fencing requirements be reduced to a four foot fence. With no objection from those present, Nierengarten made a motion to recommend the Council relieve Mr. Lambert of the six foot fencing requirement. Instead of the six foot fence, the following fencing is recommended for approval: 1 . No fence along the west side of the property. 2. A four foot fence along the south 200 feet of the east side and a six foot fence on the remaining portion of the east side. The motion was seconded by Lesnick. Ayes: Klein, Sniezek, Lesnick, Nierengarten, Brixius, Schneider. Kalinowski. Nayes: None. Motion Carried 7:0:0 The hearing was closed at 8:45 p.m. Approval of Minutes: Kalinowski made a motion to approve the minutes of the July 12, 1993 Planning Commission meeting as corrected. Motion Carried 7:0:0 Mark Mimbach: Tim Henze appeared on behalf of Mark ~Hmbach . Mr. Henze stated that Mr. "'Umbach is requesting approval to convert his property located on CSAH 75 from a restaurant to a boarding house. The boarding house would accommodate 8 to 1 3 women with a kitchentte for each bedroom and one common kitchen. A common area would be pro\'ided with one bathroom facility. Chair Klein stated that the Commission could not make a recommendation on this matter as legal counsel is needed. The Planning Commission discussed the advertising sign of Mr. Deutz. Kalinowski made a motion requesting Mr. Deutz to make application for a special use permi t , as required by the St. Joseph Code of Ordinances. Addi tionally, the property owners of CMS Body Shop are required to make application for an extension of their special use permi t as they have extended their business. The motion was seconded by Lesnick. Ayes: Klein, Sniezek, Lesnick, Nierengarten, Brixius, Schneider. Kalinowski. Nayes: None.
