HomeMy WebLinkAbout1996 [10] Oct 28 Pursuant to due call and notice thereof, the Planning Commission I for the City of st. Joseph met in regular session on Monday, October 28, 1996 at 7:00 p.m. in the st. Joseph City Hall. Members Present: Chair Hub Klein. Commissioners S. Kathleen Kalinowski, Marge Lesnick, Dan Nierengarten, Kurt Schneider. Secretary Judy Weyrens Others Present: Michael Contardo, Peter Omann. Due to a lack of a quorum, the commission opened the meeting at 7:20 p.m. Public Hearing - Joe Miller: Chair Klein called the hearing to order at 7:20 p.m. The purpose of the hearing is to consider a special use permit to allow an automobile repair shop in a general business zone. st. Joseph Code of Ordinances 52.20 subd 3(a) allows for automobile service stations including sales gasoline service stations and auto repair garages, provided that no filing station, public garage or gasoline distributing station shall be located within 200 feet of a school, church, hospital or meeting place, having a capacity of more than 50 persons. The property is legally described as Lot 3, Block 1; Miller Cedar I East. The request has been submitted by Joe Miller on behalf of Derick Gabrielson, tenant. Due to an injury, Derick Gabrielson has requested the Commission table this matter until December 3, 1996. Therefore, Nierengarten made a motion to table the Special Use Request until December 3, 1996; seconded by Lesnick. Ayes: Klein, Kalinowski, Lesnick, Nierengarten, Schneider. Nayes: None. Motion Carried 5:0:0 Michael Contardo - Rental License: Michael Contardo appeared before the Commission to discuss his rental license for 24 - 2nd Avenue NW. He stated that he did not secure a rental license for the year 1995-1996 because his son was living in the house. At that same time he discussed the matter with the rental housing inspector who indicated a license was not necessary. Contardo stated that since that time his son has moved and when applying for a rental license he was told that the would have to apply for a special use permit as his property is zoned General Business and rental is only allowed by Special Use. Contardo is requesting relief from making application for a Special Use Permit because he unaware that he would loose his grandfather I status if the rental license lapsed for a period of one year. He also stated that if he would have been informed that he would loose his grandfather status he would have secured a rental license. Kalinowski made a motion allowing Contardo to keep his grandfather status, allowing a rental in a General Business Zone, due to mis- communication between the property owner and the City. The motion was seconded by Lesnick. Discussion: Commissioner requested that all landlords be notified of the privileges of being grandfathered and the ramifications if a rental license is not secured. This communication could be included with the annual license material mailed to each license holder. Ayes: Klein, Kalinowski, Lesnick, Nierengarten, Schneider. Nayes: None. Motion Carried 5:0:0 Peter Omann - Variance Request: Chair Klein opened the hearing at 7:30 p.m. The purpose of the hearing is to consider a request for a twenty foot variance on the size of a business sign. The property is zoned General Business. st. Joseph Code of Ordinances 52.13 subd 11 (a) states that the area on one side of all such signs erected on one street frontage of anyone premises, shall not exceed fifty (50) square feet. The property is legally described as Lot 6, Block 1; Cedar East Addition. The request for special use has been submitted Omann Insurance Agency, PO Box 608, 305 East Cedar Street, st. Joseph, MN 56374 Peter Omann spoke on his own behalf. Omann stated that his proposal is to construct a sign 12' x 6' indicating both the businesses located in his building. The sign will be placed on the Eastern edge of his property and all the setback requirements will be met. Omann stated that if he were to construct two individual signs he would be allowed 50 square feet for each business. The proposal would be well under the maximum allowed for two individual signs. The Commission discussed adjoining property owner signs and the need for the signs to be visible along Highway 75. After considerable discussion, Klein made a motion to recommend the Council approve the sign request as presented with the following contingencies: 1. The sign must be aligned with the adjoining property owners sign. 2. Verification by the City that the sign will not encroach any future roadway plans, particularly, the future ingress/egress to Northland. The motion was seconded by Schneider Ayes: Klein, Kalinowski, Lesnick, Nierengarten, Schneider. Nayes: None. Motion Carried 5:0:0 Other Matters Community Sign: Lesnick discussed the location of the st. Joseph community Sign located on the corner of College Avenue North and County Rd 75. The installation of the sign has blocked the sign of Amaco when driving west on County Rd 75. All star Pizza: commissioner questioned the status of All star Pizza and if the Council authorized the business operate as an dine in restaurant. commissioners again discussed the need to establish parking regulations for the downtown area so as not to discourage business development. Adjourn: Schneider made a motion to adjourn at 8:40 p.m.; seconded by Lesnick. Ayes: Klein, Kalinowski, Lesnick, Nierengarten, Schneider. Nayes: None. Motion Carried 5:0:0
