HomeMy WebLinkAbout1996 [01] Jan 02 Pursuant to due call and notice thereof, the Planning Commission I for the City of st. Joseph met in regular session on Tuesday, January 2, 1996 at 7:30 p.m. in the st. Joseph City Hall. Members Present: Chair Hub Klein. Commissioners S. Kathleen Kalinowski, Marge Lesnick, Dan Nierengarten, Andy Brixius. Council Liaison Cory Ehlert. Secretary of the Commission Judy Weyrens. Others Present: Paul Fries, Ross Rieke, Rich Feneis, Bud Reber, Dick Taufen, Chris Foged. Special Use Hearinq - City of st. Joseph: The st. Joseph Board of Adjustments and Appeals for the City of st. Joseph shall conduct a public hearing on Tuesday, January 2, 1996 at 7:00 p.m. in Ci ty Hall. The purpose of the hearing is to consider a special use permit to allow advertising signs on properties currently zoned General Business. Zoning Ordinance No. 52.13 subd 10(a) of st. Joseph Code of Ordinances defines an advertising sign as, "a sign which directs attention to a business, profession, commodity, service or entertainment which is sold or offered on a premise other than that on which the sign is located." Furthermore, "Advertising signs or billboards may be constructed and maintained, pursuant to a Special I Use Permit, only property zoned for use as General Business, ( B), Industrial (I) , and/or Agricultural (A) . No advertising signs or billboards shall be constructed or maintained on property subject to any other zoning classification than that specifically allowed herein." The properties are located at: The Northeast corner of the intersection of Minnesota Street West and Second Avenue Northwest; adjacent to 121 Minnesota street West. And The Southwest corner of the intersection of CSAH 75 and College Avenue North/County Road 2; adjacent to the st. Joe Gas & Bait complex. The request for special use has been submitted by the City of st. Joseph. Rich Feneis, Feneis advertising spoke with regards to the advertising sign. He stated that he is proposing to construct an advertising sign adjacent to the st. Joe Gas & Bait complex in the right of way area owned by stearns County and a second sign at the intersection of Minnesota street West and 2nd Avenue NW. The City would be the property owner of the sign and be responsible for total maintenance of the sign. Feneis will sell the advertising and serve as a broker. The sign will be fully electronic and lit I from the base. Messages would be controlled and programmed by the City of st. Joseph. Paul Fries questioned the amount of lighting the sign would project and if the corner of 2nd Avenue NW and Minnesota Street West would - be appropriate. Feneis responded that the sign on Minnesota street would be smaller than the sign on County Road 75. Before installation, the layout of the lot by both a physical inspection and setback review -- would need to be completed. As far as the lighting, he encouraged the Commission to contact the City of Sartell, who has a similar sign operational. After further discussion of the proposed sign, Rieke informed the Commission that they must make their decision on if the proposed locations are appropriate for the signs. The Council must make the decisions as to they type and functioning of the sign. with that in mind, Lesnick made a motion recommending the Council approve the special use permit of the City of st. Joseph, as the proposed sites are good logistical locations for signs. The motion was seconded by Nierengarten. Ayes: Klein, Kalinowski, Lesnick, Nierengarten, Brixius, Ehlert. Nayes: None. Motion Carried 6:0:0 OTHER MATTERS Paul Fries discussed the problem of snow removal by his residence on MN street. The adjacent property owner plows the snow on the sidewalk and the end of his driveway. Mayor Reber will check into this matter. Dick Taufen questioned the parking by Corning Clinical and the need to require their employees to use off street parking. The Council will address this problem along with the parking problem on MN street by st. Joseph Lab School. Chris Foqed - Mimbach Buildinq Permit: Chris Foged, owner of star Burst Video appeared before the Commission to discuss the authorization to obtain a building permit. Foged stated that he is 1 easing space from Mr. Mimbach and assumed Mimbach would secure the building permit. st. Joseph Building Inspector Dale Haug stated that he had contacted both Mr. Foged and Mr. Mimbach who cancelled numerous appoints and failed to appear before the Planning Commission in December. The Commission stated the importance of foIl owing the st. Joseph Code of Ordinances which clearly states that all building permits in the General Business area must be approved by the Planning Commission. They also stated that the property owner is required to obtain the building permit. Foged stated that the only construction that was completed was the formation of a vestibule and separation for a possible second business. Rieke stated that at this time the Commission must decide if they would have approved the building permit application if the property owner had followed the procedure outlined in the st. Joseph Code of Ordinances. The Council must decide of the property owner will be sanctioned. Kalinowski made a motion authorizing the property owner to make application for a building permit for the property located in the former Video and Balloons To Go building. Seconded by Lesnick. Ayes: Klein, Kalinowski, Lesnick, Nierengarten, Brixius, Ehlert. Nayes: None. Motion Carried 6:0:0 The Commission agreed to conduct election of Officers at the February 1996 meeting.
