Minutes of St. Joseph Planning Commission
August 4, 1986
Members present: Hub Klein, Tom Nahan, Ben Kremer, Phil Durkee,
Art Budde, S. Kathleen Kalinowski
Others present: Ross Rieke (Council laison)
The meeting was called to order at 7:35 p.m.
Discussion of various provisions of the Zoning Ordinance was
initiated, including the topics of building permits, fences, and
violations of the Ordinance. Attention focused on building permits
that may have been issued without conformity to the ordinance, and
if this has been done, what legal recourse is available. uf special
concern was the nonconforming use of land in the central business
district which is zoned commercial.
The Planning Commission felt two legal questions needed clarification.
1) Does nonconforming status of owner~occupied and rented homes in
the central business district prohibit the sale of such structures
for continued residential use? 2) If sale of the residences is not
allowed but has taken place since the Ordinance took effect, what
should be done about the violations?
The Minutes from July 7 were read and approved.
The meeting was adjourned at 9:00 p.m.
