A public hearing was co.lled to order at 7:30 p.m. to consider a petition
to r~zone Lots 7 and 8, Blk 2 and 3 in Loso's 7th Addn. from R-l to 1-<-3.
This property is north of old Hi 52 across from EolloH Park. 'fhe petition
was submitted by Dave and Sue Dropp. The property was formerly zoned
R-2 before the new zoning ordinance and official city map were a..dopted.
Objections to the petition \-.¡ere raised by Bill Elfering and Ken Jones
concerning the density of people in the area, the distUl'bance to Hollo,:,'
Park residents, and the issue of setting a precedence for spot zoning.
Phil Durkee moved to recommend to the City Council that the petition be
granted with two stipulations attached:
(1) th!:.1. t the property will hold a certificate for rental housing as long
as it is used for that purpose;
(2) that at least 6 off-street, hard. surface parking places be constructed
since the house will be renovated as a duplex and will be used to
house 8 college students. In conformance with the Zoning Ordinance
l3.0~-B, no more than 2 spo.ces shall be allowed in the front yard setback.
In response to the objection of ..set-ting a precedence for srot zoning,
the Commission attached Lr clauses of justificntion 1:1ith the motion for
granting the petition:
1) Whereas the said property described in this ÿetition was formerly
in an R-2 zone before adoption of an officiÐ~ city map [met ne\! zoning
ordinance,
2) Wnereas the said property has been used as rental :property for 8 years,
3) ',]hereas the adjoining ~property is also rentÐ.l property and Old Hi 52
forms a natural boundary betveen rental property on the north and
single-family residences in Hollow Park on the south,
4) \1heraasthe building will be converted to duplex housing for a maximum
of 8 persons,
the Planning Commission recommends granting the petition with the attched
stipulations. The motion Has seconded and passed by a vote of 5-0.
At 8:30 I,.m. a second public hea.ring ,·¡as called to order to consider iJ
petition to re-zone property owned by Mike Liestman, located on the north
side of County Rd. 75 and east of rlJillstream Park, from Industrial to General
Business of the purrose of allowing construction of an ice crean drive thru
buil ding. The petition was submitted by ¡'like and Pattie Liestman.

After discussion and public statements by citizens, the follo0ing motion
Has made by Art Bœ~de and. seconded:
\'i11ereas the property described in the petition has limited land-use
because of the surrounding terrain,
jhereas the Planning Commission desiros a benign use of property adjacent
to the Millstream City Park,
;/hereas the o',¡lllers attention has been drawn to the proximity of the
city sewage facility and the potential of odors from the facility,
the Commission recommends to the Council the granting of the petition v¡i th
the following stipulations:
1) that a 66-ft ,,¡ide strip of land adjacent to the north boundary of
said property be annexed into the city, be dedicated to the City
after construction, and be used as the principal entrance to the
business;
2) that a sceptic system be constructed which conforms to state statutes
and which meets the approval of the city engineer;
3) that future city sewer services v!ill be assess to the entire prolicrty
in the usual fashion designated by the Subdivision Regulations.
The motion passed by a vote of 5-0.
