Pursuant to due call and notice thereof, the Planning Commission I
for the City of st. Joseph met in regular session on Monday,
November 6, 1995 at 7:30 p.m.
Members Present: Chair Hub Klein. Commissioners S. Kathleen
Kalinowski, Marge Lesnick, Linda Sniezek, Dan Nierengarten, Andy
Brixius. Council Liaison Cory Ehlert. Secretary Judy Weyrens.
Others Present: Renee Sand, Dale Haug, Rachel Stapleton, Jerry
Klaphake.
Mark Mimbach - Buildinq Permit: Chair Klein recognized that Mr.
Mimbach was not present. st. Joseph Building Official, Dale Haug,
discussed with the Commission the building permit request of Mr.
Mimbach. Haug stated that Mr. Mimbach is adding interior walls
which require a building permit. The property is located adjacent
to CR 75 in the former Video and Balloons to Go building. st.
Joseph Code of Ordinances requires that all building permit
requests in a general business zone be approved by the Planning
Commission. The building is being remodeled to house a video store
and a second business to be determined at a later date. The
Commission discussed the importance of approving building permits
in a general business zone. As Mr. Mimbach was aware of the
requirement and was knowingly placed on the Planning Commission
agenda, Ehlert made a motion to recommend the Council direct the I
Building Official to issue a cease work order and obtain legal
opinion as to the authorization to stop all business activity at
the above location until Mr. Mimbach appears before the Planning
Commission to fully disclose his plans for the building. Seconded
by Sniezek.
Ayes: Klein, Kalinowski, Sniezek, Lesnick, Brixius,
Nierengarten, Ehlert.
Nayes: None. Motion Carried 7:0:0
Jerry Klaphake - Equity Buildinq: Jerry Klaphake appeared before
the Commission requesting authorization to make application for a
building permit. Klaphake stated that he along with his partners
plan to construct an office building on the corner lot of Minnesota
Street East. The building will be 1400 square feet. After
reviewing the site plan and verifying that all setbacks
requirements are complied with Brixius made a motion authorizing
Klaphake to make application for a building permit as requested;
seconded by Nierengarten.
Ayes: Klein, Kalinowski, Sniezek, Lesnick, Brixius,
Nierengarten, Ehlert.
Nayes: None. Motion Carried 7:0:0
Renee Sand - Corninq Clinical: Renee Sand appeared before the
Commission requesting authorization to make application for a I
building permit. Sand stated that she has leased the former st.
Joseph Pharmacy building for Corning Clinical Labs and needs to
have some interior construction completed. Corning Clinical is a
courier service for area medical facilities. The lab picks up lab
tests and forwards them to the appropriate labs, and then receives
the test reports and forwards them back to the medical facility.
After verifying the parking requirements Kalinowski made a motion
authorizing Renee Sand, Corning Clinical, to make application for
a building permit as requested; seconded by Lesnick.
Ayes: Klein, Kalinowski, Sniezek, Lesnick, Brixius,
Nierengarten, Ehlert.
Nayes: None. Motion Carried 7:0:0
Buildinq Permits - General Business Zone: Dale Haug, st. Joseph
Building Official, appeared before the Commission to discuss the
requirement that all building permits in a General Business Zone be
approved by the Planning Commission. Haug stated the Ordinance
requirement sometimes places a burden on contractors and questioned
if the Commission would consider revising this requirement. After
a lengthy discussion, Commissioners agreed the requirement is a
good tool to assure the Ordinance is being adhered to and the uses
are compatible with the zoning. The Commission also stated that if
a property owner cannot wait until the next meeting, they can
request a special meeting.
Approve Minutes: Sniezek made a motion to approve the minutes of
the October 2, 1995 Planning Commission as presented; seconded by
Lesnick.
Ayes: Klein, Kalinowski, Sniezek, Lesnick, Brixius,
Nierengarten, Ehlert.
Nayes: None. Motion Carried 7:0:0
Joint City/Planninq Meetinq: The st. Joseph City Council and
Planning Commission will meet jointly at 7:00 p.m. on December 4,
1995 to discuss the st. Joseph Township Land Use Map.
Adiourn: Nierengarten made a motion to adjourn at 9:10 p.m. ;
seconded by Brixius.
Ayes: Klein, Kalinowski, Sniezek, Lesnick, Brixius,
Nierengarten, Ehlert.
Nayes: None. Motion Carried 7:0:0
