HomeMy WebLinkAbout1993 [08] Aug 23 August 23, 1993 - Pursuant to due call and notice thereof, the Planning Commission for the City of St. Joseph met on August 23, 1993 at 7:30 p.m. in the St. Joseph City Hall. Members Present: Chair Hub Kli en. Commissioners S . Kathleen Kalinowski, Marge Lesnick, Linda Sniezek, Andy Brixius. Council Liaison Ken Hiemenz. Secretary of the Board Judy Weyrens. Others Present: Dan Marrin, Bill Lunser, Joe Miller, Chuck Muske, Diane Muske, Daryl Counter. Dan Marrin Variance & Subdivision Request: Chair Klein called the hearing to order at 7:40 p.m. The purpose of the hearing is to consider a preliminary plat for St. Joseph Townhouse Addition. The Townhouse Addition will convert the existing rental units into eight ( 8 ) single family dwellings. The entire property contains approximately 28,000 square feet. Additionally, the Commission will consider a four thousand (4,000) foot variance request on the total property required for an eight ( 8 ) unit, three ( 3) bedroom townhouse site. St. Joseph Code of Ordinance No. 52.18 subd 5(b) requires 4,000 square feet of lot area for each three ( 3) bedroom unit. The proposed site would be required to contain 32,000 square feet. The property is legally described Lot 001 , Block 002; Loso , as s 7th Addition. Lots 1 & 2 Block 2 also part of Lot 9 of Auditors subdivision Number 4. & parts of St. & Alley Vacation. The property address is 300 and 304 Old Highway 52. Dan Marrin spoke on his own behalf. Mr. Marrin presented the prel iminary plat of St. Joe Town Homes. The plat contains one ( 1 ) block and seventeen ( 17) lots. As stated above, a 4,000 foot variance is needed to comply with the total required lot area. Mr. Marrin feels that a variance should be granted because the buildings have been established and he is land locked on both sides and cannot add on to his facility. He feels that the proposed change in use from a student rental to single family townhomes is the best use of the property for both the City and himself. Council Liaison Hiemenz questioned whether the proposed site would be able to comply with the parking restrictions as outlined by St. Joseph Code of Ordinance No. 52.13 subd 4 (a) , which requires two ( 2 ) off street parking spaces per unit. Mr. Marrin stated that one of the parking spaces would be the garage, and the seconded space would be provided In front of each individual garage. Additionally, there will be visitor parking on both the east and west of the garages. After discussion, Kalinowski made a motion to recommend Council approval of the variance request of four thousand (4,000) feet, allowing the above described property to be converted into 8 single family dwellings, St. Joseph Town Homes, based on the following findings: August 23, 1993 1 . ~ Joseph Code of Ordinances No. 52.7 subd 1 a) That there are exceptional or extraordinary circumstances or conditions applying to the property in question as to the intended use of the property that do not apply generally to other properties In the same zoning district. The buildings are existing and the property is bounded on all sides. c) Granting this variance will not confer on the applicant any special privilege that IS denied by this Ordinance to other lands in the same district. d) The variance will not impair an adequate supply of light and air to adjacent property, or diminish or impair established property values within the surrounding area, or in any other respect impair the public health, safety or welfare of the residents of the Ci ty of St. Joseph. e) That the condition or situation of a specific piece of property, or the intended use of said property, for which the variance was sought, is not of so general or recurrent a nature as to make reasonably practicable the formulation of a general regulation for such conditions or a situation. Based on these findings, the Planning Corru-nission recommends that the request for variance be granted. The motion was seconded by Sneizek. Ayes: Klein, Kalinowski, Sniezek, Lesnick, Brixius, Hiemenz. Nayes: None. Motion Carried 6:0:0 After reviewing the preliminary plat of the St. Joe Town Homes, Kalinowski made a motion to recommend Council approval of the plat as presented, contingent upon the approval of the Ci ty Engineer, City Attorney, and Building Inspector. The motion was seconded by Sniezek. Ayes: Klein, Kal i nowsk i , Sniezek, Lesnick, Brixius, Hiemenz. Nayes: None. Motion Carried 6:0:0 Chair Klein closed the hearing at 8:00 p.m. Joe Miller - Building Permit: Joe Miller, owner of Miller Dairy Sales, - appeared before the Commission requesting authorization to make application for a building permi t . The building permit would enclose the existing loading dock and provide additional security. Mr. Miller stated that during the winter months, the snow comes off the roof and into the loading dock area. The enclosure would be 1 1 ' wide and 74' long. The addition would follow the existing roof line. Sniezek made a motion authorizing Mr. Miller to make application for a building permit to enclose the current loading dock as requested. The motion was seconded by Lesnick. Ayes: Klein, Kalinowski, Sniezek, Lesnick, Brixius, Hiemenz. Nayes: None. \~otion Carried 6:0:0 August 23, 1993 Daryl Counter: Daryl Counter, 206 Minnesota Street West, appeared before the Commission to discuss application for a variance. Mr. Counter is considering adding a second garage (24 x 40, 960 square feet) to his property. He currently has a garage 24 x 24, 576 square feet. I f granted, Mr. Counter would need a variance of 636 square feet. The Commission discussed various sizes of garages and encouraged Mr. Counter to downsize the proposed garage. The Conm1Ìssion scheduled a variance hearing for Mr. Counter on September 13 ! 1993 at 7:30 p.m. The meeting was adjourned at 8:50 p.m. ~ ~rens Secretary of the Board
