Minutes of the .July 1, 1974 meeting were approved ,as read.
'l'heSecretary summarized a letter, dated 7-10-74 submitting attendance recørd s for the
st. Joseph P~anning Commission from May thru July 1974, to City Clerk Robert Johnson for
peymant of tier diem fees.

Knapp, city attorney,dated August 23, 1974, regarding the difference between a variance and
a special use permit, and whether these , when granted, applied to the owners of property
or to the property.
The attorney advised the chairman that:
1. a variance wssthe relaxation of some part of a zoning ordinance;
2. especial uae permit.related to requests to use property in a zoned area for pur
poses other than that for which it was zoned;
3.it was his opinion that a variance transferred, with title to the property, to any
owner;
4. it was his opinion that a speciel use permit co Id be granted either to the property
or to the owner, de ending.pon what the Planning Oommission and the Council did
when the permit was granted;
5. special use permits ¥ere to be considered by the Plannir commission as distinguished
from tae Board.. of Adjustment and APpeals.
Following some discussi:m, it was agreed that the ohairman ask the attorney for further
clarification of the last paragraph in h_s htter which referred to Hollow Park .lJevelop

Following discussion of the cross walk on College Avenue at U.$. highway 52, it was agreed that
the secretsr send Hermsn schneider a copy of her letter to E.W. MC Oulloch dated Jen.19, 11
1974, and his reply dated January 23, 1974, stating that "the H ghwaj' Department would make I
every effort to make the crosswalk aree to the highest standerds,"even to the extent of
using bituminous walks as suggested. tI
