Joseph Planning Commission met Monday, September 26, 1977 for a special I hearing. Mr. and Mrs. Milton Jones had requested a special use permit to oper- ate an electrical contracting business in a residential zoned area. Members present: Ron Klein, Marlene Schroeder, Mrs. Robert Kelly, Ben Kremer - Chairman. Also present were Mike Husen, Council representative, and Tom Jovan- ovich. Present at the hearing in addition to the Commission were: Mr. and Mrs. Sal Schneider, Wally Honer, Dr. Robert Kelly, James Landwehr, Dan Eller, Dave Pfan- nenstein, Mr. and Mrs. Milton Jones, Al Maleska, John Honor. Minutes of the previous hearing on the same issue were read by City Clerk Robert Johnson. Tom Jovanovich, City Attorney, spoke on the requirements of home occupations as stated on page three of the zoning ordinance book. He also cited safety and welfare of the neighborhood which was stated in section 5, p. 9. Mrs. Kelly cited p. 15 which stated electrical contracting was considered industrial. Mr. Jovanovich added, however, that the statement was a matter of interpretation which meant not just in industrial zoned areas. Discussion af accessory build- ing ensued. Mr. and Mrs. Jones stated that they were willing to forgo the accessary building in order to obtain the special use permit. Dan Eller, Attor- ney, spoke in behalf of Mr. and Mrs. Jones. Discussion of definition of home I occupations and whether garage was considered an accessory building. The dis- cussion up to this point was carried on primarily by Mrs. Kelly, who opposed the permit, and Dan Eller and Mr. and Mrs. Jones who were for the permit. Discussion of whether special use permit goes with the land. Mr"s. Kelly said she had called Chris Haeglie, st. Cloud City Planner, and that he had indicated that it does. Tom Jovanovich stated that the board could make stipulations regarding special use permit. Wally Honer spokè in defense of granting the special use permit. Dave Pfannen- stein, Mr. and Mrs. Sal Schneider, Dr. Robert Kelly, and Al Maleska spoke against the granting of the special use permit. Al Maleska and Dave pfannenstein invited Jones to build his house but asked board not to issue special use permit. Ron Klein, Marlene Schroeder, and Mrs. Kelly expressed opinion against granting special use permit. Marlene Schroeder made the motion to decline granting of the special use permit bacause according to the definition of Home Occupation the business intended by Mr. and Mrs. Jones does not qualify in the fact that an additional person was going to be hired in the operation of the business. Mrs. Kelly seconded. Ron Klein, Marlene Schroeder, Mrs. Kelly, Ben Kremer voted for the motion. Motion carried. Hearing closed. Respectfully submitted, I Marlene Schroeder Acting Secretary
