ZONING BOARD OF ADJUSTMENT AND APPEALS
The Zoning Board of Adjustment and Appeals of the City of st. Joseph met
to conduct a public hearing on Monday, December 8, 1975 at 7:30 p.m.
with the following members present: Chairman Ben Kremer, Mike Ryan,
Ron Klein, Paul Brinkman, Al Maleska, Secretary Bob Johnson. Also present
were: Attorney Thomas Jovanovich, representing Robert Gamades; Robert
Gamades, applicant; Attorney Dale Mossey; Council representative Hugo
Weyrens; Sr. Moira wild and another representative of Convent-College.
There were seven other residents present.
Purpose of hearing: to consider a request for re-zoning and variance
from the requirements of Zoning Ordinance No. 59 as follows: 1) Rezone
the N~ of the SW .99 acres of Lot 30, Auditors subdivision No.4 in the
City of st. Joseph from R2-Residence District to R3-Mulitple Residence
District. 2) Reduce side yard setback requirement from 20 feet to 10
feet. 3) Reduce the area per unit from 3500 sq. ft. to 2600 sq. ft.
(All other pertinent information including complete application, survey,
layouts, etc. has been placed on file.)
Secretary presented amended application of the Robert Gamades application.
Attorney Thomas Jovanovich presented a memorandum in support of the appli-
cation. (Copy of memorandum has been placed on file.) Sr. Moira Wild,
OSB, spoke of the side yard setback variance request of 10 feet, rather
than 20 feet as required by ordinance. Cited the important need of park-
ing lot and impact of snow removal, possibility of future construction
on the abutting property. Indicated an objection. Martin pfannenstein
indicated a pleasure of past relationship - have had no disturbances.
Ben Kremer reported no problems in past with the present structure. Mr.
Gamades indicated he would provide required screening on fence if necess-
ary. Asst. Fire Chief Bill Wasner indicated 20 feet distance between
apartment buildings would present no problem. Sr. Moira wild requested
board to justify variance if no other alternative were possible.
A motion was made by Al Maleska seconded by Ron Klein to submit a recommend-
ation of approval to City Council of Robert Gamades application for issuance
of building permit to construct an 8-plex multiple unit as per zoning and
variance request indicated. Application on file. Motion carried unani-
mously.
