HomeMy WebLinkAbout1994 [05] May 02May 2, 1994 Pursuant to due call and notice thereof, the Planning Commission for the City of St. Joseph met in regular session on Monday, May 2, 1994 at 7:30 p.m. in the St. Joseph City Hall. Members Present: Chair Hub Klein. Commissioners Marge Lesnick, Linda Sniezek, S. Kathleen Kalinowski, Dan Nierengarten, Kurt Schneider, Andy Brixius. Council Liaison Ken Hiemenz. Secretary Judy Weyrens. Others Present: Mike Murphy, Jessie Kellen, Oda Larson. Chair Klein stated to those present that the Stearns County HRA will not be present at this meeting. Therefore, the project will not be discussed. Aaproval of Minutes: Nierengarten made a motion to approve the minutes of April 4 and April 18, 1994 as presented; seconded by Kalinowski. Ayes: Klein, Kalinowski, Lesnick, Sniezek, Nierengarten, Brixius, Schneider, Hiemenz. Nayes: None. Motion Carried 8:0:0 Planning Commission Enabling Ordinance: Cormnission Members discussed the proposed draft of Ordinance 25, Planning Commission. Commissioner Kalinowski incorporated the recommendations of the City Attorney in the proposed draft. A lengthy discussion followed, which included the following: Size of membership, Quorums needed, ex officio membership, and voting powers. With the exception of a few minor changes, the Commission agreed to forward the proposed ordinance to the City Attorney for his review and comments. Commission members requested that after legal review of the document, it be returned to the Commission for a recommendation to the City Council. Snow Removal Ordinance: Commission Members discussed the snow removal ordinance and whether or not it needs to be updated. The current ordinance requires that all snow be removed from sidewalks within 24 hours. Discussion followed as to whether or not the City is responsible for removing snow from the sidewalks in the business district, and whether the expense could be charged back to the property owner. It was the general consensus of the Commission to enforce the current ordinance, requiring the removal of snow within 24 hours. Additionally, the businesses will be allowed to push the snow from the sidewalk into the street, which in turn will be removed by the City. Nudity Ordinance: Commission Members reviewed recommendations of the City Attorney, John Scherer, with regard to amending the Nudity Ordinance. After discussion, Sniezek made a motion requesting the City Council authorize the City Attorney to draft an amendment to the nudity ordinance with the following inclusions: 1. 1500' buffer between establishments in an industrial area 2. 1500' buffer between an establishment and a residential zone. Page 1 May 2, 1994- The motion was seconded by Nierengarten. Ayes: Klein, Kalinowski, Lesnick, Sniezek, Nierengarten, Brixius, Schneider, Hiemenz. Nayes: None. Motion Carried 8:0:0 Garage Sale: A letter has been sent to the property owner. Linnemann Inn: The owners of the Linnemann Inn have presented a parking plan and requested that the Chair of the Commission sign the plan indicating approval. After discussion, the Commission rejected the proposed parking plan stating it is inadequate for the following reasons: 1. The plan did not indicate any signage for designation of parking stalls or the fire lane. 2. The plan did not include the type of material to be used on the surface. It appears as the current material is not dust free. Art Novak ~ Preliminary Plat: Art Novak appeared before the Commission to discuss the preliminary plat for Cedar Eas t. The proposed plat will allow the office building to function as a condominium.
