Pursuant to due call and notice thereof, the Planning Commission
for the City of st. Joseph met in regular session on Tuesday,
September 5, 1996 at 7:00 p.m. in the st. Joseph City Hall.
Members Present: Chair Hub Klein. Commissioners S. Kathleen
Kalinowski, Marge Lesnick, Dan Nierengarten, Kurt Schneider.
Secretary of the Commission Judy Weyrens.
others Present: Mayor Donald "Bud" Reber, Rick Heid, Mike Deutz,
Bob Herges.
Pond View Ridge III - Plat Approval: Rick Heid presented a final
plat for Pond View Ridge III. The proposal includes 25 single
family homes. Commissioners discussed the need to establish
elevations when approving plats to help prevent drainage issues.
Heid stated that his construction is always two (2) feet above the
curb line, but cautioned the Commission establishing such
guidelines. As the contours of the land change, it may not be
possible to always remain a set distance above the curb line.
When asked about the property north phase I Pond View Ridge, Heid
stated that he is looking into developing patio homes in that area.
Before that can happen, he needs to revise the preliminary plat
thus requiring a public hearing.
Klein questioned whether Heid would consider constructing 12th
Avenue SE to Minnesota Street, Heid stated that at this time it is
cost prohibitive.
After considerable discussion, Kalinowski made a motion to
recommend the City Council approve the Pond View Ridge III and
begin the process of execution of the developers agreement
contingent upon the Engineer's approval. The motion was seconded
by Nierengarten.
Ayes: Klein, Kalinowski, Lesnick, Nierengarten, Schneider.
Nayes: None. Motion Carried 5:0:0
Minutes - August 5 and August 12, 1996: Lesnick made a motion to
approve the minutes as presented; seconded by Nierengarten.
Discussion: Klein requested the minutes clarify the parking
requirements of All Star Pizza. The motion should include that the
parking are will not exceed the Southwest corner of the building.
Ayes: Klein, Kalinowski, Lesnick, Nierengarten, Schneider.
Nayes: None. Motion Carried 5:0:0
During the discussion of the minutes the Commission also discussed
the Council action with regard to All Star Pizza. Concern was
expressed wi th the consistency of enforcing the parking
requirements of the downtown area and how the Commission intends to
develop the downtown area.
Also discussed during the approval of minutes was the rental issues
of st. Joseph and alternative enforcement methods.
Fencing Request - Mike Deutz: Mike Deutz appeared before the
Commission to discuss fencing materials. Deutz stated that he
would like authorization to construct a temporary fence along two
of his properties out of non conforming fence material. The
current fence ordinance only allows fencing materials of wood or
chain link. The fence is necessary to discourage foot traffic or
parking on his property. Deutz stated that his property at 16
Birch street East is used as an overflow parking lot for Daniels
Funeral Horne and his property on Cedar street is used by the CMS
Body Shop and students in the Villa apartments. It is his hope the
a temporary fence would give new direction to foot traffic and
overflow parking. The material he is considering is a three (3)
strand wire fence. To make the fence visible Deutz would either
spray the fence orange or tie orange flags on the wires.
Deutz also discussed his concern on the lack of follow through on
Special Use and Variances. The City has issued conditional use
permits or variances on the adjoining property and imposed
restrictions at the time of issuance. However, the lack of City
follow through has required him to construct a fence. Deutz
encourage the Commission to find an effective way in which to
enforce the allowance given.
commissioners objected to the use of the fencing materials
requested, but suggested using snow fence as an alternative since
the fence is only temporary.
Kalinowski made a motion to recommend the Council allow Mr. Deutz
to install temporary snow fencing as requested; seconded by
Lesnick.
Ayes: Klein, Kalinowski, Lesnick, Nierengarten, Schneider.

Deutz also informed the Commission that he is in the process of
purchasing the property located at 318 and 320 Old Highway 52. In
1992 the Council denied a rezoning and variance request on the
adjacent property. Deutz questioned the reason for the denial and
if the Commission would reconsider the proposal to construct an
additional unit. Weyrens read the minutes where the request was
denied. Commissioners stated that many things have changed in that
neighborhood since the request and they would consider the proposal
again if Mr. Deutz made application for the rezoning and variance.
Fence Setback Request - Bud Reber: Bud Reber appeared before the
Commission on behalf of sidney outten, 119 - 2nd Avenue SE, who
would like to construct a fence six (6) inches from the property
line. The current ordinance requires a two (2) foot setback unless
wri tten permission is granted from the property owners. Reber
stated that the fence would be six (6) inches from the ground and
would be maintainable from their property line. Reber indicated
that the property owner has not approached the adjoining neighbor
for written approval and is seeking relief of this requirement from
the Planning Commission.
After considerable discussion, Kalinowski made a motion to
recommend the Council authorize Sidney outten to construct a fence
six (6) inches from the property line as requested. The motion was
seconded by Lesnick.

Nayes: None. Motion Carried 5:0:0
Adjourn: Schneider made a motion to adjourn at 9:15 p.m.; seconded
by Kalinowski.
