HomeMy WebLinkAbout1996 [04] Apr 01 Pursuant to due call and notice thereof, the Planning Commission for the City of st. Joseph met in regular session on Monday, April 1, 1996 at 7:30 p.m. in the st. Joseph city Hall. Members Present: Chair Hub Klein. Commissioners S. Kathleen Kalinowski, Linda Sniezek, Marge Lesnick, Dan Nierengarten, Kurt Schnieder. Council Liaison Cory Ehlert. Secretary Judy Weyrens. others Present: Joe Miller, Shirley Miller, Mike Deutz, Ken Marthaler, Dale Haug. Preliminary Plat - Miller East Cedar: Chair Klein called the hearing to order at 7:30 p.m. The purpose of the hearing is to consider a preliminary plat for Miller East Cedar Addition. The proposed plat of property is located in the 200 block of East Cedar Street. That part of the SE\NW\ of section 10, Township 124 North, Range 29 West; Stearns County, Minnesota described as follows: Commencing at the intersection of a line 100.00 feet East of, measured at right angles to and parallel with the east line of Lot 16, AUDITOR I S SUBDIVISION NUMBER 4, according to the recorded plat thereof on file and of record in the Office of the County Recorder, Stearns County, Minnesota, with the northerly right of way of State Trunk Highway No. 52, as now travelled; thence North 01 degrees 35 minutes 00 seconds East on an assumed bearing, parallel with the east line of said lot a distance of 161.95 feet to the point of beginning of the land to be described; thence North B9 degrees 35 minutes 00 seconds West 100.02 feet to the east line of said Lot; thence North 01 degrees 35 minutes 00 seconds East along said east line 174.19 feet to the southerly right of way line of the Burlington Northern Railroad; thence southeasterly along said right of way 109 feet, more or less, to the intersection with a line that bears North 01 degrees 35 minutes 00 East from the point of beginning; thence South 01 degrees 35 minutes 00 seconds West parallel with the east line of said Lot a distance of 128.27 feet to the point of beginning. AND The West 200.00 feet (as measured along the northerly right-of-way line of Trunk Highway No. 52) of the following described tract: All that part of the SE\NW\ of section 10, Township 124 North, Range 29 West; in the village of st. Joseph, Stearns County, Minnesota described as follows: commencing at the southeast corner of the NW\ of Section 10; thence on an assumed bearing of NORTH along the east line of said NW\, a distance of 559.31 feet to the a point on the northerly right-of-way line of Trunk Highway No. 52; thence North 88 degrees 18 minutes 00 seconds West along said right-of-way 831.57 feet; thence North 01 degrees 35 minutes 00 seconds East 290.22 feet to its intersection with the southwesterly right-of-way line of the Burlington Northern Railroad; thence southeasterly along said right-of-way line to its intersection with said east line of NW\ of section 10; thence SOUTH along said east line 87.91 feet to the point of beginning. The proposed plat has been submitted by Joseph & Shirley Miller, 213 East Cedar Street, st. Joseph, MN 56374. Joe Miller spoke on his own behalf. Miller stated that the purpose of platting his property is to obtain tax relief and subdivide the property for possible resale. The plat includes a roadway easement to provide access to the back parcels. After reviewing the plat, Sniezek made a motion to recommend the Council approve the preliminary plat of Miller East Cedar contingent upon Attorney and Engineer approval. The motion was seconded by Nierengarten. Ayes: Klein, Kalinowski, Sniezek, Lesnick, Nierengarten, Schneider, Ehlert. Nayes: None. Motion Carried 7:0:0 Building Permit Request - Tammarack: Ken Marthaler, Riverview Builders, appeared before the Commission requesting authorization to make application for a building permit on behalf of Tarnmarack. Marthaler stated that Tammarack needs storage space for sheet rock and are proposing to construct a 48' x 100' building. After reviewing the plans, verifying the setback requirements are met, Kalinowski made a motion authorizing Riverview Builders to make application for a building permit on behalf of Tammarack as presented. The motion was seconded by Sniezek. Ayes: Klein, Kalinowski, Sniezek, Lesnick, Nierengarten, Schneider, Ehlert. Nayes: None. Motion Carried 7:0:0 Rental License - Mike Deutz: Mike Deutz appeared before the Council requesting clarification of his rental license at 33 West Minnesota Street. Deutz stated that he currently holds a rental license for two (2) units, one (1) upstairs, and one (1) downstairs. In the past the front of the lower unit was rented to businesses. Deutz has been trying to find a business to fill the vacancy but has been unsuccessful. Therefore, he has converted the former offices into living quarters. Each unit will have a separate bedroom and bathroom facility, but share a cornman kitchen. Since they share a common space Deutz felt this functioned as one unit under his current license. After a lengthy discussion, Ehlert made a motion allowing Mr. Deutz to use the lower level in its entirety as a rental unit for dwelling purposes. Mr. Deutz presently holds a rental license for the lower level and simply wishes to extend the area to encompass the entire floor. The motion was seconded by Lesnick. Ayes: Klein, Kalinowski, Sniezek, Lesnick, Nierengarten, Schneider, Ehlert. Nayes: None. Motion Carried 7:0:0 Mike Deutz also questioned the parking by CMS Body Shop and the recent building permit issued. Deutz stated that it was his understanding the property owners of CMS were to provide additional parking in the rear of their property. As of this time the parking provisions have not been met. The Planning Commission requested a letter be sent to the property owner reminding him of the conditions of his building permit. Minutes - April 1. 1996: Kalinowski made a motion to approve the minutes of the March 4, 1996 Planning Commission meeting as presented; seconded by Nierengarten. Ayes: Klein, Kalinowski, Sniezek, Lesnick, Nierengarten, Schneider, Ehlert. Nayes: None. Motion Carried 7:0:0 NEW BUSINESS Transportation Plan: Representatives of st. Benedict forwarded an alternative to the portion of the Transportation Plan which cuts through the College/Convent Campus. After reviewing the proposed change, Cornmissioners felt the road would not alleviate the traffic problems from traffic heading east. Additionally, the proposed road would place a collector street behind the Brian Klinefelter Memorial Park. While the Cornmission agreed the plan removed the road going through the Campus, it did not accomplish many other goals and felt there may be other alternatives available. East Minnesota street Improvement: Chair Klein discussed with the Cornmission the proposed 1996 East Minnesota street Improvement. The original plan for reconstruction included the installation of sidewalks from 3rd Avenue East to 91st Avenue. The Council recently has revised the plan removing the sidewalks. Commissioners present discussed the importance and need for sidewalks along East Minnesota Street. The st. Joseph Code of Ordinances and st. Joseph Comprehensive Plan all make reference to sidewalks being installed in areas of pUblic safety. After a lengthy discussion, Kalinowski made a motion recommending the Council reconsider the omission of sidewalks from the 1996 Street Improvement and install sidewalks from 3rd Avenue East to 91st Avenue, based on the following findings: 1. While sidewalk can be added at any point in time, it is most economical to install the sidewalk at the same time street and utility work is being performed. The Council is being fiscally responsible by installing the sidewalks at this time. 2. st. Joseph Code of Ordinances Section 33.6 states: The City Council may establish by resolution a Public Safety District within which it may promulgate additional rules and regulations relating to the construction and maintenance of sidewalks, including but not limited to the assumption of construction and maintenance expense by the city. Rules and regulations promulgated by the City for application in a Public Safety District may supersede the general requirements of the ordinance wi thin the designated district. Areas which may be designated as part of a Public Safety District are cornmercial areas, streets subject to extensive pedestrian traffic and street adjacent to schools and parks. (page 25) 3. When the developer of pond'View Ridge appeared before the Commission for plat approval, the Commission required and the City council approved the installation of sidewalk on the westerly edge of 12th Avenue SE. The fbl16wing is'an extract of the September 16, 1991 Planning Commission minutes: Reber made a motion to recommend Council approval of the preliminary plat of Rich Heid, Pond View Ridge Addition, as presented. The plat wilì~.include an eight (8) foot sidewalk along the westerly side ,of 1·2'th Ave SE. The motion was seconded by Hiemenz. (the mot~~~ passed unanimously). 4. The st. Jòseph Comprehensive Plan discussed the safety and need to provide safe recreational areas for the residents of st. Joseph. East Minnesota is an area of high pedestrian traffic. Not providing sidewa'¡lk·.in this area contradicts the Comprehensive Plan adopted by the City. of st. Joseph --:;. ., The motion was se~rtded by Lesnick. Ayes: Klein,~alinowski, Sniezek, Lesnick, Nierengarten, Schneider, Ehlert. Nayes: None. Motion Carried 7:0:0 Building Inspector Reports College of st. Benedict: The College of st. Benedict is in the planning process of constructing a new dormitory. Shannon's Upholstery: Shannon Hinnenkamp had indicated that he would appear before the Commission to request authorization to make application for a building permit to move a building to his business site. Since the buildings have burned down he has no work area, this building would fulfill that need. Ehlert made a motion to approve the building permit application of Shannon's Upholstery as discussed by the Building Official. The motion was seconded Kalinowski. Ayes: Klein, Kalinowski, Sniezek, Lesnick, Nierengarten, Schneider, Ehlert. Nayes: None. Motion Carried 7:0:0 The Commission stressed the importance of the property owner appearing before the Cornmission, and clarified that approval granted under the recommendation of the Building Official and is not the norm. The Planning Commission requested a letter be sent to the Silver Motors, 110 Birch Street West, as to the type of business they are operating. It appears they are repairing vehicles which is only permi tted with a special use permit. The property is· becoming cluttered with vehicles and vehicle parts.
