The meeting was a publ ic hearing regarding the Park Terrace West Develop-
ment proposed by Jim Landwehr. The plat includes 49 lots; all lots meet
the City Code. The land was annexed into the City in 1972 ; the plat has
been presented to the Planning Commission six times before this date.
Mr. Landwehr stated he had a tentative agreement for an easement with St.
Benedict's Convent and Hollow Park landholders to connect with the sewer
and water in Hollow Park. The water wi 11 also be connected on Minnesota
Street. Joe Bettendorf indicated adequacy of the sewer in Hollow Park
and even actual improvement for the water system with the proposed devel-
opment. He also stated that there is adequate space for water connection
between the telephone poles and Minnesota Street.
Curb and gutter will be put in when the development begins. Jim Land-
wehr also stated the grass would be controlled during the 3-4 years of
anticipated time for development.
The plan calls for the 20 feet to the east of the property to be sold to
the people holding property adjacent to Park Terrace West. If someone is
unwill ing to purchase the land, Jim Landwehr will add this 20 feet to the
new lots being developed. The purchase agreements offered two years ago
will need to be renewed. The homes to the south of the proposed develop-
ment wi 11 possibly have a similar offer but of less size. The City will
have an easement to this property to care for the sewer 1 ines. It is
planned that Lots 21, 22, 23 and 24 wi 11 be serviced by the present sewer
1 i ne in front. Lots 18 and 19 will possibly be serviced from the back
through the Park Terrace West Development. The citizens on Minnesota
Street wi 11 have to agree to this or another publ ic hearing regarding
that specific issue will be necessary. It need not delay a decision on
this development. Howeve r , putting water in on Minnesota Street is a
condition for approval of this project.
Between Lots 6 and 7, Jim Landwehr agreed to give an easement to the City
for a publ ic walkway--about 7-8 feet of it wi 11 be paved. He also sug-

gested the possibil ity of leaving two lots to the north for a road in
the future, connecting with Highway 75.
Bob Johnson raised a question of the zoning of the property to Residen-
tial I. Mike Husen indicated rezoning took place through acceptance and
issuance of the official map. The property under question had been zoned
as agricultural.
The title of this development was questioned by Bob Johnson as being too
much 1 ike the present Park Terrace and in conflict with the ordinance.
Jim Landwehr agreed to consider changing the name.
Roman Reber questioned the setback requirement of 30 feet on corner lots.
This was a response to a question regarding Lots 19 and 21 which had been
discussed at the March 7, 1983 meeting.
Jim Landwehr asked direction on potential egress to Highway 75 by leaving
Lots 2 and 3 vacant for a defined period of time for the development of a
road. Mike Husen said it was not an area under study by the transportation
office and also it is not a good intersection.
Jim Landwehr also asked what might happen if individuals west of Park
Terrace are unwill ing to buy the twenty feet of land where a City easement
is proposed. The members of the Planning Commission did not feel the City
would want to own this land. If the City maintains a permanent easement,
the City is not concerned about who owns the property.
Mike Husen suggested including in the motion the looping of the water system;
the proposed pathway, and oversizement of the water 1 ine that would be re-
quired on Minnesota Street from an 8-inch to a 10-inch main and be part of
the development. Al so, any easements for new water and sewer connections
can be obtained after approval of the plat, but Jim Landwehr should obtain
these. Changing of right-of-way from 66 feet to 60 feet was approved
previously by the Commission and Council. The City attorney needs to be
asked if that change can be made according to page 29 of the subdivision
regulations without a specific process.
Motion was made by Sister Kathleen Kalinowski and seconded by Art Budde,
that a recommendation be made to the Council for approval of the proposed
plat with the understanding that Jim Landwehr will provide a paved pathway
between Lots 6 and 7 in block one, an oversizement of the waterl ine on
Minnesota Street, looping of the water system on the north end, obtain the
necessary easements, and review with the City Attorney the process of
changing from a 66 to 60-foot right-of-way with a 36-foot paved surface.
Motion carried.
The meeting adjourned at 9:30 p.m.
